General Information:
The City is responsible for maintaining conveyance in streams
The City is responsible for maintaining storm drain infrastructure located in drainage
easements
The City needs to implement drainage improvement projects to preserve conveyance

The Drainage Utility District generates revenue for the operation and maintenance of
the drainage system
Staff and consultant Dan Jackson with Wildan presented background and rate model
information on September 24, 2019 and January 14, 2020.

Introduction/Analysis:
Staff and the rate consultant (Dan Jackson with Wildan) will present twodraft rate models for the
Drainage Utility District to cover the project and maintenance needs. Staff is requesting feedback on
the draft rate models and permission to hold a public hearing to consider adopting changes to the
Drainage Utility District rates on March 24, 2020.

General Information:
The City collects roadway, water and wastewater impact fees to cover costs associated
with infrastructure needed to serve future development
According to Chapter 395 of the Texas Local Government Code, Cities must review
their impact fees at least every five years
In January of 2018 the City entered into an agreement with Birkhoff, Hendricks &
Carter, LLP for System Planning and Impact Fee Update
Birkhoff, Hendricks & Carter, LLP has completed the System Planning and Impact
Fee Update study
Per Chapter 395 of the Texas Local Government Code, any amendments to the impact
fee need to follow a schedule of required actions, meetings and public notices
The Planning and Zoning Commission serves as the Capital Improvement Advisory
Committee (CIAC), as established by the City’s Impact Fee Ordinance and allowed
by statute
Analysis:
Staff will present information regarding the amendment process and draft fee changes for discussion.

problem of heart and blood vessel diseases; and
WHEREAS, heart disease is the leading cause of death for both men and women, affecting
people of all races and ethnicities; and

Reference: Consider approval of a Resolution amending Resolutions 2020-0128.2 and
2020-0128.2(SP); amending the physical address of the Dallas County Elections Department location;
amending the joint runoff date and the absentee ballot by mail deadline; and to comply with Texas
Election Code Section 123.001 by officially adopting the ballot cast system and equipment used by the
counties during the joint elections; and authorizing the Mayor to sign.
Introduction:

The Texas Election Code requires that ageneral election be ordered by the 78day prior to the
election. In keeping with the regularly scheduled Council meetings, an order was brought forward on
January 28, 2020 for Council’s consideration to enter into future joint agreements with Dallas and
Denton counties.Since that time, meetings have been held withthe county entities to discuss the fine
details about the contracts,and therefore amendments to the current order needto be made.
Analysis:
Amendment to the existing Order of Election include: a physical address correction for the new Dallas
County Elections facility; updated dates for the joint runoff elections (if needed) and absentee ballot
by mail deadlines; and an official statement of agreement, as required by the Texas Secretary of State,
to utilize the election equipment and ballot marking devices as provided for by Dallas County.This
step is not necessary with Denton County as they are not a vote center entity.
Finalized copies of the joint agreements will arrive by the end of February and will be available for
the Mayor’s signature.

BE IT REMEMBERED THAT on this the 28 day of January 2020, at a duly posted
meeting of the City Council of the City of Coppell, Texas, a quorum being present, the meeting
was called to order, and the Council issued the following order:

IT IS HEREBY ORDERED that a general election be held on the 2 day of May 2020,
7:00 a.m. to 7:00 p.m., for the purpose of electing one Councilmember for Place 1, one
Councilmember for Place 3, one Councilmember for Place 5, and one Councilmember for Place
7for a period of three years.The candidate for such office receiving a majority of all votes cast
for all candidates for such office shall be elected to serve such term or until his or her successor
is duly elected and qualified.
In the event any candidate for said office fails to receive a majority of all votes cast for all
the candidates for such office, a run-off election shall be held. If a run-off election becomes
necessary, the run-off election will be held on Saturday, June 20, 2020.
The election shall be held as a Joint Election administered by the Dallas and Denton
County Elections Administratorsutilizing specific equipment to cast ballots as approved by the

Texas Secretary of State,andin accordance with the provisions of the Texas Election Code and
the Texas Administrative Code,witha Joint Election Agreement foreach of the respective
counties. The City Manager is hereby authorized to executetheElection Contracts with the
Counties of Dallas and Denton for theconduct of the election.Pursuant to the Joint Election
Contract, the County Elections Administrator shall serve as Election Administrator for the
election. Presiding Election Judges and Alternate Presiding Election Judges appointedto serve
at said polling places shall be those election officials furnished by the Elections Administrator
from the list of proposed elections judges listed in an attachment to the Joint Election Contract.
Notice of the election shall be posted on the bulletin board used to post notice of the City
Council meetings and be published in a newspaper of general circulation in the City. Said notice
must be published on the same day in each of two successive weeks, with the first publication
occurring no earlier than the thirtieth day and no later than the fourteenth day before the date of
the election. A copy of the published notice that contains the name of the newspaper and the
date of publication shall be retained as a record of such notice, and such person posting the
notice shall make a record of the time of posting, starting date and the place of posting.
Early voting by personal appearance for Dallas County and Denton County residents will
be set forth in accordance to state law and as stated in the Joint Elections Contracts and posted on
the City’s webpage. Application for ballot by mail must be received no later than the close of
business on April 20, 2020. Applications for early voting ballot by mail shall be mailed to:

puesto, será electo para prestar sus servicios durante esa gestión o hasta que su sucesor(a) sea
debidamente electo(a) y llene las cualidades establecidas.
En caso de que cualquier candidato a dicho cargo público no logre acumular la mayoría de los
votos decisivos entre todos los candidatos a ocupar dicho cargo público, se llevará a cabo una segunda
ronda de elecciones posterior a la primaria. Si llegase a ser necesaria una segunda ronda de elecciones
posterior a la primaria, dicha ronda de elecciones se llevará a cabo el sábado 20 de junio del año 2020.
Las elecciones deberán llevarse a cabo como una Elección Conjunta administrada por los
Administradores de Elecciones del Condado de Dallas y Denton utilizando un equipo específico para

emitir los votos según aprobados por el secretariodel estado de Texas y de conformidad con las
estipulaciones del Código Electoral de Texas y del Código Administrativo de Texas a través de un

llevar un registro del horario de la publicación, la fecha de inicio y el lugar de publicación.

The Main Street Coppell Property Owners Association (POA) will be holding a Reconvened Special
Membership meeting on February 18, 2020. The meeting is being held to consider the proposed
agreement and plan of merger between the Main Street Coppell POA and RL Hammond Homeowners
Association. The item is an attempt to include the residential lots that were recently built on Travis
Street in Old Town. As property owners within the Main Street Coppell POA, the City of Coppell is
required to cast a ballot as being landowner.
In the event City Council wishes to approve this item the Covenants, Conditions and Restrictions for
Main Street Coppell POA will be amended.
As reference, the ballot has been attached to this agenda item.

Introduction:
The Coppell Arts Center project has reached the point where it is time to purchase the production
A/V equipment needed to operate the building. The project scope for the production A/V equipment
age which did not include a
presenting model where the City is purchasing touring shows and exhibits. The original project
budget also did not include the lighting and video equipment, having those purchases coming out of
the FF&E budget. After reviewing the original equipment listing against what will be needed to
operate a show-presenting business model, the Arts Center staff has identified edits to the
equipment scope. These edits include an upgraded PA system in the Main Hall, additional audio
reinforcement gear, additional lighting fixtures, and revised projector models. CORGAN and the
theatrical system design consultants working on the project have reviewed and approved all
production equipment edits. They have also strongly recommended that this production equipment
purchase be included in the construction budget as a Change Order for continuity between
manufacturers and installers who are already working on the project to ensure proper integration
and successful commissioning.
Analysis:
o The original equipment scope did not account for the proper amount of lighting
fixtures needed to accommodate resident companies as well as touring shows and

production supervisor after holding discovery sessions with resident companies and
reviewing the tech riders for show prospects.
o The original equipment scope did not include audio gear support aside from the main
PA system. Support audio gear that was missing or had inadequate qualities included
monitor and deck fill speakers, monitor and backup audio consoles, a portable PA
system and console for ancillary spaces, wireless microphones, and microphone
stands and peripherals.
o The original equipment scope had a D&B PA system designed for the Main Hall,
which is a premium audio brand satisfactory for touring productions, but it was later
value engineered out for a Fulcrum PA system which is typically designed for small-
medium sized churches and conference centers. The proposed L-Acoustics PA
system in the Change Order is a satisfactory economical solution for touring
productions.
o Staff has received comparable quotes from multiple manufacturers and distributors
and attended numerous equipment demos to determine the best purchase solution
that equally weighs quality and budget impact. Purchasing the equipment through the
the best solution for acquisition and installation of the equipment.
o Putting the equipment purchase back into the construction budget via the Change
Order ensures the installation and integration is done correctly and preserves the

The total cost of the production A/V equipment is $672,894. Approximately $350,000 of that
amount is proposed to be moved from the original FF&E budget with the remaining amount coming

above referenced project.
Scope of Work:
Loose Equipment Inventory: Walker Engineering, Inc. will provide the loose equipment
inventory items shown in the Bill of Materials at the back of this document to the City of Coppell
Performing Arts Center as part of the Audio Visual project currently contracted through CORE
Construction.

All work will be performed during normal business hours.

This proposal of Walker Engineering is based upon the assumption that the labor and materials
anticipated herein will be reasonably available and not subject to unanticipated market
fluctuations. Walker's price and schedule are subject to equitable adjustments for delays caused
by Client's failure to provide any required approval or suitable Project access or by occurrences
or circumstances beyond Walker's reasonable control, such as fires, floods, earthquakes, strikes,
riots, war, terrorism, threat of terrorism, acts of God, acts or regulations of a governmental
agency, emergency, security measure or other circumstances, including, without limitation,
unusual weather conditions and unanticipated shortage of labor and/or materials.
In the event of any changes in the scope of services to be performed by Walker, as directed by
Client, Walker shall prepare and submit a change order defining the change in scope, and setting
forth the change, if any, in the schedule and cost. Upon written approval of the change order,
Walker shall proceed with the work and compensation will be adjusted in accordance with the
approved change order.
Client must provide all reasonable assistance required by Walker in connection with the services,
including, without limitation, all information related to the services or subject matter thereof in
.
This proposal is valid for 30 days. Unless expressly stated otherwise in the Proposal, the fees,
services. The estimated probable cost is not a guaranteed maximum or not-to-exceed price.
Walker shall inform Client if it determines at any time that a material change to the nature, time or
extent of services is required or advisable.
Except as otherwise specified in the Proposal, Client will pay each invoice within 30 days of its
date. Interest will be charged on unpaid balances beginning 30 days from the invoice date at the
notice, Walker may suspend Services without liability until all past due amounts, including
accrued interest, have been paid in full. If Walker takes legal action to enforce payment and
prevails, Client shall reimburse Walker for all collection and legal costs. Client shall pay Walker
for Services rendered regardless of whether Services are intended in whole or in part to benefit a
third party.
Notwithstanding anything to the contrary contained in the Agreement, the parties agree to waive
all claims against each other for any incidental, special, indirect, punitive, exemplary or
consequential damages that may arise out of or relate to this Agreement.
Walker represents and warrants to Client that the work shall conform to the Scope of Work and
be free from defective material or workmanship for a period of twelve (12) months from
substantial completion of the work. WALKER MAKES NO REPRESENTATIONS, WARRANTIES
OR CONDITIONS OTHER THAN THOSE EXPRESSLY SET FORTH HEREIN. ANY IMPLIED
WARRANTIES INCLUDING THE WARRANTY OF MERCHANTABILITY AND THE WARRANTY
OF FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED.
The proposal and any subsequent contract shall be governed by the substantive laws of the
exclusive jurisdiction and venue over all disputes arising out of the Contract, and the Jurisdiction
is deemed to be the place of performance for all obligations under the Contract. The Parties

Scope of Work:
Black Box, Multipurpose and Hallways: In the Black Box Theater, Multipurpose Room, Hallways
and Ancillary spaces the previously specified QSC loudspeakers and amplifiers have been replaced
with Electro-Voice speakers and Dynacord amplifiers. The QSC Core DSP unit will remain in the
system and we have added two AVB network cards to accommodate
which keeping the Dante network cards for the Dynacord and Yamaha devices. The Cisco Catalyst
3650 series switches quoted with the original system are AVB and Dante compliant and will remain
in the system.

All work will be performed during normal business hours.

This proposal of Walker Engineering is based upon the assumption that the labor and materials
anticipated herein will be reasonably available and not subject to unanticipated market
fluctuations. Walker's price and schedule are subject to equitable adjustments for delays caused
by Client's failure to provide any required approval or suitable Project access or by occurrences
or circumstances beyond Walker's reasonable control, such as fires, floods, earthquakes, strikes,
riots, war, terrorism, threat of terrorism, acts of God, acts or regulations of a governmental
agency, emergency, security measure or other circumstances, including, without limitation,
unusual weather conditions and unanticipated shortage of labor and/or materials.
In the event of any changes in the scope of services to be performed by Walker, as directed by
Client, Walker shall prepare and submit a change order defining the change in scope, and setting
forth the change, if any, in the schedule and cost. Upon written approval of the change order,
Walker shall proceed with the work and compensation will be adjusted in accordance with the
approved change order.
Client must provide all reasonable assistance required by Walker in connection with the services,
including, without limitation, all information related to the services or subject matter thereof in
.
This proposal is valid for 30 days. Unless expressly stated otherwise in the Proposal, the fees,
services. The estimated probable cost is not a guaranteed maximum or not-to-exceed price.
Walker shall inform Client if it determines at any time that a material change to the nature, time or
extent of services is required or advisable.
Except as otherwise specified in the Proposal, Client will pay each invoice within 30 days of its
date. Interest will be charged on unpaid balances beginning 30 days from the invoice date at the
notice, Walker may suspend Services without liability until all past due amounts, including
accrued interest, have been paid in full. If Walker takes legal action to enforce payment and
prevails, Client shall reimburse Walker for all collection and legal costs. Client shall pay Walker
for Services rendered regardless of whether Services are intended in whole or in part to benefit a
third party.
Notwithstanding anything to the contrary contained in the Agreement, the parties agree to waive
all claims against each other for any incidental, special, indirect, punitive, exemplary or
consequential damages that may arise out of or relate to this Agreement.
Walker represents and warrants to Client that the work shall conform to the Scope of Work and
be free from defective material or workmanship for a period of twelve (12) months from
substantial completion of the work. WALKER MAKES NO REPRESENTATIONS, WARRANTIES
OR CONDITIONS OTHER THAN THOSE EXPRESSLY SET FORTH HEREIN. ANY IMPLIED
WARRANTIES INCLUDING THE WARRANTY OF MERCHANTABILITY AND THE WARRANTY
OF FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED.
The proposal and any subsequent contract shall be governed by the substantive laws of the
exclusive jurisdiction and venue over all disputes arising out of the Contract, and the Jurisdiction
is deemed to be the place of performance for all obligations under the Contract. The Parties

2030: Goal 5 states “Easy access to Dallas-Fort Worth Region” with the following
objectives; Objective 1 – Participate in regional rail service to Dallas-Fort Worth,
Objective 2- Maintain and enhance accessibility to DFW Airport, and Objective 5 –
Develop regional connections for Coppell residents and employees of Coppell
businesses
Introduction:
This agenda item is an administrative requirement related to Dallas Area Rapid Transit’s (DART)
right to exercise eminent domain for the Silver Line project. While the City has no official role
regarding the acquisition process for the rail line, DART is unique in that their enabling legislation
requires DART to have its ED Resolution approved by the governmental entity where the property
resides before DART can begin the ED process. It has long been DART’s process to obtain the
governmental approval of its resolution as soon as possible after DART’s approval and before written
offers are made to property owners.
Staff anticipates that there will be several of these resolutions brought to the Council in next few
months to allow DART to continue the acquisition process. This first resolution is for the properties
located at 390 and 400 Southwestern Blvd.
Background:
The Silver Line will connect the DFW Airport to the cities of Dallas, Carrollton, Addison, Richardson
and Plano. Along that route, only the City of Coppell is not a member of DART. In 2017, we saw
the advancement of the Silver Line regional rail service from its potential construction and activation
well beyond the year 2030 in the regional mobility plan, to actual approval, funding and scheduling
for revenue service at the end of calendar year 2022.

The Silver Line alignment extendsthe rail line off the existing DART right-of-way just west of Moore
Road, where is deviates south into City of Dallas and Cypress Waters. The rail line heads back north
and joins the existing rail right-of-way just to the east of Southwestern Boulevard. DART is
coordinating all acquisition activities for property that is required for the new rail right-of-way.
Legal: The City Attorney has reviewed and approved as to form.
Fiscal Impact: None.
Recommendation: Staff recommends approval of this resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COPPELL, TEXAS IN SUPPORT OF THE DALLAS AREA RAPID
TRANSIT RESOLUTION NO. 190138 RELATED TO THE
ADOPTION OF THE SILVER LINE LIGHT RAIL ALIGNMENT;
PROVIDING FOR AUTHORIZATION TO EXERCISE EMINENT
DOMAIN TO ACQUIRE RIGHT-OF-WAY WITHIN THE
CORPORATE LIMITS; PROVIDING FOR A SEVERABILITY
CLAUSE; PROVIDING FOR A REPEALING CLAUSE AND
PROVIDING WITH AN EFFECTIVE DATE.
WHEREAS, Dallas Area Rapid Transit (DART) was created to provide a regional public
transportation system, and the acquisition of real property and the planning, design, engineering,
and construction of improvements thereon are functions fundamental to the provision of a public
transportation system; and,
WHEREAS, the City of Coppell, in coordination with DART and other stakeholders,
identified a mutually advantageous alignment for the Silver Line to include the Cypress Waters
station in the City of Dallas; and,
WHEREAS, on August 14, 2018 the City of Coppell City Council approved an Interlocal
Agreement with DART; and,
WHEREAS, all property acquisition activities related to the Silver Line are conducted by
DART; and
WHEREAS, after careful review of impacted parcels, the DART Board desires to declare the
acquisition of parcels a public necessity, to approve the offer of just compensation for these
parcels, and to authorize the President/Executive Director or his designee to proceed with the
negotiation and purchase of these parcels, and if necessary, the acquisition of these parcels through
eminent domain; and
WHEREAS,
the property/properties are necessary and proper for construction of the Silver
Line Regional Rail Corridor project and for any other use authorized by Chapter 452 of the Texas
Transportation Code, and such use is hereby declared to be a public use for a public purpose; and
WHEREAS,in order for DART to exercise its power of eminent domain, the Coppell City
Council must authorize such within the Coppell city limits.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF COPPELL THAT:
SECTION 1.The City of Coppell supports DART Board of Directors,Resolution No.
190138, attachedhereto as Exhibit 1, related to the adoption of the Silver Line alignment for light
rail service.
SECTION 2. The City of Coppell authorizes DART to exercise eminent domain within
the corporate limits of the City of Coppell, Dallas County, Texas for thesole purpose of acquisition
of right-of-way for the approved alignment of the Silver Line as set forth in Exhibit 1.
SECTION 3. That any other prior resolution of the City Council in conflict with the
provisions contained in this Resolution are hereby repealed and revoked.
SECTION 4. Should any part of this resolution be held to be invalid for any reason, the
remainder shall not be affected thereby, and such remaining portions are hereby declared to be
severable.
SECTION 5. This resolution shall take effect immediately from and after its passage as
provided by law.
