As authorized by Section 418.016(e) of the Texas Government Code, on March 16, 2020,
Governor Greg Abbott suspended various provisions that require government officials and
members of the public to be physically present at a specified meeting location.The following
requirements have been suspended by the governor:
1. A quorum of the city council need not be present at one physical location. Id. § 551.127(b).
2. In light of (1), above, the meeting notice need not specify where the quorum of the city
council will be physically present and the intent to have a quorum present. Id. § 551.127(e).
3. In light of (1) above, the meeting held by videoconference call is not required to be open to
the public at a location where council is present. Id. § 551.127(f).
4. The audio and video are not required to meet minimum standards established by Texas
Department of Information Resources (DIR) rules, the video doesn't have to be sufficient that
a member of the public can observe the demeanor of the participants, the members faces
don't have to be clearly visible at all times, and the meeting can continue even if a connection
is lost, so long as a quorum is still present. Id. § 551.127(a-3); (h); (i); Q).

Notice is hereby given that the City Council of the City of Coppell, Texas will meet in Regular
Called Session at 5:30 p.m. for Executive Session, Work Session will follow immediately
thereafter, and Regular Session will begin at 7:30 p.m., to be held at Town Center, 255 E.
Parkway Boulevard, Coppell, Texas.
As authorized by Section 551.071(2) of the Texas Government Code, this meeting may be
convened into closed Executive Session for the purpose of seeking confidential legal advice
from the City Attorney on any agenda item listed herein.

Introduction:
The Coppell Arts Center's 2019 business model that was submitted to Council included support
from a non-profit affiliate to aid in fundraising and general community support for marketing,
strategy, and operational efforts.
A fundraising development taskforce was created in 2019 and it consisted of Coppell business and
community leaders. The goal of that taskforce was to begin evaluating the fundraising development
potential of the Arts Center project and to generate community awareness and interest. At the end of
that year, members of that taskforce sought to create an independent foundation to support the Arts
Center and began the necessary 5016 paperwork. The strategic pillars of cultivate (fundraising),
elevate (advisory), activate (volunteerism), and advocate (brand ambassadorship) served as the
underpinnings for the organization's bylaws and mission. In March of 2021, the Coppell Arts
Center Foundation was formally recognized by the IRS as a 5016 non-profit entity.
Staff was advised by Legal, Finance, and the third -party risk assessment consultant, The McHard
Firm, to draft a memo of understanding (MOU) followed by a resolution to put legal framework
around the working relationship of the City and the Foundation. The MOU document was jointly
written under the guidance of the parties listed above. The MOU document is intended to establish
the spirit of the relationship between the two organizations while also defining individual
responsibilities and joint efforts. Detailed operational measures will be addressed in a separate
Facilities Use Agreement.
Analysis:
• The MOU was crafted using approved reference documents provided by The McHard Firm
and the Bond Council.
• Finance was consulted numerous times to provide input regarding procedural guidance and
language for fundraising, sponsorships, and grants.
• The MOU has been reviewed and approved by both organizations' legal representatives.
• The document establishes joint working relationships for marketing, fundraising, and
community programming.
• The document defines the City as the formal entity to receive and manage contributions for
capital assets and the Foundation as the formal entity to receive and manage contributions in
the form of sponsorships, corporate memberships, grants, and endowments.
Legal Review:
Legal and Finance have reviewed the memo of understanding.
Fiscal Impact:
The Coppell Arts Center Foundation is an independent, self-sustaining non-profit, and having them
conduct fundraising development for Arts Center related programming and initiatives will aid in
reducing the Center's dependency on CRDC funds and bolstering its cost recovery efforts.
Recommendation:
The Parks and Recreation Department recommends approval of this item.

COPPELL ARTS, CULTURAL, & HERITAGE FOUNDATION
AND
THE CITY OF COPPELL
THIS MEMORANDUM OF UNDERSTANDING is made this day of April, 2021 between the City of
Coppell, an incorporated municipality in the state of Texas (the "City"), and the Coppell Arts, Cultural, &
Heritage Foundation, a Texas non-profit corporation (the "Foundation"), referred to collectively as the
"Parties", for the purpose of acknowledging and defining their mutually beneficial relationship to support the
Coppell Arts Center (the "Center"), a division of the City.
RECITALS
WHEREAS, the City and the Foundation share in the goal of supporting the arts as a means of enriching
the lives of the City of Coppell's citizens through their mutual support of the Center and the many resident
artists and organizations that call the City of Coppell home;
WHEREAS, the City and the Foundation view the Center as a vital component of the City's Vision 2030
and Vision 2040 citizen -based planning processes contributing to ensure that the City of Coppell always
remains "A Family Community for a Lifetime";
WHEREAS, the City recognizes the Foundation as an independent non-profit corporate entity, to educate
and activate the community and to provide charitable and other support for the Center;
WHEREAS, the City owns, operates, and maintains the land and facilities which constitute the Center
located at 505 Travis Street, in Coppell, Texas 75019 and provides for the staffing and operations of the
Center; and
WHEREAS, the City and Foundation desire to work together in good faith and in the spirit of maintaining a
collaborative relationship to jointly support the Center as an important cultural asset of the community and
intend this Memorandum of Understanding to facilitate this important effort,
NOW, THEREFORE, the Parties wish to express their shared general understanding relevant to the Center,
and they acknowledge the following:
A. FOUNDATION RESPONSIBILITIES
1. ADMINISTRATIVE
1.1 The Foundation is organized and shall operate in such a manner that will retain the
Foundation's legal status as a tax-exempt, Texas non-profit organization pursuant to section
501(c)(3) of the Internal Revenue Code, or any successor statute.
1.2 The Foundation's primary point of contact for interaction with the City will be the
Foundation's Board President.

1.3 Any current or future investment accounts or funds held or managed by the Foundation will
remain within the sole control and management of the Foundation.
1.4 The Foundation may contract with consultants and vendors and/or hire their own staff to
fulfill the Foundation's mission and organizational goals.
1.5 The Foundation will have its own budgets, accounts, and financial accounting that will be
managed by the Foundation and will not be the responsibility of the City.
1.6 The Foundation will endeavor to comply with all tax laws and regulations applicable to a
non-profit IRS Section 501(c)(3) entity.
2. MARKETING
2.1 The Foundation will apply its best efforts in utilizing its marketing channels and resources
to promote the Center on its website, social media platform, e-mail marketing campaigns, and
through the distribution of promotional materials, and onsite signage. The Foundation will be the
sole owner of its intellectual property.
2.2 The Foundation will license to the City use of the Foundation's photo, video, and audio
marketing assets for use in marketing or promoting the Center to the extent permissible by the
agreements for any licensed content. The Foundation expects and will utilize its best efforts to
negotiate an Intellectual Property Licensing Agreement with the City to facilitate this process. The
Foundation will endeavor to comply with the City's branding standards in a manner that favors and
compliments the City's image.
2.3 The Foundation acknowledges the importance of adhering to its branding standards and
communication policies when creating marketing and advertising material relating to the Center.
2.4 The Foundation will inform the City of any events it seeks to plan and hold at the Center in
order to avoid event scheduling conflicts.
2.5 The Foundation will act as primary spokesperson to the media for all matters affecting the
Foundation's business and operations.
3. FOUNDATION FUNDING OF PROGRAMS/GRANTS
3.1 The Foundation intends to solicit funds and financial support from a variety of entities and
persons and in a variety of forms such as sponsorships and in-kind gifts.
3.2 The Foundation will annually create the Foundation's budget, determine strategy for
programs and activities for the Center that the Foundation will fund, and will communicate the
results of this process to the City.
3.3 To the extent that the Foundation desires to fund the Foundation through grants, the
Foundation may, at its discretion, apply for non -municipal or non-governmental grants from time to
time. If the Foundation desires to apply for grants from local, state, or federal governmental entities,
the Foundation will first confer with the City of this intent and will engage in good faith consultation
with the City's Grants Committee to determine the propriety and feasibility of any such grants. Any
grants that will be considered "pass-through grants" that will directly affect the Center will only be

applied for in consultation and agreement with the City and a separate pass-through agreement
negotiated and agreed upon by the Parties.
B. CITY RESPONSIBILITIES
1. ADMINISTRATIVE
1.1 The City's primary point of contact for interaction with the Foundation will be the Center's
Managing Director.
1.2 Financial transactions between the City and the Foundation will be contemporaneously
memorialized in standard business and accounting documents customary to such
transactions.
1.3 The Center will have its own budgets, accounts, and financial accounting that will be
managed by the City and will not be the responsibility of the Foundation.
1.4 The City will be responsible for ensuring that the Center and the Property are in compliance
with the City's Code of Ordinances, Zoning Ordinance and all other local, state and federal
laws.
1.5 Upon reasonable written notice, the City may audit the books and records of the
Foundation insofar and only insofar as such books and records relate or pertain directly to
this Agreement. Such audit shall be conducted at the office of the Foundation or some
other reasonable location agreed upon between the Parties, shall be during normal
business hours, and shall be at the sole cost and expense of the City in conducting the
audit.
2. MARKETING
2.1 The City will be the primary spokesperson to the media for all matters relating to the Center
2.2 The City will apply its best efforts in utilizing its marketing channels and resources to
promote the Center on its website, social media platform, e-mail marketing campaigns, and through
the distribution of promotional materials and onsite signage. The City will be the sole owner of all
intellectual property for the Center.
2.3 The City will license to the Foundation use of the Center's photo, video, and audio
marketing assets for use in marketing or promoting the Center to the extent permissible by the
agreements for any licensed content. The City expects and will utilize its best efforts to negotiate
an Intellectual Property Licensing Agreement with the Foundation to facilitate this process.
2.4 The City will make a good faith effort to coordinate its marketing calendar and fundraising
campaign efforts with the Foundation to serve the best interests of the Center.
2.5 The City will advise the Foundation of availability of facilities and dates of events it intends
to plan and hold at the Center to avoid event scheduling conflicts.

3. FOUNDATION -FUNDED PROGRAMS FOR THE CENTER
3.1 With respect to Programs conducted and funded by the Foundation (i.e., a Master Class,
educational offering, engagement opportunity, etc.) at the Center, the Parties acknowledge that the
City will be the signatory and contract holder for all artist agreements for all such Foundation -funded
Programs, and, except for payment of expenses to be funded by the Foundation, the City will be
the obligor under all such artist agreements.
3.2 With respect to Events conducted and funded by the Foundation (i.e., annual fundraising
Gala, donor appreciation event, etc.) at the Center, the Parties acknowledge that the City will be
the signatory and contract holder for all artist agreements for all such Foundation Events, and the
payment of expenses to be funded by the Foundation. The Parties also acknowledge that, with
respect to Foundation Events, the Foundation will be the signatory and contract holder for all other
event expenses (i.e. catering, photographer, rentals, etc.).
3.3 The City and the Foundation acknowledge the importance of communicating the
requirements imposed by any one particular Foundation -funded Program or Event to ensure each
Party fully understands and accepts an allocation of costs and services in advance of the Program
or Event and as part of the planning process for all such activities.
C. JOINT RESPONSIBILITIES
1. DONOR DEVELOPMENT
1.1 The City will be responsible for leading all donor efforts pertaining to capital and City assets
(e.g. seating, performance halls, building -related materials and fixtures).
1.2 The Foundation will be responsible for leading all donor efforts pertaining to non -capital
assets (e.g., operational services, education programs, entertainment programming,
Foundation funded community engagement).
1.3 The Foundation will confirm with the City the feasibility of any significant sponsorship
agreement prior to the Foundation's acceptance or execution of such a sponsorship
agreement.
1.4 The Parties will endeavor to coordinate the development of the Center's Privacy and
Information Use Policies.
1.5 The Foundation may start and maintain a membership program for the Center in
coordination with the City.
1.6 The City will endeavor to coordinate with the Foundation on all sponsorship and donor
packages where both Parties are proposed to offer benefits to donors who participate in
supporting the Center at varying levels. The Parties will agree to certain donor policies that
will be contained in a Joint Donor Policy.
2. FUNDRAISING EVENTS
2.1 The Foundation may conduct its fundraising events and activities offsite or at the Center
as the Foundation might deem appropriate and based upon the Center's availability.

3. COORDINATION OF EFFORTS
3.1 The City will endeavor to meet with the Foundation upon the receipt of a reasonable
request to ensure the best interests of the Center are being addressed and will endeavor to
communicate freely and regularly with the Foundation toward this end.
3.2 The City will ensure that electronic donations directed to the Foundation may be made
through the City's ticketing website, including when tickets are purchased, and that the funds will
be held for the benefit of the Foundation until paid to the Foundation.
D. VENUE USAGE
1.1 The Parties will enter into a separate Facilities Use Agreement which they acknowledge
will control the Foundation's use of the Center for Foundation events and programs.
1.2 The Parties acknowledge that City will manage and coordinate all event logistics that occur
within the Center, including, by way of example, production, marketing and ticketing, security,
custodial, and parking services.
E. STATEMENT OF MUTUAL INTENT
1.1 The City and Foundation acknowledge the central importance that the Center has in
fulfilling the vision of being a "Family Community for a Lifetime" by increasing access to and public
awareness of the arts while embracing the rich diversity of the City of Coppell's citizens.
1.2 The Parties acknowledge and agree that the future agreements and cooperation may be
memorialized in the future agreements and amendments to this MOU. All changes, additions or
deletions to the obligations herein shall be reduced to writing and signing on behalf of each of the
signatures.

Introduction:
This work session item will provide an update to the City Council on an upcoming ordinance
amendment related to the operation of the Silver Line trains. Article 7-2-18 of the Code of Ordinances
states, "Except as otherwise provided in section 7-2-19, it shall be unlawful for any engineer or other
person in charge of any locomotive, train, motor car or other vehicle for the transportation of freight
or passengers by railroad to run the same onto any street crossing within the corporate limits of the
city at a greater rate of speed than 20 miles per hour." DART is requesting that the Council consider
amending the ordinance maximum speed to 60 mph.
Background:
The Silver Line will be crossing through eight at -grade crossings within the corporate limits of the
City and DART has requested that the City Council amend this ordinance to allow for speeds greater
than 20 miles per hour through these locations. The maximum design speeds for crossings in Coppell
vary depending on specific location and range from 25 mph to 60 mph. As the trains approach the
residential and business core of the City, the maximum operating speeds slow considerably from
those identified for the industrial and boundary crossings.

The amendment requested would be applicable to passenger train service for the DART Silver Line
only. It would not impact freight train traffic.

The City Council of the City of Coppell met in Regular Session on Tuesday, March 23,
2021 at 5:30 p.m. in the City Council Chambers of Town Center, 255 Parkway
Boulevard, Coppell, Texas.
1. Call to Order
As a result of recent Declarations of Emergency made by Dallas County and the
City of Coppell in regards to the current pandemic, Governor Abbott has
permitted for governing bodies to meet remotely and to conduct open
meetings virtually.
Mayor Karen Hunt called the meeting to order, determined that a quorum was
present and convened into the Executive Session at 5:31 p.m.

same to retiring Parks and Recreation Director Brad Reid. A motion was made
by Councilmember Biju Mathew, seconded by Councilmember Wes Mays, that
this Agenda Item be approved. The motion passed by an unanimous vote.
7. Consider approval of a Proclamation naming April 4-10, 2021, as
"National Library Week"; and authorizing the Mayor to sign.
Mayor Karen Hunt read the proclamation into the record and presented the
same to Director of Library Services Dennis Quinn. A motion was made by
Councilmember Wes Mays, seconded by Councilmember Brianna
Hinojosa-Smith, that this Agenda Item be approved. The motion passed by an

8. Annual report by the Coppell Library Board.
Presentation: Frank Gasparro, Chair of the Coppell Library Advisory Board,
made a presentation to the City Council.
9. Citizens' Appearance
Mayor Hunt asked for those who signed up to speak:
1) Thomas Burrows, 138 Wynnpage, spoke in regards to code issues.
2) Mark Henry, 611 Canemount Lane, spoke in regards to Magnolia Park Trail
Section.
3) Jack Leathers, 615 Canemount Lane, emailed a letter on behalf of the
Magnolia Park Homeowners' Association to the City Secretary's Office. The
email was read into the record.
10. Consent Agenda
A. Consider approval of the minutes: March 9, 2021.
A motion was made by Councilmember Wes Mays, seconded by
Councilmember Biju Mathew, that Consent Agenda Items A -C be approved.
The motion passed by an unanimous vote.
B. Consider approval authorizing the purchase of replacement portable
radios for the Fire Department through an Interlocal Agreement with
Houston Galveston Area Council (HGAC) in the amount of $60,781.42 as
budgeted; and authorizing the Mayor to sign and City Manager to
execute any necessary documents.
A motion was made by Councilmember Wes Mays, seconded by
Councilmember Biju Mathew, that Consent Agenda Items A -C be approved.
The motion passed by an unanimous vote.
C. Consider award of the annual contract for Mowing and Landscape
Services, Bid No. Q-0221-03 to Landscape Professionals of Texas not
to exceed $275,000.00, as budgeted, FY 20-21; and authorizing the City
Manager to sign any necessary documents.
A motion was made by Councilmember Wes Mays, seconded by
Councilmember Biju Mathew, that Consent Agenda Items A -C be approved.
The motion passed by an unanimous vote.

providing an effective date; and authorizing the Mayor to sign.

14. City Manager Reports - Project Updates and Future Agendas
City Manager Mike Land gave the following updates:
Blackberry Farms has submitted for a grading -only permit. We would expect
work to begin in the next few weeks.
Airline Road: You may recall we had a brief delay due to a conflict with a
Spectrum line, but that is now resolved. Subgrade stabilization has been
underway and should wrap up in the next week. We expect paving operations
to begin in the next two weeks, weather permitting.

Cambria/Wise Way: We expect the contractor to mobilize in the next couple of
weeks and work to begin mid-April.
Stream G6: We expect the contractor to mobilize and begin work in the first
couple weeks of April.
Intersection Improvement Project: There is a long lead time on signal poles,
but work should commence at Southwestern and Denton Tap in the next 3
weeks.
As you may have noticed, we've begun the installation of the Vision 2040
Artwork for Chambers. The icons are up and we still have the installation of
the plaques that identify each pillar with a small description of each below the
respective pillars.
15. Mayor and Council Reports
Report by the City Council on recent and upcoming events.
Outdoor entertainment is returning to the park, with socially -distant,
family -friendly events at Andrew Brown East! Enjoy a concert from Journey
cover band, "Infinite Journey" in a "Social Square" on the lawn, March 26th
from 7 to 9 p.m. For more information, visit coppelltx.gov/parks.
The Coppell Arts Center hosts Holi, an Indian festival that marks the beginning
of the spring season. Join us on March 27th from 10 am to 1 pm on the Grove to
celebrate and participate in a colorful display of interactive art activities, sip
on Indian spiced drinks while enjoying dance performances from eminent
classical Indian dance schools from the DFW metroplex. This is a free event!

The City of Coppell will host a Virtual Town Hall on Tuesday, April 6, at 6 pm.
Staff will discuss the budget process, current and upcoming projects, and
answer your budget questions. The meeting will be live streamed on the City's

On April 10th, The Watters will be live in the socially distanced Main Hall at the
Coppell Arts Center. The Watters honed their one -of -a -kind sound wandering
around the country and soaking up their habitats. Born and raised in Sedona,
The Watters developed their eclectic sound after living in several dramatically
different cities, including Los Angeles, Denver, Nashville, and now Austin.
Seamlessly blending Americana, Soul, Rock, and Jazz, they have been
described as "Fleetwood Mac with a horn section." Doors open at 7:00 p.m.,
and the performance begins at 8:00 p.m. Tickets are on sale at

The last day to register to vote in the May 1st election is April 1st, Early Voting
begins April 19th through the 27th. Early Voting by personal appearance is
available for Dallas County residents at Coppell Town Center. Coppell
residents who live in Denton County can vote anywhere in Denton County
during Early Voting.
On Election Day, Dallas County residents can vote at Coppell Town Center.

Councilmember Wes Mays reported that he attended a Dallas Regional
Mobility Coalition and recognized the significant impact that DRMC has on the
North Central Texas Council of Governments regarding transportation in the
region.
Councilmember Cliff Long reported that the Historical Society has still not met
recently due to COVID-19, but there is still plenty of activity happening. The
Historical Society has launched an updated website for ease of use and
access. Please visit www.coppelihistoricalsociety.com to view the new
webpage. Councilmember Long also reported that the Wilson House is being
furnished with 1960s period furniture and decor.
17. Public Service Announcements concerning items of community interest with no
Council action or deliberation permitted.
Councilmember Wes Mays reported that Metrocrest Services is hosting their
16th Annual Keyholder Breakfast on Thursday, April 8th beginning at 8:00 a.m.

Commercial), to amend the detail site plan to allow for an additional 1,400 -square -foot
restaurant with drive-thru to an existing development with a current restaurant use with 2
future parking spaces on 0.842 acres of land, located at 205 N. Denton Tap Road, and
authorizing the Mayor to sign.
2040: Create Business and Innovation Nodes
Executive Summary:
The applicant is proposing to keep the building and drive-thru as is with very little exterior modifications.
Smoothie King is proposing to occupy a 1,350 -square foot existing lease space at the southern endcap of
the building and retain the drive thru. A Planned Development is required because the applicant is
requesting a variance to install two "future" parking spaces that encroach in the perimeter landscaping,
and because the Smoothie King is considered a drive-thru restaurant with residential adjacency.
Analysis:
On March 9, 2021, the City Council approved this zoning change (6-0) subject to the following
conditions:
1. Allowing the two restaurant uses (Donut City and Drive-thru Smoothie King) abutting residential
zoning.
2. Hours of operation shall not to exceed the following:
Smoothie King - 10 am to 8 pm on Sunday, 7 am to 9 pm Monday - Friday and 8 am to 9 pm on
Saturday.
Donut City - 6 am to 12 pm. Tuesday -Sunday (closed Monday).
3. Signage shall be as indicated on the rendering or in compliance with the Signage Section of the
Zoning Ordinance.
4. Menu board shall be located as shown on the Site Plan and granted an exception to the 80%
masonry requirement. The speaker shall be shielded to deflect the sound away from the residential
properties to the west.
5. A construction development permit through the Public Works Department shall be required for
the future parking. If additional lighting is needed, this shall comply with the glare and lighting
standards of the Zoning Ordinance. This shall be constructed if needed or when the change in
tenant mix necessitates more parking under the current Zoning Ordinance.
6. Add an overstory tree on the western property line.
7. The menu board noise level shall not exceed 60 dB measured at the western property line.

the exercise of legislative discretion have concluded that the Comprehensive Zoning Ordinance and
Map should be amended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COPPELL, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of Coppell,
Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and
the same is hereby amended by granting a change in zoning from C (Commercial) to PD -305-C (Planned
Development -305 -Commercial) to amend the Detail Site Plan to allow for an additional 1,400 -square -
foot restaurant with drive thru to an existing development with an current restaurant use with 2 future
parking spaces on 0.842 acres of land, located at 205 N. Denton Tap Rd., for the property described
in Exhibit "A" attached hereto and made a part hereof for all purposes ("the Property")

SECTION 2. That the Property will be used, developed and maintained for Commercial uses
and as an 875 square foot restaurant and a 1,400 square foot restaurant with a drive thru window, as
defined and provided in the Code of Ordinances, as set forth in the Detail Site Plan, Exhibit B, is hereby
approved subject to the following development regulations for the site:
A. Allowing two restaurant uses (Donut City and proposed Smoothie King) on the Property.
B. The speaker on the menu board shall face to the south and shall be shielded to direct the
sound away from the residential properties to the west. The sound from the speaker of
the menu board shall not exceed 60 decibels as measured at the west property line.
C. Hours of operation for the respective uses shall not exceed the following:
South restaurant - 10 am to 8 pm on Sunday, 7 am to 9 pm Monday - Friday and 8
am to 9 pm on Saturday.
North restaurant - 6 am to 12 pm. Tuesday -Sunday (closed Monday).
D. Signage shall be as depicted on Sign Plan or as otherwise provided in the Zoning
Ordinance for the uses permitted herein.
E. Menu board shall be located as shown on the Site Plan and granted an exception to the
80% masonry requirement.
F. All exterior lighting elements shall be constructed and maintain to comply with the glare
and lighting standards as provided in the Zoning Ordinance.
G. Landscaping shall be installed and maintained in accordance with the Landscape Plan, as
depicted in Exhibit C.
SECTION 3. That the Detail Site Plan, Landscape Plan Building Elevations, and Sign Plan
attached hereto and incorporated herein as Exhibits `B" though "E"; respectively; and, are hereby
deemed as development regulations to this development.

SECTION 4. That the above property shall be used only in the manner and for the purpose
provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended,
and as amended herein.
SECTION 5. That the development of the property herein shall be in accordance with building
regulations, zoning ordinances, and any applicable ordinances except as may be specifically altered or
amended herein.
SECTION 6. That all provisions of the Ordinances of the City of Coppell, Texas, in conflict
with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not
in conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 7. That should any sentence, paragraph, subdivision, clause, phrase or section of
this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the
validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to
be unconstitutional, illegal or invalid, and shall not affect the validity of the Comprehensive Zoning
Ordinance as a whole.
SECTION 8. An offense committed before the effective date of this ordinance is governed by
prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in effect when the
offense was committed and the former law is continued in effect for this purpose.
SECTION 9. That any person, firm or corporation violating any of the provisions or terms of
this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning
Ordinance of the City of Coppell, as heretofore amended, and upon conviction shall be punished by a
fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every
day such violation shall continue shall be deemed to constitute a separate offense.
SECTION 10. That this ordinance shall take effect immediately from and after its passage and
the publication of its caption, as the law and charter in such cases provide.

carriage house as a part of the Planned Development District and to allow the addition of
a guest suite, pool pavilion, game room, greenhouse, porch, and new entry gate to an
existing residential unit located on 5.067 acres of land located at 748 Deforest Road and
authorizing the Mayor to sign.
2040: Enhance the Unique Community Oasis Experience
Executive Summary:
In March 2000, the property was rezoned from Agriculture to PD -184 -SF -ED to allow for a residential
dwelling and pool and associated PD conditions. In 2002, a carriage house was built on the property
connected to the main house with a pergola. This is a two-story building with a garage on the ground
floor and a room upstairs with a bathroom, this is located to the west of the main house along the circular
drive. The current owners would like to make some improvements to their property in the form of a
guest suite, pool pavilion, game room, greenhouse, porch, and new entry gate. The majority of the new
development will occur behind the existing house, backing up to Denton Creek
Analysis:
On March 9, 2021, the City Council unanimously recommended APPROVAL of PD -184R2- SF -ED,
subject to the following conditions:
1. There may be additional comments at the time of Building Permit and Detail Engineering
Review.
2. Building permits shall be required for all proposed buildings, structures, paving and fences.
3. The City shall not be responsible for any repairs to the driveway for responding to calls at this
address.
4. Gate to be equipped with GTT Opticom sensor for emergency apparatus to open the gate and
Knox override in the event of malfunction.
5. All new structures to be equipped with NFPA-13R fire sprinkler systems and shall provide
complete coverage including small rooms.
6. To allow the existing garage/carriage house as shown on the plans.
7. To allow for proposed accessory buildings to be taller than 12 feet in height, as shown on the
plans.
8. To allow for accessory structures with a bedroom, kitchen and bathroom plumbing as shown on
the plans.
9. The accessory units shall not be rented or leased out separately from the main house.

WHEREAS, the City Planning and Zoning Commission and the governing body of the City of
Coppell, Texas, in compliance with the laws of the State of Texas and pursuant to the Comprehensive
Zoning Ordinance of the City of Coppell, have given requisite notices by publication and otherwise,
and after holding due hearings and affording a full and fair hearing to all property owners generally,
and to all persons interested and situated in the affected area and in the vicinity thereof, the said
governing body is of the opinion that Zoning Application No. PD -184R2 -SF -ED should be approved,
and in the exercise of legislative discretion have concluded that the Comprehensive Zoning Ordinance
and Map should be amended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COPPELL, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of Coppell,
Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and
the same is hereby amended by granting a change in zoning from PD -184 -SF -ED (Planned
Development -184 - Single -Family Residential— Estate District) to PD -184R2 -SF -ED (Planned
Development -184 Revision Two- Single -Family Residential— Estate District) to incorporate the
City of Coppell Ordinance Pg 1 TM121451
existing carriage house as a part of the Planned Development District; and, to allow the construction
and maintenance of a guest suite, pool pavilion, game room, greenhouse, porch, and entry gate to an
existing residential use on 5.067 acres of land located at 748 Deforest Road., for the property described
in Exhibit "A" attached hereto and made a part hereof for all purposes.
SECTION 2. That the Property will be used, developed and maintained for Single -Family
Residential Estate District uses, as defined and provided in the Code of Ordinances, as set forth in the
Detail Site Plan, Exhibit B, is hereby approved the inclusion of the construction and maintenance of the
guest suite, pool pavilion, game room, greenhouse, porch and an entry gate subject to the following
development regulations:
A. There may be additional comments at the time of Building Permit and Detail Engineering
Review.
B. Building permits shall be required for all proposed buildings, structures, paving and fences
as provided and in accordance with the Code of Ordinances.
C. The property shall be responsible for any repairs to the private driveway notwithstanding a
response to the property by public safety vehicles, apparatus or equipment.
D. Gate to be equipped with GTT Opticom sensor for emergency public safety vehicles
apparatus or equipment to operate gate and shall include Knox box override capability.
E. All new structures to be equipped with NFPA-13R fire sprinkler systems and shall provide
complete coverage areas meant for human occupancy.
F. To allow the existing garage/carriage house as depicted on the Exhibits.
G. That none of the additional accessory structure shall be taller than 12 feet in height, as shown
on the attached Exhibits B through D.
H. To allow the guest suite and pool pavilion to contain a sleeping quarter, kitchen and bathroom
plumbing element as depicted on the plans.
I. The accessory structures shall not be rented or leased out separately from the main house.

SECTION 3. That the Site Plan, Building Elevations, and Material Board attached hereto and
incorporated herein as Exhibits `B" though "D"; respectively; and, are hereby deemed as development
regulations to this development.
SECTION 4. That the above property shall be used only in the manner and for the purpose
provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended,
and as amended herein.
SECTION 5. That the development of the property herein shall be in accordance with building
regulations, zoning ordinances, and any applicable ordinances except as may be specifically altered or
amended herein.
SECTION 6. That all provisions of the Ordinances of the City of Coppell, Texas, in conflict
with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not

General Information:
• Rolling Oaks, Columbarium Office, located at 400 Freeport Parkway, was damaged
due to the February winter storm.
• Fire sprinkler lines froze, causing extensive damage to sheetrock and furniture.
• Emergency removal and replacement of sheetrock, lighting, baseboard and all other
damaged items are underway. Estimate completion date is late April.
• The quoted amount was $82,963.21 and will be included in the City of Coppell's
insurance claim with TML.
• Repairs needed to re -open this site have begun.
Introduction:
This agenda item is being presented to consider ratifying the contract with Custard Construction in
the amount of $82,963.21 for the repair of storm damage at Rolling Oaks, Columbarium Office,
located at 400 Freeport Parkway, the cost covered by an insurance claim with TML; and authorizing
the City Manager to sign any necessary documents.
Analysis:
The City -owned facility, Rolling Oaks, Columbarium Office, was constructed in 2019/2020 and was
damaged by a broken fire sprinkler line during the February storm. Inspection of the site determined
the following work needed to be performed and was started immediately as an emergency repair.
• Replacement of all sheetrock damaged or still reading moisture after 48 hours.

• Replacement of insulation in exterior walls that had been damaged by water contact.
• Re -texture and paint interior of site.
• Scrub and re -seal floors
• Replace all light and electrical fixtures damaged by water.
Legal Review:
The Facilities Division solicited three (3) quotes from qualified contractors. Custard Construction
submitted the lowest quote and was authorized to start immediately.
Fiscal Impact:
The fiscal impact of the agenda item is a total of $82,963.21, to be covered by the insurance claim
with TML, for damage done City-wide by the February storm.
Recommendation:
The Public Works Department recommends ratifying this item.

General Information:
• 234 Parkway Blvd. was constructed in 1991.
• The Gymnasium roof is original construction and has had numerous and continuous
leaks over the years which have been patched and repaired multiple times.
• The roof was scheduled and budgeted for replacement fiscal year 2020/2021.
• A destructive test investigation including a moisture scan was performed to determine
roof condition and best course of action.
• Public Works Department is recommending the complete removal and replacement of
the roof surface for the city -owned facility at 234 Parkway Blvd. this fiscal year as
budgeted in the amount of $177,954.00
Introduction:
This agenda item is being presented to consider approval of a contract with the City's contracted
roofer, The Garland Company, a member of OMNIA Partners quote 25 -TX -201077, for the re-cover
of the Gymnasium roof located at 234 Parkway Boulevard, in the amount of $177,954.00; as budgeted
in IMF; and authorizing the City Manager to sign any necessary documents.
Analysis:
The city -owned facility at 234 Parkway was constructed in 1991 and the Gymnasium roof is original
to the facility. The roof is an asphalt "built up" roof with a gravel cover. The roof has been patched
and repaired over the years, but leaks continue. Staff recently commissioned a destructive roof
analysis and moisture scan to identify the root causes. The primary issues with the current roof as
noted by the destruction test and moisture scan are:
• Levels of moisture trapped in roof assembly.
• Gravel on roof has hidden issues making repairs difficult.
• The surface of the roof is very weathered and shows signs of "alligatoring".
• Heating and cooling over the course of its lifespan has caused the material to become brittle.
Conclusion:
Based on physical roof discoveries, destructive investigation, moisture scan, IBC 218, ASCE 7-10
ASTM and all applicable codes, the recommendation is to:
• Remove the surface material of the roof.
• Remove and replace any insulation damaged by moisture.
• Remove and replace all drain and pitch pans.
• Install a vapor barrier and a mineral based cap sheet according to manufacturer's
recommendation.
The work will be performed during normal hours and performed such to minimalize the disruption to
city staff and patrons. The roof replacement will take approximately one month to complete. This
will not conflict with the use of the Gymnasium which will remain open while the work is performed.
Legal Review:
The work is being performed through Garland/DBS who currently hold the City of Coppell's Roof
Asset Management contract and has solicited three (3) quotes from qualified contractors.
Fiscal Impact:
The fiscal impact of the agenda item is a total of $177,954, as budgeted in the Infrastructure
Maintenance Fund.
Recommendation:
The Public Works Department recommends approval of this item.

As requested by, an inspection of the roofing system at the referenced address above was performed on August 27, 2020.
GHLA, Stephen Bingham, Manufacturer representative Russell Roberts arrived on site at Aquatic and Recreation Center to
complete post -storm roof inspection of metal roof assembly and exterior metal panels on vertical wall assemblies owned
by City of Coppell (referred to as "Client" hereafter).
Introduction:
This report contains current roof conditions and ASTM, City codes applicable to the roof system installed at Aquatic and
Recreation Center located at address listed above. Please note that if new or additional information becomes available
after the date listed on this report relative to these roof systems, GHLA, Architecture Firm (referred to as "Architect or
Designer" herein) reserves the right to revise report for case #0234-01 based on new information provided after the date
of August 27, 2020.
Project Description:
This investigation is limited to the performance of roofing materials and assembly of roof components at the subject
property. The subject project consisted of a flat roof section and metal roof sections, all part of one building located at 234
Parkway Blvd, Coppell, TX 75019.
Scope of Work:
Architect/Designer scope of work for this project is to determine IF the integrity of roofing materials applications is in
compliance with the ASTM requirements, local building codes and investigate existing weather related damage that
occurred on all metal roof surfaces and all other assemblies adjoining roof system.
This Investigation(s) was organized to determine:
• To document the cause of reported roof leaks.
• if the metal roofing assembly performance was impacted by weather-related events.
• if the roofing assembly water tight capabilities were compromised by weather related events.

City of Coppell building department adopted the 2018 International Building Code (IBC).
City of Coppell building department adopted the 2018 International Energy Code Council (IECC) design requirements.
IBC 2018: Section 1403.2 Flashings shall be installed in such a manner so as to prevent moisture from entering the wall or
to redirect it to the exterior. Flashing shall be installed at the perimeters of exterior. Flashings shall be installed at the
perimeter of exterior door and window assemblies, penetrations and terminations of exterior wall assemblies, exterior
wall intersections with roofs, chimney, porches, decks, balconies and similar projections and at built-in gutters and similar
locations where moisture could enter the wall. Flashing with projecting flanges shall be installed on both sides and the
ends of copings, under sills and continuously above projecting trim.
IBC 1503.3.1 requires roof covering shall be applied and installed in accordance with this code and the manufacturer's
instructions such that the roof covering shall serve to protect the building or structure.
Wall Coping Metal (Parapet):
For parapet walls, positive slope to the roof side should be provided at the top of the wall. A continuous tapered shim
installed over the wood blocking is a common method of sloping the top of the wall to the roof side. When weather -tight
seams are not installed, copings should have a continuous sheet membrane liner under the coping that should be capable
of providing a secondary water barrier. If installed, a sheet membrane liner may also act as an isolation sheet for
incompatible materials or act as a slip sheet for materials with differential movement.
During this visual observation of water shedding surfaces, consistent visible evidence has the cause of mineral
displacement on mineral cap surface along with disengaged metal roof panel and weather related impacts metal roof
panel surfaces. Visible signs and/or reports have been brought to our attention related to damage caused by the weather
event that occurred at the address listed above.
Roofing Product Identification:
Manufacturer's specifications and design requires roof surface to provide positive discharge of moisture from roof
assembly, Ultra -Violent ray protection and sustain life cycle of design according to ASTM requirements.

General Summary of Observations and ASTM D 2829-07 Test Results:
The core received is a three-ply built up roof with a flood and gravel surfacing and inter -ply glass mat applied in hot
asphalt. The surface of the roof is very weathered and shows signs of alligatoring. The flood and gravel surfacing acts as an
important UV protectant for the asphalt; this loss of minerals and surface cracking will potentially lead water penetration
though to the roof deck below.
The roof core is well intact, with no signs of air gaps or loss of adhesion. The plies were not readily able to be pulled a part.
The key mechanism of any built-up roof system consists of all plies being adhered together as a system with an adhesive;
by keeping the system intact, the total system strength remains strong and waterproof to avoid any cracks or reduction in
mechanical properties.
The average softening point of the inter -ply asphalt was 281.5°F with a pen of 7. Standard Type III asphalt has a softening
point of 185-205°F and a pen of 15-35. This asphalt sample tested above the ASTM D 312-00 specifications listed above.
This could be due to the asphaltic oils baking out over time from weathering and heat cycling, leading to an increased
softening point and more brittle asphalt. The loss of oil leads to overall brittleness, cracking and crazing of the roof system,
especially in climates with temperature variation between seasons.
In accordance with the Recommended Performance Criteria for Modified Bitumen Roof Membrane Systems, bitumen roof
systems should have a minimum of 2.5% elongation, and 200 Ibf/in tensile strength to ensure adequate field performance.
This roof core had a tensile strength of 189.5 Ibf/in and an elongation of 1.3%. Both the tensile strength and elongation are
not within the recommended criteria. This can be related to the degraded roof system not being solidly adhered to reach
the full tensile strength and the brittle asphalt reducing its overall elasticity.
Based on the analysis of the core provided and from our observations, the overall construction of the core has sufficient
integrity and adhesion qualities; the aged asphalt has negatively affected the total system strength. The softening point of
the asphalt for both cores was very high, indicating degradation of the asphalt. As a result, the physical properties of this
roof core exhibit that the roof is toward the end of its life cycle and will continue to deteriorate with time.
Recommendations:
Based on ASTM D 2523, ASTM D 2829 test results, physical roof discoveries and moisture migrating through existing failing
roof system our recommendation is to remove roof surfacing, prepare existing roof membrane and apply new roof
system over existing roof system. This proposed solution will ensure interior conditions of gym are not compromised and
will avoid raising all roof top units to install new applicable IECC/ASHRAE requiring R-25 continues insulation on roof deck.

ribbon pattern. Space 1/4" to 12" (12.7mm) wide beads, 12" (300mm) o.c., to achieve proper coverage rates.
j. Install new cant strips on all vertical wall assemblies and parapet walls.
k. Install one (1) torch HPR Base Sheet with woven fiberglass scrim reinforcement with the following minimum
performance requirements ASTM D 6163. Install base sheet in cold process inter -ply low voc adhesive.
I. Install one (1) StressPly UV Mineral surfaced rubber modified roofing membrane with a fiberglass and
polyester composite scrim surfaced minerals. Install mineral cap sheet in cold process low voc adhesive
according manufacturers installation instructions.
m. Install HPR Base Sheet and StressPly UV Modified Mineral Cap Sheet on all penetrations and units per
manufacturers specifications.
n. Install HPR Base Sheet and StressPly UV Modified Mineral Cap Sheet on all vertical wall assemblies according

o. Seal all vertical laps of flashing membrane with a six inch strip of mineral torch.

• In 2019, a Request for Proposals for Janitorial Services was utilized with weighted evaluation
criteria.
• The lowest responsive, responsible bidder was Oriental Building Services, Inc.
• The agreement term is effective June 1, 2019 — May 31, 2020 with (4) four (1) one-year
renewals. This request is for the second renewal.
• The contract includes service to 17 municipal buildings including the provision of cleaning
supplies and materials.
• The value of this contract renewal is $410,616.00, as budgeted.
Introduction:
This agenda item is being presented to consider approval of awarding renewal two (2) of RFP# Q-
0419-01 Janitorial Service of 17 Municipal Buildings. for a one-year period beginning June 1, 2021
through May 31, 2022, with options to renew an additional two (2), one-year terms, at a cost of
$410,616.00, as budgeted; and authorizing the City Manager to sign any necessary documents.
Analysis:
In 2019, after significant difficulty with the existing janitorial contractor, the City of Coppell
Facilities Division solicited proposals for Janitorial Services for 16 municipal buildings, including
the provision of supplies and cleaning materials. The recently opened office building at Rolling Oaks
Memorial Center has since been added bringing the total to 17 municipal buildings. Because this
contract is for Citywide service, the proposals were evaluated by a committee that included
representatives from Purchasing, Fire, Police, Parks and Public Works.

Facilities worked with Purchasing to solicit the original proposal. Oriental Building Services was
awarded a contract with option for up to four annual renewals. Renewals are only recommended if
service is satisfactory. Although the contract would allow for two additional renewals, staff
anticipates requesting new proposals for these services for next fiscal year to ensure pricing is current
with the market. Funds for these services are included within the Facilities operating budget.
Legal Review:
The City's standard form contract is being utilized and is reviewed periodically by the City Attorney.
Fiscal Impact:
Fiscal impact of this agenda item is $410,616.00, as budgeted.
Recommendation:

otherwise provided herein, payinent to the Contractor shall be monthly based on the Contractor's
monthly progress report and detailed nionthly iteinized staternent for Services that shows, the names
of the Conti -actor's employees, agents, contractors performing the Services, the time worked, the
actual Services Performed, the rates charged for soch Service, the total aniount of fi.-e carned to date
and the aniount due and payable as ofthe current statement, in a 1.oTni reasonably acceptable to the
City, Monthly statenients shall include authorized non -salary expenses with suppotling iterilized
invoices and documentation, 'rhe City shall pay such rii(.,)nthly statements \vithin thirty (30) days, after
receipt and City verification of the Services and expenscs unless otherwise provided herein.
4.2, The parties acknowledge that the Agreement pricing is based on the federal and state
mininiurn Nvage rate current at the effective (late of' this Agreement, and agree that the cost of any
statutory raises to said mininium wage rate enacted during the term of this Agreement shall be borne
by the City.
4.3 [Jifless otherwise provided in the Scope of Services, Contractor shall be resp orisible
for all expenses related to (Ile services provided pursuant to this Agreement including, but not litilited
to. travel, copying and facsimile charges, telephone, internet and email charges.
Article V
Devotion of Time; I-lersonnel; and 1"Auipment

63 Successors and Assigils. Subject to the provisions, regarding aqsigntrient, this
Agreement shall be binding on and inure to the- benefit of the Parties to it and their respective heirs,

6.4 ("Joverilim-,Law '. The laws of'lhe State ol'Texas shall over this Agreement without
regard to any conflict of law rules; and venue for any action concerning this Agreeilient shall be in
the State District Court of Dallas County, Texas. The Parties agree to submit to the Personal and
subject rnatterjurisdiction of said court.
6,5 Amendments, This Agreement may be amended by, the inulual written agreement of

A. Contractor shall assign not less than one (1) qualified supervisor to physically supervise

Security of the building while Contractors eniployees are performing their duties. 'I 'he
supervisor will make certain that all doors are securely, locked prior to leaving each nigllt.

V. RULES AND REGULATIONS REGARDING CONTRAcrOR EMPLOYEE
CONDUCT:

Executive Summary:
The property improvements include a new lift station, new concrete pavement, an odor control system, yard piping,
emergency generator, and electrical control building. The existing lift station will be demolished and abandoned
in place once the new lift station is online. The lift station will have a firm capacity of 6.9MGD and this lift station
provides service to approximately 23% of the city. Estimated construction cost is about $5M. The property will
be platted in conjunction with this upgrade.
Introduction:
The lift station is nestled in between the Universal Academy and St. Joseph's Retirement Village on Sandy Lake
Road. The existing sanitary sewer lift station is approximately 50 -years old and was modified in 2004. This is a
dry -pit lift site which pumps wastewater from a lower elevation to a higher elevation through a 20 -inch force main.
This process will improve the site and provide a new lift station. The site is and will continue to be accessed from
Sandy Lake Road from a mutual access easement with Universal Academy. The existing gravel along the driveway
and remainder of the site will be upgraded to concrete. The existing chain link fence at the entrance of the site will
be replaced with an eight -foot wrought iron fence with swinging gates. The upgraded lift station will include a
new electrical building, emergency generator and odor control system positioned along the southwest side of the
site and will be screened from view both from the existing screening wall and the Universal Academy building.
The odor control system is proposed to have a shelter to protect it from the elements. The new lift station will be
positioned along the southern portion of the site. There are no proposed landscaping changes to the property, other
than replacing grass that may be disturbed during construction.
On March 18, 2021, the Planning and Zoning Commission unanimously recommended APPROVAL (7-0) of PD -
280R -R, subject to the following condition:
1. There may be additional comments at the time of Building Permit and Detail Engineering Review.

HISTORY: This property has had a lift station on it for over 50 years. In 2015, a Planned
Development was approved to allow for a cell tower to be placed on the site. Just
after the approval, the site was impacted by a severe flood and the cell tower was
never constructed.
HISTORIC COMMENT: There is no historic significance other than a lift station has been on this site for over
50 years.
TRANSPORTATION: Sandy Lake Road is a four -lane divided concrete road contained within an
approximate 110 -foot right-of-way.

Neighborhood Center Retail.

The new lift station building will be a prefabricated building with a split -face block relief
textured pattern and sandy beige in color. The building is approximately 12 feet in height
and 11 -ft 6 -in by 25 -ft 6 -in. The shade structure over the odor control system will be made
of metal, protecting the equipment.
RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
Staff is recommending APPROVAL of PD -280R -R, subject to the following conditions:
