CITY OF COPPELL, TEXAS ORDINANCE NO. 98833 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 3, SECTION 3.1-12 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL, TEXAS, BY AMENDING THE PENALTY FOR A VIOLATION OF THE DAILY WATER USE PLAN; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR A PENALTY OF FlNE NOT TO EXCEED THE SUM OF TWO HUNDRED ($200.00) DOLLARS; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THK CITY COUNCIL OF ~ C1TY OF COPPELL, TEXAS: SECTION 1. That Chapter 3, Section 3-1-12 of the Code of Ordinances of the City of Coppelt, Texas, be, and the same is hereby amended in part to read as follows: "Sec. 3-1-12 DAILY WATER USE PLAN All persons using water for lawn watering, garden watering, or irrigation, during the period of May 15 to the September 15 of each year shall do so in the following manner: A .... B .... C .... D .... E .... F .... G .... I-I .... A person who violates Section 3-1-12 is guilty of a separate offense for each day or portion of a day during which the violation confmues and, upon conviction, shall be punished as follows: First conviction: Fine of not more than twenty-five ($25.00) dollars; B. Second conviction: Fine of not more than ~ ($50.00) dollars; 1 17527 C. Third and subsequent convictions: Fine of not less than fifty ($50.00) dollars, nor more than two hundred ($200.00) dollars." SECTION 2. That all provisions of the Code of Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That should any word, sentence, paragraph, subdivision, clause, phrase or section of this ordinance, or of the Code of Ordinances, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. An offense committed before the effective date of this ordinance is governed by the prior law and the provisions of the Code of Ordinances, as mended, in effect when the offense was committed and the former law is confmued in effect for this purpose. SECTION 5. Any person, firm, or corporation violating any of the provisions of Section 3-1- 12 of the Code of Ordinances as amended herein, shall be deemed guilty of a misdemeanor and, upon the first conviction, shall be punished by a fine not to exceed twenty-five ($25.00) dollars, upon second conviction be punished by a penalty of fine not to exceed fifty ($50.00) dollars for each offense, and upon the third and subsequent conviction shall be punished by a penalty of fine not less than fifty ($50.00) dollars, nor more than two hundred ($200.00) dollars for each offense, and each and every day such offense is continued, shall constitute a new and separate offense. SECTION 6.
