ORDINANCE NO. 90479
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, CHANGING THE SPEED
LIMIT ON A PART OF COPPELL ROAD AS FOLLOWS: AMENDING SECTION 8-1-
3 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL ESTABLISHING 35
MILES PER HOUR AS THE MAXIMUM PRIMA FACIE SPEED LIMIT ON COPPELL
ROAD FROM SANDY LAKE ROAD, IN A NORTHWESTERLY DIRECTION, TO THWEATT
ROAD, SAID ROAD BEING A PUBLIC STREET WITHIN THE CORPORATE LIMITS
OF THE CITY; MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE
A VEHICLE ON SAID PUBLIC STREET AT A SPEED GREATER THAN SAID
DESIGNATED SPEED; PROVIDING THAT ANY SPEED IN EXCESS OF SUCH
DESIGNATED SPEED SHALL BE PRIMA FACIE EVIDENCE THAT SUCH SPEED IS
NOT REASONABLE NOR PRUDENT AND IS UNLAWFUL; PROVIDING A REPEALING
CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY
OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR
EACH OFFENSE AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
From and after the effective date of this ordinance Section
8-1-3 of the Code of Ordinances of the City of Coppell, which
establishes speed limits on certain specific streets within the
city, shall be amended by changing the maximum prima facie speed
limit of the following street as follows:

Coppell Road From Sandy Lake Road, 35
Northwesterly to Thweatt Road
A person commits an offense if he operates or drives a vehicle
on an above designated street at a speed greater than the speed
designated by this section for that street or portion thereof and
any speed in excess of such designated speed shall be prima facie
evidence that such speed is not reasonable nor prudent and is
unlawful.
SECTION 2. REPEALING CLAUSE
All ordinances, or parts of ordinances, inconsistent or in
conflict with the provisions of this ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision
of this ordinance shall be adjudged invalid or held
unconstitutional, the same shall not affect the validity of this
ordinance as a whole or any part or provision thereof, other than
the part so decided to be invalid or unconstitutional.
SECTION 4. PENALTY CLAUSE
Any person, firm or corporation violating any of the
provisions of this ordinance shall be deemed guilty of a
misdemeanor and, upon conviction, shall be punished by a penalty
of fine not to exceed the sum of Five Hundred Dollars (500.00) for
each offense, and each and every day such offense is continued
shall constitute a new and separate offense.
SECTION 5. EFFECTIVE DATE
This ordinance shall take effect immediately from and after
the publication of its caption, as the law in such cases provides.
