OR 87-387 Declares a period of temporary water rationing AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 87387 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, DECLARING A "PERIOD OF TEMPORARY WATER RATIONING"; PROVIDING THAT SUCH "PERIOD OF WATER RATIONING" SHALL CONTINUE UNTIL PUBLIC ANNOUNCEMENT THROUGH NEWS RELEASE IS MADE BY THE OFFICE OF CITY MANAGER OF THE CITY OF COPPELL; MAKING IT UNLAWFUL FOR ANY PERSON, FIRM OR CORPORATION, DURING THE EFFECTIVE "PERIOD OF WATER RATIONING" TO USE WATER FROM THE CITY OF COPPELL WATERWORKS SYSTEM WHICH IS NOT IN COMPLIANCE WITH THE FOLLOWING WATER RATIONING SCHEDULE: While this ordinance in in effect, the following measures to ensure an adequate supply shah be implemented: i. Odd/Even Watering: Home and/or businesses with odd numbered street addresses may water on odd numbered days only. Homes and/or businesses with even numbered street addresses may water on even numbered days only. Watering shall be limited to three (3) hours per day. City and School District facilties shall also follow the above schedule. 2. Watering of landscaping in parkways and medians shah not exceed three (3) hours per day per water service. No watering on weekends between the hours of 12:00 a.m. Saturday and 11:59 p.m. Sunday evening. The odd/even watering method shah apply to the following: (a) Predominantly north/south streets may water on odd calendar days. (b) Predominantly east/west streets may water on even calendar days. 3. Where odd/even calendar days for residential homes and/or businesses fall during the weekend, watering between the hours of 12:00 a.m. Saturday and 11:59 p.m. Sunday evening for landscaping purposes shall be limited to the following two (2) time periods: (a) 1:00 a.m. to 4:00 a.m. (b) 11:00 a.m. to 2:00 p.m. 4. Where watering is necessary for retail and commercial purposes such as landscape nurseries, paragraph 3 above shah not apply, however, no more than nine (9) hours of watering per day shah be permitted. 5. Utility/paving construction projects may water during the week; however, such projects shall be limited to twenty thousand (20,000) gallons of water within any twenty-four (24) hour period and shah be prohibited from watering between 12:00 a.m. Sattu'day and 11:59 p.m. Sunday evening. PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. SECTION 2. DURATION OF PERIOD OF TEMPORARY WATER RATIONING The "period of temporary water rationing" shall continue as a temporary measure until public announcement is made through the office of the City Manager of the City of Coppert, Texas, at which time this ordinance shah no longer be effective. SECTION 3. WATER RATIONING MANDATORY During the effective "period of temporary water rationing," it shall be unlawful for any person, firm or corporation to use water from the Municipal Waterworks System which such use is not in accordance with the above mentioned schedule of water rationing. SECTION 4. REPEALING CLAUSE All ordinances, or parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed. SECTION 5. SEVERABILITY CLAUSE If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 6. PENALTY CLAUSE Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 7. EFFECTIVE DATE This ordinance shall take effect immediately from and after the publication of its caption, as the law in such cases provides.
