AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 8
OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL BY AMENDING SECTION
8-4-6 WHICH HERETOFORE ESTABLISHED A TRUCK ROUTE FOR THROUGH TRUCK
TRAFFIC; PROVIDING THAT TRUCKS HAVING A CARRING CAPACITY OF TWO TONS
OR MORE MUST USE ONLY THE DESIGNATED TRUCK ROUTE (BELTLINE ROAD OR
DENTON TAP ROAD) WHEN TRAVELING THORUGH THE CITY; PROVIDING A
REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A
PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00)
FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1. AMENDING SECTION 8-4-6 OF CHAPTER 8 OF THE CITY CODE
OF ORDINANCES ESTABLISHING A TRUCK ROUTE FOR THROUGH
TRUCK TRAFFIC
Chapter 8 of the Code of Ordinances of the City of Coppell is hereby amended
by amending Section 8-4-6 to read as follows:
Sec. 8-4-6 TRUCK ROUTE FOR THROUGH TRUCK TRAFFIC
A. It shall be unlawful for any person to drive or operate a truck or
other commercial motor vehicle having a weight of two tons or more
over, on or upon the public streets and roadways within the corporate
limits of the City, without having a bona fide destination or point
of origin within the City, except on Beltline Road and/or Denton
Tap Road, which streets are hereby designated as official through
truck route streets to be used by heavy trucks being operated
through the City.
The term "bona fide point of origin" shall mean the location where
the vehicle is loaded with its primary cargo. The term "bona fide
destination" shall mean the location where the primary cargo of the
vehicle is off loaded.
B. It shall be unlawfull for any person to drive or operate a "Through
Truck" over, on or upon any public street or roadway within the
corporate limits of the City of Coppell, except on a designated
truck route.
A "Through Truck" shah mean any truck or other Commercial motor
vehicle having a weight of two (2) tons or more which is loaded with
a cargo at a point outside the corporate limits of the City and
travels through the City to reach a bona fide destination outside
the City.
C. The intent of this section is to protect certain streets from damage
caused by heavy through truck traffic by limiting such traffic to
streets designated as an official through truck route.
SECTION 2. REPEALING CLAUSE
All parts of ordinances, inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shall be adjudged invalid or held unconstitutional, the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decided to be invalid or unconstitutional.
SECTION 4. PENALTY CLAUSE
Any person, firm or corporation violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and, upon conviction, shah be punished by a
penalty of fine not to exceed the sum of Five Hundred Dollars ($500.00) for each
offense, and each and every day such offense is continued shall constitute a new and
separate offense.
SECTION 5. EFFECTIVE DATE
This ordinance shall take effect immediately from and after the publication of
its caption, as the law in such cases provides.
