RE City of Dallas "Quiet Zone" E Belt Line Road- 2020-08-26WHEREAS, Dallas Area Rapid Transit is currently designing and planning the construction and operation of a 26 -mile rail line between Dallas Fort Worth International Airport and the City of Plano known as the Cotton Belt Project or Silver Line (the "Project"); and WHEREAS, the Project alignment follows the existing Cotton Belt Rail Line that passes through the cities of Plano, Richardson, Dallas, Addison, Coppell, and Carrollton; and WHEREAS, the portion of the Project alignment that passes through the northwestern part of the city of Dallas is a section that crosses East Belt Line Road where the City of Dallas and the City of Coppell city limits adjoin; and WHEREAS, the project passes through the Cypress Waters mixed-use development; and WHEREAS, the project crosses the rail at grade at East Belt Line Road and has an additional proposed at grade crossing within the Cypress Waters development; and WHEREAS, both the City of Dallas and the City of Coppell desire to establish "Quiet Zones" under the U.S. Department of Transportation -Federal Railroad Administration (FRA) Train Horn Rule (49 CFR Part 222) (FRA rule) on East Belt Line Road and in the Cypress Waters development area; and WHEREAS, the Parties are each a "local government" as defined in the Interlocal Cooperation Act, as amended (Chapter 791, Texas Government Code, as amended, or "the Act"), whose governmental functions include the authority to provide for public transportation within their respective jurisdictions; and WHEREAS, the project crosses both local government's jurisdictional territory; and WHEREAS, the FRA rule allows for the cooperation of the local governments having jurisdiction over the roadway -rail at -grade crossings; and WHEREAS, the City of Dallas desires to facilitate the processing of the quiet zone establishment on East Belt Line Road and in the Cypress Waters area; and WHEREAS, the FRA rule requires a diagnostic team review of the effected crossings and compliance with the diagnostic team's recommendations concerning those crossings. 1 Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DALLAS: SECTION 1. That the City Council hereby authorizes a resolution to support the City of Coppell as the applicant for the establishment of the Project's "Quiet Zone" on East Belt Line Road and in the Cypress Waters area based on the city of Dallas's review and approval of the final diagnostic team recommendations in accordance with the FRA rule. SECTION 2. That this resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Dallas, and it is accordingly so resolved.
