Notice is hereby given that the City Council of the City of Coppell, Texas will meet in Regular
Called Session at 5:30 p.m. for Executive Session, Work Session will follow immediately
thereafter, and Regular Session will begin at 7:30 p.m., to be held at Town Center, 255 Parkway
Boulevard, Coppell, Texas.
As authorized by Section 551.071(2) of the Texas Government Code, this meeting may be
convened into closed Executive Session for the purpose of seeking confidential legal advice
from the City Attorney on any agenda item listed herein.
The City of Coppell reserves the right to reconvene, recess or realign the Work Session or

Reference: Discussion Concerning Drainage Associated with Development North of Sandy Lake
and West of Coppell Road (Prologis)
2030: Sustainable City Government
Excellent and Well-Maintained City Infrastructure and Facilities
General Information:
Discussion will cover all development that has taken place in this drainage basin.
Information will be provided on what the Engineering Department reviews prior to accepting
a drainage design for development.
All developments calculated similar drainage runoff, since the initial 1997 development.
Introduction:
In 1991, the City Council approved the Storm Water Management Study (1991 Study). This study
was a comprehensive evaluation of existing drainage problems and a look ahead on how to address
future flooding in the City. The study was a follow-up to flooding that took place in Coppell in 1989.
During the course of performing the study, flooding again hit this area in 1990. To prepare for future
development, the City needed a way to anticipate what future drainage would be. In the early 90’s a
large part of west Coppell was vacant land (see attached street map from 1987).
Prior to the completion of the 1991 Study, there wasn’t a consistent way to anticipate what future
runoff from property would be. Coppell joined the FEMA program in 1975 and the first maps for
Coppell were published in 1980. Those maps showed what property could be impacted by runoff
during a 100-year storm. The only problem with the FEMA maps is that they are based on existing
conditions. To accurately anticipate future runoff, you need to calculate drainage runoff assuming
that all the land in the drainage basin has been developed based on its proposed future use. The 1991
Study is based on the ultimate developed conditions. This means that all property was analyzed based

on its future use not its undeveloped status. While the FEMA maps provide a drainage runoff based
on a static point in time, the 1991 Study provides a runoff based on fully developed land in the future.
What does this mean? It means that if you are one of the first properties that develop in a drainage
basin you are required to design your drainage facilities based on what the drainage runoff will be in
the future once all the upstream land is developed. In essence, a development may be on the ground
for years before the upstream area develops. During this time, they may have very little runoff going
through their drainage systems. As the upstream properties develop the runoff increases, however,
the systems were designed to handle the increase.
Analysis:
The analysis of the drainage basin involved reviewing each development to determine if they
accurately anticipated future runoff from upstream development. The first development was Asbury
Manor Subdivision in 1997. On sheet 6 of their plans, a note was added that states “Q100 = 1500 cfs
as stated in the City of Coppell Ultimate Development Storm Management Study”. To verify this
number, I reviewed the 1991 Study. Plate 4-5 and Plate 5-13 of the 1991 Study show cross section
32+50 at Coppell Road upstream of Asbury Manor. Sheet E-30 of the 1991 Study shows a Q100 at
cross section 32+50 of 1500 cfs. So while there was no upstream development in 1997, Asbury
Manor was already planning for the ultimate runoff.
The next development was Mansions by the Lake in 1998. This development is north of Asbury
Manor. Sheet 6 of Mansions by the Lake Phase II shows a Q100 entering their site from Asbury
Manor of 1600 cfs. Again, this is consistent with all information in the 1991 Study which shows a
Q100 of 1600 cfs at cross section 21+12, which is generally at the north property line of Asbury
Manor. So while no upstream development had yet occurred, both developments were designed for
the future conditions.
The next construction was Coppell Road in 2002. Sheet 6 of the Paving and Drainage Improvements
for Coppell Road shows a Q100 at Coppell Road of 1750 cfs. The drainage design for Coppell Road
was the first time since 1991 that a design engineer had provided an addition study of the upstream
runoff.
The next construction was North Freeport Parkway in 2015. Sheet 47 of the plans show a Q100 at
Coppell Road of 1700 cfs. Again, this is generally consistent with the anticipated drainage from the
1991 Study.
The most recent development is Prologis in 2016. Sheet C3.08 of the plans show a Q100 of 1497 cfs
at Coppell Road. Again, this is generally consistent with the 1991 Study and every calculation over
the prior 25 years.
The above information is provided to show that developments in Coppell are designed based on future
conditions and that over time downstream properties will see an increase in the amount of runoff
through their property as vacant upstream land develops. Staff will provide additional information at
the Work Session.

General Information:
Amending Chapter 9 ‘General Regulations’, Article 9-14 ‘No Smoking Ordinance’ in its
entirety and replacing it with a new Chapter 9, Article 9-14, “No Smoking” by eliminating
smoking in common areas, at city-sponsored events and city-owned facilities.
Provide limited areas of smoking in restaurants and on restaurant patios.
The new ordinance will include regulation of electronic nicotine devices.
This ordinance was created based on the Wellness Committee and business community
recommendation.
Introduction:
This item is being presented to the Council to repeal Chapter 9 ‘General Regulations’, Article 9-14
‘No Smoking Ordinance’ in its entirety and replacing it with a new Chapter 9, Article 9-14, “No
Smoking”. The new ordinance will eliminate smoking in common areas, at city-sponsored events,
city-owned facilities, places of employment and will allow limited areas of smoking in restaurants
and certain outdoors areas. The intent of the ordinance is to reduce general public exposure to
secondhand smoking and establish smoke free zones around city buildings and places of employment.
Analysis:
Staff considered Wellness Committee and business owner recommendations before writing this
ordinance. The Wellness Committee requested that we redefine some terms such as smoking to
include electronic nicotine devices, and to prohibit smoking at city-sponsored events and city-owned
facilities. Business owners wanted to see an ordinance that is similar to surrounding cities and to
provide them with the freedom to smoke on patios. Staff surveyed 13 surrounding cities and used
their ordinances as a guide to create City of Coppell ordinance.

An ‘e-cigarette’ is a device used to simulate the experience of smoking. In our current ordinance
there is no mention of e-cigarette, so this ordinance defines e-cigarette and the act of smoking to
include any technology that simulates the experience of smoking.
Surveying surrounding cities ensures that our ordinance is consistent with their ordinances and makes
it easier for our business owners to comply. This ordinance ensures that our residents are protected
from the danger of secondhand smoke.

Introduction:
In late April 2016 the City Council approved a contract for services between the City and Span Transit
to provide transportation services in the amount of $25,000 for seniors and disabled citizens. The
contract was for June 1 – September 30, 2016. The intention was for the contract to be renewed
beginning October 1, 2016 through September 30, 2017, in the amount of $75k which also coincides
with the City’s fiscal year.
Span began taking reservations in early June and its first rider boarded in late June. As expected with
any new service there have been a few riders utilizing the service but it has grown over time. To
increase awareness, there is a plan in place to target market the service and educate the community
by attending the meetings of Coppell civic organizations, presenting at senior/assisted living facilities,
organizations and groups that serve the disabled community, and utilize the city’s existing advertising
efforts.
The purpose of the August 23rd work session is the following:
• Discuss observations noticed since inception
• Discuss ridership numbers and the City’s education/market efforts
• Discuss the service area map
• Discuss ideas to improve service delivery to our residents.

PROCLAMATION
WHEREAS, autoimmune disease is one of the top 10 leading causes of death in female
children and women in all age groups up to 64 years old; and
WHEREAS, the NIH (National Institutes of Health) estimates up to 23.5 million
Americans and rising suffer from autoimmune disease; more than cancer and more than heart
disease; and
WHEREAS, the disease can cause inflammation in vital organs and tissues, and once
damaged, the inflammation can be chronic; and
WHEREAS, while genetics plays a role, autoimmune diseases are often unpredictable
and misunderstood, difficult to diagnose, can affect any part of the body, and are hard to live
with and a challenge to treat; and
WHEREAS, some of the most common of the 80–100 recognized autoimmune diseases
are celiac disease, juvenile diabetes, juvenile arthritis, lupus, multiple sclerosis, psoriasis,
rheumatoid arthritis, alopecia, and scleroderma.
NOW, THEREFORE, I, Karen Selbo Hunt, Mayor of the City of Coppell, do hereby
proclaim September 3, 2016, as
“Autoimmune Disease Awareness Day”
in the City of Coppell, and encourage citizens to observe this day by educating themselves on the
symptoms and impact of autoimmune diseases, and to support programs of research, education
and community service, including the second annual fundraiser event entitled “Compete Every
Day Fighting Autoimmunity 5k,” hosted by the City of Coppell.

Cooperation Agreement for Operation and Maintenance of Traffic
Signals between the Texas Department of Transportation, City of
Lewisville and City of Coppell as approved by City Council on
February 9, 1999; and authorizing the Mayor to sign.
A motion was made by Councilmember Marvin Franklin, seconded by
Councilmember Gary Roden, that Agenda Items A-E be approved on the

terms and conditions set forth herein; and authorizing the Mayor
and/or City Manager to sign any necessary documents.
A motion was made by Councilmember Marvin Franklin, seconded by
Councilmember Gary Roden, that Agenda Items A-E be approved on the
Consent Agenda. The motion passed by an unanimous vote.
D.Consider approval of the annual review of the written Investment
Policy of the City of Coppell as provided by the Public Funds
Investment Act, Chapter 2256, Texas Government Code.
A motion was made by Councilmember Marvin Franklin, seconded by
Councilmember Gary Roden, that Agenda Items A-E be approved on the
Consent Agenda. The motion passed by an unanimous vote.
E.Consider approval of the certification of the 2016 anticipated tax
collection rate for the period July 1, 2016 through June 30, 2017 and
the amount of the excess debt collections during the period July 1,
2015 through June 30, 2016.
A motion was made by Councilmember Marvin Franklin, seconded by
Councilmember Gary Roden, that Agenda Items A-E be approved on the
Consent Agenda. The motion passed by an unanimous vote.

8.Consider approval of a proposed tax rate of $.5795 for the 2016 tax
year and to set the Public Hearings on the proposed tax rate for the
next regularly scheduled Council meeting on August 23, 2016 at 7:30
p.m. and a Special called meeting on August 30, 2016 at 6:00 p.m.
Presentation: Jennifer Miller, Director of Finance, made a presentation to City
Council.
A motion was made by Mayor Pro Tem Wes Mays, seconded by
Councilmember Gary Roden, that this Agenda Item be approved. The motion
passed by an unanimous vote.
9.CITIZEN’S AGENDA REQUEST:
Requesting the City Council to consider an improved landscaping plan
to help mitigate the impact of Prologis on our neighborhood.
Coppell resident, Ken Kuehn, 240 Bricknell, made a presentation to the City
Council. He believed that the Prologis development was taking priority over the
residents. He expressed concern that the next building would be taller than the
power lines and would provide an obstruction of view. He asked that the City
Council instruct the City to purchase the easement and right-of-way between
the development and subdivision to maintain the landscape. Representatives
from the development reported that additional landscaping efforts were made
as an effort to make concessions with the residents. No further action was
taken.

10.PUBLIC HEARING:
Consider approval of CASE NO. PD-272R4-LI, Prologis Park @
Callejo, a zoning change request from PD-272R-LI (Planned
Development-272 Revised-Light Industrial), to PD-272R4-LI (Planned
Development-272 Revision 4-Light Industrial), to approve a Detail Site
Plan for a 144,465-square-foot office/warehouse building on 10.85
acres of land located approximately 450 feet south of SH 121, west of
Freeport Parkway.
Presentation: Gary Sieb, Director of Planning, made a presentation to Council.
Casey Dillon, 2501 Harwood Dr., Dallas, representing the applicant, answered
questions of the Council.
Mayor Hunt opened the Public Hearing and asked for those who signed up to
speak:
1) Earl Shanks, 319 Buttonwood, asked questions about the riprap and
landscaping choices.
A motion was made by Councilmember Gary Roden, seconded by
Councilmember Cliff Long, to close the Public Hearing and approve this
Agenda Item subject to the following conditions:
1) There will be additional comments during detailed engineering plan review
for this site; and
2) A replat document shall be filed for record prior to any construction
occurring on this site.
The motion passed 4-3 with Mayor Pro Tem Wes Mays and Councilmembers
Cliff Long, Gary Roden and Marvin Franklin voting in favor of the motion and
Councilmembers Brianna Hinojosa-Flores, Nancy Yingling and Mark Hill voting
against the item.
11.PUBLIC HEARING:
Consider approval of CASE NO. PD-136R2-LI, DFW Trade Center, a
zoning change request from A (Agriculture) and PD-136-LI (Planned
Development-136-Light Industrial) to PD-136R2-LI (Planned
Development-136 Revision 2-Light Industrial), to incorporate 6.45
acres into the existing Planned Development and approve a Concept
Plan for an approximate 115,000-square-foot office/warehouse
building on 9.08 acres of land located in the City of Coppell and 0.8
acres located in the City of Grapevine, on property located at the north
corner of SH 121 and Patriot Drive.
Presentation: Marcie Diamond, Assistant Director of Planning, made a
presentation. The applicant was available for questions.
A motion was made by Councilmember Marvin Franklin, seconded by
Councilmember Nancy Yingling, to close the Public Hearing and approve this
Agenda Item subject to the following conditions:
1) Detail Site and Landscape Plans, Building Elevations will be required prior to
the issuance of a building permit.

2) Replat/Minor Plat, including utility and engineering plans will be required to
be approved in the Cities of Coppell and Grapevine.
3) A complete tree survey and tree removal permit will be required prior to the
removal of any trees; and

submitted for this lot.
The motion passed by an unanimous vote.
12.PUBLIC HEARING:
Consider approval of a Resolution granting a variance of ninety feet
(90') feet to Mico 21 Club, Inc. from the 300-foot prohibited
requirement for the sale of alcoholic beverages for on premise
consumption, with a business address being 110 W. Sandy Lake
Road, Suite 112; and authorizing the Mayor to sign.
Presentation: Christel Pettinos, City Secretary made a presentation to the City
Council.
Mayor Hunt opened the Public Hearing and advised that no one signed up to
speak.
A motion was made by Mayor Pro Tem Wes Mays, seconded by
Councilmember Cliff Long, to close the Public Hearing and approve this
Agenda Item. The motion passed by an unanimous vote.
City Manager Reports - Project Updates and Future Agendas13.
Under Project Updates, City Manager Clay Phillips reported that facility
projects are coming along as planned. Tours for the City Council will be
scheduled soon. As for street projects, the pavement replacement project
should be finished by the beginning of school and the median projects are
coming along nicely. Regarding the "Sonic Drive" project, the road way will
have to be finished by the opening of school.
For Future Agendas, budget items will be on the August 23rd Agenda with a
special public hearing and 5th Tuesday work session scheduled for August
30th.
Mayor and Council Reports14.
Report by Mayor Hunt on the Back-to-School Ice Cream Social.
Mayor Hunt announced the Back-to-School Ice Cream Social in Old Town will
be held on Saturday, August 20th from 6-8 p.m. The City will be collecting
school supplies for the "Buy One, Give One" program. Attendees who donate
school supplies will receive a free snow cone from Kona Ice.

Introduction:
Pursuant to Chapter 363 (363.205) of the Local Government Code, the governing body that created
the district shall hold a public hearing on the budget adopted by the Board. Any resident of the district
is entitled to be present and participate at the hearing. At the conclusion of the public hearing, the
governing body is required to take action on the proposed budget.
Analysis:
The Crime Control Board held a public hearing on July 14, 2016. No citizens were present to speak.
The Board closed the public hearing and approved the budget as presented. Once the public hearing
is concluded, Council must take action on the proposed budget for the Crime Control and Prevention
District.

Performance Measures
Mission
The Crime Prevention District facilitates the Coppell Police Department's efforts to maintain a safe
community environment. This is accomplished by providing quality programs and services such as our School
Resource Officers and Community Services Crime Prevention Officer programs. The district also provides
funding for public safety communications, which is done in collaboration with our partner cities in the North
Texas Emergency Communications Center (NTECC).
Authorized Personnel

Collaborate with the management staff and personnel of the North Texas Emergency Communications Center
to provide public safety services while NTECC moves through its first year of operation.
Support the CISD and provide education to the younger citizens of Coppell with the School Resource Officer
program, the Police Explorer program, the Junior Police Academy, and various safety education classes,
including the Self-Defense for Women course offered to high school senior girls.
Continue to engage our citizens through our perennially award-winning National Night Out program.

Introduction:
Pursuant to Section 26.06 of the Texas Property Tax Code, when a proposed tax rate exceeds the
notice and hearing limit, the taxing unit’s governing body must hold two (2) public hearings on the
proposal. At these hearings, taxpayers must have the opportunity to expr ess their views on the
proposed increase. The governing body may not adopt the tax rate at these hearings; and must
announce the date and time of the meeting at which it will vote on the tax rate. The meeting to adopt
the 2016 tax rate must be at least three (3) days but no more that fourteen (14) days after the public
hearing.
Analysis:
As required by Local Government Code, Sec. 140.010, attached is the notice that was published in
the newspaper on August 12, 2016. The 1st public hearing will be at the regular Council meeting on
August 23, 2016 and the 2nd will be at a Special called meeting on August 30, 2016. The tax rate
adoption is scheduled for September 13, 2016.

PROPERTY TAX RATE FOR CITY OF COPPELL
A tax rate of $0.579500 per $100 valuation has been proposed for adoption by the governing body of City of
Coppell. This rate exceeds the lower of the effective or rollback tax rate, and state law requires that two
public hearings be held by the governing body before adopting the proposed tax rate.
The governing body of City of Coppell proposes to use revenue attributable to the tax rate increase for the
purpose of address public safety concerns and the maintenance and operations of new facilities.

PRECEDING YEAR'S TAX RATE $0.584000 per $100
EFFECTIVE TAX RATE $0.556490 per $100
ROLLBACK TAX RATE $0.597105 per $100
The effective tax rate is the total tax rate needed to raise the same amount of property tax revenue for City of
Coppell from the same properties in both the 2015 tax year and the 2016 tax year.
The rollback tax rate is the highest tax rate that City of Coppell may adopt before voters are entitled to
petition for an election to limit the rate that may be approved to the rollback rate.

2030: Community Wellness and Enrichment Strategy: Multi-Use Trail System Connecting
the City
Introduction:
A primary objective of the Coppell Trail System Implementation Plan of 2009 is making connections
to adjacent communities via Coppell’s trail system. A major component of this effort for making
connections is the idea of accessing the Irving Campion Trail and opening up areas to the south for
Coppell resident’s access to recreation and commerce. The City of Irving, Dallas County and the
developers of Cypress Waters share in this vision of making these trail connections to serve the
citizens of the region.
The Campion Trail system is Irving’s marquee recreational amenity, comprised of concrete, fully
accessible trail, bringing access to the Elm Fork and the West Fork of the Trinity River, with
connections beyond Irving. Bringing easy access of this major amenity to Coppell residents will be
an enhancement to the quality of life for all trail users.
Analysis:
The Coppell Trail System Master Plan effort included ideas for eventually tying into the Campion
Trail system. However, the Campion currently ends in Valley Ranch at a location well south of where
Coppell could reach it. With the Cypress Waters development in the planning and construction
phases, the developer desired to have access to the Campion Trail and the Coppell Trail system, and
set out to determine how this connection might be designed and funded. Dallas County came through
with $2,500,000 in funding to extend the trail north through Valley Ranch, west along Grapevine
Creek and Beltline Road, eventually coming through areas in Coppell. At this time the trail will likely
stop at Beltline and Mockingbird Lane in Coppell as it is projected the funding will run out at that
location. This does, however, bring the trail close enough to the streets, sidewalks and proposed trails
of Coppell to allow adequate access for Coppell residents.

The design of the trail extension is early in the planning process and Coppell staff will be working
with the designers at the City of Irving to ensure the trail through Coppell meets the minimum
standards established for our trail system. The proposed agreement under consideration will authorize
the City of Irving to design and cause the construction of the trail within the boundaries of Coppell,
with funding by Dallas County.
Legal Review:
Legal Counsel reviewed and approved the proposed agreement.
Fiscal Impact:
There will be no fiscal impact of this Agenda item.
Recommendation:
The Parks and Recreation Department recommends approval of this item.

INTERLOCAL AGREEMENT FOR THE DEVELOPMENT OF
THE CAMPION TRAIL CONNECTION
INTRODUCTION
This Agreement (hereinafter referred to as the “Agreement”), which is authorized under the
Interlocal Cooperation Act, Texas Government Code, Chapter 791, is made by and entered
into between the City of Irving, Texas (hereinafter referred to as “City of Irving”), the City of
Coppell, Texas (hereinafter referred to as “City of Coppell”), for the purpose of constructing
a trail (hereinafter referred to as “Trail”) that will provide a Trail in Coppell and connect to
the Campion Trail in Irving.
NOW THEREFORE, in consideration of the foregoing and other valuable consideration,
the sufficiency and receipt of which are hereby acknowledged, the parties agree to the
following:
I. TERM OF AGREEMENT
The term of this Agreement shall be for a period of twenty-five (25) years commencing on
the last day all of the parties have executed this Agreement, unless terminated earlier as
provided herein.
II. DESIGN/ALIGNMENT OF TRAIL
The Trail that will be constructed under this Agreement will extend the City of Irving’s
existing Campion Trail, which presently ends in Valley Ranch, by approximately 2.65 miles
so that it extends into the City of Coppell. The Trail shall have the general alignment as
denoted in the attached map and shall be constructed of reinforced concrete and shall
generally have a width of at least ten (10) feet. This Trail shall be known as the Campion
Trail Connection for the term of this Agreement.
III. TRAIL USE
The Trail shall be accessible to all users, free of charge, regardless of residence and shall
be used for public recreational activities, including, but not limited to hiking, walking,
jogging, biking, and roller-blading and for non-motorized alternative transportation
purposes. Each City reserves the right to establish hours of operation that are consistent
with other park and recreational facilities in its jurisdiction.
IV. TRAIL IMPLEMENTATION RESPONSIBILITIES
The City of Irving and the City of Coppell shall be responsible for securing any property
needed for the Trail.

The City of Irving shall be responsible for proposing the alignment of the Trail, designing
the Trail (or selecting a consultant engineer and overseeing the design of the Trail),
proposing needed signage, bidding and awarding the construction contract for the Trail
(including the installation of signage), administering the construction contract, and
overseeing the construction of the Trail. The City of Irving shall also be responsible for
funding and installing any amenities within the portion of the Trail that is located within the
City of Irving and that are not provided for under the terms of this agreement.
The City of Coppell shall also be responsible for reviewing and approving the Trail’s
proposed alignment, design plans, safety standards and signage and ensuring that Trail is
adequately built to its standards. The City of Coppell shall signify its approval of design,
alignment, and signage by execution of the plans.
The City of Coppell shall also be responsible for funding any amenities within the portion of
the Trail that is located within the City of Coppell and that are not provided for under the
terms of this agreement
V. FUNDING
The Trail is being funded through a Dallas County Reimbursement Grant up to Two-Million-
Five-Hundred-Thousand Dollars ($2,500,000) from its FY2017 major capital improvement
program. These funds may be used solely for the design, surveying, construction, and
signage of the Trail. They may not be used to conduct environmental assessments or to
alleviate any environmental hazard or to construct or install any other capital improvement
or amenity or for land acquisition. The County will reimburse the City of Irving for the
reasonable costs associated with the surveying, construction, and installation of approved
signage and trail surfaces within sixty (60) days of having received proof of the satisfactory
completion of associated work items, invoices, and supporting documentation.
Should sufficient funding not be available or if field conditions present design constraints
which prevent the construction of the Trail’s alignment as described in Article II, then the
scope of the project may be revised with the mutual consent of the parties, one or more
parties may provide additional funding, or the Trail Project may be terminated.
VI. OWNERSHIP/OPERATION/MAINTENANCE
Each City shall own the Trail and all related amenities and improvements located within its
jurisdiction. Each City’s ownership and maintenance responsibility shall commence
immediately upon the start of construction within its jurisdiction.
Each City shall be responsible for operating the Trail as a public recreational facility for a
period of at least twenty-five (25) years after the date this agreement is executed by both
parties, unless terminated at an earlier date in accordance with Article XIII of this
Agreement.

Each City shall also be responsible for adequately maintaining the Trail and its amenities in
accordance with its standard trail maintenance practices.
VII. TRAIL SYSTEM ACKNOWLEDGEMENT
Once opened for public use, signs that acknowledge that the Trail is a City of Irving or a
City of Coppell facility shall be posted at the Trail’s various starting and ending points and
at key entrances and shall be maintained by each City as long as the Trail is operated
under the terms of this Agreement.
VIII. AMENDMENTS AND CHANGES IN THE LAW
This Agreement may be amended; however, no modification, amendment, novation,
renewal or other alteration of this Agreement shall be effective unless mutually agreed
upon in writing and executed by the parties hereto. Any alteration, addition, or deletion to
the terms of this Agreement which are required by changes in federal or Stat e law are
automatically incorporated herein without written amendment to this Agreement and shall
be effective on the date designated by said law.
IX. AGENCY AND LIABILITY
City of Irving and City of Coppell agree that each entity is not an agent of the other entity
and that each entity is responsible for its own acts, forbearance, negligence and deeds,
and for those of its agents or employees in conjunction with the performance under this
Agreement.
Each City agrees to be responsible for any liability or damages each City may suffer as a
result of claims, demands, costs or judgments against each City, including workers’
compensation claims, arising out of the performance of the work and services under this
Agreement, or arising from any accident, injury or damage, whatsoever, to any person or
persons, or to the property of any person(s) or corporations in connection with this
Agreement and caused by sole negligence of each City, its agents, officers and/or
employees.
Each City agrees that such liability or damages as stated above occurring during the
performance of this Agreement caused by the joint or comparative negligence of their
employees, agents and officers shall be determined in accordance with the comparative
responsibility laws of the State of Texas.
Nothing herein shall be deemed in any manner to constitute a waiver of immunity or
defense which may be asserted by County or each City pursuant to law; nor shall this
provision be in any manner construed to create a cause of action for the benefi t of any
person not a party to this Agreement or to create any rights for the benefit of any person

not a person to this Agreement.
X. VENUE AND APPLICABLE LAW
This Agreement is made subject to and shall be construed under and in accordance with
the laws of the State of Texas, and the exclusive venue for any legal action between the
parties arising from this Agreement shall be in Dallas County, Texas.
XI. SOVEREIGN IMMUNITY
The parties expressly agree that no provision of this Agreement is in any way intended to
constitute a waiver of any immunities from suit or from liability that the parties ha ve by
operation of law.
XII. TERMINATION
This Agreement shall, if applicable, automatically terminate in accordance with Article V if
the funds have not been expended or obligated within three years of the execution of this
Agreement. This Agreement may also be terminated before commencement of
construction with the mutual written consent of the parties; or by either party providing thirty
(30) days prior written notice to the other party or may be terminated during construction by
the mutual consent of the parties.
XIII. NOTICE
Any notice required or permitted to be delivered hereunder shall be deemed received when
sent by United States Mail, postage prepaid, certified mail, return receipt requested,
addressed to the party at the address set forth below, or by hand-delivery, or upon receipt
of facsimile transmission thereof:

XIV. SEVERABILITY
In the event any one or more of the provisions contained in this Agreement shall for any
reason be held to be invalid, illegal, or unenforceable in any respect, such invalidity,
illegality, or unenforceability shall not affect the other provisions, and the Agreement shall
be construed as if such invalid, illegal, or unenforceable provision had never be en
contained in this Agreement.

XV. PREVIOUS AGREEMENTS
This Agreement embodies the complete understanding of the parties hereto, superseding
all oral or written, previous and contemporary, agreements between the parties relating to
the matters in this Agreement, and except as otherwise provided herein, cannot be
modified without written agreement of the parties.
XVI. COUNTERPARTS
This Agreement may be executed in any number of counterparts, each of which shall be
deemed an original and constitute one and the same instrument.
XVII. EFFECTIVE DATE
This Agreement shall not become effective until executed by the authorized
representatives of the City of Irving and the City of Coppell.

Introduction:
Over the past few years, staff have received feedback from the community regarding the desire for
the sale of alcoholic beverages at city events. Amending the current Ordinances relating to
alcoholic beverages would allow for flexibility in the ability to sell alcohol at designated city-
sponsored special events. This would also allow the city to create and strengthen partnerships with
local businesses.
Analysis:
The Parks and Recreation Department recommends the amendment of Chapter 6, Article 6-16-4
(Alcoholic Beverages - City Facilities) and the amendment of Chapter 9, Article 9-11-3 (Parks &
Recreation Code – General Regulations) to allow for the sale of alcoholic beverages by approved
vendors at designated city-sponsored special events, with City Manager or designee approval.

WHEREAS, the City of Coppell finds it will benefit to amend the City’s Code of
Ordinances to provide for the issuance of a permit for the sale of alcohol at special
events; and
WHEREAS, the City Manager or designee may grant a special event permit to
allow for the consumption, possession and/or sale of alcohol by a state license
vendor.
WHEREAS, the City Manager or his designee is further authorized to adopt and
enforce such other appropriate health, safety and welfare to ensure safe use of the
premises and general welfare of the areas adjacent thereto.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF COPPELL, TEXAS:
SECTION 1. The City of Coppell Code of Ordinances, to amend Chapter 6, Business
Regulations, Article 6-16, Alcoholic Beverages, Section 6-16-4, City facilities, by repealing
said section in its entirety and provide with a new Section 6-16-4, City facilities; to hereinafter
read as follows:
“CHAPTER 6 – BUSINESS REGULATIONS

ARTICLE 6-16 – ALCOHOLIC BEVERAGES

Sec. 6-16-4. – City facilities
A. No person, firm, corporation, or business entity of any land shall sell, store,
possess or consume an alcoholic beverage in any city, park, facility or city
owned premises, except as provided in this subsection. The term "alcoholic
beverage," as that term is used in this article, shall be defined as used in the
Texas Alcoholic Beverage Code.
B. The City Manager or designee may, notwithstanding the prohibition in
subsection A. of this section, issue a permit to a person or entity for the
consumption, possession and/or sale of alcoholic beverages for on premises
consumption, for a period not to exceed 72 consecutive hours, for city
facilities or city owned property. For such event, the city manager or
designee may grant a special event permit to allow for the consumption,
possession, and/or sale of beer and wine by a state licensed vendor or permit
holder under the Texas Alcohol Beverage Code in accordance with state
law and reasonable conditions as set forth herein.
C. No permit shall be issued until satisfactory proof has been provided for
liability insurance and compliance with the Texas Alcoholic Beverage
Code, as amended, and rules issued by the appropriate state agency. The
City Manager is further authorized to implement such other appropriate
safety and control regulations concerning location, hours of operations,
security and other appropriate conditions to protect the health, safety and
welfare of the general public and event attendees.
D. The City by resolution may establish an appropriate fee for issuance of such
permit.”
SECTION 2. That the City of Coppell Code of Ordinances is hereby amended by
amending Chapter 9, Article 9-11, Section 9-11-3 General Regulations, Subsection (Q) by
repealing the same and replacing with a new subsections (Q) to read as follows:
“CHAPTER 9 – GENERAL REGULATIONS

Sec. 9-11-3 – General Regulations

Q. No person, firm corporation or business entity of any kind shall sell,
store, possess or consume an alcoholic beverage in any City park except as

SECTION 3. That all provisions of the ordinances of the City of Coppell in conflict with
the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions of
the ordinances of the City of Coppell not in conflict with the provisions of this ordinance shall
remain in full force and effect.
SECTION 4. That should any sentence, paragraph, subdivision, clause, phrase or section
of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance as a whole, or any part or provision thereof other than the part
so decided to be invalid, illegal or unconstitutional, and shall not affect the validity of the Code of
Ordinances as a whole.
SECTION 5. That any person, firm or corporation violating any of the provisions or terms
of this ordinance shall be subject to the same penalty as provided for in the Code of Ordinances of
the City of Coppell, as heretofore amended, and upon conviction shall be punished by a fine not
to exceed the sum of two hundred dollars ($200.00) for each offense.
SECTION 6. This Ordinance shall take effect immediately from and after its passage and
the publication of the caption, as the law and charter in such cases provide.

Introduction:
Coppell Senor Locos, LLC, is opening at the location of 110 W. Sandy Lake Road, Suite 150. This
is in the same location as Sprouts and Mi Cocina, which have been granted variances in the past.
Analysis:
The reason for the variance is the location of the restaurant is 100’ feet from the property line
belonging to the Coppell Montessori Academy. Public Hearing notices were placed in the Citizens’
Advocate newspaper on August 12th and August 19th.

NOTICE OF PUBLIC HEARING
The City Council of the City of Coppell will hold a public hearing on Tuesday,
August 23, 2016, at 7:30 p.m., in the Coppell Town Center, for the purpose of
considering a variance filed by Coppell Senor Locos, LLC d/b/a Senor Locos Tex-Mex
Icehouse, with regards to a submitted application for a Mixed Beverage Restaurant
Permit with FB, located at 110 W. Sandy Lake Road, Suite 150. This address falls within
300 feet of a public or private school or day care center. Any citizen of the city, or other
party of interest, may also express his or her opinion concerning this request by letter
addressed to the city of Coppell City Secretary Department, 255 Parkway Boulevard,
Coppell, TX 75019.
PUBLIC NOTICE STATEMENT FOR ADA COMPLIANCE
The City of Coppell acknowledges its responsibility to comply with the Americans with
Disabilities Act of 1990. Thus, in order to assist individuals with disabilities who require
special services (i.e. sign interpretative services, alternative audio/visual devices, and
amanuenses) for participation in or access to the city of Coppell sponsored public
programs, services and/or meetings, the City requests that individuals make requests for
these services forty-eight (48) hours ahead of the scheduled program, service and/or

RESOLUTION NO. ______________
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COPPELL, TEXAS, GRANTING A DISTANCE VARIANCE OF
ONE HUNDRED (100’) FEET TO COPPELL SENOR LOCOS, LLC.,
LOCATED AT 110 WEST SANDY LAKE ROAD, # 150, COPPELL,
TEXAS, AS PROVIDED IN SECTION 6-16-2(H) OF THE CODE OF
ORDINANCES OF THE CITY OF COPPELL; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Article 6-16 of the Code of Ordinances places certain distance
prohibitions from churches, schools, and day cares to businesses that sell or offer to sell
alcoholic beverages; and
WHEREAS, the City Council may grant a variance to such business upon proof
that the best interest of the public are not served by strict compliance with the regulations;
and
WHEREAS, Coppell Senor Locos, LLC. (hereinafter, “Applicant”) is located
within 300 feet of a church, school or day care; and
WHEREAS, the Applicant has provided sufficient proof that such regulation
constitutes waste or inefficient use of land, or creates an undue hardship and is otherwise not
effective or necessary after consideration of the health, safety and welfare of the public; and,
WHEREAS, the City Council has determined that the best interest of the
community will be served by a grant of such variance.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF COPPELL, TEXAS:
SECTION 1. That a variance of one hundred (100’) feet shall be granted to Coppell
Senor Locos, LLC., located at 110 West Sandy Lake Road, #150, Coppell, Dallas County,
Texas, for on-premise consumption of alcoholic beverages, as provided in Section 6-16-2 (H)
of the Code of Ordinances of the City of Coppell.
SECTION 2. That the variance granted herein is in personam to the above named
Applicant and shall expire upon relinquishment of any permit authorized by the TEXAS
ALCOHOLIC BEVERAGE COMMISSION or its successor.

SECTION 3. That this Resolution shall take effect immediately from and after its
passage as the law and charter in such cases provide.
DULY PASSED by the City Council of the City of Coppell, Texas, this the 23rd day
