OR 90-492 Adds Sect. 3-5-9, prohibits scavenging AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 90492 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDINGARTICLE3-5 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL, TEXAS, BY ADDING SECTION 3-5-9, PROHIBITING SCAVENGING WITHIN TfIE CITY; PROVIDING FORANEXCEPTION; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: Section 1. That Article 3-5 of the Code of Ordinances of the City of Coppell, Texas, be, and the same is hereby, amended by adding Sections 3-5-9 and 3-5-10, which provides as follows: "Article 3-5 Sanitation Department *** Section 3-5-9 Scavenging Prohibited It shall be unlawful for any person other than an authorized employee of the City of Coppell Sanitation Department or a commercial trash hauler acting under a franchise from the City of Coppell for public collection and disposal to collect, take, remove, tamper with, interfere with, scavenge from, carry away or otherwise disturb garbage or trash which has been placed for collection at any authorized recycling site operated by the City or in any container on public or private property, as provided by this Article. Section 3-5-10 Exception which is acting under a contract, license h r United States Postal Service to collect, take, remove or carry away garbage or trash which has been placed for collection at United States Postal Offices located in the City. Section II. That all ordinances in conflict with the provisions of this ordinance be, and the same is hereby, repealed and all other ordinances not in conflict with the provisions of this ordinance shall remain in full force and effect. Section III. That should any word, section, phrase, paragraph, or part of this ordinance be held to be void or unconstitutional for any reason, such invalidity shall not affect the remaining portions of said ordinance which shall continue in full force and effect the same as if no portion of said ordinance had been held to be void or unconstitutional. Section IV. This ordinance shall take effect immediately from and after its passage as the law and Charter in such cases provide.
