OR 2019-1509 Alternate JudgesORDINANCE NO. 2019-1509 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, APPOINTING ALTERNATE MUNICIPAL JUDGES OF THE MUNICIPAL COURT NO. I OF THE CITY OF COPPELL; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on November 23, 2018 a vacancy was created for an alternate judge of the Coppell Municipal Court No. l; and, WHEREAS, the Council desires to increase the number of alternate judges from two to three in said Court; and, WHEREAS, the Council has determined that upon interview and review that Kimberly Lafferty should be appointed to the remainder of term for said vacancy and that Peter Graham should be appointed in the new alternate judge position, respectively, for terms expiring on September 30, 2020. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That in accordance with the provisions of the City Charter, ordinances and State Law, the City Council hereby immediately appoints Kimberly Lafferty as Alternate Judge of the Coppell Municipal Court No. 1 on January 28, 2019 to serve the remainder of the unexpired term until September 30, 2020. The Municipal Judge appointed herein shall have and possess the authority, powers, rights, duties, and jurisdiction granted to and imposed on municipal judges of the Courts of Record of the State of Texas by the provisions of State Law, City Charter and the ordinances of the City of Coppell. SECTION 2. That in accordance with the provisions of the City Charter, ordinance and State Law, the City Council hereby immediately appoints Peter Graham as the Alternate Judge of the Coppell Municipal Court No. 1 to serve until expiration of September 30, 2020. The Alternate Judge appointed herein shall have and possess the authority, powers, rights, duties, and jurisdiction granted to and imposed on municipal judges of the Courts of Record of the State of Texas by the provisions of State Law, City Charter and the ordinances of the City of Coppell. SECTION 3. That the Municipal Judges appointed hereunder shall each serve the remainder of the term of office, set to conclude September 30, 2020, unless sooner terminated according to the provisions of law. SECTION 4. That the City Manager shall negotiate and execute with the foregoing persons such contracts and agreements as may be deemed necessary and appointment. SECTION 5. That should any word, phrase, paragraph, section or phrase of this ordinance or of the Code of Ordinances, as amended hereby, be held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Code of Ordinances as a whole. SECTION 6. That this ordinance shall take effect immediately from and after its passage and the publication, as the law and charter in such cases provide. DULY PASSED by the City Council of the City of Coppell, Texas, on the day of '2019.
