CM 1972-05-30COUNTY OF DALLAS STATE OF TEXAS The City Council of the City of Coppell met in regular session on May 30, 1972, in the fire station. The following members were present: Hulen Scott, Mayor Bob Hefner, Mayor Pro Tern Bill Harris, Councilman James Henderson, Councilman Don Carter, Councilman Sam Tiner, Councilman Also present were City Administrator Sam Little, City Attorney Larry Jackson, City Engineer Derrell Johnson, City Financial Advisor Jerry Pierce, and representative from TRA, Buddy Lewis. The meeting was called to order and the audience asked to stand while Councilman Sam Tiner gave the invocation. The minutes of the previous meeting were read and the following correction noted: The mayor was authorized to sign the resolution for the repair of Lodge Road with the City agreeing to pay half the estimated cost of repair. Even though the City will pay their half of the cost, in actual fact, the company responsible for the damages to Lodge Road with pay the city' s share. Mayor pro tern Hefner moved that the minutes be approved as corrected. Councilman Tiner seconded; motion carried 4-0-1 with Councilman Henderson abstaining and the mayor showing his approval. The bills were presented for approval. Total from each department were as follows: Water Department $284.40 Police Department 19.78 General Government 104.49 Fire Department 204.87 The fire department bills include 18 jumpsuits which the firemen had originally intended to pay for themselves. Councilman Carter moved that the bills be approved, including the jumpsuits for the firemen that had passed the first aid course. Councilman Tiner seconded; motion carried 5-0 with the mayor stating his approval. Next, AlEverett of Lone Star Gas Company presented the gas rate increase requested by the gas company. After discussion on the subject, Councilman Carter moved that the rate increase be approved with the deletion of the paragraph starting with "Adjustments" and ending with "applicable to such bills". Councilman Tiner seconded; motion carried 4-1 with Councilman Henderson against and the mayor showing his approval. A resolution from the Lewisville City Council was presented for the City of Coppell to sign supporting Lewisville's resolution petitioning the Railroad Commission to investigate the financial position of Lone Star Gas Company. Councilman Carter moved that the mayor be authorized to sign this resolution. Councilman Henderson seconded; motion passed 4-1 with Mayor pro tem Hefner against and the mayor showing his approval. Next, Wheelice Wilson presented a petition to the Council signed by fifty citizens of the town requesting the Council to revoke the permit issued to Mrs. C. L. Plumlee to move her house onto Coppell Road for the following reasons: 1. The house would not conform to the area. Z. Because of its size and construction, it would be a potential fire hazard. 3. The old structure would lower the value of other properties in the area. 4. Because of its height, the power and telephone lines would have to be cut in order to move the huge structure. The Plumlee's attorney, Mr. Roy Davis, was present and stated to the Council that Mr. Plumlee had stated to him that the house would be put in good condition. After considerable discussion, Mr. Plumlee appeared before the Council and publicly stated that he would see that the house was put in good condition. Mayor pro tem Hefner then moved that with Mr. Plumlee's public statement, the Council leave the permit as issued on January 31. He further moved that the Plumlee's have 90 days to comply with all city regulations and codes and from the date that this is done, that they have 90 to 120 days to put the house in good condition and repair. At that time the Building Inspector and the City Council will inspect the house and will approve it if it conforms to and is equal to the environment of the surrounding area. The Council reserves the right to extend the time if conditions warrant. Councilman Harris seconded; motion carried 5-0 with the mayor showing his approval. Next, Buddy Lewis, representative from TRA stated that he had looked over the proposed contract with Dallas and he would answer any questions the Council might have concerning the city' s part in this contract. Since there were several items that were inconsistent, this item was tabled for two weeks and during that time, Mr. Lewis will talk with the city' s advisors and with the City of Dallas and bring back to the Council a more accurate draft of the contract. The next item to be considered was the budget revision for 1971-72. After looking the revision over and having the administrator's assurance that it met with his approval, Councilman Harris moved that the budget revision be accepted. Councilman Tiner seconded; motion carried 5-0 with the mayor showing his approval. A copy of the revision is attached to the minutes. The water and sewer tap fee resolution was next on the agenda. Councilman Carter moved that the resolution be adopted with the rates set out in the May 1, 1972, agenda, a copy of which is attached. Mayor pro tem Hefner seconded; motion carried 5-0 with the mayor showing his approval. Councilman Henderson moved that the consideration of termination of employment of the city attorney be tabled until next meeting; Councilman Harris seconded and motion carried 4-0-1 with Councilman Tiner abstaining and the mayor showing his approval. Mr. Little then gave a status report. He stated that there were several junk --'~ cars and vehicles around the city which are in violation of Ordinance #65 which sets up a procedure to take care of these vehicles. The Council indicated that these steps should be taken and followed through starting now. Mr. Little also is in the process of preparing a personnel policy booklet which he will submit to the council at a later date. Also the subdivision ordinance has been sent to the city' s advisors for their comments and will be submitted to the council for their review as soon as possible. The pro-rata ordinance will be set up at a later date as it will not be needed as soon as the subdivision ordinance. On the Bethel Road extension, the city administrator has received work from the Cotton Belt Railroad stating they would object to Route "A" which would go across their tracks at one point, and they stated they will be in touch with the city administrator to make an appointment to come before the City Council to discuss this subject. The meeting was then closed to the public for an executive session. In this session, the City Administrator's raise and the possibility of his moving to Coppell were discussed. Scott, Mayor Dorothy Timmons, Acting City Secretary # A RESOLUTION WHEREAS, THE ATTACHED "WATER TAP FEE" AND "SEWER TAP FEE" HAS BEEN PRESENTED TO THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, and WHEREAS, THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, DID DULY ADOPT THE ATTACHED "WATER TAP FEE" AND "SEWER TAP FEE" IN REGULAR SESSION ON MAY 1, 197Z; and, WHEREAS, the attached "Water Tap Fee" and "Sewer Tap Fee" was posted in City Hall for a period of two weeks and no objection was voiced on the adoption of the "Water Tap Fee" and "Sewer Tap Fee"; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Coppell, Texas, that the attached "Water Tap Fee" and "Sewer Tap Fee" is approved and made a part of the official minutes of the Council meetings of the City of Coppell, Texas, and the Mayor of the City of Coppell is hereby authorized to sign this re solution.
