ORDINANCE NO. 87383
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ABANDONING AN UNUSED
STREET RIGHT-OF-WAY; PROVIDING THAT SUCH ABANDONMENT SHALL BE THE
INTEREST WHICH THE CITY MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING
THAT SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM DEED THAT MAY BE
RECORDED WITH THE COUNTY CLERK OF DALLAS COUNTY, TEXAS; AND FOR
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Coppell fines that the following
street right-of-way is no longer needed for public purposes; and
WHEREAS, the abutting property owner desires that said street right-of-way be
abandoned and in consideration thereof has dedicated to the City of Coppell, Texas,
additional right-of-way which is needecl by the city for public purposes;
WHEREAS, the City Council of the City of Coppell finds that said peoperty is
a naerow strip of land incapable of being used independently as zoned oF under applicable
subdivision or other development control ordinances and should be exchanged for such
other property to be dedicated by the abutting property owner, H. T. Ardinger,
NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1. The hereinafter described right-of-way for street and road purposes
is no longer needed or necessary for publie purposes and should be, and is hereby,
abandoned in favor of H, T, Ardinger, Jr,, the abutting property owner, The street
and road of right-of-way hereby abandoned is deseribed as follows:

RIGHT-OF-V~AY ABANDONMENT FOR
DENTON TAP ROAD
BEING a 0.352 acre tract of land situated in the Edward A. Crow Survey Abstract
No. 301 in the City of Coppoll, Dallas Counk-y, Texas and being a portion of the existing
right-of-way of Denton Tap Road (variable width right-of-way) and being more
particularly described as follows:
COMMENCING ar the most northerly northeast corner of a 12.69 acre tract of
land described in a deed to H. T. Ardinger, Jr. as recorded in Volume 80024 Page 0676
(DRDCT) and a 25 foot wide right-of-way dedication for Sandy Lake Road as described
in a deed recorded in Volume 85192, page 2324 (DRDCT) and being located in the original
south right-of-way line of Sandy Lake Road (85 foot wide) at the northwesterly corner
of a corner cut off line;
THENCE following the east line of said 12.69 acre tract of land and said 25 foot
wide right~of-way dedication with said corner cut off line South 44°49'40'' East a distance
of 35.30 feet to a two inch iron rod in concrete found for the easterly southeast corner
of said 25 foot wide right-of-way dedication and being the POINT OF BEGINNING of
the heroin described tract of land;
THENCE following a projected south line of said 25 foot wide right-of-way
dedication South 89°55'20" East a dLstance of 12.14 feet to a two inch iron rod in concrete
set for the northwesterly comer of a corner cut off line for the newly established west
right-of-way Iine of Denton Tap Road (120 foot wide) with the south right-of-way line
of Sandy Lake Road (II0 foot wide);
THENCE following said comer cut-off line South 46°02'12'' East a distance of
28.83 feet to a two inch iron rod in concrete set in the newly established west
right-of-way line of said Denton Tap Road;
THENCE following the newly established west right-of-way line of said Denton
Tap Road, being 120 feet west of and parallel to the existing east right-of-~vay line
as follows:
South 02°09'05" East a distance of 605.03 feet to a 5/8 lnch iron rod with
cap (PAWA-WlNK) set for corner;
South 02Q06'19" East a distance of 114.02 feet to a 5/8 inch iron rod with
cap (PAWA-WlNK) set for the point of intersection of the newly established
west right-of-way line with the existing west right-of-way line of said Denton
Tap Road and being located in the east line of a 21.004 acre tract of land
described in a deed to H.T. Ardinger, Jr. as recorded in Volume 80198 Page
3516 (DRDCT);
THENCE departing the newly established west right-of-way line of said Denton
Tap Road and following the existing west right-of-way line and as follows:
Following the east line of said 21.004 acre tract of land, North i0°19'00'' West
a distance of 28.52 feet to a 5/8 inch iron rod found for the beginning of
a curve to the right from which the radius point bears North 79°41'05'' East
a distance of 1,939.86 feet;
Continuing along the east lhte of said 21.004 acre tract of land and said
curve to the right, a passing arc length of 183.89 feet a 5/8 tnch iron found
for the northeast corner of said 21.004 acre tract of land and the southeast
corner of said 11.69 acre tract of land, continuing with the east 1Lne of said
11.69 acre tract of land through a central angle of i0°34'55'' for a total
arc length of 358.17 feet to a 5/8 inch iron rod found for the end of said
curve, said iron rod being the southeast corner of a 10 foot roadway cledication
for Denton Tap as described in a deed recorded in Volume 85192 Page 2314
(DRDCT);
THENCE departing the east line of said 12.69 acre tract of land and and following
the south line of said 10 foot roadway dedication, North 89°44'00" West a distance of
I0.00 feet to a5/8 inch iron rod found for the southwest corner of said 10 foot roadway
dedication;
THENCE following the west line of said 10 foot roadway dedication
North 00°16'00' East a distance of 339.0? feet to a two inch iron rod in concrete found
in a corner cut-off line at the intersection of the existing. south right-of-way line of
Sandy Lake Road with the existing west right-of-way line of said Denton Tap Road;
THENCE along said comer cut-off line, North 44°49'40' West a distance of 21.18
feet to the POINT O1~ BEGINNINGI
CONTAINING within these metes and bounds 0.351 acre or 15,329 square feet
of land, more or less.
SECTION 2. This abandonment ordinance shall constitute a Quitclaim Deed in
favor of H. To Ardinger, Jr., the abutting property owner, and a certified copy of the
same may be filed in the Deed Records of Dallas County, Texas, to indicate such
abandonment.
SECTION 3. The abandonment provided for herein shall extend only to the public
right, title and interest which the City of Coppell, Texas, may have in and to said
street right-of-way, and shall be construed to extend only to such interest that the
governing body of the City of Coppell, Texas, may legally and lawfully abandon.
SECTION 4. The fact that the above described street and road right-of-way is
no longer needed or necessary for public purposes, and that such street right-of-way
should be abandoned in favor of the abutting property owner or owners, creates an
urgency and an emergency in the preservation of the public health, safety and welfare,
and requires that this ordinance shall take effect immediately from and after its passage,
as the law in such cases provides.
