CM 1976-02-101;44 STATE OF TEXAS COUNTY OF DALLAS The City Council met in regular session on February 10, 1976 at 7:30 p.m., in the meet ing room at the First Bank of Coppell. The f ol lowlug members were present: Hulen Scott, Mayor Sam Tiner, Mayor Pro Tem Don Carter, Councilman Fred Baker, Councilman James Rainey, Councilman Hazel Beal, Councilwoman Also present was City Administrator George Campbell, City Attorney Larry Jackson, City Engineer Steve Harrison and City Secretary Margaret Johnson. The invocation was given by Councilman Carter. 76 -ZZ Councilman Baker made motion, seconded by Councilman Carter to waive the reading of the minutes of the January 27, 1976 meeting. Motion carried 4-0 with Councilman Rainey abstaining, and the mayor showing his approval. Mayor Pro Tem Tiner made motion, seconded by Councilman Carter, to approve the minutes of the previous meeting with the correction to minute order 76-15 to show the date that the rate increase from Lone Star Gas was filed was December 4, 1975, at 9:40 a.m. with the city secretary. Motion carried 4-0 with Councilman Rainey abstaining and the mayor showing his approval. ' 76-Z3 Councilwoman Beal gave a report on the Citizens' Advisory Committee and asked Council about the number of copies needed for the brochure that is being printed. The consensus was that approximately 3,000 copies should be sufficient. She also advised that she should have some facts on the North Texas Commission by next council meeting. 76 -Z4 County Commissioner Jim Jackson was present to discuss with Council the Bethel-Bettline Road extension. Each councilmember stated their Opinion in the discussion and County Commissioner Jackson advised that the county would spend $112,000 on the project which would include building a bridge over Grapevine Creek. The City's cost would be $20,000 which would be for one- half of materials only. Councilman Carter made motion, seconded by Council- man Rainey, to pass a Resolution to spend the money for this road. Motion carried 4-1 with Councilwoman Beal voting against, and the mayor showing his approval. Commissioner Jackson also mentioned that council might like to consider that Esters Road extension might be included in a future bond election in the county. 76 -25 Status of Sewer Grant Application and System Design was next and City Admin- istrator Campbell asked council to consider requesting Robert Kyle and Assoc. to stop work on the design of TRA line between our lift station and the TRA interceptor. Councilman Carter made motion, seconded by Mayor Pro Tem Tiner to write a letter to Kyle and Associates advising them to stop work on this design. Motion carried 5-0 with the mayor showing his approval. 76 City Attorney Jackson presented a Resolution to council concerning the compliance of the City of Coppell with the requirements of the Voting Rights Act Amendments of 1975, Public Law 94-73 and the Order calling for City Election to be held on April 3, 1975. Councilman Carter made motion to pass the Resolution as presented and Councilman Baker seconded. Motion carried 5-0 with the mayor showing his approval. Motion was made by Mayor Pro Tem Tiner to pass the Election Order, showing three to be the maximum number of Clerks to be appointed, Absentee voting hours to be 8 a.m. to 5 p.m. at the office of the city secretary and payment to election judge and alternate judge, as well as election clerks should be $2.00 per hour which are the maximum amounts set out in Article 3.08, Texas Election Code. Presiding judge would be paid an additional sum of $5.00 fo'r delivering the returns. Motion was seconded by Councilman Carter and motion carried 5-0 with the mayor showing his approval. Councilman Carter made motion, seconded by Councilman Rainey, to approve the agreement between the city and MUD for sewer services. Motion carried 5-0 with the mayor showing his approval. The new contract with the TRA would be effective on February 1, 1976. 76 -28 Councilman Carter reported on the MUD and advised that the audit was com- plete and came out fine with the cost of the construction as planned. He also advised that members of the MUD Board were working to get parties interested in Coppell. He also advised that he had talked to Mr. Wayne Claycomb of the Baptist Foundation concerning the site of the proposed water tower, . City Engineer Steve Harrison discussed with council the advantages of having TRA approach the Texas Water Development Board on financing the water towef. A meeting was being set up for TRA and the City to go to the Texas Water Development Board with this request for funding of bonds to build the water storage. Latest estimate on cost if $460,000 with engineering work to be completed at the latest by July 1976 and construction complete in approx- imately four months after that date. Mr. Charles Lambert was present to advise Council of his complaint on his gas bill. 76-29 There was no new business. Councilman Carter was excused at 8:55 p.m. 76-30 Councilman Baker made motion to approve the bills as presented, with staff to check on the billing from the electric company for service during October 1975 which was just received. Motion was seconded by Councilman Rainey and motion carried 4-0 with the mayor showing his approval. 76-31 Executive Session (Closed to the public) A. Article 6Z5Z~lT, Section Z (c) discussion with city attorney. 1 46 76 -3Z Motion was made by Councilman Baker, seconded by Councilman Rainey, to join the County on the injunction against Highland Oaks Trailer Park being a public nuisance and asking the Judge to enjoin Highland Oaks Trailer Park from dumping selvage in the creek and if they continued to do so would be in cornpernpt of court. Motion carried 4-0 with the mayor showing his approval. 76-33 Motion was made by Councilman Baker, seconded by Councilman Rainey to employ a new police patrolman under the County Grant. The new patrolman is Tommy R. Winn and he would begin work immediately. Motion carried 4-0 with the mayor showing his approval. Meeting then adjourned. Hulen A. Scott, Mayor ATTEST: Margaret V. Johnson, City Secretary ELECTION OF MUNICIPAL OFFICERS Coppell, Texas April 3, 1976 ELECTION ORDER BE IT REMEMBERED THAT ON THIS DAY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, ISSUED THE FOLLOWING ORDER: IT IS ORDERED that an election be held in the City of Coppell, Texas, on the 3rd day of April, 1976, the same being the first Saturday of said month, for the purpose of electing 3 City Councilmembers. The polling place for said election shall be the Police Annex Building at the City Hall. The polls shall be open from 7:00 A.M. to 7:00 P.M. The 3 candidates receiving the highest number of votes cast for Councilmember shall be elected for a 2-year term. None but legally qualified voters of the City shall be entitled to vote at said election. Notice of said election shall be posted in 3 public places within the limits of the City at least 30 days prior to the election day. A return of such posting shall be made by affidavit of the Secretary. A Presiding Election Judge and an Alternate Presiding Election Judge shall be appointed by written order of the Mayor, approved and signed by at least a majority of the members of the governing body of the municipality to serve at each polling place. The Presiding Judge for each polling place shall appoint 2 Election Clerks and as many additional Clerks as are necessary for the proper conduct of the election. Provided, however, 3 shall be the maximum number of Clerks which may be appointed to serve at any polling place. All Judges and Clerks shall be qualified voters in the City. The absentee voting for the above designated election shall be held at the regular office of the City Secretary at the City Hall Building, in said City, and said place of absentee voting shall remain open for at least 8 hours on each day of absentee voting which is not a Saturday, Sunday or an official State holiday, beginning on the 20th day and continuing through the 4th day preceding the date of said election. Said place of voting shall remain open between the hours of 8 o'clock a.m. and 5 o' clock p.m. After holding said election, the Election Judges shall promptly make their returns to the City Secretary and to the Mayor, and the Secretary shall thereafter present such returns to the City Council for the canvassing of said election.. The Presiding Election Judge shall be paid the sum of $2.00 per hour, plus an additional sum of $5.00 for his services in delivering the returns of the election. The Alternate Presiding Election Judge shall be paid the sum of $ 2.00 per hour and each Election Clerk shall be paid the sum of $ 2.00 per hour for their services in holding the election.
