CM 1965-03-29STATE OF TEXAS COUNTY OF DALLAS The Town Council of the Town of Coppell, Texas, met in special meeting on the129th day of March, 1965, with the following members present, to-wit: W. T. Cozby, Mayor Cecil Dobecka, Councilman W. H. Wilson, Councilman B. J. Harwell, Councilman E. C. Gentry, City Secretary Constituting a quorum where among the other proceedings had was the following: The Council canvassed the returns of the March 27, 1965, election. A resolution was passed declaring the result of the election. (A copy of said resolution is herewith attached.) The motion to pass said resolution was made by Bill Harwell and seconded by Cecil Dobecka. The motion carried unanimously. A resolution was presented to the Council authorizing Mayor W. T. Cozby to make application to the Federal government for a grant to be lapplied to the cost of the construction of said sewage facilities. (A copy of said resolution is here- with attached.) A motion was made by W. H. Wilson the said resolution by adopted. The motion was seconded by Bill Harwell and carried unanimously. Mr. Travis Maynard appeared before the Council and stated that the Fire Department had been given 6 pair of firemen pants, 16 fire coats, and 25 pair of boots, and 5 pair of suspenders. He stated that they needed helmets to complete the suits and said that they would cost approximately $85.00. He requested the Council for permission to purchase these helmets. A motion was made by W. H. Wilson to grant this permission. The motion was seconded by Bill Harwell and carried unanimously. No further business being brought before the Council at this time, upon a motion duly made, seconded and carried the meeting was adjourned. PASSED AND APPROVED this 29 day of March , 1965. W. T. 'RESOLUTION CANVASSING RETURNS AND DECLARING RESULT OF ELECTION THE STATE OF TEXAS I I CITY OF COPPELL ~ COUNTY OF DALLAS ~ ON THIS, the 29th day of March , 1965, the Cit y Council of the City of Coppell, Texas, convened in ~ to-wit: W. T. COZBY MAYOR W, H WILSON ) B. J. HARWELL ) ALDERMEN CECIL DOBECka ) /' and with the following absent: Waters and McDonald , constituting a quorum; and among other proceedings had were the following: Mayor Cozby introduced a resolution and order as follows: WHERES, under and by virtue of a resolution and order duly passed by the City Council of the City of Coppell, on the 1st day of March, 1965, an election was held in said City on the 27th day of March, 1965, on four propositions for the issuance of the bonds of the City of Coppell, Texas, in the following amounts and for the following purposes, to-wit: $150,000 revenue bonds for the purpose of constncting improvements and extensions to the City's Waterworks System; $195,000 revenue bonds for the purpose of constucting or purchasing, improving and extending a Sanitary Sewer System in and' for said City; $ 50,000 general obligation bonds for the purpose of constructing improvents and extensionss to the City's Waterworks System; and $ 50,000 general obligation bonds for the purpose of constructing or purchasing, improving and extending a Sanitay Sewer System in and for said City; and WHEREAS, on this the 29th day of March 1965 same being a special session of the City Council, there came on to be considered the returns of said election; and WHEREAS, upon consideration of the returns .of said elec- tion,. tt appears that the same was in all respects legally held, after due notice had been given, and that the said returns were duly and legally made; and WHEREAS, it further appears from said returns that on Proposition Number 1, being "THE ISSUANCE OF $150,000 WATERWORKS SYSTEM REVENUE BONDS", 148 votes were cast for the proposition and 129 votes were cast against the proposition; and WHEREAS, it further appears from said returns that on Proposition Number 2 being "THE ISSUANCE OF $195,000 SANITARY SEWER SYSTEM REVENUE BONDS", 141 votes were cast for the proposition and 133 votes were cast against the proposition; and WHEREAS, it further appears from said returns that on Proposition Number 3, being "THE ISSUANCE OF $50,000 GENERAL OBLIGATION WATERWORKS SYSTEM BONDS", 149 votes were cast for the proposition and 127 votes were cast against the propo- s it ion; and WHEREAS, it further appears from said returns that on Proposition Number 4 being "THE ISSUANCE OF $50,000 GENERAL OBLI- GATION SANITARY SEWER SYSTEM BONDS", 143 votes were cast for the proposition and 131 votes were cast against the proposition, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1: That the aforesaid election was duly and leg- ally called and notice thereof given in accordance with the laws of the State of Texas and the resolution and order calling said elec- tion; that said election was held in strict conformity with the Constitution and laws of the State of Texas, and the returns thereof have been properly made to the officials of the City entitled to receive same; that only resident qualified property taxpaying electors of the said City of Coppell, Texas, who owned taxable property therein, and who. had duly rendered the same for taxation, were permitted to vote at said election; and further, that said election properly represents the desires of those qualified to vote as aforesaid. SECTION 2: That the proposition to issue the $150,000 revenue bonds for the purpose of constructing improvements and extensions to the City's Waterworks System was sustained by a majority of the resident qualified electors of said City, voting at said election, who own taxable property in said City and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to provide for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 3: That the proposition to issue the $195,000 revenue bonds for the purpose of constructing or purchasing, improving and extending a Sanitary Sewer System in and for said City was sustained by a majority of the resident qualified elec- tors of said City, voting at said election, who own taxable property in said City, and who had duly rendered thesame for taxation, and that the City Council of said City is authorized to issue said bonds and to provide for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 4: That the proposition to issue $50,000 general obligation bonds for the purpose of constructing improvements and extensions to the City's Waterworks System was sustained by a majority of the resident qualified electors of said City, voting at said election, who own taxable property in said City and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 5: That the proposition to issue $50,000 general obligation bonds for the purpose of constructing or purchasing, improving and extending a Sanitary Sewer System in and for said City, was sustained by a majority of the resident qualified elec- tors of said City; voting at said election, who own taxable property= in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for 'the payment of the principal of and interest on said bonds in the time and manner prescribed by law. The above resolution having been read in full, it was moved by Alderman Harwell and seconded by Alderman Dobecka that the same be passed and adopted. Thereupon, the mayor put the motion to a vote of the members of the City Council and the following members voted "AYE": Alderman Wilson, Harwell and Dobecka; and non voted "NO". Gentry City Secretary,City of Coppell,Texas (City Seal) RESOLUTION OF CITY OF COPPELL, TEXAS WHEREAS, it is contmplated that the City of Coppell will construct certain sewage transmission and treatment facilities with an estimated total cost of $226,000.00; and WHEREAS, it is found that the City of Coppell is unable to provide the total cost of such improvements; and WHEREAS, it is deemed necessary and proper to appy for Federal grant under the Federal Water Pollution Control Act, Public Law 660, as amended, in order to have sufficient funds to complete these much needed improvements; NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF COPPELL, that William T. Cozby, Mayor of the City of Coppell be and is hereby authorized and directed to make application, in the name of the City of Coppell, for a Federal grant under Public Law 660, as amended; to be applied to the cost of the construction of said seage facilities. The City of Coppell hereby agrees that if a Federal grant for the project is made pursuant to the Federal Water Pollution Control Act, the City will pay the remaining costs of the approved project. RIGHTS ACT OF 1964 City of Coppell (hereinafter called the "Applicant") (Name of Applicant) HEREBY AGREES THAT it will comply with title VI of the Civil Rights Act of 1964 (P.L. 88-352) and all requirements imposed by or pursuant to the Regulation of the Department of Health, Education, and Welfare (45 CFR Part 80) issued pursuant to that title, to the end that, in accordance with title VI of that Act and the Regulation, no person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which the Applicant receives Federal financial assistance from the Department; and HEREBY GIVES ASSURANCE THAT it will immediately take any measures necessary to effectuate this agree- meat o If any real property or structure thereon is provided or improved with the aid of Federal financial assistance extended to the Applicant by the Department, this assurance shall obligate the Applicant, or in the case of any transfer of such property, any transferee, for the-laeriod during which the real property or structure is used for a purpose for which the Federal financial assist- ante is extended or for another purpose involving the provision of similar services or benefits. If any personal property is so provided, this assurance shall obligate the Applicant for the period during which it retains ownership or possession of the property. in all other cases, this assurance shall obligate the Applicant for the period during which the Federal financial assist- ante is extended to it by the Department. THIS ASSURANCE is given in consideration of and for the purpose of obtaining any and all Federal grants, loans, contracts, property, discounts or other Federal financial assistance extended after the date hereof to the .Applicant by the Department, including installment pay- meats after such date on account of applications for Federal financial assistance which were approved before such date. The Applicant recognizes and agrees that such Federal financial assistance will be extended in reliance on the representations and agreements made in this assurance, and that the United States shall have the right to seek judicial enforcement of this assurance. This assurance is binding on the Applicant, its successors, transferees, and assign- ees, and the person or persons whose signatures appear below are authorized to sign this assur- ante on behalf of the Applicant.
