OR 2019-1524 Sanitary Sewer Easement Abandonment ORDINANCE NO. 2019-1524 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ABANDONING A TWENTY-FOOT SANITARY SEWER EASEMENT AS DESCRIBED IN EXHIBITS "A" AND “B”, ATTACHED HERETO; RESERVING ALL EXISTING EASEMENT RIGHTS OF OTHERS IF ANY, WHETHER APPARENT OR NON-APPARENT, AERIAL, SURFACE, UNDERGROUND OR OTHERWISE; PROVIDING FOR THE FURNISHING OF A CERTIFIED COPY OF THIS ORDINANCE FOR RECORDING IN THE REAL PROPERTY RECORDS OF DALLAS COUNTY, TEXAS AS A QUITCLAIM DEED; AND AUTHORIZING THE MAYOR TO SIGN AND TO EXECUTE ANY NECESSARY DOCUMENTS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Coppell has determined that the easement located on Lot 1 and Lot 2 of Block A of the Creek View Addition, City of Coppell, Dallas County described in Exhibits "A" and “B”, and hereto, is no longer needed for public purposes; and WHEREAS, the City Council has determined that said easement has never been utilized or used for a public purpose and does not have any value to the City; and WHEREAS, the adjacent property owner desires that said easement be abandoned upon payment of fair market value; and, WHEREAS, the City Council desires to abandon a twenty-foot sanitary sewer easement for public utilities including the right to access and maintain thereof, situate in which may be used in the future by the City, as described and depicted on Exhibits “A” and “B” attached hereto; and WHEREAS, this ordinance shall be considered a quit claim deed to be filed in the Deed Records of Dallas County. NOW, THERFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS; SECTION 1. That the City Council of the City of Coppell, Texas has determined that the easement described in Exhibits “A” and “B” attached hereto and made a part hereof for all purposes, is no longer needed or necessary for public purposes and should be, and is hereby, abandoned in favor of the adjacent property owners. SECTION 2. That said easement is abandoned, vacated and closed insofar as the right, title and interest of the public to such are concerned. That the City of Coppell does not abandon any other interest other than that described in Exhibits "A" and “B”, but does hereby abandon all of its right, title and interest subsurface rights in and to that certain tract of land described in Exhibits "A" and “B”, either in fee simple or by easement or otherwise, together with any and all TM 112001 EXHIBIT ‘A’ TM 112001 TM 112001 TM 112001 EXHIBIT ‘B’ TM 112001 TM 112001 TM 112001
