The City Council of the City of Coppell met in regular session on April 13,
1976, at 7:30 p.m., in the meeting room at the First Bank of Coppell.
The following members were present:
Hulen Scott, Mayor
Sam Tiner, Mayor Pro Tem ~=~
Fred Baker, Councilnm.n
~ Don Carter, Councilman
James Rainey, Councilman
Hazel Beal, Councilwoman (arrivedat 8:15 P.M.)
Also present was City Administrator Campbell and City Secretary Margaret Johnson.
The invocation was given by Councilman Carter.

Councilman Baker made motion, seconded by Mayor Pro Tem Tiner, to waive the
reading of the minutes of March 23, 1976 meeting. Motion carried 4-0 with the
mayor showing his approval.
Councilman Rainey made motion, seconded by Mayor Pro Tem Tiner, to approve the
minutes of the previous meeting with no corrections. Motion carried 3-0 with
Councilman Carter abstaining.

Item 5, discussion with citizens regarding resurfacing of DeForest Road and water
well problems was considered next and Mrs. Andrew Grant was present. She advised
council about the condition of DeForest Road and the fact that it had been in bad
condition for a year and was causing residents on the road problems with their
cars and dust was getting all over plants and trees and asked when the road
would be resurfaced. She also advised Council about her water well, said the
water table would not come back up in a normal period of time and that she felt
that the pumps put at the lift station by the MUD might be responsible for this,
but she knew there was nothing the city could do about that. She did want to
advise council of this problem also. Mayor Scott was to confer with the County
on the time table for resurfacing DeForest Road and advise her.

Item 6, Discussion with citizens regarding requirements for moving a house into
the city, was next and Mr. and Mrs. Gary Dutt were present to ask that they be
allowed to move ahouse on to their property on DeForest Road. They had pictures,
a drawing of the house and some other documents for council to see.
At this point, a five minute recess was declared.
Meeting was called to order after the five minutes recess.
Councilman Carter made motion that Mr. and Mrs. Butt be allowed to move this
house in with the following conditions;
The house mover must first provide the City of Coppell with a
notarized letter stating they would make the following minimum
improvements: provide a pier and cap foundation, construct a
floor in the living room, replace damaged sheetrock in bedroom,
replace all broken windows and replace two outside doors and
screens, replace faulty or substandard sills, all to comply with
the City Building Code. The house mover would also furnish evidence
of insurance with the policy number and a house mover's bond.
In addition, the house mover must comply with Ordinance NO. 110, including the
payment of all fees.

The City Council would issue a building permit to the owner with these additional
requirements: sufficient improvement to the outside of the house within six months
of the date of issuance of the house moving permit, i.e. replacement of damaged
siding or painting, roofing materials replaced, trim, box cornice, underpinning
and sufficient structural repair must be made to the house on the inside within
one year of the date of issuance of the house moving permit to comply with all
other building code requirements. These requirements must be met before a
Certificate of Occupancy is issued and when such certificate is issued, the mobile
home must be moved to a licensed mobile home park or to a location outside the city.
All city permits and fees must be obtained by the owner. Mr. and Mrs. Dutt would
be given a letter stating these facts that had been agreed to this date, with Mrs.
Dutt to sign that she had received this letter. Motion was seconded by Councilman
Rainey and motion carried 5-0 with the mayor showing his approval.

Item 4, report from the Citizens 'Advisory Committee was next, as Councilwoman Beal
had arrived at 8:15 P.M. She advised that T. P. & L. had decided not to pay for
the printing of the brochure on Coppell and she was checking with Lone Star Gas
to see if they might do this, and would advise Council when she received an answer.

Canvass returns of April 3, 1976 Municipal Election and installation of Council
Members. Councilman RAiney made motion, seconded by Councilwoman Beal, that it
be unanimously ordered that the City Council consider the official returns of
this election held in the City on April 3, 1976, for the election for City Officers,
and that the official returns be approved. Motion carried 5-O with the mayor
showing his approval. Following the Canvass of the Returns, the following were
sworn in with the official Oaths of Office: Fred Baker, Donald J. Carter, and Sam
Tiner. A copy of the canvass of the returns and the oaths of office are attached
as a permanent part of these minutes.

Consider appointment of Mayor ProTem. Councilman Carter made motion that Sam
Tiner be appointed Mayor Pro Tem. Motion was seconded.by Councilman Rainey and.
motion carried 4-0 with Mayor Pro Tem Tiner abstaining.

Councilman Carter made motion that Council adopt a Resolution declaring Coppell's
support and participation in the American Bicentennial efforts. Motion was
secondedbyMayor Pro Tem Tiner and'motion carried 5-0 with the mayor showing his
approval.
Mayor Pro Tem Tiner then left the meeting at 8:50 P.M

Discuss and consider sending representative of the city on trip with other rep-
resentatives of the North Texas Commission. Motion was made by Councilman Carter,
seconded by Councilwoman Beal, to ask MUD to send a representative on.this tour.
Motion carried 4-0 with the mayor showing his approval.

Councilman Carter made motion, seconded by Councilman Rainey to appoint City
Administrator Campbell as the voting member to the North Central Texas. Council
of Governments. Motion carried 4-0 with the mayor showing his approval.

Other Old Business:
Report on the MUD: Mayor scott and City Administrator Campbell reported
on the MUD. They advised that the lift stations may not be finished by
May 10, 1976, as previously reported, that C & W Construction Company's
final bill had tentatively been approved.

Report on the Grant Application: City Administrator Campbell advised
that Tom Cullum, from EPA in Dallas had called about Robert Kyle and
Associates talking to him about the interceptor line he. had been working
on that is supposed to be taken over by TRA. Also that he would like to
wait until next Council meeting to discuss the Grant further when Mr.
Dan.Vance from TRA could be present.
Report on Water Storage Facilities: City Administrator Campbell advised
that Mr. Dan Vance with TRA, Mr. Boyd London, with First Southwest
Corporation and Mr. Steve Harrison, City Engineer, would be present at
the next Council Meeting to discuss the Water Storage Facilities.
Discussion concerning gas rates:LAfter much discussion, Councilman
Rainey made motion, seconded by Councilwoman Beal, to hire Mr. Joe
Nall of Nall and Associates, Consulting Engineers, to represent the
City of Coppell at the May 19, 1976 hearing before the Texas Railroad
Commission on the Full Rate Increase filed by Lone Star Gas Company.
Motion carried 2-1 with Councilman Baker voting against and Council-
man Carter abstaining due to the fact that he advised he would secure
a $2,000 donation to help pay the consultant fees and with the mayor
showing his approval.
Discussion concerning Dallas-Denton County boundary, Councilman Baker
made motion, seconded by Councilman Rainey, for the mayor to write a
letter to County Commissioner Jim Jackson asking him to get together
with the County Commissioner in Denton County and try to resolve the
boundary line between Dallas and. Denton County which has been disputed
for some time.and which needs to be resolved. Motion carried 4-0 with
the mayor showing his approval.

Other New Business: Councilman Baker asked that staff write a letter to the owner
of the property behind E-Z Way Grocery on Beltline Road and ask that this property
be cleaned up. Mayor Scott asked that the City Administrator and Police Chief make
a survey of all old junk cars in the City and advise owners that these cars must
be removed under Ordinance No. 123. City Administrator Campbell ,reported that he
had not been able to find out the status of the injunction against Highland Oaks
Trailer Park but would advise Council just as soon as he could. He also advised
that the Lesley property case had come to Municipal Court and that the Judge had
given Mr. Lesley another month, until May 6, 1976, to clean up the property and
if he had not by that time, he could be assessed up to the maximum fine for
Municipal Court. Councilman Rainey asked that the hole in the driveway in front of
the Fire Station be repaired. Councilman Carter asked if City Administrator
Campbell would check with the city attorney to see if council would have the
authority to enter into an agreement with a business who wishes to come to Coppell
for some sort of tax relief for up to five years, to be an incentive to get new
business in Coppell. Councilw.oman Beal advised that she had attended a meeting of
the Dallas County Community College District this date, which was to inform the
surrounding communities that another branch would be built in the Brookhaven area
and to show the design of the new buildings.
Councilman Baker asked that city administrator Campbell or Mayor Scott contact
Mayor Dan Mankin of Irving to see what could be done about cattle getting out onto
the road and becoming a traffic hazard on Beltline in the Irving City Limits.

Councilman Carter made motion, seconded by Councilman Baker to approve the bills
as presented. Motion carried 3-1 with Councilman Rainey abstaining and the mayor
showing his approval.

CANVASS OF RETURNS AND DECLARATION OF
RESULTS OF ELECTION
BE IT REMEMBERED THAT on this the 13th day of April,
1976 at a meeting of the City Council of the City of Coppell,
Texas, a quorum being present, the meeting was called to order
and the following business was transacted.
Upon motion of Councilmember James Rainey
and seconded by Councilmember Hazel Beal ,
it was unanimously ordered that the City Council consider the
official returns of an election held in the City on the above
mentioned date, for the election of City Officers.
WHEREUPON said official returns were opened, examined,
canvassed and the results declared as follows:
CANVASS OF RETURNS AND DECLARATION OF RESULTS
WHEREAS, heretofore, the City Council of the City of
Coppell, Texas, called an election to be' held in the City on
April 3, 1976 for the purpose of electing Three City Councilmembers
for terms of two years; and
WHEREAS, immediately after said election the Presiding
Judge and other officials holding said election made their returns
of the results thereof to the City Council as follows, and said
returns being made according to law, and duly authenticated, and
it being shown that written notice of said election was posted
for the time and in the manner provided by law and all other pro-
ceedings pertaining to said election having been shown to have
been done and performed at and within the time and in the manner
provided by law, and all papers pertaining thereto having been
returned and filed with the City Council and no protest or objec-
tion being made to or regarding any matter pertaining to said
election ;
NOW, THEREFORE, be it resolved by the City Council
of the City of Coppell, Texas, after examining said returns and
opening and canvassing the votes of said election, that the
results of said election are as follows:
That the following number of votes were cast for
the following named candidates for the office of Councilmember
for a two (2) year term, to-wit:

to be elected to said office to serve after qualifying for the
term commencing April, 1976.
IT IS, FURTHER ORDERED that this canvass and declaration
of results of said election be entered in the Minutes of the City
Council and that said officers, after they have qualified and taken
their oaths, shall serve during the term commencing April, 1976
and thereafter until their successors are duly elected and qualified.
That this Resolution declaring the results of the
election called for April 3, 1976 shall become effective imme-
diately after its passage.
DULY PASSED by the City Council of the City of
