OR 91500-A-738 PD-297-HC WhitestoneAN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 91500-A-738 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND MAP OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED, BY GRANTING A CHANGE IN ZONING FROM HC (HIGHWAY COMMERCIAL) TO PD -297 - HC (PLANNED DEVELOPMENT -297 -HIGHWAY COMMERCIAL) TO ESTABLISH A CONCEPT SITE PLAN FOR HOTEL, RETAIL, RESTAURANTS AND OFFICE USES ON 16.57 ACRES OF PROPERTY AND A DETAIL SITE PLAN FOR TWO HOTELS, ONE BEING A RESIDENCE HOTEL, ON APPROXIMATELY 6 ACRES OF LAND LOCATED AT THE NORTHEAST CORNER OF SANDY LAKE AND SH 121, AND BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO AND INCORPORATED HEREIN; PROVIDING FOR APPROVAL OF THE CONCEPT PLAN, DETAIL SITE PLAN, LANDSCAPE PLAN, TREE SURVEY, LAQUINTA ELEVATIONS, LAQUINTA FIRST FLOOR PLANS, LAQUINTA 2- 5 FLOOR PLANS, HOME2SUITES ELEVATIONS, HOME2SUITES FIRST FLOOR PLANS, HOME2SUITES 2-5 FLOOR PLANS, HOME2SUITES —ROOM LAYOUT, STREET CROSS SECTION, INTERSECTION DESIGN AND 40 - FOOT MULTI -TENANT SIGN, ATTACHED HERETO AS EXHIBITS `B" THOUGH "O"; AND PROVIDING FOR DEVELOPMENT REGULATIONS; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Planning and Zoning Commission and the governing body of the City of Coppell, Texas, in compliance with the laws of the State of Texas and pursuant to the Comprehensive Zoning Ordinance of the City of Coppell, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, and to all persons interested and situated in the affected area and in the vicinity thereof, the said governing body is of the opinion that Zoning Application No. PD -297 -HC should be approved, and in the exercise of legislative discretion have concluded that the Comprehensive Zoning Ordinance and Map should be amended. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of Coppell, Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and the same is hereby amended by granting a change in zoning from HC (Highway Commercial) to PD -296 -HC (Planned Development -296 -Highway Commercial) to establish a Concept Site Plan for hotel, retail, restaurants and office uses on 16.57 acres of property and approving a Detail Site Plan City of Coppell Ordinance Pg 1 TM 105729 for two Hotels, including on as a Residence Hotel, as defined by the Coppell Code of Ordinances, on approximately 6 acres of land located at the northeast corner of Sandy Lake and SH 121, for the property described in Exhibit "A" attached hereto and made a part hereof for all purposes. SECTION 2. That the Property will be used and developed for Highway Commercial purposes as provided in the Code of Ordinances, as provided in Section 1, is the same hereby approved subject to the following development regulations: 1. Concept Plan is hereby approved subject to the development regulations, as follows: a. That a Detail Site Plan shall be required for approval(s) for the remaining 11.6 acres, to provide additional buffers along the freeway, to provide a focal point feature at the intersection of SH 121 and Sandy Lake Road; and shall be designed to take advantage of the tree preservation amenity as noted and designated on the Concept Plan, attached as Exhibit B. b. Detail Site Plans shall be filed and approved by development regulations and Highway Commercial standards, as amended herein, and in accordance with the Comprehensive Zoning Ordinance. c. There shall be a coherent architectural theme and Detail Site Plans shall include elevation facades to assure architectural compatibility. Type of exterior construction relating to the color of exterior wall surfaces elements shall be reviewed at the time of Detail Site Plan and shall be consistent with compatible materials color and architectural style. d. There shall be a consistent sign plan throughout the Planned Development for all attached and monument signage; and such signs shall be compliant with the provisions of the Sign Ordinance, except otherwise as provided herein. e. This property shall to be replatted as necessary under the City subdivision to provide building sites, necessary easements, fire lanes and public access. City of Coppell Ordinance Pg 2 TM 105729 f. The following traffic improvements are required to support this development, based on the Traffic Impact Analysis (T.LA.) submitted and shall be at the time of the prior to and/or time of plat submittal which shall include: i. Provide an eastbound left turn lane with 150 feet of storage on Sandy Lake Road at Royal Lane. ii. Provide a northbound right turn lane with 425 feet of deceleration including 100 -foot taper on SH 121 Northbound Frontage Road at Driveway 2; as depicted on Concept Plan. iii. Provide a northbound right turn lane with 300 feet of deceleration including 100 -foot taper on SH 121 Northbound Frontage Road at Driveway 3. Modify existing signal at the intersection of Sandy Lake Road and Royal Lane to accommodate for southbound portion and eastbound left turn lane including a new traffic signal pole for the southbound direction and pedestrian signals for all portions. iv. Provide for construction for one additional northbound through lane to the development at the intersection of Sandy Lake and Royal Lane; and v. Provide an addition of a deceleration lane for the right turn into the Royal Lane Driveway. g. At the time of platting of Phase 1, Fire lane(s) shall be stubbed -out at intersections to Phase 2 to allow connection of future development and use. h. Property Owners Association shall be formed and continued to maintain all common areas, including the landscape medians, tree preservation area pedestrian areas, and all enhanced paving surfaces. Property Owners Association documents City of Coppell Ordinance Pg 3 TM 105729 areas shall be submitted prior to filing for staff review and approved prior to the filing of the Final Plat to ensure compliance with this ordinance; and i. Detailed site plans for Phase 1 (La Quinta and Home 2 Suites) shall be in compliance with this ordinance. 2. Detail Plan — LaQuinta a. Allowance to colors of masonry and accent materials shall be in conformity with the Code of Ordinances, except as provided on the Building Elevations, attached hereto as Exhibit "F" b. All signage shall be compliant with the Sign Ordinance, except as amended herein in Section 4 of this ordinance. c. Provide a minimum 131 parking spaces being provided, including American Disability Act requirements. d. First Floor Plans, the hotel shall meet the following development regulations: i. There shall be a minimum of 125 guest rooms; ii. the minimum guest room size shall be 335 square feet; iii. the lobby/waiting/atrium area shall be a minimum of 820 square feet; iv. there shall be a dedicated meeting room space of at least 1,200 square feet. v. there shall be a limited food service/restaurant defined as — buffet food available for self-service by a customer through a serving line and with a table/seating. vi. there shall be a minimum of 2,600 square feet outdoor plaza or patio area as depicted in Exhibit C. vii. there shall be a swimming pool with a minimum of 600 square feet of water surface area and be maintained in good working order. City of Coppell Ordinance Pg 4 TM 105729 viii. there shall be equipped weight or fitness room with a minimum of 600 square feet. 3. Detail Plan — Home2-Suites, a. Not more than 22 room units per acre, and the provision of three amenities, as noted on Exhibit G. b. The masonry and accent materials, to be compliant with the 80% masonry requirement, as indicated and noted on Exhibit I, attached hereto and incorporated herein. c. All signage shall be compliant with the Sign Ordinance, except as amended herein in Section 4 of this ordinance. d. As indicated in Exhibit J, First Floor Plan, attached hereto shall meet the following development regulations: i. There shall be a minimum of 126 guest rooms; ii. the minimum guest room size shall be 323 square feet; iii. the lobby/waiting/atrium area shall be a minimum of 750 square feet; iv. there shall be a dedicated meeting room space of at least 1,200 square feet. V. there shall be a limited food service/restaurant defined as —buffet food available for self-service by a customer through a serving line and with a table/seating for consumption. vi. there shall be a minimum of 2,600 square feet outdoor plaza or patio area as depicted in Exhibit C. vii. there shall be a swimming pool with a minimum of 600 square feet of water surface area and be maintained in good work order. One 40' tall pylon sign shall be permitted on SH 121 at the main driveway, as indicated on the Exhibit "0". b. One 60 square foot monument sign, as permitted by the Sign Ordinance be allowed at Sandy Lake and the main driveway. c. All other signs shall be in accordance with the Sign Ordinance, except as specifically amended herein" SECTION 3. That the Concept Plan, Detail Site Plan, Landscape Plan, Tree Survey, LaQuinta Elevations, LaQuinta First Floor Plans, LaQuinta 2-5 Floor Plans, Home2Suites Elevations, Home2Suites First Floor Plans, Home2Suites 2-5 Floor Plans, Home2Suites — room layout, Street Cross Section, Intersection Design and 40 -foot Multi -Tenant Sign, attached hereto as Exhibits "B" though "0"; respectively, shall be deemed as development regulations to this development. SECTION 4. That the above property shall be used only in the manner and for the purpose provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and as amended herein. SECTION 5. That the development of the property herein shall be in accordance with building regulations, zoning ordinances, and any applicable ordinances except as may be specifically altered or amended herein. SECTION 6. That all provisions of the Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect.
