RE 2020-0324.1 Postponing - Canceling May 2020 General Election RESOLUTION NO. 2020-0324.1 ORDER OF GENERAL ELECTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, AMENDING RESOLUTIONS 2020-0128.2 AND 2020-0128.2 (SP), ORDERING CANCELLATION OF THE JOINT ELECTION ON MAY 2, 2020, AND DECLARING THE ELECTION OF UNOPPOSED CANDIDATES FOR THE PURPOSE OF ELECTING ONE COUNCILMEMBER FOR PLACE 1 AND ONE COUNCILMEMBER FOR PLACE 7 FOR A PERIOD OF THREE (3) YEARS; POSTPONING THE GENERAL ELECTION OF MAY 2, 2020 TO NOVEMBER 3, 2020, FOR ONE COUNCILMEMBER FOR PLACE 3, ONE COUNCILMEMBER FOR PLACE 5 FOR A PERIOD OF THREE (3) YEARS; DESIGNATING POLLING PLACES; AUTHORIZING EXECUTION OF JOINT ELECTION CONTRACT FOR THE NOVEMBER 3, 2020 ELECTION; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the general laws and Constitution of the State of Texas and the Charter of the City of Coppell, Texas, and pursuant to Resolution No. 2020-0128.2 and 2020-0128.2 (Sp), a Municipal Officers’ election was ordered to held on May 2, 2020, for the purpose of electing the Councilmember for Place 1, one Councilmember for Place 3, one Councilmember for Place 5 and one Councilmember for Place 7 for a period of three (3) years; and; WHEREAS, the time for filing as a candidate for the May 2, 2020, Joint Election has passed and there were not any contested races for Councilmember Place 1 and Councilmember Place 7; and, WHEREAS, Subchapter C, Election of Unopposed Candidate of the Election Code provides that a municipality may cancel an election for council members if each candidate whose name is to appear on the ballot is unopposed and no proposition or special election has been called to appear; and, WHEREAS, that in accordance with the Texas Election Code, City Council desires to cancel such election for Councilmembers Place 1 and Place 7 and declare the unopposed candidates elected to office; and WHEREAS, pursuant to Section 418.016 of the Texas Government Code, on March 18, 2020, the Governor of the State of Texas signed a proclamation suspending certain provisions of the Texas Election Code and the Texas Water Code to allow all local political subdivisions that 1 TM 114644 are utilizing the May 2, 2020 uniform election date to postpone their elections to the November 3, 2020, uniform election date; and WHEREAS, pursuant to the Governor’s proclamation authorizing the City of Coppell to postpone the May 2, 2020 election date, the City Council does by this Resolution exercise its authority to postpone the General Election ordered for May 2, 2020, for the purpose of electing the one Councilmember for Place 3 and one Councilmember for Place 5 to November 3, 2020 unless by judicial order of a court of competent jurisdiction or by gubernational proclamation provides a sooner alternative; IT IS HEREBY ORDERED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the general election called for May 2, 2020, to elect Councilmember for Place 1 and Place 7 is cancelled. SECTION 2. That the following unopposed candidates have been certified as unopposed and are declared elected: NAME OF CANDIDATE OFFICE SOUGHT TERM Cliff Long Councilmember Place 1 Full – 3-year Mark Hill Councilmember Place 7 Full – 3-year rd SECTION 3. That a general election shall be held on the 3 day of November 2020, 7:00 a.m. to 7:00 p.m. unless by judicial order of a court of competent jurisdiction or gubernatorial proclamation provides an earlier date, for the purpose of electing one Councilmember for Place 3 and one Councilmember for Place 5 for a period of three (3) years. In the event any candidate for said office fails to receive a majority of all votes cast for all the candidates for such office, a run-off election shall be held. If a run-off election becomes 2 TM 114644 necessary, the run-off election will be held in accordance with the Texas election date, judicial order or gubernatorial proclamation. The election shall be held as a Joint Election administered by the Dallas and Denton County Elections Administrators or by the City Election Official utilizing specific equipment to cast ballots as approved by the Texas Secretary of State, and in accordance with the provisions of the Texas Election Code and the Texas Administrative Code, with a Joint Election Agreement for each of the respective counties. The City Manager is hereby authorized to execute the amended Election Contracts with the Counties of Dallas and Denton for the conduct of the postponed election herein. Pursuant to, as amended, the Joint Election. Presiding Election Judges and Alternate Presiding Election Judges appointed to serve at said polling places shall be those election officials furnished by the Elections Administrator from the list of proposed elections judges listed in an attachment to the Joint Election Contract. In the event that a date other than November 3, 2020 is provided by order or proclamation, the City Council may revise this order as necessary. Notice of the new election date shall be posted on the bulletin board used to post notice of the City Council meetings and be published in a newspaper of general circulation in the City. The notice of the postponed election date must be published on the same day in each of two successive weeks, with the first publication occurring no earlier than the thirtieth day and no later than the fourteenth day before the date of the election. A copy of the postponed election notice that contains the name of the newspaper and the date of publication shall be retained as a record of such notice, and such person posting the notice shall make a record of the time of posting, starting date and the place of posting. Early voting by personal appearance for Dallas County and Denton County residents 3 TM 114644 will be set forth in accordance to state law and as stated in the Joint Elections Contracts, as amended, or other order or proclamation set forth herein, and posted on the City's webpage. Application for ballot by mail must be received no later than the close of business on October 23, 2020, unless an earlier date is ordered or proclaimed respectively.
