OR 91-504 Disannexation over described area of land AN ORDINANCE OF THE CITY OF COPPEt.L, TEXAS ORDINANCE NO. 91504 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, DISANNEXING AND/OR WAIVING EXTRATERRITORIAL JURISDICTION OVER THE HEREINAFTER DESCRIBED AREA OF LAND AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it is the desire of the City of Coppell, Texas, to disannex and/or waive any and all extraterritorial jurisdiction it may have or claim in and to the hereinafter described area of land, so that the same may be annexed to and become a part of the City of Lewisville; and WHEREAS, this Ordinance is adopted in furtherance of an agreement between the City of Coppell and the City of Lewisville dated April 15, 1988, and approved by city councils on April 26, 1988, and May 2, 1988, respectively~ and WHEREAS, this action is taken in accordance with paragraph 4 of said agreement which provided that the City of Coppell would on or before April 15, 1991, disannex the property described in said agreement as Exhibit 31 NOW, THEREFORE, BE IT ORDAINlED BY THECITYCOUNCIL OFTHE CITY OF COPPEr&, TEXAS: SECTION 1. That the statements made in the preamble to this Ordinance are hereby adopted and incorporated into this Ordinance by reference for all purposes. SECTION 2. That the tract of land described in said Exhibit 3, a copy of which is attached hereto and made a part hereof for all purposes and containing 83.82 acres more or less, ORDINANCE Page I be, and the same is hereby, disannexed and discontinued as a part of the City of Coppell to the extent to which it is now a part of the City of Coppell and/or, in the alternative, any and all extraterritorial jurisdiction the City of Coppell may have in and to said property be, and it is hereby, relinquished and waived for all purposes only in favor of the City of Lewisville. SECTION 3. The disannexation and waiver of extra- territorial jurisdiction set out in Section 2 above is effective over such territory described in Exhibit 3 over which the City of Coppell has or may have jurisdiction under the provisions of Chapter 42 and 43, Vernon's Local Government Code of the State of Texas, and upon passage of this ordinance, the said City of Coppell shall no longer have or exercise any right, jurisdiction or control over the above described tract of land. SECTION 4. All parts of ordinances inconsistent or in conflict herewith are hereby repealed. SECTION 5. If any section or part of any section, paragraph or clause of this ordinance is declared invalid or unconstitutional for any reason, such declaration shall not be held to invalidate or impair the validity, force or effect of any other section or sections, part of sections, paragraphs or clause of this ordinance. SECTION 6. This ordinance shall take effect from and after its passage as the law in such cases provides. Harmonson Survey, Abstract No. 530~ and being more particularly described as follows: Commencing at the intersection of the southerly right of way line of SH 121 with Denton Creek; THENCE northeasterly along the said southerly right of way line to a point of intersection with the east line of the P. Harmonson Survey, Abstract No. 530, said point being the POINT OF BEGINNING; THENCE north crossing SH 121 (100' ROW) to a point on the north right of way line of SH 121, said point being the east-southeast corner of a 2.81 acre tract of land owned by S. Jackson, as recorded in Vol. 563, Page 472, of D.R.D.C.T.~ THENCE north along the east line of the P. Harmonson Survey, Abstract No. 530; and passing through the northeast corner of the 2.81 acre S. Jackson Tract and the east-southeast corner of a 75.05 acre tract of land owned by Jackson Sand and Gravel, as recorded in Vol. 623, Page 175, of D.R.D.C.T., a distance of 2270 feet, more or less, to the northeast corner thereof; said point also being the southeast corner of another 20 acre tract of land owned by Jackson Sand and Gravel, as recorded in Vol. 623, Page 175, of D.R.D.C.T.; THENCE west 1380 feet, more or less, along the north line of the said 75.05 acre tract of land and passing through the southwest corner of said 20.00 acre tract and the southeast corner of a 31.18 acre tract of land owned by Riddle Construction Co., as recorded in Vol. 574, Page 299, of D.R.D.C.T., to a point for corner; THENCE southwesterly 127.28 feet, more or less, measured along a corner clip to a point on the west line of said 75.05 acre tract; THENCE south 1880 feet, more or less, along the west line of the said 75.05 acre tract to the southwest corner thereof~ said corner also being the northwest corner of a 1.126 acre tract of land owned by E. Grider, as recorded in Vol. 1101, Page 647, of D.R.D.C.T.; THENCE 890 feet, more or less, in a southeasterly direction along the south line of the said 75.05 acre tract and along the north line of the 1.126 acre E. Grider Tract, the north line of a 0.712 acre M. Karr Tract (Vol. 1101, Page 643) and the north line of a 1.109 acre R. Brown Tract (Vol. 1527, Page 779), of D.R.D.C.T., to a point in the west line Of a 4.85 acre tract of land owned by H.
