OR 88-410 Provides adjustment & establishment of mutual boundary line with City of Lewisville
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 88410 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, PROVIDING FOR THE ADJUSTMENT AND ESTABLISHMENT OF A MUTUAL BOUNDARY LINE WITH THE CITY OF LEWISVILLE, PROVIDING FOR THE DISANNEXATION AND/OR WAIVING OF EXTRATERRITORIAL JURISDICTION OVER THE HEREINAFTER DESCRIBED AREA OF LAND; PROVIDING A SPECIAL CONDITION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it is the desire of the City of Coppell, Texas, to disannex and/or waive any and all extraterritorial jurisdiction it may have or claim in and to the hereinafter described area of ]and, so that the same may be annexed to and become part of the City of Lewisville; and WHEREAS, this ordinance is adopted in furtherance of an agreement between the City of Lewisville and the City of Coppell dated April 15, 1988, and approved by City Councils on April 26, 1988, and May 2, 1988, respectively, a copy of which is attached hereto as Exhibit "1" and incorporated herein for all purposes; and WHEREAS, this action is taken in accordance with paragraph 4 of said agreement; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the statements made in the preamble to this ordinance are hereby adopted and incorporated into this ordinance by reference for all purposes. SECTION 2. That upon the effective date of this ordinance the property lying north of the following boundary line (save and except that property described in Exhibit "3," which encompasses the property referenced in paragraph 4 and Exhibit "D" of Exhibit "1" attached hereto hereinafter called the "Exhibit 3 Property") be, and the same is hereby, disannexed and discontinued as a part of the City of Coppell to the extent to which it is now a part of the City of Coppell and/or, in the alternative, any and all extraterritorial jurisdiction the City of Coppell may have in and to said property be, and it is hereby, relinquished and waived for all purposes only in favor of the City of Lewisville, said boundary line being more particularly described in Exhibit "2" attached hereto and also shown on the map attached hereto as Exhibit "4", both made a part hereof for all purposes, subject to the special condition set out in the following sections hereof. SECTION 3. The disannexation and waiver of extraterritorial jurisdiction set out in Section 2 above is effective over said property described in Section 2 above, over which the City of Coppell has or may have jurisdiction under the provisions of Chapters 42 and 43, Vernon's Local Government Code of the State of Texas, and upon the effective date of this ordinance, the City of Coppell shall no longer have or exercise any right, jurisdiction, or control over the property described in Section 2 above and the boundary line described in Exhibit "2" and shown on Exhibit "4" hereof, save and except the "Exhibit 3 Property" described above, shall between its place of beginning and place of ending, be the jurisdictional boundary line between the two cities. It is noted that in the agreement (Exhibit "1") the City of Coppell has agreed to disannex and release to the City of Lewisville the "Exhibit 3 Property" on or before May 2, 1991, and thereafter, the boundary line described in Exhibit "2" and shown on Exhibit "4" shaH, between its place of beginning and place of ending, become the boundary line between the two cities with the "Exhibit 3 Property" released by Coppell to the City of Lewisville under the same provisions as the property described in Section 2 above is released to the City of Lewisville pursuant to this ordinance. SECTION 4. This ordinance is adopted for the purpose of carrying out the provisions of the agreement between the City of Coppell and the City of Lewisville which is attached hereto as Exhibit "1." It is recognized that paragraph 6 of said agreement establishes as an essential and necessary condition, the development of agreements between the City of Lewisville, the City of Coppel], Denton County Road Utility District No. 1, and Lomas & Nettleton, therefore, this ordinance shah become effective upon such agreements being fully executed by all parties and copies of said agreements made a part of this ordinance by ratification or amendment. SECTION 5. All ordinances or parts of ordinances inconsistent or in conflict herewith are hereby repealed. Box 278 Coppell, Texas 75a~9 RE: BOUNDARY SETTLEMENT ~/i~D D,= L."qi', ,__.~ Dear Mr. Ratliff: This letter is to reduce to writing the agreement between the City Council of the City of Coppe!! and the City Council of the City of Lewisvitie to settle the boundary dispute between Coppall and Lewisvilla. This agreement shall serve as the basis upon which final settlement documents containing necessary property descriptions will be prepared in connection with the settlement of said boundary and extraterritorial jurisdiction dispute which is the subject of litigation pending between the cities in Cause No. 87~ 2757-A, 16th Judicial District Court, Denton County, Texas. The term "agreed boundary line" as used herein shall mean that line described in Exhibit "A" and shown in blue on Exhibit "B", both Exhibits being attached hereto and made a part hereof. The "agreed boundary line", subject to the time schedule mentioned in paragraph ~ hereof, shall become the common boundary line of the corporate limits and/or extraterritorial jurisdiction between the two cities. This agreement is predicated upon the following conditions: 1. Parts of the "agreed boundary line" follow a right-of-way line of certain roads in the area including the southern right-of-way line of proposed S. H. 121. It is mutually agreed that all property owners owning property in one city, which is adjacent to the right-of-w~y line which marks the boundary of the other city, shall have reasonable egress and ingress to the roadways of the other city. it is agreed that property in the City of Coppei!, which shall be adjacent to the right-of-way of ~ street which is within the City of Lewisvi!!e, shell be governed by Coppel!'s rules and regu!a%inns for egress and ingress, or such rules and regulations of the City of Coppall as amended to require higher levels of safety and engineering standarcs. It is further agreed that Coppe!l's rules and regulations shall be amended to provide for: 2On-foot minimum distance offset for streets, lOG-foot minimum distance upstream offsets for driveways, and 75-foot minimum distance downstream offsets for ~riveways, per Exhibit 2. It is understood that certain thoroughfareS, roadways, and adjacent right-of-';ays thereto will be built in such a way that they are contiguous Exhibit 1 Page 1 Mr. Alan Ratliff April 15, 1988 Page 2 and adjacent to the agreed boundary line. It ia agreed that the city in which such thoroughfares, roadways, and adjacent right-of-ways thereto are constructed or located will maintain them at a level equal to or better than those thoroughfares, roadways, or right-of-ways which are located or to be constructed within the Lomas & Nettleton subdivision by the Road Utility District operating within said subdivision. 3- The City of Lewisville will provide the City of Coppoll with a proposal to furnish water and sewer service to the property north of Denton Creek on the basis of a contract between the two c~ties. The City of Lewisvi!le will furnish the City of Coppel! such proposal within 90 days from the date of execution of this agreement. Upon receipt of the proposal, the City of Coppell shall ascertain the most practical and economically feasible method of providing water and sewer to such land north of Denton Creek which will be in the City of Coppel!, and the City of Coppell will have an option for a period of one year following receipt of such proposal to accept the proposal of the City of Lewisville for such water and sewer service. The City of Lewisvi!le agrees to cooperate with the City of Coppell and permit Coppe!l to jointly use easements and street right-of-ways within the City of Lewisville to serve said property in the event the City of Coppoll elects to furnish service to said area. 4. Except for the area marked on Exhibit "D", all disannexation proceedings necessary to accompl:sh this division of corporate and extraterritorial jurisdiction between the two cities shall be accomplished within 60 days from the execution of this settlement agreement by both cities. It is agreed that the City of Coppoll may, beyond said 60-day period, retain within its corporate limits that property above the agreed boundary line which is shown on the plat attached hereto as Exhibit "D". The City of Coppe!l agrees that it shall disannex that property shown on Exhibit "D" on or before three years from the date of execution of this agreement by both cities. All disannexation proceedings necessary to ac~cmp!ish this division of corporate or extraterritorial jurisdiction between the two cities shall be made in favor of the other party city pursuant to the provisions of the ~unieipal Annexation Act of the State of Texas. 5. It is r~cognized that participation by the Denton County Road Utility District No. 1 may be required to complete the construction of certain roadways, bridges and thoroughfares which are of interest to either or both of the cities. Since this boundary agreement will place the Road Utility District within both cities, therefore requiring both cities to approve changes in the boundaries of the Road Utility District, it is agreed that neither city will oppose extensions or alterations of the Road Utility District boundaries when such changes occur strictly within the boundaries Exhibit 1 Page 2 Mr. Alan Ratliff April 18, 1988 Page 3 of the other city. It is agreed, therefore, that any future annexation by Denton County Road Utility District No. 1, will be solely at the option of the City in which the land to be annexed is located. 6. It is recognized that each city has an interest in certain north~ south thoroughfares, namely MacArthur Boulevard and Denton Tap Road. This interest extends to concern about these roads in each other's jurisdiction, as well as the city's own jurisdiction. For this reason, both cities agree to pursue, as below stated, the expeditious construction and/or improvement of these roads in as timely a manner as possible. In this regard, it is further agreed that: a. On or before the date of approval by the court of the formal agreement, a separate agreement shall be obtained between Denton County Road Utility District No. 1 and both cities, providing that the Road Utility District boundaries shall be amended to include an area west of Denton Tap Road and certain bridges, roads, and thoroughfares within this area and within the area generally north of Denton Creek which is presently within the Road Utility District, shall be constructed by and paid for by the Road Utility District or others at no cost or expense to either city, This specifically includes the widening of Denton Tap Road from the creek to the northern Road Utility District boundary as well as the bridges over Denton Creek for Denton Tap Road. b. On or before the date of the approval by the court of the formal agreement, a separate agreement will be obtained between the Road Utility District, Lomas& Nettleton, and the City of Coppe!l, providing that right-of-way and construction costs for building MacArthur Road from and including the bridges on Denton Creek south to existing MacArthur Boulevard will be paid for and constructed by Lomas& Nettleton or the Road Utility District, at no cost to either city. It is understood and agreed by both cities that obtaining the agreements mentioned in subsections a and b above constitute essential and nezessary conditions subsequent to this agreement. 7. That though not legally bound to do so by this agreement, the City of Coppoll, through its platting and development review process, will assist the City of Lewisvilla in obtaining utility easements needed to extend water and sewer transmission mains west of Denton Tap Road and the City of Coppe!l will cooperate with the City of Lewisrifle and permit Lewisvi!le to jointly use such easements and street right-of-ways for such purpose. Subject: Access Standards - Lewisvitle vs. Coppoll Per your request of March 3, 1988, we have reviewed the material submitted regarding the above referenced subject and offer the following comments. Overall, the City of Lewisville standards appear to be somewhat more stringent than those of the City of Coppoll. Both standards, however, are good functional standards consistent with other communities within the Dallas/Ft. Worth metroplex. All cities do differ to varying degrees from one another. The City of Lewisville stated concern over Coppell's minimum allowable driveway distance both "upstream and downstream" of an intersection and the offset street requirements. The following table denotes the two city's standards and our recommendation on these issues. CoDDell Lewisville Recommended Offset Streets 125' (min) 200' (min) 200' (min) Driveways: Upstream distance 50' (min) 150' (min) 100' (min) Downstream distance 50' (min) 75' (min) 75' (min) The reason we recommend a compromise on the upstream distance is because 50' really is too short a distance when considering lane stacking and !50' too long since the property on the corner would have to have as a minimum 200' of frontage, which may prohibit certain type developments on a corner that the City may want to consider.
