STATE OF TEXAS
The Council of the City of Coppell, Texas, met in regular session March 16, 1970,
with the following members present to-wit:
W. T. Cozby, Mayor
Jim McGiboney, Councilman
W. H. Wilson, Councilman
Johnny Dobecka, Councilman
E. C. Gentry, City Secretary
Constituting a quorum, where among other proceedings had was the following:
Billy Harrison appeared before the council again to request that the city pay the
cost of his tying onto the city's water line, an amount of approximately $120.00.
Mr. Harrison said he felt as entitled to this treatment as C. F. Hitchcock, for
whom the council had recently agreed to pay the fee. The council discussed the
fact that whetever was done in 'this matter might set a precedent for future problems
along this line. Mr. Cozby agreed with Mr. Harrison that the council had already
set a precedent by paying Mr. Hitchcock's fee. Mr. Wilson disagreed however,
stating that Harrison's line had been put in long before Mr. Hitchcock's case had
come up, Mr, Harrison had agreed in.advance to pay his own fee and Mr. Hitchcock
had asked the city's cooperation prior to putting in his line. Mr. Wilson moved
that Billy Harrison be denied his request that he be reimbursed the cost of labor
and materials within Sandy Lake Road. Mr. Dobecka seconded the motion and the
motion was passed unanimously, The council discussed the need to draw up an
ordinance that would take care of such decisions in the future and Mr. Cozby said
he would get a copy of the ordinances from Lewisville, Carrollton and Irving for
the council to study.
Mr. Cozby stated that the city's fire contract ordinance with Dallas County was ·
up for its annual renewal. The contract provides $2500,00 for the city of Coppell
plus additional funds for making outside runs. Mr. Dobecka moved that the ordinance
be adopted. Mr. Wilson seconded the motion and the motion passed unanimously.
Mr. Cozby informed the council that th e Water & Sewer Digest magazine subscription
is due for renewal, Mr. McGiboney moved that the city renew the subscription for
three years for $15.00. Mr. Dobecka seconded the motion and the motion was passed
unanimously,
The council was informed that, through the city's error, the monthly $10.00 sewer
charge had not been added to Robinett's water bill for one month. After some
discussion, the council agreed that when the city neglected to bill the customer,
the customer should not be required to make a payment that month unless he . ·
volunteered to do so, thus extending the amount of time needed to pay the city in
full. Mr. Wilson moved that the person authorized to bill customers for anything
on a monthly basis carry this out according to the previous agreement. Mr.
.Dobecka seconded the motion and the motion was passed unanimously.
Mr. Cozby said that he had finally located Payton-Wright's bill for some $80.00
for repairs on the police car. Mr. Wilson moved that the bill be paid. Mr,
McGiboney seconded the motion and the motion was passed unanimously.
B,C. Gentry requested that the petty cash fund be replenished in the amount of
$24.94, Mr. Dobecka so moved, the motion was seconded and was passed unanimously.
Minutes of the March 2 meeting were read and approved.
Mr. Wilson moved that the council approve Mr. Roach's application for a mobile home
at his station. Mr. Dobecka seconded the motion and motion was passed
unanimously. Mr. McGiboney moved that Mr. Roach's permit be granted for a period
of one year from this date, March 16, 1970. Mr. Dobecka seconded the motion and
the motion was passed unanimously.
The .council discussed whether or not to pay for two manholes for the B. B. Parker
subdivision. Cost would be approximately ,$200.00 per manhole. Mr. Parker has
previously agreed to pay for running lines from the main to his property (including
Forgy and Malloy whom the city would pay for. Later when they tie on, they would
have to pay $50.00 plus a pro-rata share of the line from tlte curb to the sewer line).
Mr. McGiboney asked if an ordinance had not been drawn up subject to change and if
it dealt with the ,problem of manholes. Mr. Cozby told him the ordinance
had beenstarted but never rewritten. Mr. Wilson moved that the city pay
.the expense of running the sewer mains to Parker's property and require Parker
to pay for the manholes. Mr. McGiboney Seconded the motion and the motion
was passed unanimousIy.
Mr. Colby suggested that the city change its policy on sewer lines, In the
past, the customer has put up $100.00 for tying. on to the line and a $75.00
fee for work in the street, payable. to the city, The city then paid for the
work in the street with the expense varying according to whether the house
and the sewer mains were on the same side of the street. Mr. Wilson moved
that the city charge the property owner $100.00. for tapping the sewer main
and then have him pay his own expenses from his property to the main including
the tapping. Mr. McGiboney seconded the motion and the motion was passed
unanimously.'
The meeting was adjourned.
