OR 90-486 Adopts National Electrical Code AN ORDINANCE OF THE CITY OF COPFELL, TEXAS ORDINANCE NO. 90486 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ADOPTING AN ELECTRICAL CODE FOR THE CITY OF COPFELL, TEXAS; PROVIDING THAT IN THE EVENT SAID CODE IS NOT CLEAR, OR IS SILENT, THEN THE RULES AND REQUIREMENTS OF THE UNIFORM ADMINISTRATIVE CODE PROVISIONS FOR THE NATIONAL ELECTRICAL CODE, 1990 EDITION, AND THE NATIONAL ELECTRICAL CODE, 1990 EDITION, AS AMENDED ARE ADOPTED; PROVIDING FOR THE REGULATION OF ELECTRICAL WORK WITHIN THE CITY OF COPFELL, TEXAS; DEFINING CERTAIN TERMS; PROVIDING SPECIFICATIONS, MATERIALS AND METHODS OF ELECTRICAL INSTALLATION; REPEALING ALL PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING THAT ARTICLE 15-2 OF CHAPTER 15, OF THE CODE OF ORDINANCES OF THE CITY OF COPFELL BE AMENDED TO REFLECT THE ADOPTION OF THIS ORDINANCE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF FIVE HUNDRED ($500.00) FOR EACH OFFENSE; EXCEPT WHERE A DIFFERENT PENALTY HAS BEEN ESTABLISHED BY STATE LAW, AND FOR ANY OFFENSE WHICH IS A VIOLATION OF ANY PROVISION THAT GOVERNS FIRE SAFETY, ZONING, PUBLIC HEALTH AND SANITATION OR DUMPING OF REFUSE AS THAT TERM IS DEFINED BY SECTION 2.09 OF THE TEXAS LITI'ER ABATEMENT ACT, ARTICLE 4477-9a, VERNON'S ANNOTATED CML STATUTES, AS AMENDED, THE PENALTY SHALL BE A FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPFELL, TEXAS: ADOPTING RI.F. CTRICAL CODE - Page I SECTION 1. 'ITrLE This ordinance shall be known as the "City of Coppell Electrical Code" and article 15-2 of the City Code shall be amended to reflect its adoption. SECTION 2. ADOPTION OF COPPF. IJ. F.I.F. CYRICAL CODE There is hereby adopted by the City of Coppell, Texas, for the purpose of providing requirements for the safeguarding of persons and property and promoting the welfare of the public, that certain "ELECTRICAL ORDINANCE" attached hereto as Attachment #1 and in the event such ordinance be not clear is silent, then the rules and requirements of the UNIFORM ADMINISTRATIVE CODE PROVISIONS for the NATIONAL ELECTRICAL CODE, 1990 Edition, and the NATIONAL ELECTRICAL CODE, 1990 Edition, as adopted by the National Fire Protection Association, as amended, are adopted. A copy of said UNIFORM ADMINISTRATIVE CODE PROVISIONS for the NATIONAL ELECTRICAL CODE, 1990 Edition, and of said NATIONAL ELECTRICAL CODE, 1990 Edition, are attached hereto as Attachment #2 and Attachment #3, respectively, and Attachments #1, #2, and #3, are made a part hereof, the same as ff fully set out at length herein, and from the date this ordinance shall take effect, the provisions thereof shall be controlling within the corporate limits of the City. SECTION 3. REPEAIJNG CLAUSE. All parts of ordinance inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Ordinance No. 88-408 and all amendments thereto are hereby specifically repealed. However, the repeal of existing ordinances by this ordinance shall not affect or prevent the prosecution or the punishmere of any person for any act done or committed prior to the effective date of this ordinance in violation of any ordinance hereby repealed; and ADOPTING F.I.E{.;rRICAL CODE - Page 2 prosecution for such offenses may be instituted and causes presently pending proceeded with in all respected as if such prior ordinance or ordinances had not been repealed. SECTION 4. SEVERABILITY CLAUSE. If any article, paragraph or subdivision, clause, phrase or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of tiffs ordinance as a whole or any part of provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 5. PENALTY CLAUSE. Any person, finn or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a penalty of fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense; except where a different penalty has been established by state law for such offense, the penalty shall be that fixed by state law, and for any offense which is a violation of any provision that governs fire safety, zoning, public health and sanitation or dumping of refuse as that term is defined by Section 2.09 of the Texas Litter Abatement Act, Article 4477-9a, Vemon's Annotated Civil Statutes, as mended, the penalty shall be a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense, and each and every day such offense is continued shatl constitute a new and separate offense. SECTION 6. EFFECTIVE DATE This ordinance shall have an effective date of October 1, 1990 from and after its passage and publication of its caption, as the law in such cases provides. SEL'I'ION 7. SPECIAL HANDLING OF ORDINANCE Due to the size of the volumes attached hereto, it is hereby directed that the original ADOPTING F.I.RCrRICAL CODE - Page 3 of this ordinance, with attachmems, be kept as a separate file in the office of the City Secretary, and that a duplicate original of this ordinance, with a photocopy of the cover sheet of such volumes be placed in the official ordinance book. The UNIFORM ADMINISTRATIVE CODE PROVISIONS for the NATIONAL ELECTRICAL CODE, 1990 Edition, is hereby adopted with the amendments stated herein as part of this ordinance. A. Section 103 "General", under Definitions of Chapter 1 "Title and General" is amended to add the following definitions: 1. Electrical Consauction: All work and materials used in installing, maintaining, or extending a system of electrical wiring and all appurtenances, apparatus, or equipment used in connection therewith, inside of or attached to any building, structure, lot or premises. 2. Electrical Contractor: Any person engaged in the business of installing or altering, by contract, electrical conductors or equipment. It will include any authorized person who subcontracts to do such work, but does not include bona fide employees employed by such contractor to do or supervise such work. 3. Electrical Wiring: The installation of electrical wires, fixtures, appliances, or apparatus, or the addition to any wires, fixtures or apparatus used or to be used on or in any building for the purpose of transmitting electrical current for electric light, heat, house power, lighting fixtures, or for any purpose, of any kind, nature, or description. 4. Jonrneyman Electrical: Any individual who possess the necessary qualifications, training, and technical knowledge to install, maintain and extend electrical conductors and equipment. Further, such person shall be capable of doing such work in accordance with plans and specifications furnished to such person and in accordance with standard rules and regulations governing such work. S. Licensed: When used with the words "electrical contractor", "electrician", or the like, shall mean that the person has made application to the Code Advisory and Appeals Board and has satisfied the Board that applicant is qualified to do the work stated in the application, that applicant has paid the necessary registration fees to date, and that applicant's name is carried in the records of the Building Inspections Department as a person authorized to do electrical work as defined in this article. 6. Master Elech'-ical: Any individual who possesses qualifications, rra/ning, and 1 ATFACHMENT # 1 - Coppell Electrical Code technical knowledge to plan, lay out, and supervise the installation, maintenance and extension of electrical conductors and equipment. 7. Qualified Person: One familiar with the construction and operation of the apparatus and the hazard involved and one who has satisfactorily passed examination of the Code Advisory and AppeaLs Board. B. Section 201(e) "Authority to Disconnect Utilities in Emergencies", under Powers and Duties of Building Official of Chapter 2 "Organization and Enforcement" is amended to add a second paragraph as follows: In cases of emergency, when necessary for safety to persons or when electrical equipment may interfere with the work of the fLre department, the senior officer of the fize deparunent at the site shall have the authority to immediately cause the disconnection of any electrical equipment. C. Section 203 under Board of Appeals of Chapter 2 "Organization and Enforcement" is amended to change the term "Board of Appeals" to "Code Advisory and Appeals Board". D. Section 303 (a) "Issuance" under Pennlts Issuance of Chapter 3 "Permits and Inspections" is amended to add a fourth paragraph as follows: Permits will be issued only to contractors who are licensed with the City and to qualified homeowners as defined in this ordinance. Permit validations for new construction will be issued only to electrical contractors who are licensed with the City as provided in this ordinance. E. Section 304(a) "Permit Fees" under Fees of Chapter 3 "Permits and Inspections" is amended as follows: Sec.304(a) Permit Fees. The fee for each electrical permit shall be as set forth in Exhibit "A" as attached. F. Sections 304Co) "Plan Review Fees" and 304(c) "Expiration of Plan Review", under Fees of Chapter 3 "Permits and Inspections" are hereby deleted. G. Section 306 under Connection Approval of Chapter 3 "Permits and Inspections" is amended to add sections (c) and (d) as follows: c. Electrical Utility Company to Notify of Change in Responsible Party for Electrical Service. When the responsible party, as listed by the electrical utility company, for a non-dwelLing electrical service relinquishes that responsibility and another party assumes the responsibility for that electrical service, the electric utility 2 A~FACHMENT # 1 - Coppell Elecl~ical Code company shah notify the Building Official by written notice within ten (10) calendar days of the date of such change giving the name of the party assuming responsibility and the address of the electrical service. d. Electrical Utility Company to Make Permanent Connection of Service. Only authorized employees of the electric utility company will be permitted to make the connection which will energize the customer's service entrance conductors except in an urfforeseen emergency involving an existing service connection. In such emergencies, the Building Official shall be notified within twenty-four (24) hours after the service entrance conductors are energized. H. Table No. 3-A - Electrical Permit Fees of Chapter 3 "Permits and Inspections" is hereby deleted. SECTION 2. Qualification and Regislration of Electridan~. A. Registration Required; Exceptions. 1. No person, firm or corporation shah engage in the business of electrical construction or cause to make any repairs, alterations, additions, or changes to an existing system of electrical conductors, wiring, apparatus, or equipment within the city unless: a. the person, firm or corporation is registered as a qualified contractor or electrician in accordance with the provisions of this chapter; b. the person, firm or corporation is registered in a classification as stated in subsection (b) of this section: c. a person who is an employee of an electrical utility company and who is conducting work described in Section 19 of this ordinance, or d. a person who is engaged in work described in Section 19 of this ordinance. 2. Electrical registration shall be in the classification listed below: a. Electrical Contractor b. Master Electrician c. Journeyman Electrician 3. A person registered in a classification stated in subsection (b) of this section shall 3 ATTACHMENT #1 - Coonell Electrical Code be permitted to perform the work of that classification as defined in this chapter. 4. To secure a certificate of registration as a qualified electrician in any of the classes designated in subsection Co), a person shall apply in writing to the building official upon a form furnished by the building inspection department. 5. AppLicants for a certificate as electrical contractor, shall file with the appLication an affidavit setting for the name or names of the persons who are responsible for the business. Applicants shall appear in person firequested by the board and be examlned as provided in this ordinance. B. Prerequisites for Electrician's License. 1. New applicants for a certificate as a master electrician shall be at least 21 years of age and: a. have been registered for at least one year as a journeyman electrician with the city, or b. file with the application, affidavits from past or present employers showing no less than five years experience in the installation, alteration, and maintenance of electrical equipment. Evidence required in Paragraph (2) may be waived by a vote of the board. One half of the time spent in attendance at an electrical technical school may be considered toward satisfaction of the required five years experience. 2. Applicants for a certificate as a journeyman electrician shall be at least 20 years of age and: a. have been registered with the city as an electrician in any classification for at least four years, or b. file with the application, affidavits from past or present employers showing not less than four years experience in the installation, alteration, or maintenance of electrical equipment. Evidence required in paragraph (2) may be waived by a vote of the board. One half of the time spent in attendance at an electrical technical school may be considered toward satisfaction of the required four years experience. 4 A'rrACHMENT #1 - Coppell Electrical Code C. Examination and Issuance. 1. Applicants for a certificate as a master electrician or journeyman electrician, shall appear in person before the board and be examined as prescribed by the board except as provided in Section 19. 2. After an applicant has been certified by the board and has paid the required registration fee, the building inspection department shall register the name of the applicant in the records and shall issue to the applicant a certificate of registration. D. Recognition of Licenses of Certificates of Registration From Other Cities. 1. An electrician holding a currently valid license or certificate of registration in another city may apply for and receive a similar license or certificate or registration in this city without taking an examination if the applicant: a. submits evidence satisfactory to the board that: 1) the appllcant's license or certificate of registration was issued under conditions not less restrictive than required by this ordinance for issuance of a similar license or certificate or registration, and 2) an electrician holding a certificate of registration issued by this city would be penratted to apply for and receive a similar certificate of registration or license in the other city under reciprocal conditions; and b. show proof of being currently licensed or registered: 1) in a reciprocal city which participates in the Dallas or Taxrant County electrical examinations, or 2) for at least one year in the same capacity in a reciprocal city which does not participate in the Dallas or Tarrant County electrical examinations; and 3) pays the registration fee required and complies with all other requirements of this code. 2. The Code Advisory and Appeals Board shall approve all such reciprocal electrical licensing agreements. 5 ATFACHMENT # 1 - Coppell Electrical Code E. Transferability: Display of Certificate A person shah not lend, rent, or transfer his certificate of registration to any other person. It is unlawful for a person other than the building official or an electrical inspector to alter a certificate or registration in any manner. Every holder of a certificate as an electrical contractor shall display their certificate in a conspicuous place in their principal place of business. Every holder of a certificate as registered master or journeyman electrician, shall carry their registration card or certificate on their person at all thnes while doing electrical work and shall produce and exhibit it when requested by an inspector or officer of the city. F. Renewal: Expiration. 1. Except for renewal licenses issued staffing December 1 for the coming year or new licenses issued from December 1 through December 31 of the present year, a certificate or registration required by this chapter expires at midnight December 31 of any year shah be dated to exp/ze December 31 of the next year. In any event, all licenses shall be renewed annually by the building inspections department upon application and payment to the city of the required renewal fee; provided, however, that if during the preceding year the certificate holder has been convicted of a violation of this code or no longer meets the original certification requirements, the building official shall require the application for renewal be reviewed by the board. 2. A certificate of registration that has expired for more than one month but less than one year may be renewed upon application and payment of the required renewal fee, plus a penalty equal to the registration fee set forth in Exhibit "A" of the classification of electrician in which the certificate holder was registered. A certificate that has expired for one year or longer is not renewable. A new certificate may be obtained by complying with the requirements of Section 11 and 12 of this code. 3. An electrician renewing a license must submit satisfactory evidence that their license or certificate of registration was issued under conditions that were not less restrictive than those required by this ordinance. A waiver of this evidence or requirement may be given by a vote of the board. G. Suspension or Revocation of Certificate. 1. The board shall have the power to suspend or revoke the certificate of registration of any class of electrician who is found guilty of: 6 ATFACHMENT # 1 - Coppell FAect~cal Code a. the practice of any fraud or deceit in obtaining a certificate of registration; b. intentionally vlolaring any provisions of this code; c. any gross negligence, incomperency, or mAsconduct in the performance of electrical work with~ the city. 2. In considering charges under this section, the board shall proceed upon sworn information furnished by an official of the city, or by some person aggrieved by the action of an electticlan in the performance of electrical work for which an electfical perrnlr is required. Such information shall be in wfiring and shall be duly verified by the person familiar with the allegations made. The board, ff it deems the information sufficient to support further action on its part, shall issue an order setting the matter for hearing at a specified rime and place, the building official, with the advice of the City Attorney, shall cause a copy of the board's order and the information to be served upon the electrician by certified mall, return receipt requested, at least fifteen days before the date set for the hearing. The electrician may appear in person or by counsel, at the time and place named in the order and present their defense to the board. The City Attorney shall provide counsel for the board. If the electrician fails or refuses to appear, the board may proceed to hear and determine the charge in their absence. If they plead guilty, or if, upon a hearing of the charge, the board finds any of the charges to be true it may enter an order suspending or revoking the certificate of registration of the electrician. 3. When the board has completed the hearing, it shah cause a record of its finding and decision to be ~ed with the City Secretary and shall cause a certified copy to be forwarded to the electrician. 4. The board shall, in reciting its decision make provision for reinstatement based upon written notice by the board at the expiration of a specified period, or by the suspended person satisfactorily passing an examination given for the same grade of electrician from which they are suspended. An order of reinstatement shall be filed as a part of the record and a copy shall be made and given or mailed to the electrician concerned. 5. Any person who may feel themselves aggrieved by any action or decision of the board may, witkin 30 days after receiving notice of the board's final order, file suit in the district court of Dallas County, to correct any error of law in the decision. The suit shall be filed against the board as defendant and service of process may be made upon the board by serving the City Secretary. 6. A person whose fights under a certificate of registration have been suspended 7 ATFACHMENT # 1 - Copper[ Electrical Code or revoked by the board, shah not engage in or electrical construction for which a permit is required. H. Examination and Registration Fees. 1. In addition to an annual registration fee, new applicants or those requ/red to take an examination shall pay the examination fee spech~ed in Exhibit "A", which must be submitted with application to the building inspections department. An applicant who fails to take the first exam/nation foilowing the date of their application forfeits the examination fee unless the applicant notifies the building inspections department before the examination date and unless the applicant files a new application before the next scheduled examination. 2. After an applicant has been certified by the board, the annual registration fee as specified in Exhibit "A" shall be paid by the applicant. The fee, which is due by January 1 of each year, must be paid at the building inspection department before the issuance of a certificate of registration. Renewal applications will be accepted starting December 1 of the preceding year. 3. A person desiring to take an examination at a time other than at the scheduled examination time may file an application for a special examination with the board, together with a receipt showing that the sum of $500 has been paid to the building inspection department as a special fee paid in addition to the fee specified in Exhibit "A" to offset the increased expense of conducting a special examination. A license issued under the terms of a special examination cannot be reciprocated. 4. Examinations: a. The board shall prescribe a reasonable examination of a uniform, fair and impartial nature, testing the knowledge and skill of each applicant to do electrical work, involving the installation, alteration, repair, and maintenance of electrical conductors and equipment. b. Examinations shall be in writing. c. The board shall conduct examinations with utmost fairness and patience. Should any applicant fail an examination, the board shall, so far as it may be practicable, apprise the applicant wherein they are deficient, or fails to meet in a reasonable manner the requirements of the examination. d. An unsuccessful applicant may make application for re-examination at such time as may be prescribed by the rules adopted by the board. No 8 ATFACHMEhrr #1 - Goppell Electrical Code applicam, however, may be re-examined before the expiration of two months from the date of his previous examination. An applicant that is unsuccessful in two successive exan~nations shall be required to wait six months before being allowed to make application for re-examination. An applicant that is unsuccessful in three successive examinations shall be required to wait twelve months before being allowed to make application for re-examination. e. An applicant shall not be derded an examination or certificate on account of their aff~iarion with any person or any lawful organization, union, or association. f. The board shall be diligent and tolerant in aiding and assisting all applicants by enlightening them concerning the rules prescribed by the board for examination. g. The board shall authorize the building inspections department to issue each applicant who passes the examination a certificate of registration. 5. Records: The building official shall keep a record of all persons qualified by the board to whom certificates of registration have been issued and shall not be responsible for the record of any person whose registration has not been renewed for a period of one year. I. False Representation as to Registered Class of Electrician and Registration and Regulation Generally. 1. A person shall not represent themselves as a registered electrician of any class set out in this chapter or use the works of similar import or meaning on signs, cards, stationary, or by any other manner, unless the person is the holder of a valid certificate or registration in the class for which they are representing themselves as being registered. 2. A person shall not engage in the business of electrical contracting without being registered in the manner required by this section. 3. An electrical contractor shall not establLsh, maintain, or advertise a place of business at any location within the city under any name other than that registered with the building official. 4. Any person desiring to engage in the business of electrical contracting shah make application for registration at the building inspection department office. After 9 ATFACHMENT #1 - Coppell Electrical Code the application has been approved by the board, and upon payment of the registration fee required by this subchapter, the building official shall register the applicant and issue to the applicant a certificate of registration. The certificate of registration must include the proper address of the applicant's established place of business. Upon request, the building official may grant permission for an applicant for electrical contractor's license to begin work on a single project before approval of their electrical contractor's license by the board if in the opinion of the building official the applicant meets all the requirements of the provisions of this ordinance. An applicant for contractors license temporarily quaiLfled by this method shall at the time of application submit a fee in the form of a cashier's check or money order with their application which shall be made payable to the City of Coppell in the amount as specified in Exhibit "A" and such payment as received shall not be refundable under any circumstance. 5. An electrical contraetor's certificate shall enti~e the holder to engage in the business of, and to secure permits for, the installation, addition, alteration, devices, and equipment. 6. An electrical contractor shall not engage in an electrical contracting business within the city unless the business is qualified by a master electrician; and a. is an owner or fuli-tirne employee of the business; and b. actively supervises the daily operation of the business; and c. is not engaged in or employed by any other electrical business at the same time that the electrical contracting business is registered to perform electrical work within the city unless the master is an owner/operator; and d. is authorized to order employees of the business to correct defects, errors, and deficiencies in electrical work installed or performed by the business. 7. The building official is authorized to withhold inspections from, and the issuance of permits to, any registered contractor who: a. fails to correct a defect, error, or deficiency in work installed under the authority of an electrical permit within 10 calendar days after written notification from the office of the building official and/or b. fails to pay any indebtedness to the city for inspection fees or permits obtained. 10 A1TACHMENT # 1 - Coppell Electrical Code 8. Master Electrician a. A person who has been employed as a master electrician by a registered electrical contractor shall register with the building official in writing on a form to be furnished by the building inspections department. When an applicant has complied with the requirements of this code, the building official shall certify them as a master electrician for a specific registered electrical contractor by placing their name on the contractox~s registration certificate and by identification card issued to the registered master electrician. b. When a master electrician has not acted in the capacity of a master electrician or in a supervisory position on electrical work in the city for a continuous period of two (2) years, the building official may require them to be re-examined before they are certified as a registered master electrician. c. A master electrician who qualifies an electrical contracting business assumes responsibility for the business complying with the provisions of this code in ks entirety, including payment for indebtedness to the city of permit fees. d. Whenever a master electrician leaves or is discharged from the employ of a person who is required by this code to employ a master electrician, a notice in writing shall be given immediately by both the employer and the master electrician to the building official, and the permit privileges of the employer shall, without further order or action, be suspended until the employment and qualifying of another master electrician. e. A master electrician shah not qualify more than one electrical contracting business at any one time. f. A master electrician shall not knowingly permit their name to be used or themselves to be held out as the master electrician who qualifies a specific electrical contracting business unless they: 1) are an owner or full-time employee of the business; and 2) actively supervises the daily operation of the business; and 3) are not engaged in or employed by any other business at the same time that the electrical contracting business is registered to perform electrical work within the city unless the master is an owner/operator; and 11 ATI'ACHMENT # 1 - Coppell Electrical Code 4) is authorized to order employees of the business to correct defects, errors, and deficiencies in electrical work installed or performed by the business; and 5) resides within the trade area of the city in which the electrical contracting business is located. 9. Journeyman Electrician. A journeyman electrician's certificate or a temporary journeyman's certificate shall entitle the holder to engage themselves in the employ of any person registered under the provision of this code as an electrical contractor. 10. Supervision. An electrical contractor may have laborers or apprentices on any of such contractors jobs, but they must at all times be under the direct supervision of a licensed journeyman, maintenance or master electrician, until such time as they pass the examination. Direct supervision shall mean that a licensed electrician shall be on the job site or project site at all times when electrical installations are being made or maintained. There may be no more than four (4) laborers or apprentices supervised by a licensed journeyman electrician. J. Certain Work Exempt From Registration Reqtdrements 1. The following classes of work may be carried out by persons who are not registered electricians: a. The replacement of lamps, fuses, and the connection of portable devices to suitable receptacles which have been permanently installed; b. The installation, alteration, or repairing of any wiring devices or equipment for the operation of signals or the transmission of intelligence, where such wiring, devices, appliances, or equipment operates at a voltage not exceeding 25 volts between conductors and does not include generating or transforming equipment; c. The installation, alteration, or repair of electric wiring, devices, appliances, and equipment installed by or for an electrical public service corporation operating under a franchise from the city, when for the use of the corporation in the generation, transmission, distribution, or metering of electrical energy; d. Any work involved in the manufacture or test of electrical materials, devices, appliances, or apparatus, but not including any installation of wiring other than that required for testing purposes if the equipment is 12 ATfACHMENT # 1 - CoDDeJ] E[eciI'[ca[ Code approved by the building official before k is installed or used wichin the city. e. The installation, alteration, or repair of any wiring devices or equipment installed by or for a cable television company operating under a franchise from the city when such devices or equipment is used solely for the transmission or distribution of a television signal. 2. A homeowner may personally install electrical conductors of equipment with that person's own home ff the owner files with the building official approved plans and specifications, has satisfied the building official as to that person's ability to install electrical wiring, applies for and secures a permit, pays required fees, does work in accordance with this article, and applies for inspection. Work performed by a homeowner under the provisions of this section must be done by such homeowner on homestead premises owned and occupied by such homeowner, without compensation. A homeowner shall not employ another person to assist such homeowner in any way on the work. 3. The provisions of this article shall not apply to the installation, alteration, or repair of electrical equipment installed for or by an electric utility company for the use of such company in the generation, transmission, distribution, or meterlng of electricity. SECTION 3 The National Electrical Code, 1990 Edition, is hereby adopted with the amendments stated herein as part of this ordinance. Additions to the 1990 National Electrical Code are identified by shading. Deletions to the 1990 National Electrical Code are identified by a single line extending through the deleted text. This is an example of how deleted text is marked. The following are changes: A. The first paragraph of Article 210-4(d) "Identification of Ungrounded Conductors" under Article 210-4 "Multi-wire Branch Circuits" of Article 210 "BRANCH CIRCUITS" is amended to add a sentence as follows: Ideatificalion of Ungrounded Conductors. Where more than one nominal vokage system exists in a building, each ungrounded system conductor shall be identified by phase and system. 13 A'FFACHMENT # 1 - CopI~]I Electrical Code B. Article 210-5(a) "Grounded Conductor" under Article 210-5 "Color Code for Branch Circuits" of Article 210 "BRANCH CIRCUITS" is amended as follows: Grounded Conductor. The grounded conductor of a branch circuit shall be identified by a continuous white or natural gray color. C. Article 210-63 "Heating, Air-Conditioning, and Refrigeration Equipment Outlet" under Article 210 "BRANCH CIRCUITS" is amended as follows: 210-63. Heating, Air-Conditioning, and Refrigeration Equipment Outlet. A 125-volt, single-phase, 15- or 20-ampere-rated receptacle outlet shall be installed at an accessible location for the servicing of hearing, air-conditioning, and refrigeration equipment on rooftops and in attics and crawl spaces. The receptacle shall be located on the same roof level and within 7~ ~5 feet of the heating, air-conditioning, and refrigeration equipment, ~:!~i~i~:~.:.~:~i~::~.~.~ii~ii~i The receptacle outlet shah not be connected to the load side of the equipment disconnecting means. D. Article 300-4(d) "Cables and Raceways Parallel to Framing Members" under Article 300- 4 "Protection Against Physical Damage" of Article 300 "WIRING METHODS" is amended as follows: Cables and Raceways Parallel to Framing Men~bers. In both exposed and concealed locations, where a cable- or raceway-type wiring method is installed parallel to flaming members, such as joists, rafters, or studs, the cable or raceway shall be installed and supported so that the nearest outside surface of the cable or raceway is not less than 11/4 inches (31.8 mm) from the nearest edge of the flaming member where nails or screws are likely to penetrate. SECTION 4 The following requirements take precedence over the wording of the National Electrical Code, 1990 Edition as adopted. INSTALLATION REQUIREMENTS A. Unlaw~xl to interfere with Wiring. It shall be unlawful for any owner, contractor or workman, other that an authorized electrician, in any manner to interfere with any electrical wiring being installed in or on any building. If in the course of construction of a building, the wiring is in such a position as to interfere with its erection or completion as called for by plans, notice shall immediately be given to the person installing the viring, or the electrical contractor, and the needed change shall be made by such persons. B. Senrice Requirements. 1. Location of Disconnecting Device. The service disconnecting means shall be installed outside of a building or other structure on all occupancies except those classified as Group R, Division 3 occupancies. The disconnecting means for Group R, Division 3 occupancies shall be located on a wall of the garage. If located on the inside of the garage, the box must be located directly opposite the meter. If the disconnect is located on the outside of the garage, the inside circuit box must be located opposite the outside disconnect box. All disconnecting means must be direct from service to disconnect. There shall be no more than one main disconnecting device for each service. Alternate installations must be approved by the Code Advisory and Appeals Board. C. General Specifications. The following general specifications shall apply to all wiring installed in the city: 1. Any addition to, alteration of, or any bttilding or structure hereafter erected and used for other than single family, duplex, or multi-family uses, shall have all wiring installed in rigid metallic conduit, steel tube or metal molding system above the ground or slab level. Exception No. 1. Approved cable tray and busways shall not be prohibited. Exception No. 2. Underground installation of polyvinyl chloride conduit containing feeder or branch circuit conductors shall be permitted to extend above ground level or floor grade to a maximum length of five (5) feet where not subject to mechanical injury or prohibited by the Building Code. 2. Ground Clamps. All clamps for wiring system grounds shall be placed so as to be readily accessible at all times. 3. Underground Conduit. All conductors installed underground except those suitable for direct burial shall be installed in rigid metal conduit, or rigid nonn~etallic conduit (PVC). 4. Aluminum Conductors. Aluminum or copper-clad aluminum conductors shall not be used or installed in the city as a wiring method. This requirement shall not limit the use of materials of the Electrical Utility Company. Exception: Aluminum conductor material may be used as service entrance conductors provided that the nominal size of the conductor is Number 2 AWG or larger and the conductor material is an AA-8000 series Aluminum Alloy. All aluminum conductors shall tennlnate with approved compression connectors. S. Armored Cable.
