OR 87-379 Prohibiting parking of trucks & other motor vehicles AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 87379 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL BY ADDING THERETO A NEW SECTION PROHIBITING PARKING OF TRUCKS AND OTHER MOTOR VEHICLES WITHIN THE PARKWAY AREA OF ANY PUBLIC ROADWAY, HIGHWAY OR STREET WITHIN THE CITY; DEFINING THE TERM PARKWAY AREA TO MEAN THAT AREA BETWEEN THE PROPERTY LINE AND THE PAVED OR DRIVING PORTION OF THE ROADWAY, WHETHER OR NOT AN ALLEY OR OTHER PUBLIC PROPERTY INTERVENES; PROVIDING AN EXCEPTION FOR VEHICLES IN AN EMERGENCY SITUATION; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. ADDING NEW SECTION 8-3-4 TO CHAPTER 8 OF THE CITY CODE Chapter 8 of the Code of Ordinances of the City of Coppell is hereby amended by adding thereto a new Section 8-3-4 to read as follows: "Section 8-3-4 PARKING PROHIBITED ON PARKWAYS A. It shall be unlawful and an offense for any person to park or leave standing a truck or other motor vehicle upon any parkway area within the city, provided however, this section shall not apply to motor vehicles in an emergency situation in which such parking or standing of a motor vehicle was urgent and necessary. B. For the purpose of this section, the term "parkway area" is defined as that area between the property line and the paved or driving portion of any public roadway, highway or street, whether or not an alley or other public property intervenes. C. In addition to any penalty provided in this code or by any other ordinance or statute, the city shall have the right, under the police powers granted, to remove and impound at the owner's expense any vehicle left unattended in any parkway within the city. No liability shall exist upon the part of the city for any loss, damage or inconvenience to the owner by reason of such removal of such vehicle." SECTION 2. REPEALING CLAUSE All ordinances, or parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed. SECTION 3. SEVERABILITY CLAUSE If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional SECTION 4. PENALTY CLAUSE Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 5. EFFECTIVE DATE This ordinance shah take effect immediately from and after the publication of its caption, as the law in such cases provides.
