A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS, CANVASSING AND DECLARING THE RESULTS OF THE
MAY 1, 2021GENERAL ELECTION FOR MAYOR AND
COUNCILMEMBERS PLACE 2, PLACE 4, PLACE 6FOR A THREE (3)
YEAR TERM; AND CANVASSING AND DECLARING THE RESULTS OF
THEMAY 1, 2021 SPECIAL ELECTION FOR COUNCILMEMBER
PLACE 3 TO FILL AN UNEXPIRED TERM; AND ORDERING A RUNOFF
ELECTION TO BE HELD ON JUNE 5, 2021, FOR THE PURPOSE OF
ELECTING A CITY COUNCILMEMBER FOR PLACE 3; ORDERING
NOTICES OF ELECTION TO BE GIVEN AS PRESCRIBED BY LAW IN
CONNECTION WITH SUCH ELECTION; PROVIDING FOR EARLY
VOTING AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, it is hereby found and determined that notices of a general election were duly
given in the form, manner and time required by law, and said elections were in all respects legally
held and conducted in accordance with applicable laws of the State of Texas and the proceedings
calling and governing the holding of such elections; and
WHEREAS, it is imperative to consider the returns of the general and special election held
on May 1, 2021, for the purpose of electing the hereinafter named officials before the qualified
voters of the City; and
WHEREAS, the returns of the general and special election have been duly and legally
made and submitted to the City Council for canvassing, and a tabulation of the returns for the
polling places and for early voting, as canvassed and tabulated by this governing body; and
WHEREAS, the returns for Mayor and Councilmember for Places 2, 4 and 6 received a
majority of votes cast and resulted in the election of candidate for said positions; and,
WHEREAS, the returns for Councilmember for Place 3 did not result in a candidate
receiving a majority of votes cast and a runoff is required by law.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Coppell,
Texas after examining said returns and opening and canvassing the votes of said election, for
mayor council members Places 2, 3, 4 and 6 that the results of said general and special election are

It appearing that no candidate received majority of all votes cast for the office of
Councilmember Place 3. That a runoff election is hereby ordered for June 5, 2021, for the purpose
of electing a City Councilmember for Place 3 for an unexpired term. The only candidates for said
runoff election shall be the two candidates for Place 3 who received the highest and second highest
number of votes for said office at the Municipal Officers Election for the City conducted on May
1, 2021and canvassed on May 11, 2021. According to the official canvass of said election, no
candidate for said Place 3 received a majority of the votes cast, for said office and the candidate
receiving the highest number of votes was as follows:
1. Don Carroll 1,840 votes
2. Davin Bernstein 2,010 votes
SECTION 6. The Presiding Election Judge and Alternate Presiding Election Judge
appointed to serve the authorized polling place and the early voting clerk (City Secretary) and
deputy early voting clerk shall be those election officials who served at the regular election on
May 1, 2021. A voting system or systems meeting the standards and requirements of the Texas
Election Code, as amended, is hereby adopted and approved for early voting by personal
appearance, by mail and for Election Day voting.

SECTION 7. The election shall be held as a Joint Election administered by the Dallas
and Denton County Elections Administrators utilizing specific equipment to cast ballots as
approved by the Texas Secretary of State, and in accordance with the provisions of the Texas
Election Code and the Texas Administrative Code, with a Joint Election Agreement for each of
the respective counties. The City Manager is hereby authorized to execute the Election Contracts
with the Counties of Dallas and Denton for the conduct of the election. Pursuant to the Joint
Election Contract, the County Elections Administrator shall serve as Election Administrator for
the election. Presiding Election Judges and Alternate Presiding Election Judges appointed to serve
at said polling places shall be those election officials furnished by the Elections Administrator
from the list of proposed elections judges listed in an attachment to the Joint Election Contract.
Notice of the election shall be posted on the bulletin board used to post notice of the City
Council meetings and be published in a newspaper of general circulation in the City. Said notice
must be published on the same day in each of two successive weeks, with the first publication
occurring no earlier than the thirtieth day and no later than the fourteenth day before the date of
the election. A copy of the published notice that contains the name of the newspaper and the date
of publication shall be retained as a record of such notice, and such person posting the notice shall
make a record of the time of posting, starting date and the place of posting.
Early voting by personal appearance for Dallas County and Denton County residents will
be set forth in accordance to state law and as stated in the Joint Elections Contracts and posted on
the City’s webpage. Application for ballot by mail must be received no later than the close of
business on May 25, 2021. Applications for early voting ballot by mail shall be mailed to:

SECTION 8. All resident qualified electors of the City shall be permitted to vote at said
election. This election shall be held and conducted in accordance with the provisions of Texas
Election Code, and as may be required by law, all election materials and proceedings shall be
printed in both English and Spanish.
SECTION 9. The City Secretary is hereby directed to cause notice of said election to be
published at least once, not earlier than the 30th day nor later than the 15th day, before election
day as provided in Section 4.003(a) (1) of the Texas Election Code; and shall be posted on the
bulletin board used for posting notices of the City Council meetings not later than the 15th day
before election day. A copy of the published notice that contains the name of the newspaper and
the date of publication shall be retained as a record of such notice, and the person posting the notice
shall make a record at the time of posting stating the date and place of posting in accordance with
Texas Election Code Section 4.005.
SECTION 10. This resolution shall take effect immediately upon its passage.

CONSIDERANDO, dieron como resultado que un candidato recibiera la mayoría de los
votos emitidos y la ley exige una elección de desempate.
POR LA PRESENTE SE RESUELVE que el Consejo de la ciudad de Coppell, Texas,
luego de examinar dichas declaraciones y abrir y sondear los votos de dicha elección, para el
concejal del Lugar 2, 3, 4 y 6 que los resultados de dicha elección general son los siguientes.
SECCION 1. Que se emitieron los siguientes números de votos para el siguiente
candidato para el cargo de concejal del alcalde, es decir:

Parece que ningún candidato recibió la mayoría de los votos para el puesto de Concejo
Lugar 3. Que por la presente se ordena un desempate para el 5 de junio del 2021, con el propósito
de elegir un concejal de la ciudad para el Lugar 3por un periodo completo. Los únicos candidatos
para dicho desempate serán los dos candidatos para el Lugar 3que recibieron el mayor y el segundo
mayor número de votos para dicho cargo en la Elección de Oficiales Municipales para la Ciudad
realizada el 1 de mayo del 2021 y sondeo del 11 de mayo del 2021. De acuerdo con el sondeo
oficial de dicha elección, ningún candidato de dicho Lugar 5 recibió la mayoría de los votos

emitidos para dicho cargo y el candidato que obtuvo el mayor número de votos fueron los
siguiente:
1.Don Carroll 1,840 votes
2. Davin Bernstein 2,010 votes
SECCION 6.El Juez Presidente de elecciones y el juez suplente de elecciones
presidenciales designados para servir en el lugar de autorizado de votos y el secretario de votación
anticipada (Secretaría de la ciudad) y el secretario adjunto de votación anticipada serán los
funcionarios electorales que prestaron servicio en la elección regular el 1 de mayo del 2021. Un
sistema de votación o sistemas que cumplen con los estándares y requisitos del Código Electoral
de Texas según enmendado, por la presente se adoptan y aprueban para la votación anticipada en
persona, por correo y para la votación el día de las elecciones.
SECCION 7. Las elecciones se llevarán a cabo como una Elección Conjunta administrada
por los administradores de elecciones de los condados de Dallas y Denton utilizando equipo
específico para emitir los votos según lo aprobado por el secretario del estado de Texas, y de
acuerdo con las disposiciones del Código Electoral de Texas y el Código Administrativo de Texas,
con un Acuerdo de Elección Conjunta para cada uno de los respectivos condados. Por la presente
se autoriza al Administrador de la ciudad a ejecutar los contratos electorales con los condados de
Dallas y Denton para la realización de la elección. De conformidad con el contrato de Elección
Conjunta, el administrador de elecciones del condado actuará como administrador de elecciones
para la elección. Los presidentes y jueces electorales y presidentes alternos designados para servir
dichos lugares de votación serán aquellos funcionarios electorales proporcionados por el
Administrador Electoral de la lista de jueces electorales propuestos enumerados en un anexo al
contrato de Elección Conjunta.
El aviso de la elección se publicará en el tablero de anuncios utilizado para publicar el aviso
de las reuniones del consejo de la ciudad y se publicará en un periódico de circulación general en
la ciudad. Dicho aviso deberá publicarse en el mismo día en cada una de las dos semanas sucesivas,
ocurriendo la primera publicación no antes del trigésimo díay no mástardar del decimocuarto día
antes de la fecha de la elección. Una copia del aviso publicado que contiene el nombredel
periódico y la fecha de publicación se conservará como registro de dicho aviso, y la persona que
publique el aviso deberá registrar la hora de publicación, la fecha de inicio y el lugar de
publicación.
La votación anticipada en persona para los residentes del condado de Dallas y el condado
de Denton se establecerá de acuerdo con la ley estatal y como se establece en los Contratos de
Elecciones Conjuntas y se publicará en la página web de la ciudad. La solicitud de boleta de

votación por correo debe recibirse a más tardar al cierre de operaciones del 30 de noviembre del
2020. Las solicitudes de boleta de votación anticipada por correo se enviarán por correo a:

SECCION 8. A todos los electores calificados residentes de la ciudad se les permitirá
votar en dicha elección. Esta elección se llevará a cabo de acuerdo con las disposiciones del Código
Electoral de Texas y, según lo requiera la ley, todos los materiales y procedimientos electorales se
imprimirán en inglés y español.
SECCION 9. Por la presente se ordena a la Secretaría de la Ciudad haga la notificación
de dicha elección se publique al menos una vez, no antes del día 30 ni después del día 15, antes
del día de la elección según lo dispuesto en la Sección 4.003 (a) (1) de la Elección de Texas Código;
y se publicará en el tablón de anuncios utilizando para publicar avisos de las reuniones del Consejo
municipal a más tardar el día 15 antes del día de las elecciones. Se conservará una copia del aviso
publicado que contiene el nombre del periódico y la fecha de publicación como registro de dicho
aviso, y la persona que publique el aviso hará un registro en el momento de la publicación
indicando la fecha y el lugar de publicación de acuerdo con la Sección 4.005 del Código Electoral
de Texas.
SECCION 10. Esta resolución tomara efecto inmediatamente después de su aprobación.
