ORDINANCE NO. 89461
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS,
DESIGNATING THE BAPTIST FOUNDATION TAX ABATEMENT AREA AS A
REINVESTMENT ZONE PURSUANT TO SECTION 312.201 OF THE PROPERTY
REDEVELOPMENT AND TAX ABATEMENT ACT; PROVIDING A SEVERABILITY CLAUSE;
AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of CoppeI1, Texas, held a public hearing
at 7:30 o'clock p.m. on the 12th day of December, 1989, at the Coppert City Hall, to
consider designation of the Baptist Foundation Tax Abatement Area as a reinvestment
zone pursuant to Section 312.201 of the Property Redevelopment and Tax Abatement
Act; and
WHEREAS, the Council finds that all notices required by law were properly and
timely given and that at such hearing all interested persons were heard and given the
opportunity to present evidence for and against the designation; and
WHEREAS, after holding said public hearing the City Council made a finding,
and does hereby find, that the area if so designated, would be reasonably likely to
contribute to the retention or expansion of primary employment or to attract major
investment in the zone that would be a benefit to the property and that would contribute
to the economic development of the City of Coppell and that said property is eligible
for residential tax abatement and/or commercial-industrial tax abatement; and
WHEREAS, the City Council further found, and does hereby find, that the
improvements sought are feasible and practical and would be a benefit to the land to
be included in the zone and to the City of Coppel] after expiration of an agreement
between the City and the owners of said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. DESIGNATION OF REINVESTMENT ZONE
That the property owned by the Baptist Foundation of Texas and its wholly owned
subsidiary, Branch Properties, Inc., that is generally bounded on the north by Bethel
Road, on the east by Denton Tap Road, on the south by the STL & SW RR, and on the
west by Coppell Road, more specifically described in Exhibit "1" and shown on Exhibit
"2" attached hereto, which are made a part hereof for all purposes, be and the same
is hereby designated a Reinvestment Zone pursuant to Section 312.201 of the Property
Redevelopment and Tax Abatement Act.
SECTION 2. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shall be adjudged invalid or held unconstitutional, the same shah not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decided to be invalid or unconstitutional.
ECTION 3. EFFECTIVE DATE
This ordinance shall take effect immediately from and after its adoption, as the
law in such eases provides.
