Notice is hereby given that the City Council of the City of Coppell, Texas will meet in Regular
Called Session at 5:30 p.m. for Executive Session, Work Session will follow immediately
thereafter, and Regular Session will begin at 7:30 p.m., to be held at Town Center, 255 E.
Parkway Boulevard, Coppell, Texas.
As authorized by Section 551.071(2) of the Texas Government Code, this meeting may be
convened into closed Executive Session for the purpose of seeking confidential legal advice
from the City Attorney on any agenda item listed herein.
As authorized by Section 551.127, of the Texas Government Code, one or more
Councilmembers or employees may attend this meeting remotely using videoconferencing
technology.
The City of Coppell reserves the right to reconvene, recess or realign the Work Session or

Reference: Presentation and discussion regarding Moore Road Boardwalk Project
2040: Implement Innovative Transportation Networks
Introduction:
The purpose of this agenda item is to provide an update on the Moore Road Boardwalk Project
(MRBP). Specifically, staff will provide an update on how the project originated and progressed
from its infancy in 2019 to present day. City Council will also be presented with what the next
steps are in order to move forward with the project.
Background:
Moore Road Park, which is located in a flood plain, is prone to rising water levels during large
rain events. Approximately ten years ago, the city was forced to remove the former wooden
boardwalk that existed in the park due to too many large rain events over the years. Shortly
thereafter, the citizens of Coppell presented strong community input and urged city leaders to
make bringing a new and improved boardwalk to the park a top priority.
In January 2019, a contract was executed between the City of Coppell and Halff & Associates
for the MRBP that included a design of an elevated boardwalk that could be engineered to
withstand large flooding events. In July 2019, Halff & Associates presented the City with a
preliminary finding report that provided details on boardwalk alignments as well as a preliminary
cost estimate of $1.03M. At the beginning of 2020, the boardwalk project was put on hold while
the City evaluated the impact of the proposed rules that would change how sales taxes were
collected in Texas.
In January of 2021, City Council provided direction to move forward with the design phase for
the MRBP. During the site survey element of the design, erosion concerns were identified along
the south shoreline of the pond at the park. At that time, estimates for this erosion work was
$160,000, which was to be funded via ARP, bringing the ARP allocation for MRBP to $1.260M.

In 2022, the design phase was completed for both the boardwalk and the erosion projects and the
City bid both components out as one bid advertisement. One bid, in the amount of
$1,952,477.31, was submitted by Rebcon, LLC. The cost drivers pushing this project over the
original construction estimate are directly related to the market and the rising costs for supplies
and materials. This situation has surfaced on other City projects and staff have sought more
information from various vendors and contractors. The current market is inflationary, with
rising costs for fuel, steel, concrete, and labor. Fifty-five percent of the Rebcon, LLC bid cost
rests in two bid items: installing the 486’ of concrete boardwalk and drilling 66 piers at depths
that range from 20’- 40'. An additional $300,000 of the bid is directly related to the Public
Works’ erosion control component. It shall be noted that this bid cost is taking into consideration
worst case scenario, and it is possible that if the piers don’t need to be driven down to a depth of
40’ this could result in savings for the City. Throughout the entire project the City has
continuously looked for ways to help with cost savings. In addition to combining the MRBP and
the erosion control components, the City also combined all three of its elevated boardwalk
projects (Asbury Manor, Magnolia, Moore Road) into one design process with Halff &
Associates.
Staff plans to bring this project back to City Council for award at the November 8, 2022,
meeting. Benefit to the Community: This project will improve the City’s parks and trail system at Moore
Road Park, promoting health and wellness, and satisfying a community desire for replacement of
this boardwalk.

The fiscal impact of this agenda item is $1,952,477.31 and these funds are currently available
through the American Recovery Plan Act (ARPA).

PROCLAMATION
WHEREAS, the Hanbok is the traditional attire of the Korean people; and
WHEREAS, the origin of the Hanbok can be traced back to 2333 B.C. when the legendary god-
king, Dangun, founded the first Korean kingdom, Gojoseon. Portraits of Dangun depict him dressed in a
garb resembling a Hanbok; and
WHEREAS, the Hanbok consists of three main components, the jeogiri (upper garment), baji
(pants) and chima (skirt) and was created during the early years of the Three Kingdoms of Korea period.
The purpose of the Hanbok was to represent beauty and to facilitate the ease of movement; and
WHEREAS, mural paintings dating back to the Three Kingdoms of Korea period show that there
was no distinct difference in men’s and women’s Hanbok; and
WHEREAS, the Hanbok has been a continuous part of traditional Korean culture, society, and
history for over two thousand years; and
WHEREAS, the Hanbok is representative of the important ancient traditions that benefit all of
society by demonstrating beauty, stability, and respect for our ancestors;
WHEREAS, in 1996 the Republic of Korea declared October 21st as Hanbok Day; and
WHEREAS, we celebrate the contributions of the Korean community since 1903, when the first
Korean immigrants arrived in Hawaii.
NOW THEREFORE, I, Wes Mays, Mayor of the City of Coppell, do hereby declare
October 21, 2022, as
“KOREAN HANBOK DAY”
and I urge all citizens to participate and celebrate the beauty of Korean culture.

PROCLAMATION
WHEREAS, Arbor Day, was first observed in 1872 with the planting of more
than a million trees in Nebraska; and
WHEREAS, 2022 is the 150th anniversary of the holiday and Arbor Day is now
observed throughout the nation and the world; and
WHEREAS, trees beautify our community, provide habitat for wildlife, and are a
source of joy and spiritual renewal wherever they are planted.
NOW, THEREFORE, I, Wes Mays, Mayor of the City of Coppell, do hereby
proclaim the month of November as
"ARBOR DAY CELEBRATION MONTH"
in the City of Coppell, and I urge all citizens to celebrate Arbor Day and support efforts
to protect our trees and woodlands, thereby promoting the well-being of the future

B.Consider approval of an Ordinance of the City Council of the City of
Coppell, Texas, by amending the Code of Ordinances, by amending
Chapter 6 “Business Regulations’, Article 6-15 ‘Temporary signs’ by
repealing Section 6-15-7 ‘Political signs and polling places’ in its entirety
and replacing it with a new Section 6-15-7 ‘Political signs and polling
places’, providing a severability clause; and providing an effective date;
and authorizing the Mayor to sign.

asking voters whether or not to reauthorize two propositions concerning the
allocation of sales and use taxes paid on goods and services purchased within
city limits. Reauthorization of the sales tax collection will NOT result in an
increase to the sales tax rate. Early voting for both Dallas and Denton Counties
begins Monday, October 24, 2022, and goes through November 4, 2022. For

Reference: Consider approval of a Resolution that denies Oncor Electric Delivery Company's requested
rate increase; and authorizing the Mayor to sign.
2040: Vision 2040 Foundation
Introduction:
The purpose of the Resolution is to deny the rate change application proposed by Oncor. Once the Resolution is
adopted, Oncor will have 30 days to appeal the decision to the Public Utility Commission of Texas where the
appeal will be consolidated with Oncor’s filing (i.e. PUC Docket No. 53601) currently pending at the
Commission.
On May 13, 2022, Oncor Electric Delivery Company LLC (“Oncor” or “Company”) filed an application with
cities retaining original jurisdiction seeking to increase system-wide transmission and distribution rates by about
$251 million or approximately 4.5% over present revenues. The Company asks the City to approve an 11.2%
increase in residential rates and a 1.6% increase in street lighting rates. The impact of this requested increase on
an average residential customer using 1,300 kWh/month would be about $6.02 per month.
In a prior City action, Oncor’s rate request was suspended from taking effect for 90 days, the fullest extent
permissible under the law. This time period has permitted the City, through its participation with the Steering
Committee of Cities Served by Oncor (“Steering Committee”), to determine that the proposed rate increase is
unreasonable. Consistent with the recommendations of the experts engaged by the Steering Committee, Oncor’s
request for a rate increase should be denied.
All cities with original jurisdiction will need to adopt the Resolution prior to October 30, 2022.
Benefit to the Community:
The benefit of denying the proposed rate increase by Oncor is that the City, via its consultant, can ensure that any
increases to consumer rates reflect reasonable and legally recoverable costs. These costs are ultimately passed
through to all end-user customers. The regulatory process to review Oncor’s requests typically results in a lower
increase than the company originally requested, which saves consumers money on the rates.

History of OCSC:
Under state law, city governments and the Texas Public Utility Commission share regulatory authority over
monopoly electric utilities. Cities typically band together in coalitions to exercise their portion of this shared
authority. The largest and most significant of these coalitions is the Steering Committee of Cities Served by
Oncor. Comprised of more than 140 cities in north and central Texas, the OCSC has spent decades protecting
ratepayer interests in complex and far-reaching regulatory proceedings.
The Steering Committee of Cities Served by Oncor (and its predecessor organization, the Steering Committee of
Cities Served by TXU Electric) has been representing the interests of electric consumers for more than two
decades. Formed in 1989 to provide cities a united front at the Public Utility Commission, the Steering Committee
over the years has helped save Texans more than $1 billion. The organization began its work with the
representation of consumers during the PUC’s regulatory review of construction costs of the Comanche Peak
Nuclear Plant. It later negotiated a sweeping deal with the North Texas electric utility relating to certain costs
associated with electric deregulation and has represented consumer interests in rate cases. The non-profit coalition
also represents the interests of municipalities and their citizens at the Electric Reliability Council of Texas, which
oversees the state’s power grid.

A RESOLUTION OF THE CITY OF COPPELL, TEXAS
FINDING THAT ONCOR ELECTRIC DELIVERY
COMPANY LLC’S (“ONCOR” OR “COMPANY”)
APPLICATION TO CHANGE RATES WITHIN THE CITY
SHOULD BE DENIED; FINDING THAT THE CITY’S
REASONABLE RATE CASE EXPENSES SHALL BE
REIMBURSED BY THE COMPANY; FINDING THAT THE
MEETING AT WHICH THIS RESOLUTION IS PASSED IS
OPEN TO THE PUBLIC AS REQUIRED BY LAW;
REQUIRING NOTICE OF THIS RESOLUTION TO THE
COMPANY AND LEGAL COUNSEL.
WHEREAS, the City of Coppell, Texas (“City”) is an electric utility customer of Oncor
Electric Delivery Company LLC (“Oncor” or “Company”), and a regulatory authority with an
interest in the rates and charges of Oncor; and
WHEREAS, the City is a member of the Steering Committee of Cities Served by Oncor
(“Steering Committee”), a coalition of similarly situated cities served by Oncor that have joined
together to efficiently and cost effectively review and respond to electric issues affecting rates
charged in Oncor’s service area; and
WHEREAS, on or about May 13, 2022, Oncor filed with the City an application to increase
system-wide transmission and distribution rates by $251 million or approximately 4.5% over
present revenues. The Company asks the City to approve an 11.2% increase in residential rates
and a 1.6% increase in street lighting rates; and
WHEREAS, the Steering Committee is coordinating its review of Oncor’s application and
working with the designated attorneys and consultants to resolve issues in the Company’s filing;
and
WHEREAS, through review of the application, the Steering Committee’s consultants
determined that Oncor’s proposed rates are excessive; and
WHEREAS, the Steering Committee’s members and attorneys recommend that members
deny the Application; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
COPPELL, TEXAS:
Section 1. That the rates proposed by Oncor to be recovered through its electric rates
charged to customers located within the City limits, are hereby found to be unreasonable and shall
be denied.

Section 2. That the Company shall continue to charge its existing rates to customers
within the City.
Section 3. That the City’s reasonable rate case expenses shall be reimbursed in full by
Oncor within 30 days of the adoption of this Resolution.
Section 4. That it is hereby officially found and determined that the meeting at which
this Resolution is passed is open to the public as required by law and the public notice of the time,
place, and purpose of said meeting was given as required.
Section 5. That a copy of this Resolution shall be sent to Oncor, Care of Howard
