CM 1964-12-07STATE OF TEXAS COUNTY OF DALLAS The Town Council of the Town of Coppell, Texas, met in regular meeting on the 7th day of December, 1964, with the following members present, to-wit: W. T. Cozby, Mayor J. R. McDonald, Councilman Cecil Dobecka, Councilman C. T. Waters, Councilman W. H. Wilson, Councilman E. C. Gentry, City Secretary Absent: B. J. Harwell, Councilman Constituting a quorum where among the other proceedings had was the rollowing: Mr. Jack Thompson appeared before the Council. He did not have his plat completed and stated he would appear before the Council at a later date. Mr. C. R. Story appeared and asked permission of the Council for V. E. Wall and himself to build a Police Station on the south side of City Hall. Said Police Station to be built through public subscription, and as per drawing attached. J. R. McDonald made a motion that their offer and plans be endorsed and the motion was seconded by W. H. Wilson and carried unanimously. The following bills were presented and approved for payment: Lucky Corner - $ 7.71 Dallas Office Supply Co. - $37.80 Northlake S. C. - $28.10 Motor Supply Co. - $43.45 Melton's Mobil Service Sta. - $3.80 Gray's Office Furniture Co. - ~12.00 Lewisville Leader - $10.68 Factory Sales Co. - $34-35 Sar~ent-Sowell, Inc. - $2 .O0 H. L. Eldridge - $50.00 B. E. Parker - $353.00 Bill Decker, Sheriff - $3.00 A letter from Mr. Lawrence W. Jackson was read by the Council and is herewith attached. Mayor Cozby expressed his complete willingness to call a full election next year. The canvass of the returns and declaration of the result of the election held on November 21, 1964, was presented and is herewith attached. Cozby City Hall Coppell, Texas Re: 1965 Municipal Election Dear Mayor Cozby: As I have explained to you, a town operating under the provisions of Chapter 11V.A.C.S. must hold an annual election each year for election of its city officials. Since the Town of Coppell did not, as contemplated, adopt the provisions of Chapters 1 through 10, under which a staggered two year term is provided, it will be necessary for you, when calling the next Town election, to provide for the election of all five aldermen as well as for the office of Mayor. As you know, it was contemplated that prior to the last election, the Town would adopt the provisions of Chapterl and therefore your last election order provided for staggered terms for the Mayor and aldermen. Please explain to the Council that since this Chapter i was not adopted, their term of office, by operation of law, is limited to a one year term. I would suggest that at your next Council meeting you direct that this letter be incorporated into the Minutes of the meeting and that the Minutes show an expression on your part indicating your intention to call a full election next year. Jackson 804 THE STATE OF TEXAS COUNTY OF DALLAS CANVASS OF THE RETURNES AND DECLARATION OF THE RESULT OF AN ELECTION HELD IN THE TOWN OF COPPELL, TEXAS, ON NOVEMBER 21, 1964, ON THE QUESTION OF AVOLISHING THE CORPOTATE EXISTENCE OF SAID TOWN AND AN ORDER CON- TINUING THE CORPORATE EXISTENCE OF THE TOWN OF COPPELL, TEXAS BE IT REMBERED that on the 6th day of November, 1964, the County Judge of Dallas County, Texas, called an election to be held on November 21, 1964, on the question of abolishing the corporate existence of the Town of Coppell, and It appearing that proper notice had been given as required by law and that the other requirements of law having been complied with, such election was submitted the proposition: For Abolishment Against Abolishment Whereupon, official returns of said election have been filed with the Country Judge of Dallas County for the purpose of canvassing the same and declaring the results of said election. It appearing that said returns being duly made accord- ing to law and duly authenticated, and it being shown by affidavit of that written notices of said election were duly posted for the time and in the manner provided by law and all other proceedings pertaining to said election having been shown to have been done and performed at and within the time and in the manner provided by law and all papers pertaining thereto have been returned and filed according to law; NOW, THEREFOR, I, W.L. STERRETT, Country Judge of Dallas County, Texas, after examining said returns and opening and canvassing the votes cast in said election, do hereby declares the result of said election as follows: That a total of 319 votes were cast at said election. That 117 votes were cast for abolishment. That 193 votes were cast against abolishment. That a majority of said votes cast favored continuing the corporate existence of the Town of Coppell and said result is hereby so declared and the said corporation shall continue in existence. IT IS, THEREFORE, ORDERED that the corporation of the Town of Coppell. Texas be, and the same is hereby continued, and that such corporation shall continue in existence from this date. IT IS FURTHER ORDERED that this order shall be spread upon the minutes of the Commissoner's Court of Dallas Country, Texas. ORDERED this the 7th day of December, 1964. W.L.
