OR 91-523 Maximum speed limit on MacArthur Bld AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 91523 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ESTABLISHING 35 MILES PER HOUR AS THE MAXIMUM PRIMA FACIE SPEED LIMIT ON ALL OF MacARTHUR BOULEVARD WITHIN THE CORPORATE LIMITS OF THE CITY OF COPPELL, SAID ROAD BEING A PUBLIC STREET WITHIN THE CORPORATE LIMITS OF THE CITY; MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A VEHICLE ON SAID PUBLIC STREET AT A SPEED GREATER THAN SAID DESIGNATED SPEED; PROVIDING THAT ANY SPEED IN EXCESS OF SUCH DESIGNATED SPEED SHALL BE PRIMA FACIE EVIDENCE THAT SUCH SPEED IS NOT REASONABLE NOR PRUDENT AND IS UNLAWFUL; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. AMENDING SECTION 8-1-3 OF CITY CODE From and after the effective date of this ordinance Section 8-1-3 of the Code of Ordinances of the City of Coppell, which establishes speed limits on certain specific streets within the city, is hereby amended to change the maximum prima facie speed limit on the following designated street: STREET PORTION OF STREET SPEED MILES PER HOUR MacArthur Boulevard All 35 A person commits an offense if he operates or drives a vehicle on an above designated street at a speed greater than the speed designated by this section for that street or portion thereof and any speed in excess of such designated speed shall be prima facie evidence that such speed is not reasonable nor prudent and is unlawful. SECTION 2. REPEALING CLAUSE All parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed. SECTION 3. SEVERABILITY CLAUSE If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 4. PENALTY CLAUSE Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a penalty of fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 5. EFFECTIVE DATE This ordinance shall take effect immediately from and after the publication of its caption, as the law in such cases provides.
