RE 2021-0209.1 Moratorium for COVID FacilitiesRESOLUTION NO. 2021-0209.1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS GRANTING A MORATORIUM FROM ENFORCEMENT WITHIN THE LI, HC, C, R AND TC ZONED DISTRICTS WITHIN THE CITY OF COPPELL, AS DEPICTED ON THE ADOPTED ZONING MAP OF THE CITY OF COPPELL, FROM USE OF PROPERTY AND/OR SPECIAL USE PERMIT REQUIREMENT IN ORDER FOR THE PROPERTY OWNER TO OPERATE A MEDICAL FACILITY ON PROPERTY LOCATED IN SAID DISTRICTS FOR THE SOLE PURPOSE TO OPERATE AS A COVID-19 TESTING FACILITY AND/OR COVID-19 VACCINATION SITE, OR COMBINATION THEREOF, A TEMPORARY MEDICAL FACILITY; PROVIDING FOR THE PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the COVID-19 pandemic has caused tremendous suffering and the ability to our citizens to receive rapid and variable testing impaired; and WHEREAS, the City desires to make such testing and vaccination easily available; and, WHEREAS, the City of Coppell desires to increase the ability of qualified medical personnel and operations to afford its citizens a convenient and efficient method to receive COVID-19 testing and/or vaccination; and WHEREAS, the City Council of the City of Coppell finds it to be in the public interest to grant a moratorium from enforcement within said zoned districts for the operation of a medical facility for COVID-19 testing and vaccination. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS; SECTION 1. That the City Council of the City of Coppell, Texas hereby grants a moratorium from enforcement within the LI, HC, C, R and TC zoned districts within the City of Coppell, as depicted on the adopted Zoning Map of the City of Coppell, from use of property and/or special use permit requirement in order for the property owner to operate a medical facility on property located in said districts for the sole purpose to operate as a COVID-19 testing facility and/or COVID-19 vaccination site, or combination thereof, a temporary medical facility. SECTION 2. That in order for such moratorium from enforcement to be effective the property owner must file with the City of Coppell a request for the temporary medical facility and receive authorized herein; the City ensure the general health, safety and welfare of adjacent use and the general welfare. The City Manager or designee may grant a temporary operating permit for a COVID-19 testing or vaccination medical facility upon application to include the following but not limited to: Page 1 TM 120456 1. Administrative Site Plan Application, 2. Site Plan, 3. Vehicular Circulation and Stacking Plan, 4. Ensure this will not infringe upon the already approved main use or ancillary uses of the site. 5. Duration of the use and hours of operation, 6. Elevations, details/specifications or rendering of any temporary structures, tents or shelters proposed, 7. Proposed movement control signage, 8. Generator location and specifications, 9. Waste medical and/or biohazard management and disposal plan, 10. Toilets and sinks location and specifications of site elements, and 11. Copy of operating authority from the State of Texas to operate, administrate and conduct COVID-19 testing and vaccination. SECTION 3. That this Resolution shall take effect immediately from and after its adoption and it is so resolved. SECTION 4. That this Resolution shall expire and no longer be in effect after 11:59 pm on June 30, 2021 unless sooner repealed by City Council.
