CM 1972-04-07 COUNTY OF DALLAS STATE OF TEXAS The City Council of the City of Coppell met in a special called session on April 7, 1972, in the fire station. The following members were present: Hulen Scott, Mayor Wheelice Wilson, Mayor Pro Tern Bill Harris, Councilman Johnny Burns, Councilman Billy Harwell, Councilman Councilman James Henderson was not present. Also present was City Administrator Sam Little. Mayor Scott asked the Council if everyone was satisfied there was a quorum present. Councilman Wilson stated that he would like for the records to show that in his opinion there was not a quorum present for a special called meeting. Mayor Scott stated that since there has been no court ruling as yet as to the legality of the present Council, a quorum was present and if there was no objection, the meeting would proceed. No objection was voiced. The minutes of the two previous meetings were read. Councilman Harris moved that the minutes be approved. Burns seconded; motion carried 2 for, 0 against, 2 abstentions which were Councilmen Wilson and Harwell. The Mayor stated his approval. The first item was the approval of the bills. Councilman Wilson stated that he would not set on the Council to approve any bills except the election expenses necessary for approval before the new councilmen could be sworn in. Wilson moved that the expense for the election officials be approved. Harwell seconded; motion carried 4-0 with the ,--- Mayor stating his approval. Next the canvass of the election returns was held, a copy of which is attached to the minutes. Donald J. Carter, Samuel Lee Tiner, and Bobby E. Hefner were declared the new councilmen. These men were asked to come forward and they were sworn in with the official oaths of office. Councilman Carter moved that Bob Hefner be appointed the new mayor pro tern. Tiner seconded and motion carried 4-0 with the mayor stating his approval. The meeting was then closed to the public for an executive session. In this session, city policies were discussed. It was decided when there is a new chief of police appointed, he will be in total command of that department. It was decided an invocation will proceed all meetings. The meeting was then adjourned. Hulen Scott, Mayor ATTEST: Dorothy Timmons, Acting City Secretary ATTEST: Councilman THE STATE OF TEXAS COUNTY OF DALLAS CITY OF COPPELL CANVASS OF RETURNS AND DECLARATION OF RESULTS OF AN ELECTION HELD IN THE CITY OF COPPELL, TEXAS APRIL 1, 19 72 BE IT REMEMBERED THAT on this the 7th day of April, 1972, at a meeting of the City Council of the City of Coppell, Texas, a quorum being present, the meeting was called to order and the following business was transacted. Upon motion of Councilman Harris and seconded by Councilman Wilson , it was unanimously ordered that the City Council consider the official returns of an election held in the City on the above mentioned date, for the election of three City Councilmen for a two year term. WHEREUPON said official returns were opened, examined, canvassed and the results declared as follows: CANVASS OF RETURNS AND DECLARATION OF RESULTS WHEREAS, heretofore, the City Council of the City of Coppell, Texas, called an election to be held in the City on April 1, 1972, for the purpose of electing three City Councilmen for two year terms, commencing April, 1972, and caused notice thereof to be posted in the manner and for the time provided for by law, which Order, together with the Notice issued thereon, is recorded in the minutes of the City /~2 Council and is hereby referred to and made a part hereof for all purposes, and, WHEREAS, immediately after said election the Presiding Judge __. and other officials holding said election made their returns of the results thereof to the City Council as follows, and said returns being made according to law, and duly authenticated, and it being shown that written notice of said election was posted for the time and in the manner provided by law and all other proceedings pertaining to said election having been shown to have been done and performed at and within the time and in the manner provided by law, and all papers pertaining thereto having been returned and filed with the City Council and no protest or objection being made to or regarding any matter pertaining to said election: NOW, THEREFORE, Be it resolved by the City Council of ' the City of Coppell, Texas, after examining said returns and ~ opening and canvassing the votes of said election, that the results of said election are as follows: That the following number of votes were cast for the following named candidates for the office of City Councilman or Councilwoman for a two year term, to wit: NAME NO. OF VOTES Donald J. Carter 281/ Bobby E. Hefner 276 Melanie Nan Woolery 46 Michael B. Miller 192 ," Joseph c. Thweatt 163 Louie C. Bailey, Jr. 169 Samuel Lee Tiner 281 It appearing that Dondald J. Carter, Samuel Lee Tiner, and Bobby E. Hefner received the largest number of votes for the office of City Councilman / Councilwoman, for a two year term, and they are hereby declared to be elected to the office to serve after qualifying for the term commencing April, 1972. IT IS, FURTHER, ORDERED that this canvass and declaration of results of said election be entered in the minutes of the City Council and that said officers, after they have qualified and taken their oaths, shall during the term commencing April, 1972, and thereafter until their successors are duly elected and qualified. That this Resolution declaring the results of the election called for April 1, 1972, shall become effective immediately after its passage.
