Notice is hereby given that the City Council of the City of Coppell, Texas will meet in Regular
Called Session at 5:30 p.m. for Executive Session, Work Session will follow immediately
thereafter, and Regular Session will begin at 7:30 p.m., to be held at Town Center, 255 E.
Parkway Boulevard, Coppell, Texas.
As authorized by Section 551.071(2) of the Texas Government Code, this meeting may be
convened into closed Executive Session for the purpose of seeking confidential legal advice
from the City Attorney on any agenda item listed herein.
As authorized by Section 551.127, of the Texas Government Code, one or more
Councilmembers or employees may attend this meeting remotely using videoconferencing
technology.
The City of Coppell reserves the right to reconvene, recess or realign the Work Session or
called Executive Session or order of business at any time prior to adjournment.

Reference: Five-Year Forecast Discussion
Introduction:
The purpose of this agenda item is to provide City Council with an overview of the Five-Year
Forecast. The Five-Year Forecast is more informal than the Budget document. Its purpose is that
of an internal tool used by staff to identify where and what strategies to consider for future planning
purposes. As an informal planning tool, no action to approve the Five-Year Forecast is necessary.
Analysis:
The Five-Year Forecast is an internal tool used by staff to identify where and what strategies to
consider for future planning purposes. The document also communicates to Council, citizens, and
other interested parties the City’s long-range planning. The document intends to educate readers on
the City’s future activities and is used to communicate the story about how the City will incorporate
citizen engagement from the Vison 2040 strategic plan into the City’s future operations and
financial decision- making.
Along with the purpose of preparing the Five-Year Forecast, this evening’s presentation will also
include:
- an overview of the document.
- the process and approach used to create the document.
- a high-level overview of what is included, as well as various assumptions used to project
revenues and various expenditures.
Legal Review:
N/A
Fiscal Impact:
While there are some items included in the Five Year Forecast that are ultimately included in
upcoming fiscal year budgets (specifically around items listed in FY24 of the Plan), the plan itself
has no fiscal impact.
Recommendation:
No action is required.

Reference: Discussion regarding the approval of the proposed adoption of the 2023 National
Electrical Code
2040: Sustainable Government
Introduction:
The purpose of this agenda item is to update the City of Coppell Electrical Ordinance through
adoption of the most current version of the National Electrical Code. The verbiage of the Electrical
Ordinance is also proposed to be updated.
Background:
The State of Texas adopts the latest version of the National Electrical Code during that code’s
cycle-year. The State adopted the 2020 National Electrical Code in 2020. The City is currently on
the 2014 version of the Code.
Benefit to the Community:
Through adoption of the most current version of the National Electrical Code, the City will be on
the same edition as the State once the adoption process is complete in September.
Legal Review:
This has been reviewed and recommended for approval by the Board of Adjustment on
December 8, 2022.
Fiscal Impact:
This has a minimal fiscal impact, as there are only minor budgeted expenses for new code books
and training.
Recommendation:
The Building Inspections division is recommending approval of the adoption of the 2023 National
Electric Code as the City of Coppell Electrical Code.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS AMENDING
THE CODE OF ORDINANCES BY AMENDING CHAPTER 15 ARTICLE 15-2
TO ADOPT THE NATIONAL ELECTRICAL CODE, 2023 EDITION, AS THE
CITY OF COPPELL ELECTRICAL CODE; PROVIDING AMENDMENTS TO
THE NATIONAL ELECTRICAL CODE, 2023 EDITION AND
ADMINISTRATIVE PROVISIONS; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING A PENALTY FOR VIOLATION OF THIS
ORDINANCE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS
($500.00) FOR EACH OFFENSE; EXCEPT HOWEVER, WHERE A
DIFFERENT PENALTY HAS BEEN ESTABLISHED BY STATE LAW FOR
SUCH OFFENSE WHICH IS A VIOLATION OF ANY PROVISION OF LAW
THAT GOVERNS FIRE SAFETY, ZONING, OR PUBLIC HEALTH AND
SANITATION, INCLUDING DUMPING OF REFUSE, THE PENALTY SHALL
BE A FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS
($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
SECTION 1. That the City of Coppell Code of Ordinances be, and the same is, hereby amended
by amending Chapter 15, Article 15-2, in part to adopt the National Electrical Code, 2023 Edition
as it existed on October 3, 2022, with amendments to read as follows:
CHAPTER 15-2. NATIONAL ELECTRICAL CODE
Sec. 15-2-1. National Electrical Code -Adopted.
There is hereby adopted by the City of Coppell, Texas, the National Electrical Code, 2023
Edition, and made a part hereof for all purposes, the same as if fully copied in full herein, with
the exception of such sections hereof, which are hereafter deleted, modified or amended.
Sec. 15-2-2. Amendments:
The following sections of the National Electrical Code, 2023 Edition, and administrative
provisions for the National Electrical Code, 2023 edition, are hereby amended to read as follows:

1. Article 90.4 Enforcement add the sections B, though I to read as follows:
(A) Enforcement. Existing language to remain
(B) Supervision of Work. In the actual work of installing, maintaining, altering, or
repairing any electrical conductors or equipment for which requires a permit,
apprentice electricians must have on-site supervision (as defined by Texas
Administrative Code, Title 16, Chapter 73, Subsection 73.10) provided by a TDLR-
issued journeyman or master electrician license holder.
(C) Powers and Duties of building official.
1. General. The Chief Building Official and designee are hereby authorized to
enforce all the provisions of this Code. They shall cause a record to be kept of all
permits issued and inspections made.
2. Deputies. In accordance with prescribed procedures and with the approval of the
appointing authority, the Chief Building Official may appoint designees as their
deputies with powers and duties as designated by the Chief Building Official.
3. Reference to Inspector/Electrical Inspector. References to "Inspector" and
"Electrical Inspector" in this Code shall mean the Chief Building Official or
designee authorized to perform inspections.
4. Right of entry. Where it is necessary to make an inspection to enforce the
provisions of this code, or where the Chief Building Official has reasonable cause to
believe that there exists in a structure or upon a premises a condition that is contrary
to or in violation of this code that makes the structure or premises unsafe, dangerous
or hazardous, the Chief Building Official or designee is authorized to enter the
structure or premises at reasonable times to inspect or to perform the duties imposed
by this code, provided that if such structure or premises be occupied that credentials
be presented to the occupant and entry requested. If such structure or premises is
unoccupied, the Chief Building Official or designee shall first make a reasonable
effort to locate the owner or other person having charge or control of the structure or
premises and request entry. If entry is refused, the Chief Building Official or
designee shall have recourse to the remedies provided by law to secure entry.
5. Notice. When any order or notice is issued pursuant to the provisions of this
Code to any person who cannot be found after a reasonable search, such order or

notice may be served by posting it in a conspicuous place upon the premises
occupied by that person or upon the premises where the defects are alleged to
exist. Such posting of the notice shall be considered equivalent to personal
service of such order or notice. An order sent by mail in a sealed envelope with
postage prepaid and directed to the address of the contractor, owner, lessee, or
occupant of the premises shall be equivalent to personal service of such order.
The Chief Building Official and their designees are hereby empowered to attach
to the nearest electrical cabinet or equipment feeding defective or hazardous
wiring, any official notice or seal to prevent use of electricity in that area, and it
shall be unlawful for any other person to place or attach such seal, or to break,
change, destroy, tear, mutilate, cover or otherwise deface or injure any such
official notice or seal posted by the Chief Building Official or their designee.
6. Stop Work Orders. Whenever any work is being done contrary to the provisions
of this Code, the Chief Building Official may order the work stopped by notice in
writing served on any persons engaged in the doing or causing such work to be
done, and any such persons shall forthwith stop such work until authorized by
the Chief Building Official to proceed with the work.
7. Authority to disconnect utilities in emergencies. The Chief Building Official
or their designee shall have the authority to disconnect any electric power or
energy service supplied to the building, structure or building service equipment
therein regulated by this Code in case of emergency where necessary to eliminate
an immediate hazard to life or property, or, where there is a violation of the
temporary electric connection per section 85-6(b). The Chief Building Official
or their designee shall, whenever possible, notify the serving utility, the owner
and occupant of the building, structure or building service equipment, in writing,
of such disconnection immediately thereafter.
8. Authority to condemn electrical system and equipment. Whenever the Chief
Building Official or designee ascertains that any electrical system or equipment
regulated in this code has become hazardous to life, health or property, they may
order in writing that such electrical system or equipment either be removed or
restored to a safe condition, whichever is appropriate. The written notice itself

shall fix a time limit for compliance with such order. No person shall use or
maintain defective electrical system or equipment after receiving such notice.
When such equipment or installation is to be disconnected, a written notice of
such disconnection and causes therefore shall be given within 24 hours of the
order to disconnect to the serving utility, the owner and occupant of such
building, structure or premises. When any electrical system or equipment is
maintained in violation of this code and in violation of any notice issued
pursuant to the provisions of this section, the Chief Building Official or designee
shall institute any appropriate action to prevent, restrain, correct, or abate the
violation.
9. Connection after order to disconnect. No person shall make connections from
any energy or power supply nor supply power to any electrical system or
equipment which has been disconnected or ordered to be disconnected by the
Chief Building Official or designee; the use of which has been ordered to be
discontinued until the Chief Building Official or designee authorizes the
reconnection and use of such electrical system or equipment.
10. Liability. The Chief Building Official and their designees charged with the
enforcement of this code, acting in good faith and without malice in the
discharge of his duties, shall not thereby render themselves personally liable for
any damage that may accrue to persons or property as a result of any act or by
reason of any act or omission in the discharge of their duties. Any suit brought
against the Chief Building Official or their designees because of such act or
omission performed by them in the enforcement of any provision of this code
shall be defended by legal counsel provided by this jurisdiction until final
termination of such proceedings. This code shall not be construed to relieve
from or lessen the responsibility of any person owning, operating, or controlling
any building, structure or building service equipment therein for any damages to
persons or property caused by defects, nor shall the code enforcement agency or
its parent jurisdiction be held as assuming any such liability by reason of the
inspections authorized by the code or approvals issued under this code.

11. Appeals. Any person, firm, or corporation may file an appeal through the
Building Inspections department for the Board of Adjustment to review any
decision of the Chief Building Official, provided that such appeal is made in
writing within (5) days of receiving the notification by the Chief Building
Official or their designee. The Board of Adjustment shall meet within a
reasonable time following receipt of such appeal to hear the appeal and render a
decision and findings in writing to the appellant with a duplicate copy to the
Chief Building Official or designee.
(D) Electrical License and Registration.
1. Registration required. It shall be unlawful for any person, firm, or corporation
who is not registered as a qualified electrician in the City of Coppell to engage in
work regulated by this code. Prior to the approval of any permit to do work
regulated by this code, the applicant for such permit must first register with the
Building Inspection Department.
2. Application for Registration. A person, firm, or corporation who desires to
register as an electrician in the City of Coppell shall complete the appropriate
application and provide the following information:
(a) A current master electrician or master sign electrician license issued by the
TDLR (Texas Department of Licensing and Regulation).
(b) A form of picture identification.
(c) Business identification to include the business name, business owner(s),
address, and telephone number.
(d) Copy of liability insurance (minimum of $1 million coverage).
3. Issuance and Term of Registration. Upon satisfactory completion of the
requirements and payment of applicable fees as specified by the City of Coppell
Master Fee Schedule for registration as an electrician, as classified, the chief
building official may approve such registration. An approved registration is valid
for a period of not more than one (1) year and shall terminate at the end of each
calendar year.

4. Transfer of registration. It shall be unlawful for any person, firm, or corporation
to lend, rent, or transfer an electrical contractor registration issued by the City of
Coppell to another person firm, or corporation for any purpose.
5. Revocation of registration. An electrical registration issued by the City of
Coppell may be revoked by the Chief Building Official for the following:
(a) Falsification of any portion of an application for registration with intent to
defraud.
(b) Any person, firm, or corporation who, after being found guilty in municipal
court of violations of this code, is unwilling to make appropriate
corrections to the satisfaction of the Chief Building Official or his
designee.
(c) Threatening or abusive behavior to City staff or City representatives.
(d) Notice of revocation of electrical registration. The Chief Building Official
or designee shall provide proper notice in writing to the person, firm or
corporation holding a revoked electrical contractor registration. Notice
shall be deemed effective on the post date of certified mail.
(e) Appeal of revocation. In the event that any person, firm, or corporation
shall appeal the decision of the Chief Building Official or designee to
revoke an electrical registration, a request for a public hearing of the
matter shall be made in writing to the Chairman of the Building and
Standards Commission within five (5) days of receipt of notice of
revocation. The Building and Standards Commission shall meet to
consider an appeal of revocation within a reasonable time of receipt of a
written request.
6. False Representation as to Registration Unlawful. It shall be unlawful for any
person, firm, or corporation to represent themself or a business as an electrician
or electrical contractor in the City of Coppell without having first properly
registered with the Building Inspection Department.
7. Electrical Company Vehicles to Be Marked. All electrical contractors’
vehicles engaged in doing work in the City of Coppell shall have signs

permanently affixed to both sides of the vehicle indicating the company name of
the electrical contractor.
8. Supervision. The actual work of installing, maintaining, altering, or repairing of
electrical work for which a permit is required by this Code shall have supervision
by a licensed master or journeyman electrician as provided by this Code. In the
event the owner of electrical contracting business is not a licensed master
electrician, their master electrician of record shall be the person responsible for,
and supervising, the electrical work done. Should such supervision not be
constantly provided, the Chief Building Official or their designee may order the
work being done by such electrical contractor to be removed and replaced under
the proper supervision.
9. License display. Each holder of a master, journeyman or specialist license shall
carry evidence of proper license on their person at all times while doing electrical
work, and shall produce and exhibit same when requested by any officer of the
City.
10. Exception from Licensing and Registration.
Persons who are not registered electricians may carry out the following classes
of work:
(a) The installation, alteration, or repairing of any wiring, devices, or equipment
for signaling, remote control, or the transmission of information, provided
such are inherently power limited and have a maximum nameplate rating not
exceeding one volt- ampere.
(b) Electrical work done by a property owner in a building owned and occupied
by them is thereby classified as their homestead. Where the electrical work
done by property owner is deemed by the Chief Building Official or
designee to be hazardous to persons or property, and the repair thereof is
beyond the skills and electrical knowledge of the property owner as deemed
by the Chief Building Official or designee, the Chief Building Official may
void the permit and/or registration obtained by the homeowner. In such an
event, the electrical work shall only be completed by a licensed electrical
contractor, registered with the City of Coppell, through a new permit.

(c) Application for permit. To obtain a permit, the applicant shall first file an
application with the Building Inspection Department for that purpose.
11. Plans and specifications. With each application for a permit, and where
required by the Chief Building Official or designee for enforcement of any
provision of this Code, plans, specifications, and calculations shall be submitted.
When deemed necessary to ensure code compliance, the Chief Building Official
or designee may require plans and specifications to be prepared and designed by
an engineer licensed by the State of Texas.
12. Information on plans and specifications. Plans and specifications shall be
drawn to scale and shall be of sufficient clarity to indicate the location, nature
and extent of the work proposed and show in detail that it will conform to the
provisions of this code and all relevant laws, ordinances, rules, and regulations.
13. Permits issuance. After all review requirements have been met and have been
approved by the Chief Building Official or their designee, and the fees specified
by the City of Coppell Master Fee Schedule for the proposed scope of work have
been paid, the Chief Building Official or designee may issue the permit to the
applicant. When the Chief Building Official or designee issues the permit where
plans are required, they shall endorse in writing or stamp the plans and
specifications as stated in the currently adopted edition of the International
Building Code. Such approved plans and specifications shall not be changed,
modified, or altered, and all work shall be done in accordance with the approved
plans. Any deviations from the city-stamped plans must be submitted to and
approved by the City prior to execution of the changes in field.
14. Validity of permit. The issuance of a permit or approval of plans and
specifications shall not be construed to be a permit for, or an approval of, any
violation of any of the provisions of this code, or of any other ordinance of the
City, nor shall the issuance of a permit or approval of plans be construed as
representing or warranting the safety or lack of defects of any electrical work
described therein. No permit presuming to give authority to violate or cancel the
provisions of these Codes shall be valid. The issuance of a permit based upon
plans, specifications, and other data shall not prevent the Chief Building Official

or designee from thereafter requiring the correction of errors in said plans,
specifications, and other data, or from preventing building operations being
carried on thereunder when in violation of these codes or of any other ordinances
of the City. Work on a property may not commence until the issued permit is
posted in a conspicuous location visible from the main street that the structure or
property is addressed from.
15. Expiration. Every permit issued shall become invalid unless the work on the site
authorized by such permit is commenced within 180 days after its issuance, or if the
work authorized on the site by such permit is suspended or abandoned for a period
of 180 days after the time the work is commenced. The Chief Building Official is
authorized to grant, in writing, one or more extensions of time, for periods not more
than 180 days each. The extension shall be requested in writing and justifiable cause
demonstrated.
16. Suspension or revocation. The Chief Building Official or designee may, in
writing, suspend or revoke a permit issued under the provisions of this code
whenever the permit is issued in error or on the basis of incorrect information
supplied, or in violation of any ordinance or regulation of the City.
17. Fees. Permit fees shall be levied in the amounts specified by the City of Coppell,
Master Fee Schedule approved by city council.
(E) Inspections.
1. General. All electrical systems and equipment for which a permit is required by
this code shall be subject to inspection by the Chief Building Official or designee.
No portion of any electrical system intended to be concealed shall be concealed
until inspected and approved. The Chief Building Official, their designee, nor the
City shall be liable for expense entailed in the removal or replacement of any
material necessary to allow inspection. When the installation of an electrical
system and equipment is complete, an additional and final inspection shall be
made. Electrical systems and equipment regulated by this code shall not be
connected to the energy source until authorized by the Chief Building Official or
designee.

2. Inspection requests. It shall be the duty of the permit holder to request the scope
of work to be inspected through the appropriate process. Every request for
inspection must be filed at least one working day before such inspection is
desired. It shall be the duty of the permit holder to provide access to and means
for proper inspection of such work.
3. Other inspections. In addition to the inspections required by this code, the
Chief Building Official or designee may make or require other inspections of any
work to ascertain compliance with the provisions of this Code and other laws
which are enforced by the Code enforcement agency.
4. Reinspections. A reinspection fee may be assessed for each inspection or
reinspection when such portion of work for which inspection is called is not
complete or when required corrections are not made. This provision is not to be
interpreted as requiring reinspection fees the first time a job is rejected for
failure to comply with the requirements of this code, but as controlling the
practice of calling for inspections before the job is ready for such inspection or
reinspection or when required corrections are not made. Reinspection fees may
be assessed when the approved plans are not readily available to the Inspector,
for failure to provide access on the date for which inspection is requested, or for
deviating from the city-approved plans. In instances where reinspection fees
have been assessed, no additional inspection of the work will be performed until
the required fees have been paid.
(F) Service Connections.
1. Connection approval. An electrical system or equipment regulated by this code
for which a permit is required shall not be connected to a source of energy or
power until approved by the Chief Building Official or designee.
2. Temporary connections. The Chief Building Official or designee may authorize
the temporary connection of the electrical system or equipment to the source of
energy or power for the purpose of testing the equipment, or for the use under a
temporary Certificate of Occupancy.
3. Authorized connection. When new electrical meters are installed or existing
electrical meters are to be relocated, the disconnection, connection or

reconnection to the meter shall be made only by authorized employees of the
utility purveyor.
(G) Violations.
It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge,
alter, repair, move, improve, remove, convert, demolish, equip, use or maintain any
electrical system or equipment or cause or permit the same to be done in violation of
this Code.
The issuance or granting of a permit or approval of plans and specifications or the
completion or approval of an inspection shall not be deemed or construed to be a
permit for, or an approval of, any violation of any of the provisions of this Code. No
permit presuming to give authority to violate or cancel the provisions of this Code
shall be valid, except insofar as the work or use which is authorized is lawful.
2. Article 100, Part I definitions shall be added or amended to read as follows:
Definitions.
Board of Adjustment. The Board of Adjustment shall be as appointed by the City
Council of the City of Coppell.
Building Code is the International Building Code, as adopted by the City of Coppell.
Chief Building Official (building official) is the officer charged with the administration
and enforcement of this Code, or his duly authorized representative, and is the authority
having jurisdiction for this Code.
Code Enforcement Agency is the department, division or agency of the City of Coppell
charged with the function of Code Enforcement and shall be under the administration
and operational control of the building official.
Engineering Supervision: Supervision by a Qualified State of Texas Licensed
Professional Engineer engaged primarily in the design or maintenance of electrical
installations.
Electrical Code is the National Electrical Code, 2023 edition promulgated by the National
Fire Protection Association, as adopted by the City of Coppell.

SECTION 2. If any section, subsection, paragraph, sentence, phrase or work in this ordinance,
or application thereof to any person or circumstance is held invalid by any court of competent
jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance,
and the City Council of the City of Coppell, Texas hereby declares it would have enacted such
remaining portions despite any such invalidity.
SECTION 3. That the repeal of any ordinance or any portion thereof by the preceding sections
shall not affect or impair any act done or right vested or accrued or any proceeding, suit or
prosecution had or commenced in any cause before such repeal shall take effect; but every such act
done, or right vested or accrued, or proceedings, suit or prosecution had or commenced shall
remain in full force and effect to all intents or purposes as if such ordinance or part thereof so
repealed shall remain in force.
SECTION 4. That any person, firm or corporation violating any of the provisions of this
ordinance or the Code of Ordinances as amended hereby, shall be guilty of a misdemeanor and
upon conviction in the Municipal Court of the City of Coppell, Texas, shall be subject to a fine
not to exceed the sum of Five Hundred Dollars ($500.00) for each offense, except where a
different penalty has been established by State law for such offense, the penalty shall be that
fixed by State law, and for any offense which is a violation of any provision of law that governs
fire safety, zoning or public health and sanitation, including dumping of refuse, the penalty shall
be fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each
and every day such offense is continued shall constitute a new and separate offense.
SECTION 5. That this ordinance shall become effective_____________________.

PROCLAMATION
WHEREAS, the entire community can inspire, equip, and mobilize people to take action
that changes the world; and
WHEREAS, volunteers can connect with local community service opportunities through
hundreds of community service organizations; and
WHEREAS, individuals and communities are at the center of social change, discovering
their power to make a difference; and
WHEREAS, experience teaches us that government by itself cannot solve all of our
nation’s social problems; and
WHEREAS, National Volunteer Week was established in 1974 and has grown
exponentially each year; and
WHEREAS, during this week all over the nation, service projects will be performed, and
volunteers recognized for their commitment to service; and
WHEREAS, our City’s volunteer force is a great treasure and is vital to the City of
Coppell’s future as a caring and productive community.
NOW THEREFORE, I, Wes Mays, Mayor of the City of Coppell, do hereby proclaim
April 16 – 22, 2023, as

PROCLAMATION
WHEREAS, sexual harassment, abuse, and assault are widespread problems. In the
United States alone, nearly one in five women and one in 33 men have been raped at some time
in their lives, and one in four girls and one in 6 boys is sexually abused by their 18th birthday.
WHEREAS, sexual assault affects every adult, teen, and child in Denton and Dallas
County either as a victim/survivor of sexual assault or as a family member, significant other,
friend, neighbor, or co-worker; and,
WHEREAS, few survivors of sexual violence seek help immediately after victimization
due to shame or fear of not being believed. To end sexual assault, we must alleviate these fears.
We must begin by believing; and,
WHEREAS, Denton County Friends of the Family staff and volunteers provide
comprehensive and compassionate services to those impacted by sexual assault, including a
Survivor Advocate Team responding 24/7 to local hospitals and law enforcement agencies to
support victims of sexual assault; and,
WHEREAS, April 2023 marks the 21st anniversary of Sexual Assault Awareness Month
during which Denton County Friends of the Family will be intensifying efforts to promote public
understanding of sexual assault, publicizing their services, emphasizing the need for increased
community support for their agency, and to increase awareness of needs of survivors;
NOW, THEREFORE, I, Wes Mays, Mayor of the City of Coppell, do hereby declare
the month of April 2023, as:
“SEXUAL ASSAULT AWARENESS MONTH”
in the City of Coppell and encourage all citizens to learn more about the effects of sexual assault
and how to support survivors.

Consider approval of PD-295R3-HC, Starbucks Restaurant, a zoning
change request from PD-295-HC (Planned Development-295-Highway
Commercial) to PD-295R3-HC (Planned Development-295 Revision
3-Highway Commercial, to approve a Detail Site Plan for a Starbucks sit
down/drive-thru restaurant on 0.76 acres of property, located on the south
side of SH 121, between Freeport Parkway and Northwestern Drive, just
northeast of the proposed Popeyes, at the request of Archway 121
Coppell, LTD, being represented by Clay Cristy of Claymoore
Engineering.
The requester has asked to withdraw the zoning change request; therefore no
action was taken on this item.
10.PUBLIC HEARING:
Consider approval of PD-295R2-HC, Popeyes Chicken Restaurant, a
zoning change request from PD-295-HC (Planned
Development-295-Highway Commercial) to PD-295R2-HC (Planned
Development-295 Revision 2-Highway Commercial, to approve a Detail
Site Plan for a Popeyes Chicken sit down/drive-thru restaurant, on 0.97
acres of property, located on the south side of SH 121, between Freeport
Parkway and Northwestern Drive, just southwest of the proposed
Starbucks, at the request of Archway 121 Coppell, LTD, being
represented by Clay Cristy of Claymoore Engineering.
Senior Planner Mary Paron-Boswell informed City Council that the requester
has asked for a continuation of the Public Hearing to the April 11, 2023, City
Council Meeting.
Mayor Wes Mays opened the Public Hearing and stated that no one had signed
up to speak.

Councilmember Don Carroll, to continue the Public Hearing to the April 11,

City Manager Mike Land gave the following updates regarding ongoing and
future projects:
The ribbon-cutting ceremony for the cricket pitch by Wagon Wheel Field 6 is
next Tuesday, April 4th at 11AM. The address is 1001 Northpoint Drive.
The Moore Road Boardwalk construction project is making progress. The
Moore Road Pond has been de-watered and all wildlife have been relocated.
Contractors are continuing to pour concrete on S. Belt Line Road.
Beginning this week there will be panel replacement work on E. Sandy Lake
Road.

Coppell Police Department.

A motion was made by Councilmember Mark Hill, seconded by Mayor Pro Tem
Biju Mathew, to approve a settlement agreement by and among the City of
Allen, et al and Spectrum Gulf Coast LLC, Cause No. 2018-3835-4, pending
USDC in the Western District of Texas, whereby the cities have alleged an
unpaid franchise and PEG fees based on unreported increase; the City of
Coppell shall receive a net franchise fee of $40,000 over a ten year period; and
authorize the City Manager to sign the appropriate settlement documents. The
motion passed by an unanimous vote.

The City Council of the City of Coppell met in Special Called Session at 6:00 p.m., at
the City of Coppell's Senior and Community Center, 345 W. Bethel Road, Coppell,
Texas.
Call to Order1.
Mayor Wes Mays called the meeting to order, determined that a quorum was
present and convened into the Special Called Session at 6:02 p.m.

Consultant Randy Pennington facilitated the tabletop discussions and
participating members of the public provided input.

Introduction:
This purpose of this agenda item is to consider approval of an award of a bid to J.B. & Co. LLC in
the amount of $810,490.00 for the reconstruction of Duck Pond Park.
Background:
Duck Pond Park is a 5-acre neighborhood park located at 400 E. Bethel Road. This park was the first
neighborhood park built in Coppell in 1978 and features a playground, picnic areas, pedestrian
walking trail, and a pond. In 2019, City Council approved the funding for improvements and
reconstruction of Duck Pond Park. In April 2022, the City engaged Kimley-Horn for the design
portion of the project. The final design and construction documents were provided to the City in
January 2023 and bid documents were subsequently prepared.
Major improvements to the park include a new concrete walking trail around the entire pond, site
grading, pond edge reestablishment, retaining walls, concrete channel lining, playground surface
replacement with a perimeter beam and accessible ramp, drainage flume replacements, landscape
improvements, and irrigation. The playground structure itself is not included as part of this project.
In March 2023, the City released the bid for the project and received three base bids:
• J.B. & Co., LLC $769,090.00
• Millis Development & Construction, LLC $886,937.69
• RLM EarthCo $946,349.00
Three alternate bid items were also included in the project scope and include two playground
benches, two pond fountains, and the restocking of the pond with fish.
Three alternate bids were received and are listed as follows:
• RLM EarthCo $30,646.31
• J.B. & Co., LLC $41,400.00
• Millis Development & Construction, LLC $42,785.20
J.B. & Co. LLC, who provided the lowest base bid in the amount of $769,090.00, has worked with
the City before having completed the erosion control and bank stabilization project at Hunterwood
Park and the site improvement project at Water Tower #1. The City has had a good experience
working with this contractor.
Benefit to the Community:
This project will provide park beautification and improved experiences for park users. The new
concrete trail will be an upgrade for trail users who wish to maintain an active lifestyle. The
improvements to the playground surface will eliminate safety concerns and correct drainage issues
so that the playground can be used regularly as intended. The pond edge reestablishment will provide
a safer fishing experience and opportunity for people to utilize the shoreline.
Legal Review:
City attorney has reviewed the bid.
Fiscal Impact:
The total fiscal impact of this project is $810,490.00 ($769,090.00 plus $41,400.00 with the addition
of the add alternate items), to be paid from the amount of fund balance designated for this project in
the CRDC Fund.

Dear Mr. Cline:
On March 23, 2023, bids were received, publicly opened, and recorded by the City of Coppell
Procurement Services, at 2:00 PM. There were three (3) bidders for this project: J.B. & Co. LLC, Mills
Development & Construction LLC, RLM Earthco. The bid tabulation and review is included as Exhibit
#1.
The average bid for the Duck Pond Park Reconstruction (Base Bid) was $867,485.90, and the low
base bid for the project was $769,090.00. The apparent low bid was submitted by J.B. & Co., LLC,
and their package appears to be complete and qualified based on our review. J.B. & Co., LLC has
also completed similar projects for other municipalities and has completed previous projects that were
designed by Kimley-Horn.
It is our understanding that there is adequate funding to award the base bid and project to J.B. & Co.,
LLC for $769,090.00. The City may also award any selected alternates as follows: Alternate #1 (Two
Playground Benches) for $2,400, Alternate #2 (Two Pond Fountains) for $34,000, and Alternate #3
(Pond Restocking) for $5,000.
Based on the information provided above, we find no reason why the City should not award the
project to J.B. & Co. LLC.

The purpose of this agenda item is to appoint a replacement for a Future Oriented Approach to
Residential Development (FOARD) Task Force vacancy. On March 23, 2023, Seth Hong provided
written notification of his resignation. Mr. Hong served as a Regular member on the FOARD
Taskforce.
Staff recommends appointing Alternate member Nancy Dugan to fill the unexpired term as a Regular
member. The unexpired term will end in December of 2023. At this time, the Alternate member
position will remain vacant until the annual appointment process.

The new appointment allows for the business of the board to continue.

Introduction:
The purpose of this agenda item is to seek approval from City Council for the purchase of three (3)
Chevrolet Tahoes through The Interlocal Purchasing System (TIPS) #210907 from Lake Country
Chevrolet for replacement of existing Fire Department vehicles.
Background:
To operate a clean, efficient, and reliable fleet, Public Works sets an initial life expectancy on all
vehicles & equipment introduced into the fleet. During its service life, each vehicle and piece of
equipment is subject to close monitoring of availability, operating cost, accumulated miles/hours,
condition, obsolescence, and the ability to perform required tasks. The vehicles being replaced have
reached the end of useful service life and it has been determined that replacement is necessary.
Benefit to the Community:
These vehicles are an essential piece of equipment used by the Fire Department to perform daily
duties that provide public safety in the community.
Legal Review:
The Procurement Division has reviewed the documents and determined that this is an appropriate
method of contracting with the vendor.

Introduction:
The purpose of this agenda item is to enter into an Interlocal Agreement with Hurst, Euless, Bedford,
Colleyville, and Grapevine to share resources for accidents requiring specialized investigators. The
named five cities currently have an Interlocal Agreement. If the City Council approves this Interlocal
Agreement, Coppell would be added to the resource sharing unit called the Combined Reconstruction
& Accident Specialists, also known as C.R.A.S.H.
Background:
The Coppell Police Department currently participates in a shared accident investigation unit with
Carrollton, Farmers Branch, and Addison. Coppell PD will continue to assist these cities when
requested. The number of requests from these current cities have dropped significantly.
The officers who investigate these types of accidents receive advanced training in the areas of
automobile vs. pedestrian, motorcycle, commercial, and automobile accident reconstruction. These
skills need to be utilized on a more consistent basis.
Benefit to the Community:
Participation in this new resource sharing unit will help maintain our investigators’ skills and will
also provide the City of Coppell with additional resources for accidents that occur in Coppell.

Legal:
The City Attorney has reviewed the Interlocal Agreement.
Fiscal Impact:
There are no current fiscal impacts. If equipment is needed in the future, Coppell would be responsible
for 1/6th of the cost.
Recommendation:
The Police Department recommends approval of this Interlocal Agreement.

Introduction:
This item is submitted annually to the City Council so that guidelines for state exemption of day care
licensing can be applied for all youth camp programs offered by the Community Experiences
Department. These camps include Camp Do-It-All, and those offered at the Recreation Center in the
summer and any individual holiday camps that are scheduled throughout the school year. While there
are no changes proposed to the Standards of Care, the City Council is required to hold a public
hearing and adopt the guidelines each year.
Analysis:
The youth camps offered by the City of Coppell are exempt from licensure as observed in the Texas
Administrative Code Title 40 Chapter 745.115(3) of the Texas Department of State Health Services
(DSHS). This is applicable because these programs are operated by a municipality, are recreation
programs for children ages 5 through 13, and because they meet the following criteria:
• The Standards of Care for the program are annually adopted by Ordinance.
• The Standards of Care include staffing ratios and qualifications, facility health and safety
standards, and monitoring and enforcement provisions.
• The Standards of Care are provided to the parents of each program participant.
• The parents of each program participant are informed that the program is not licensed by the state.
• The program is not advertised as childcare.

As parents register their children for Coppell camps, they are provided a copy of the Standards of
Care, as listed in the requirements. Along with the standards they are also provided information on
camp hours of operation, rules, attire, activities and field trips, and all other information parents need
for camp to be successful for their child. These Standards of Care are closely monitored by the
Recreation Coordinator, CORE Manager and the Assistant Director of Community Experiences.

AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, READOPTING,
RATIFYING, REPUBLISHING AND EXTENDING CHAPTER 9 OF THE
CODE OF ORDINANCES, ARTICLE 9 -19, YOUTH CAMP PROGRAMS
STANDARDS OF CARE; PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Coppell operates Youth Camp programs; and
WHEREAS, the City of Coppell has adopted and implemented a comprehensive standards
of care to provide a safe and instructive atmosphere; and
WHEREAS, the City of Coppell has previously passed and adopted youth camp programs
standards of care and desires to re-adopt in accordance with state law; and
WHEREAS, that state law requires each City to review and update its standards of care
regulations for youth programs and having held the required public hearing in accordance with
state law.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF COPPELL,
TEXAS, THAT:
SECTION 1. That Ordinance No. 2010-1248, as readopted and amended by Ordinance
No. 2012-1306, No. 2013-1338, No. 2014-1375, No. 2015-1411, No. 2016-1432, No. 2017-1475,
No. 2018-1489, No. 2019-1512, No. 2020-1538, No. 2021-1553, No. 2022-1577, as codified in
Chapter 9, Article 9-19 Youth Camp Program Standards of Care, Section 9-19-1 through Section
9-19-19 of the Code of Ordinances of the City of Coppell, Texas, as amended, after public hearing,
is hereby readopted ratified, republished and extended in its entirety from the date of its adoption
and shall remain in effect through April 2024 unless otherwise repealed, amended or terminated
as provided by state law.
SECTION 2. That all provisions of any ordinance or the Code of Ordinances of the City of
Coppell, Texas, except as provided herein, in conflict with the provisions of this ordinance be, and

the same are hereby, repealed, and all other provisions not in conflict with the provisions of this
ordinance shall remain in full force and effect.
SECTION 3. That should any word, phrase, paragraph, or section of this ordinance or of the
Code of Ordinances, as amended hereby, be held to be unconstitutional, illegal or invalid, the same
shall not affect the validity of this ordinance, in whole, in part or provision thereof other than the part
so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Code of
Ordinances of the City of Coppell, Texas as a whole.
SECTION 4. That this ordinance shall take effect immediately from and after its passage
and publication, as the law and charter in such cases provide.

CITY OF COPPELL YOUTH CAMP PROGRAMS
STANDARDS OF CARE
The Standards of Care are intended to be minimum standards by which the City of Coppell Parks
& Recreation Department will operate the City's Youth Camp Programs. The programs operated
by the City are recreational in nature and are not day care programs.
I. GENERAL ADMINISTRATION
1.01 Organization
1.01.1 The governing body of the City of Coppell Youth Camp Programs is the Coppell City
Council.
1.01.2 City of Coppell Youth Camp Programs are exempt from the Department of TEXAS state
Health Department licensure under state law.
1.01.3 Implementation of the Youth Programs Standards of Care is the responsibility of the Parks
& Recreation Department Director and Departmental employees.
1.01.4 Youth Program ("Program") to which these Standards of Care will apply is the Summer
Recreation Program and selected days off from the school calendar.
1.01.5 Each Youth Program site will have available for public and staff review a current copy of
the Standards of Care.
1.01.6 Parents of participants will be provided a current copy of the Standards of Care during the
registration process.
1.01.7 Criminal background checks will be conducted on prospective Youth Program employees.
If results of the criminal check indicate that an applicant has been convicted of any of the
following offenses, he or she will not be considered for employment:
a. A felony or a misdemeanor classified as an offense against a person or family;
b. A felony or misdemeanor classified as public indecency;
c. A felony or misdemeanor violation of any law intended to control the possession
or distribution of any controlled substance;
d. Any offense involving moral turpitude;
e. Any offense that would potentially put youth participants or the City of Coppell at
risk.

1.02 Definitions
Assistant Director of Recreation shall mean City of Coppell Parks and Recreation
Department’s Assistant Director of Recreation.
City shall mean City of Coppell
City Council shall mean City Council of the City of Coppell
Department shall mean Parks & Recreation Department of The City of Coppell
Director shall mean City of Coppell Parks & Recreation Department Director or designee.
Employee(s) shall mean term used to describe people are employees, permanent,
temporary/seasonal of the City of Coppell and have been assigned responsibility for
managing, administering, or implementing some portion of the Coppell Youth Programs.
Parent(s) shall mean This term will be used to represent one or both parent(s) or adults
who have legal custody and authority to enroll their child(ren) in Coppell Youth Programs.
Participant shall mean a youth between ages of 6 to 12 years whose parent(s) have
completed all required registration procedures and determined to be eligible for a Coppell
Youth Program.
Program Counselor shall mean City of Coppell Parks & Recreation Department
Seasonal/Temporary employee who has been assigned responsibility to implement the City's
Youth Program.
Program Manual shall mean notebook of policies, procedures, required forms, a nd
organizational and programming information relevant to Coppell Youth Programs.
Program Site shall mean area and facilities where Coppell Youth Programs are held
consisting of the Coppell Independent School District Campus and The CORE.
Recreation Center shall mean The Coppell Independent School District campuses or The
CORE which hosts the Summer Recreation Program and selected days off from school.
Recreation Coordinator shall mean City of Coppell Parks & Recreation Department
Recreation Coordinator.
Site Director shall mean City of Coppell Parks & Recreation Department
Seasonal/Temporary Programmer who has been assigned administrative responsibility for a
Coppell Youth Program.
Waterfront Director shall mean City of Coppell Parks & Recreation Department Aquatics
Operation Supervisor or Head Lifeguard as assigned by the Recreation Manager.

Youth Programs or Program shall mean City of Coppell Youth Programs currently
consisting of the Summer Recreation Program and selected days off from school.
1.03 Inspections/Monitoring/Enforcement
1.03.1 A monthly inspection report will be initiated by the Site Director of each Program to
confirm that the Standards of Care are being met including site conditions and
programing.
a. Completed inspection reports will be sent to the Recreation coordinator for
review and kept on record for at least two years.
b. The Recreation Coordinator will review the report and establish deadlines and
criteria for compliance with the Standards of Care.
1.03.2 The Recreation Coordinator will make visual inspections of the Program based on the
following schedule:
a. The Summer Recreation Program will be inspected twice during its summer schedule.
b. The Spring Recreation Program will be inspected once during the Spring Break
Recreation Program schedule.
c. The Holiday Recreation Program will be inspected one during the Holiday Recreation
Program schedule.
1.03.3 Complaints regarding enforcement of the Standards of Care will be directed to the Site
Director. The Site Director will be responsible to take the necessary steps to resolve the
problems. The Site Director will record complaints regarding enforcement of the
Standards of Care and their resolution. The Recreation Coordinator will address serious
complaints regarding enforcement of the Standards of Care and the complaint and
resolution will be noted.
1.03.4 The Parks & Recreation Department’s Director will make an annual report to the City
Council on the overall status of the Youth Program and its operation relative to
compliance with the adopted Standards of Care.
1.04. Enrollment
1.04.1 Before a child can be enrolled a parent must sign registration forms that contain the
child's:
a. name, address, home telephone number;

b. name and address of parents and telephone number during Program hours;
c. the names and telephone numbers of people to whom the child can be released
or names of those who may not pick them up;
d. a statement of the child's special problems or needs;
e. emergency medical authorization;
f. proof of residency when appropriate; and
g. a liability, transportation, photo, and movie waiver
1.05 Suspected Abuse
Program employees will report any observed or reported suspected child abuse or neglect
in accordance with the Texas Family Code.
II. STAFFING - RESPONSIBILITIES AND TRAINING
2.01 Site Director Qualifications
2.01.1 Site Director will be Seasonal/Temporary professional employees of the City of Coppell
Parks & Recreation Department and will be required to have all Recreation Site Director
qualifications as outlined in this document.
2.01.2 Site Director must be at least 18 years old
2.01.3 Site Director must have experience planning and implementing recreational activities.
2.01.4 Site Director must pass a background investigation including testing for illegal substances.
2.01.5 Site Director must have successfully completed a course in First Aid and Cardiopulmonary
Resuscitation (CPR) based on either American Heart Association or American Red Cross
standards.
2.01.6 Be mature, responsible, and able to complete duties with minimal supervision.
2.01.7 Ability to communicate well with the public, and skilled at interacting with children.
2.01.8 Skilled in supervising children of varying age levels in a group setting.
2.01.9 Have strong organizational skills and have the ability to adapt easily to change.
2.02 Site Director's Responsibilities
2.02.1 Site Directors are responsible to administer the Programs' daily operation s in compliance
with the adopted Standards of Care.
2.02.2 Recreation Coordinator and Site Directors are responsible to recommend for hire,
supervise, and evaluate Counselors. Camp management shall ascertain and have on

record information, such as a letter of reference, attesting to the character and integrity
of each staff member, and information, such as training certificates, attesting to the
ability of each staff member to perform the tasks required in his or her position.
2.02.3 Site Directors are responsible for planning, implementing, and evaluating programs.
2.02.4 Site Directors will be considered Camp Health Officers. Duties will consist of, but not
limited to: dispensing of medication and first aid, records management of incidences,
emergencies, and camper’s health files.
2.03 Camp Counselor Qualifications
2.03.1 Counselors will be Seasonal/Temporary employees of the Parks & Recreation
Department.
2.03.2 Counselors working with children must be age 18 or older and have completed high
school.
2.03.3 Counselors should be able to consistently exhibit competency, good judgment, and self-
control when working with children.
2.03.4 Counselors must relate to children with courtesy, respect, tolerance, and patience.
2.03.5 Counselors must have successfully completed a course in First Aid and CPR based on
either American Heart Association or American Red Cross standards. An exception can be
made for no more than one staff person at each site and that person shall successfully
complete a First Aid and CPR course within two weeks of starting work.
2.03.6 Counselors must pass a background investigation including testing for illegal substances.
2.04 Counselor Responsibilities
2.04.1 Counselors will be responsible to provide participants with an environment in which they
can feel safe, can enjoy wholesome recreation activities, and can participate in
appropriate social opportunities with their peers.
2.04.2 Counselors will be responsible to know and follow all City, Departmental, and Program
standards, policies and procedures that apply to Coppell Parks and Recreation Youth
Programs.
2.04.3 Counselors must ensure that participants are released only to an authorized parent, or an
authorized adult designated by the parent. All Program sites will have a copy of the
Department approved plan to verify the identity of a person authorized to pick up a
participant if that person is not known to the Counselor

2.05 Training/Orientation
2.05.1 The Department is responsible for providing training and orientation to Program
employees in working with children and for specific job responsibilities. Recreation
Coordinator will provide each Counselor and Site Director with a Program Manual specific
to the Youth Program.
2.05.2 Program employees must be familiar with the Standards of Care for Youth Program
operation as adopted by the City Council.
2.05.3 Program employees must be familiar with the Program's policies including discipline,
guidance, and release of participants as outlined in the Program Manual.
2.05.4 Program employees will be trained in appropriate procedures to handle emergencies by
the Recreation Coordinator and/or professionals in the field.
2.05.5 Program employees will be trained in areas including City, Departmental, and Program
policies and procedures, provision of recreation activities, safety issues, child psychology,
and organization.
2.05.6 Program employees will be required to sign an acknowledgement that they received the
required training.
III. OPERATIONS
3.01 Staff-Participant Ratio
3.01.1 In a Coppell Youth Program, the standard ratio of participants to Counselors shall not
exceed 20 to 1. In the event a Counselor is unable to report to the Program site, a
replacement will be assigned. The camp director shall not be included in the supervisor
to camper ratio in camps serving over 50 campers at a time.
3.01.2 Each participant shall have a Program employee who is responsible for him or her and
who is aware of the participant's habits, interests, and any special problems as identified
by the participant's parent(s) during the registration process.
3.02 Discipline
3.02.1 Program employees will implement discipline and guidance in a consistent manner based
on the best interests of Program participants.
3.02.2 There must be no cruel or harsh punishment or treatment.
3.02.3 Program employees may use brief, supervised separation from the group if necessary.

3.02.4 As necessary, Program employees will initiate discipline reports to the parent(s) of
participants. Parents will be asked to sign discipline reports to indicate they have been
advised about specific problems, incidents or behavior.
3.02.5 A sufficient number and/or severe nature of discipline reports as detailed in the Program
Manual may result in a participant being suspended from the Program.
3.02.6 In instances where there is a danger to participants or staff, offending participants will be
removed from the Program site as soon as possible.
3.03 Programming
3.03.1 Program employees will attempt to provide activities for each group according to the
participants' ages, interests, and abilities. The activities must be appropriate to
participants' health, safety, and well-being. The activities also must be flexible and
promote the participants' emotional, social, and mental growth.
3.03.2 Program employees will attempt to provide indoor and outdoor time periods that include:
a. Alternating active and passive activities;
b. Opportunity for individual and group activities, and
c. Outdoor time each day weather permits.
3.04 Communication
3.04.1 The Program site will have a mobile phone to allow the site to be contacted by Parks &
Recreation personnel or for making emergency calls.
3.04.2 The Site Director will post the following telephone numbers adjacent to a mobile phone
accessible to all Program employees at the site:
a. Coppell Ambulance or Emergency Medical Services;
b. Coppell Police Department;
c. Coppell Fire Department;
d. Coppell Independent School District campuses;
e. Numbers at which parents may be reached;
f. The telephone number for the site itself.
3.05 Transportation
3.05.1 Before a participant may be transported to and from city sponsored activities, a
transportation form, completed by the parent of the participant, must be filed with the
Site Director.
3.05.2 First Aid supplies and a First Aid and emergency care guide will be available in all Program
vehicles that transport children.

3.05.3 All Program vehicles used for transporting participants must have available a 6 -BC
portable fire extinguisher which will be installed in the passenger compartment of the
vehicle and must be accessible to the adult occupants.
IV. FACILITY STANDARDS
4.01 Safety
4.01.1 Program employees will inspect the Program site daily to detect sanitation and safety
concerns that might affect the health and safety of the participants. A daily inspection
report will be completed by Program employees and kept on file by the S ite Director.
4.01.2 Buildings, grounds, and equipment on the Program site will be inspected, cleaned,
repaired, and maintained to protect the health of the participants.
4.01.3 Program equipment and supplies must be safe for the participants' use.
4.01.4 Program employees must have First Aid supplies readily available at each site, during
transportation to an off-site activity, and for the duration of any off-site activity.
4.01.5 Program air conditioners, electric fans, and heaters must be mounted out of participants'
reach or have safeguards that keep participants from being injured.
4.01.6 Program porches and platforms more than 30 inches above the ground must be equipped
with railing participants can reach.
4.01.7 All swing seats at the Program site must be constructed of durable, lightweight, relatively
pliable material.
4.01.8 Program employees must have First Aid supplies readily available to staff in a designated
location. Program employees must have an immediately accessible guide to First Aid and
emergency care.
4.01.9 Restrooms will be inspected on a frequent basis to ensure that no undesirable activity is
occurring. Manual logs will be included with inspection reports indicated above to show
that staff checks restrooms.
4.02 Fire
4.02.1 In case of fire, danger of fire, explosion, or other emergency, Program employees' first
priority is to evacuate the participants to a designated safe area.
4.02.2 The Program site will have an annual fire inspection by the local Coppell Fire Marshall,
and the resulting report will detail any safety concerns observed. The report will be
forwarded to the Director of Parks & Recreation who will review and establish deadlines
and criteria for compliance. Information from this report will be included in the Director
of Parks & Recreation annual report to the Council.

4.02.3 The Program site must have at least one fire extinguisher approved by the Fire Marshall
readily available to all Program employees. The fire extinguisher is to be inspected
monthly by the Site Director, and a monthly report will be forwarded to the Recreation
Coordinator who will keep the report on file for a minimum of two years. All Program
employees will be trained in the proper use of fire extinguisher.
4.02.4 Fire drills will be initiated at Program sites based on the following schedule:
a. Summer Recreation Program: A fire drill twice during the session.
4.03 Health; Illness or Injury
4.03.1 A participant who is considered to be a health or safety concern to other participants or
employees will not be admitted to the Program.
4.03.2 Illnesses and injuries will be handled in a manner to protect the health of all participants
and employees.
4.03.3 Program employees will follow plans to provide emergency care for injured participants
with symptoms of an acute illness as specified in the Program manual.
4.03.4 Program employees will follow the recommendation of the Texas Department of Health
concerning the admission or readmission of any participant after a communicable
disease.
4.03.5 Program employees will administer medication only if:
a. Parent(s) complete and sign a medication form that provides authorization for staff
to dispense medication with details as to time and dosages. The form will include a
hold harmless clause to protect the City.
b. Prescription medications are in the original containers labeled with the child's name,
a date, directions, and the physician's name. Program employees will administer the
medication only as stated on the label. Program employees will not administer
medication after the expiration date.
c. Nonprescription medications are to be labeled with the child's name and the date the
medication was brought to the Program. Nonprescription medication must be in the
original container. Program employees will administer it only according to label
direction.
d. Medication dispensed will be limited to routine oral ingestion not requiring special
knowledge or skills on the part of Program employees. The Program employees will
administer no injections.

4.03.6 Program employees must ensure medications are inaccessible to participants or, if it is
necessary to keep medications in the refrigerator (when available), medications will be
kept separate from food.
4.04. Toilet Facilities
4.04.1 The Program site will have inside toilets located and equipped so children can use them
independently and Program staff can supervise as needed.
4.04.2 There must be one flush toilet each for every 15 females and 15 males. Urinals may be
counted in the ratio of toilets for males, but they must not excee d 70% of the total
number of toilets.
4.04.3 An appropriate and adequate number of lavatories (sinks) will be provided.
4.04.4 Hand sanitizer is required at all times.
4.05 Sanitation
4.05.1 The Program facilities must have adequate light, ventilation, and heat.
4.05.2 The Program must have an adequate supply of water meeting the standards of the Texas
Department of Health for drinking water and ensure that it will be supplied to the
participants in a safe and sanitary manner.
4.05.3 Program employees must see that garbage is removed from buildings daily.
4.06 Water Safety
4.06.1 An adult waterfront director shall be in charge of all waterfront activities. While
waterfront activities are in progress, the waterfront director or an adult certif ied lifeguard
assistant shall be in the immediate vicinity of the campers, supervising the program.
4.06.2 All campers’ swimming ability will be tested on their first fieldtrip to the pool. Children
shall then be confined to the limits of swimming skills for which they have been classified.

Introduction:
The purpose of this agenda item is to update the City of Coppell Electrical Ordinance through
adoption of the most current version of the National Electrical Code. The verbiage of the Electrical
Ordinance is also proposed to be updated.
Background:
The State of Texas adopts the latest version of the National Electrical Code during that code’s
cycle-year. The State adopted the 2020 National Electrical Code in 2020. The City is currently on
the 2014 version of the Code.
Benefit to the Community:
Through adoption of the most current version of the National Electrical Code, the City will be on
the same edition as the State once the adoption process is complete in September.
Legal Review:
This has been reviewed and recommended for approval by the Board of Adjustment on
December 8, 2022.
Fiscal Impact:
This has a minimal fiscal impact, as there are only minor budgeted expenses for new code books
and training.
Recommendation:
The Building Inspections division is recommending approval of the adoption of the 2023 National
Electric Code as the City of Coppell Electrical Code.

THE CODE OF ORDINANCES BY AMENDING CHAPTER 15 ARTICLE 15-2
TO ADOPT THE NATIONAL ELECTRICAL CODE, 2023 EDITION, AS THE
CITY OF COPPELL ELECTRICAL CODE; PROVIDING AMENDMENTS TO
THE NATIONAL ELECTRICAL CODE, 2023 EDITION AND
ADMINISTRATIVE PROVISIONS; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING A PENALTY FOR VIOLATION OF THIS
ORDINANCE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
SECTION 1. That the City of Coppell Code of Ordinances be, and the same is, hereby amended
by amending Chapter 15, Article 15-2, in part to adopt the National Electrical Code, 2023 Edition
as it existed on October 3, 2022, with amendments to read as follows:
CHAPTER 15-2. NATIONAL ELECTRICAL CODE
Sec. 15-2-1. National Electrical Code -Adopted.
There is hereby adopted by the City of Coppell, Texas, the National Electrical Code, 2023
Edition, and made a part hereof for all purposes, the same as if fully copied in full herein, with
the exception of such sections hereof, which are hereafter deleted, modified or amended.
Sec. 15-2-2. Amendments:
The following sections of the National Electrical Code, 2023 Edition, and administrative
provisions for the National Electrical Code, 2023 edition, are hereby amended to read as follows:

1. Article 90.4 Enforcement add the sections B, though I to read as follows:
(A) Enforcement. Existing language to remain
(B) Supervision of Work. In the actual work of installing, maintaining, altering, or
repairing any electrical conductors or equipment for which requires a permit,
apprentice electricians must have on-site supervision (as defined by Texas
Administrative Code, Title 16, Chapter 73, Subsection 73.10) provided by a TDLR-
issued journeyman or master electrician license holder.
(C) Powers and Duties of building official.
1. General. The Chief Building Official and designee are hereby authorized to
enforce all the provisions of this Code. They shall cause a record to be kept of all
permits issued and inspections made.
2. Deputies. In accordance with prescribed procedures and with the approval of the
appointing authority, the Chief Building Official may appoint designees as their
deputies with powers and duties as designated by the Chief Building Official.
3. Reference to Inspector/Electrical Inspector. References to "Inspector" and
"Electrical Inspector" in this Code shall mean the Chief Building Official or
designee authorized to perform inspections.
4. Right of entry. Where it is necessary to make an inspection to enforce the
provisions of this code, or where the Chief Building Official has reasonable cause to
believe that there exists in a structure or upon a premises a condition that is contrary
to or in violation of this code that makes the structure or premises unsafe, dangerous
or hazardous, the Chief Building Official or designee is authorized to enter the
structure or premises at reasonable times to inspect or to perform the duties imposed
by this code, provided that if such structure or premises be occupied that credentials
be presented to the occupant and entry requested. If such structure or premises is
unoccupied, the Chief Building Official or designee shall first make a reasonable
effort to locate the owner or other person having charge or control of the structure or
premises and request entry. If entry is refused, the Chief Building Official or
designee shall have recourse to the remedies provided by law to secure entry.
5. Notice. When any order or notice is issued pursuant to the provisions of this
Code to any person who cannot be found after a reasonable search, such order or

notice may be served by posting it in a conspicuous place upon the premises
occupied by that person or upon the premises where the defects are alleged to
exist. Such posting of the notice shall be considered equivalent to personal
service of such order or notice. An order sent by mail in a sealed envelope with
postage prepaid and directed to the address of the contractor, owner, lessee, or
occupant of the premises shall be equivalent to personal service of such order.
The Chief Building Official and their designees are hereby empowered to attach
to the nearest electrical cabinet or equipment feeding defective or hazardous
wiring, any official notice or seal to prevent use of electricity in that area, and it
shall be unlawful for any other person to place or attach such seal, or to break,
change, destroy, tear, mutilate, cover or otherwise deface or injure any such
official notice or seal posted by the Chief Building Official or their designee.
6. Stop Work Orders. Whenever any work is being done contrary to the provisions
of this Code, the Chief Building Official may order the work stopped by notice in
writing served on any persons engaged in the doing or causing such work to be
done, and any such persons shall forthwith stop such work until authorized by
the Chief Building Official to proceed with the work.
7. Authority to disconnect utilities in emergencies. The Chief Building Official
or their designee shall have the authority to disconnect any electric power or
energy service supplied to the building, structure or building service equipment
therein regulated by this Code in case of emergency where necessary to eliminate
an immediate hazard to life or property, or, where there is a violation of the
temporary electric connection per section 85-6(b). The Chief Building Official
or their designee shall, whenever possible, notify the serving utility, the owner
and occupant of the building, structure or building service equipment, in writing,
of such disconnection immediately thereafter.
8. Authority to condemn electrical system and equipment. Whenever the Chief
Building Official or designee ascertains that any electrical system or equipment
regulated in this code has become hazardous to life, health or property, they may
order in writing that such electrical system or equipment either be removed or
restored to a safe condition, whichever is appropriate. The written notice itself

shall fix a time limit for compliance with such order. No person shall use or
maintain defective electrical system or equipment after receiving such notice.
When such equipment or installation is to be disconnected, a written notice of
such disconnection and causes therefore shall be given within 24 hours of the
order to disconnect to the serving utility, the owner and occupant of such
building, structure or premises. When any electrical system or equipment is
maintained in violation of this code and in violation of any notice issued
pursuant to the provisions of this section, the Chief Building Official or designee
shall institute any appropriate action to prevent, restrain, correct, or abate the
violation.
9. Connection after order to disconnect. No person shall make connections from
any energy or power supply nor supply power to any electrical system or
equipment which has been disconnected or ordered to be disconnected by the
Chief Building Official or designee; the use of which has been ordered to be
discontinued until the Chief Building Official or designee authorizes the
reconnection and use of such electrical system or equipment.
10. Liability. The Chief Building Official and their designees charged with the
enforcement of this code, acting in good faith and without malice in the
discharge of his duties, shall not thereby render themselves personally liable for
any damage that may accrue to persons or property as a result of any act or by
reason of any act or omission in the discharge of their duties. Any suit brought
against the Chief Building Official or their designees because of such act or
omission performed by them in the enforcement of any provision of this code
shall be defended by legal counsel provided by this jurisdiction until final
termination of such proceedings. This code shall not be construed to relieve
from or lessen the responsibility of any person owning, operating, or controlling
any building, structure or building service equipment therein for any damages to
persons or property caused by defects, nor shall the code enforcement agency or
its parent jurisdiction be held as assuming any such liability by reason of the
inspections authorized by the code or approvals issued under this code.

11. Appeals. Any person, firm, or corporation may file an appeal through the
Building Inspections department for the Board of Adjustment to review any
decision of the Chief Building Official, provided that such appeal is made in
writing within (5) days of receiving the notification by the Chief Building
Official or their designee. The Board of Adjustment shall meet within a
reasonable time following receipt of such appeal to hear the appeal and render a
decision and findings in writing to the appellant with a duplicate copy to the
Chief Building Official or designee.
(D) Electrical License and Registration.
1. Registration required. It shall be unlawful for any person, firm, or corporation
who is not registered as a qualified electrician in the City of Coppell to engage in
work regulated by this code. Prior to the approval of any permit to do work
regulated by this code, the applicant for such permit must first register with the
Building Inspection Department.
2. Application for Registration. A person, firm, or corporation who desires to
register as an electrician in the City of Coppell shall complete the appropriate
application and provide the following information:
(a) A current master electrician or master sign electrician license issued by the
TDLR (Texas Department of Licensing and Regulation).
(b) A form of picture identification.
(c) Business identification to include the business name, business owner(s),
address, and telephone number.
(d) Copy of liability insurance (minimum of $1 million coverage).
3. Issuance and Term of Registration. Upon satisfactory completion of the
requirements and payment of applicable fees as specified by the City of Coppell
Master Fee Schedule for registration as an electrician, as classified, the chief
building official may approve such registration. An approved registration is valid
for a period of not more than one (1) year and shall terminate at the end of each
calendar year.

4. Transfer of registration. It shall be unlawful for any person, firm, or corporation
to lend, rent, or transfer an electrical contractor registration issued by the City of
Coppell to another person firm, or corporation for any purpose.
5. Revocation of registration. An electrical registration issued by the City of
Coppell may be revoked by the Chief Building Official for the following:
(a) Falsification of any portion of an application for registration with intent to
defraud.
(b) Any person, firm, or corporation who, after being found guilty in municipal
court of violations of this code, is unwilling to make appropriate
corrections to the satisfaction of the Chief Building Official or his
designee.
(c) Threatening or abusive behavior to City staff or City representatives.
(d) Notice of revocation of electrical registration. The Chief Building Official
or designee shall provide proper notice in writing to the person, firm or
corporation holding a revoked electrical contractor registration. Notice
shall be deemed effective on the post date of certified mail.
(e) Appeal of revocation. In the event that any person, firm, or corporation
shall appeal the decision of the Chief Building Official or designee to
revoke an electrical registration, a request for a public hearing of the
matter shall be made in writing to the Chairman of the Building and
Standards Commission within five (5) days of receipt of notice of
revocation. The Building and Standards Commission shall meet to
consider an appeal of revocation within a reasonable time of receipt of a
written request.
6. False Representation as to Registration Unlawful. It shall be unlawful for any
person, firm, or corporation to represent themself or a business as an electrician
or electrical contractor in the City of Coppell without having first properly
registered with the Building Inspection Department.
7. Electrical Company Vehicles to Be Marked. All electrical contractors’
vehicles engaged in doing work in the City of Coppell shall have signs

permanently affixed to both sides of the vehicle indicating the company name of
the electrical contractor.
8. Supervision. The actual work of installing, maintaining, altering, or repairing of
electrical work for which a permit is required by this Code shall have supervision
by a licensed master or journeyman electrician as provided by this Code. In the
event the owner of electrical contracting business is not a licensed master
electrician, their master electrician of record shall be the person responsible for,
and supervising, the electrical work done. Should such supervision not be
constantly provided, the Chief Building Official or their designee may order the
work being done by such electrical contractor to be removed and replaced under
the proper supervision.
9. License display. Each holder of a master, journeyman or specialist license shall
carry evidence of proper license on their person at all times while doing electrical
work, and shall produce and exhibit same when requested by any officer of the
City.
10. Exception from Licensing and Registration.
Persons who are not registered electricians may carry out the following classes
of work:
(a) The installation, alteration, or repairing of any wiring, devices, or equipment
for signaling, remote control, or the transmission of information, provided
such are inherently power limited and have a maximum nameplate rating not
exceeding one volt- ampere.
(b) Electrical work done by a property owner in a building owned and occupied
by them is thereby classified as their homestead. Where the electrical work
done by property owner is deemed by the Chief Building Official or
designee to be hazardous to persons or property, and the repair thereof is
beyond the skills and electrical knowledge of the property owner as deemed
by the Chief Building Official or designee, the Chief Building Official may
void the permit and/or registration obtained by the homeowner. In such an
event, the electrical work shall only be completed by a licensed electrical
contractor, registered with the City of Coppell, through a new permit.

(c) Application for permit. To obtain a permit, the applicant shall first file an
application with the Building Inspection Department for that purpose.
11. Plans and specifications. With each application for a permit, and where
required by the Chief Building Official or designee for enforcement of any
provision of this Code, plans, specifications, and calculations shall be submitted.
When deemed necessary to ensure code compliance, the Chief Building Official
or designee may require plans and specifications to be prepared and designed by
an engineer licensed by the State of Texas.
12. Information on plans and specifications. Plans and specifications shall be
drawn to scale and shall be of sufficient clarity to indicate the location, nature
and extent of the work proposed and show in detail that it will conform to the
provisions of this code and all relevant laws, ordinances, rules, and regulations.
13. Permits issuance. After all review requirements have been met and have been
approved by the Chief Building Official or their designee, and the fees specified
by the City of Coppell Master Fee Schedule for the proposed scope of work have
been paid, the Chief Building Official or designee may issue the permit to the
applicant. When the Chief Building Official or designee issues the permit where
plans are required, they shall endorse in writing or stamp the plans and
specifications as stated in the currently adopted edition of the International
Building Code. Such approved plans and specifications shall not be changed,
modified, or altered, and all work shall be done in accordance with the approved
plans. Any deviations from the city-stamped plans must be submitted to and
approved by the City prior to execution of the changes in field.
14. Validity of permit. The issuance of a permit or approval of plans and
specifications shall not be construed to be a permit for, or an approval of, any
violation of any of the provisions of this code, or of any other ordinance of the
City, nor shall the issuance of a permit or approval of plans be construed as
representing or warranting the safety or lack of defects of any electrical work
described therein. No permit presuming to give authority to violate or cancel the
provisions of these Codes shall be valid. The issuance of a permit based upon
plans, specifications, and other data shall not prevent the Chief Building Official

or designee from thereafter requiring the correction of errors in said plans,
specifications, and other data, or from preventing building operations being
carried on thereunder when in violation of these codes or of any other ordinances
of the City. Work on a property may not commence until the issued permit is
posted in a conspicuous location visible from the main street that the structure or
property is addressed from.
15. Expiration. Every permit issued shall become invalid unless the work on the site
authorized by such permit is commenced within 180 days after its issuance, or if the
work authorized on the site by such permit is suspended or abandoned for a period
of 180 days after the time the work is commenced. The Chief Building Official is
authorized to grant, in writing, one or more extensions of time, for periods not more
than 180 days each. The extension shall be requested in writing and justifiable cause
demonstrated.
16. Suspension or revocation. The Chief Building Official or designee may, in
writing, suspend or revoke a permit issued under the provisions of this code
whenever the permit is issued in error or on the basis of incorrect information
supplied, or in violation of any ordinance or regulation of the City.
17. Fees. Permit fees shall be levied in the amounts specified by the City of Coppell,
Master Fee Schedule approved by city council.
(E) Inspections.
1. General. All electrical systems and equipment for which a permit is required by
this code shall be subject to inspection by the Chief Building Official or designee.
No portion of any electrical system intended to be concealed shall be concealed
until inspected and approved. The Chief Building Official, their designee, nor the
City shall be liable for expense entailed in the removal or replacement of any
material necessary to allow inspection. When the installation of an electrical
system and equipment is complete, an additional and final inspection shall be
made. Electrical systems and equipment regulated by this code shall not be
connected to the energy source until authorized by the Chief Building Official or
designee.

2. Inspection requests. It shall be the duty of the permit holder to request the scope
of work to be inspected through the appropriate process. Every request for
inspection must be filed at least one working day before such inspection is
desired. It shall be the duty of the permit holder to provide access to and means
for proper inspection of such work.
3. Other inspections. In addition to the inspections required by this code, the
Chief Building Official or designee may make or require other inspections of any
work to ascertain compliance with the provisions of this Code and other laws
which are enforced by the Code enforcement agency.
4. Reinspections. A reinspection fee may be assessed for each inspection or
reinspection when such portion of work for which inspection is called is not
complete or when required corrections are not made. This provision is not to be
interpreted as requiring reinspection fees the first time a job is rejected for
failure to comply with the requirements of this code, but as controlling the
practice of calling for inspections before the job is ready for such inspection or
reinspection or when required corrections are not made. Reinspection fees may
be assessed when the approved plans are not readily available to the Inspector,
for failure to provide access on the date for which inspection is requested, or for
deviating from the city-approved plans. In instances where reinspection fees
have been assessed, no additional inspection of the work will be performed until
the required fees have been paid.
(F) Service Connections.
1. Connection approval. An electrical system or equipment regulated by this code
for which a permit is required shall not be connected to a source of energy or
power until approved by the Chief Building Official or designee.
2. Temporary connections. The Chief Building Official or designee may authorize
the temporary connection of the electrical system or equipment to the source of
energy or power for the purpose of testing the equipment, or for the use under a
temporary Certificate of Occupancy.
3. Authorized connection. When new electrical meters are installed or existing
electrical meters are to be relocated, the disconnection, connection or

reconnection to the meter shall be made only by authorized employees of the
utility purveyor.
(G) Violations.
It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge,
alter, repair, move, improve, remove, convert, demolish, equip, use or maintain any
electrical system or equipment or cause or permit the same to be done in violation of
this Code.
The issuance or granting of a permit or approval of plans and specifications or the
completion or approval of an inspection shall not be deemed or construed to be a
permit for, or an approval of, any violation of any of the provisions of this Code. No
permit presuming to give authority to violate or cancel the provisions of this Code
shall be valid, except insofar as the work or use which is authorized is lawful.
2. Article 100, Part I definitions shall be added or amended to read as follows:
Definitions.
Board of Adjustment. The Board of Adjustment shall be as appointed by the City
Council of the City of Coppell.
Building Code is the International Building Code, as adopted by the City of Coppell.
Chief Building Official (building official) is the officer charged with the administration
and enforcement of this Code, or his duly authorized representative, and is the authority
having jurisdiction for this Code.
Code Enforcement Agency is the department, division or agency of the City of Coppell
charged with the function of Code Enforcement and shall be under the administration
and operational control of the building official.
Engineering Supervision: Supervision by a Qualified State of Texas Licensed
Professional Engineer engaged primarily in the design or maintenance of electrical
installations.
Electrical Code is the National Electrical Code, 2023 edition promulgated by the National
Fire Protection Association, as adopted by the City of Coppell.

SECTION 2. If any section, subsection, paragraph, sentence, phrase or work in this ordinance,
or application thereof to any person or circumstance is held invalid by any court of competent
jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance,
and the City Council of the City of Coppell, Texas hereby declares it would have enacted such
remaining portions despite any such invalidity.
SECTION 3. That the repeal of any ordinance or any portion thereof by the preceding sections
shall not affect or impair any act done or right vested or accrued or any proceeding, suit or
prosecution had or commenced in any cause before such repeal shall take effect; but every such act
done, or right vested or accrued, or proceedings, suit or prosecution had or commenced shall
remain in full force and effect to all intents or purposes as if such ordinance or part thereof so
repealed shall remain in force.
SECTION 4. That any person, firm or corporation violating any of the provisions of this
ordinance or the Code of Ordinances as amended hereby, shall be guilty of a misdemeanor and
upon conviction in the Municipal Court of the City of Coppell, Texas, shall be subject to a fine
not to exceed the sum of Five Hundred Dollars ($500.00) for each offense, except where a
different penalty has been established by State law for such offense, the penalty shall be that
fixed by State law, and for any offense which is a violation of any provision of law that governs
fire safety, zoning or public health and sanitation, including dumping of refuse, the penalty shall
be fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each
and every day such offense is continued shall constitute a new and separate offense.

Introduction:
The purpose of this agenda item is to hold a public hearing and consider approval of a zoning change for
the Main Street Old Town project, which includes the construction of six new buildings. The site is
located at the southwest corner of W. Bethel Road and Main Street. It currently contains two buildings
that are proposed to be removed from the site to allow for this development. The site is just under an
acre in size and is proposed to have seven lots containing six new mixed-use buildings and a parking lot.
The main change from the previous submittal in November of 2022 to this submittal is the proposed uses
for the buildings, with restaurant uses being added to buildings 3-6 and the addition of medical office and
retail to building 6.
Background:
The property has been for sale for some time and the prospective buyer/developer is planning to build
six mixed-use buildings on the site and a common parking area. The development of the site in this
manner will necessitate the removal of the two existing buildings on the site which is being requested as
a separate agenda item. While the buildings are noted in the Historic Resource Survey, they are not listed
on the State or Federal registries for historic buildings.
On March 16, 2023, the Planning and Zoning Commission recommended unanimous APPROVAL of
PD-250R28-H, subject to the following conditions:
1. There may be additional comments during the Detail Engineering review.
2. Final Plat cannot be filed until buildings have been removed and zoning is approved.
3. Tree removal permit will be required prior to construction.

4. Coordinate with Parks Department for the removal of offsite trees and relocation of irrigation
south of Lot 7X to allow for access via the City’s parking lot.
5. Lot 7X, Block A, Main Street Old Town Addition shall only be used for parking.
6. Lot 7X, Block A, Main Street Old Town Addition will not have street frontage but will be
accessible via an access easement which will be required between Lot 7X, Block A, Main Street
Old Town Addition and the City of Coppell.
7. Existing 15 parking spaces on Main Street in front of this development shall be counted for this
development on the condition that this development becomes part of the Old Town POA.
8. Existing parking spaces in the “Old Town” area shall be counted towards this development on the
condition that this development becomes part of the Old Town POA.
9. The POA shall be responsible for maintenance of the common area, proposed Lot 7X, Block A,
Main Street Old Town Addition, and all landscaping.
10. All signage must comply with H District ordinance requirements.
11. Building 3 will not have any residential uses but may have a commercial occupancy on the second
floor.
12. Maximum building height shall not exceed 35-ft above finished floor.
13. The POA shall maintain all amenities including benches, dumpster, trash receptacles, bicycle
racks, sidewalk easements between buildings, etc.
14. The POA shall maintain the private drainage easement.
15. Submit a letter from the Old Town Main Street POA stating that they will accept this development
into their POA and all of the responsibilities and conditions stated above.
Benefit to the Community:
This will give additional professional and medical offices, retail, restaurant and dwelling opportunities
to the residents of Coppell.

City Attorney has reviewed the item.
Fiscal Impact:
This will generate additional sales tax and business personal property tax.
Recommendation:
The Planning and Zoning Commission recommended APPROVAL of the PD request subject to staff
conditions listed above.

HISTORY: This property has never been platted. There are two structures on the site.
According to the Historic Resource Survey, the “T” shaped building was built in
1948 as the Coppell Baptist Church, replacing a building erected in 1896. The other
structure, an education building, is an addition to the church that was built in 1953
and housed the kitchen, nursery, and Sunday School rooms. Additional information
regarding the style of the structure has been included as an attachment. In
December of 2022, a request for this site failed by a vote of (3-4) by the Coppell
City Council. The request included 7 lots (three (3) mixed-use office/residential
(Bldgs. 1, 2 and 6), two (2) mixed-use retail/residential (Bldgs. 4 and 5), one (1)
retail building (Bldg. 3) and one (1) common parking lot.)
HISTORIC COMMENT: The site has Historic District zoning and is listed in the Historic Resource Survey
as Priority A (church) and Priority B (education building). According to the survey
Priority A is architecturally and historically significant and Priority B is historically

significant. The resource survey lists the “T” shaped church as a one-story
minimalist traditional structure that lacks decorative detailing but does have a front-
facing gabled roof and front porch. The survey also lists the educational building
as being constructed in the minimalist traditional style featuring wood construction,
a front gabled roof and a simple façade.
TRANSPORTATION: West Bethel Road is a two-lane undivided road and Main Street is a two-lane
divided road with angled on-street parking.

COMPREHENSIVE PLAN:
Coppell 2030, A Comprehensive Master Plan, indicates this property as Old
Coppell Historic District. The Old Coppell Master Plan identifies this area as ideal
for mixed-use with a retail and service concentration for ground floors.
DISCUSSION: Site Plan
The site is located at the southwest corner of W. Bethel Road and Main Street. It
currently contains two buildings that are proposed to be removed from the site to
allow for this development. The site is just under an acre in size and is proposed to
have seven lots containing six new mixed-use buildings and a parking lot. The main
change from the previous submittal to this submittal is the proposed uses for the
buildings, with restaurant uses being added to buildings 3-6 and the addition of
medical office and retail to building 6. Buildings 1 and 2 will front W. Bethel Road.
Building 3 is located at the corner of Main Street and Bethel and the remaining
three buildings (4, 5 & 6) will front Main Street. These will have a similar spacing
as the existing buildings to the south. The proposed uses for the buildings are as
follows:
· Buildings 1 & 2 – office ground floor and residential above.
· Building 3 - retail or restaurant ground floor and retail above.
· Buildings 4 & 5 – retail or restaurant ground floor and residential above.
· Building 6 - medical office or retail or restaurant below and residential
above.
In the buildings with the residential component, the residential portion will be
located on the second floor and will have two garage spaces on the ground level
accessed from the rear of the lot. Lot 7X is not developable and will solely be used
as a common parking lot and is part of the PD conditions. Parking for the site will
be a combination of garage parking, on-street parking on Main Street, parking on
proposed Lot 7X, and parking spaces from the existing public parking spaces
nearby. The number of parking spaces required depends on the uses that will
occupy the buildings. The combination of existing and proposed parking in the

area will accommodate the proposed uses. As proposed, using the denser restaurant
uses per building, 118 parking spaces will be required versus the previous proposal
that required 74. This site is proposed to be added to the conceptual Planned
Development for the Old Town/Main Street Project and the existing P.O.A. for
maintenance of the parking lot and amenities (benches, dumpster, trash receptacles,
bike racks, sidewalks between buildings in easements, etc.). A sidewalk will be
built along Bethel Road and connecting sidewalks will be constructed from the
proposed Lot 7X parking lot to the street frontages via a four-foot (4-ft) sidewalk
easement located in between each of the buildings. No signs have been proposed
with this development.
Building Elevations
The development will contain six (6) buildable lots that share common design
elements and materials. They are in compliance with the Historic District design
guidelines. Each of the buildings will be two-story, with heights varying from
roughly 28-ft to just under 35-ft. Building one’s height increased approximately
two feet and building six’s height was reduced by four feet from the previous
submittal. The other buildings’ height did not change, neither did the elevations,
materials and colors. The material board identifies the color palette to be used on
the buildings within the development. A common shingle, brick and stone will be
used in the structures as well as building trims and accent color. The siding and
trims will be cement fiber board lap siding and shingle look siding with wood or
insulated steel front doors painted to match the trim. The two-car garage doors will
be a decorative insulated metal in the Arts and Crafts style. More detailed
information is provided on the elevations themselves for buildings 1-6, along with
the materials and colors proposed. A rendering with different views is also
provided.
Colors are from the Sherwin Williams exterior historic preservation palette. The
color for Building 1 will be Bunglehouse Blue with trims and soffits in a classical
white or light gray; the building is a combination of cement fiber board lap siding
and shingle look siding with decorative brackets and decorative porch poles with a
stone base.
The color for Building 2 will be a Westchester Gray with trims and soffits in a
classical white or light gray; cement fiber board lap siding makes up the elevation
materials. A front porch with a standing seam metal roof with exposed rafter tails
and painted tapered columns on a brick base. This will be carried over to the porch
at the rear of the dwelling but will have a roof matching the main roof of the house.
Architectural brackets will be located over the garage door, and a second story
balcony in the front of the building as well.
Building 3 will be Downing Earth in color, with trims and soffits in a classical white
or light gray; a standing seam metal roof on the turret with a decorative finial, and
stone construction, a wrap-around porch with decorative wood porch poles, a stone
base is located on the ground floor. A second story balcony with wall sconces is
located on the eastern elevation, with wooden railings for all of the balconies and
porch areas.

The color for Building 4 will be Downing Stone with trims and soffits in a classical
white or light gray; the cement fiber board siding will be a combination of wood
shingle look and a smoother looking siding with a stone base for a portion of the
front façade, and a balcony on the second story.
The color for Building 5 will be Roycroft Copper Red with trims and soffits in a
classical white or light gray; with vertical cement fiber siding with battens, a front
porch with a standing seam porch roof and architectural brackets over the garage
door.
The color for Building 6 will be Rockwood Blue Green with trims and soffits in a
classical white or light gray; the cement fiber board siding will be a combination of
wood shingle look and a smoother looking siding and a front porch with a standing
seam porch roof a stone base; and dormers on the roof.
Landscaping
There are no changes to the landscape plans from the previous submittal. The
existing trees interior to the site are proposed to be removed. A tree removal permit
will be required to remove trees on-site. There are also some Hackberry trees that
will need to be removed to provide access to this site through the existing city
parking lot located south of this site. The applicant will need to coordinate with the
Parks Department for the removal of those trees and any existing irrigation system.
The developer will be planting additional overstory trees on-site. Per the landscape
plans provided additional Cedar Elm, Chinese Pistache, Lacebark Elm and Texas
Red Oak trees will be planted throughout the site. The yards will have a variety of
landscaping that includes trees, grass, shrubs and groundcovers, with the focus
being the front yards. The parking lot (Lot 7X) will also have trees located in the
islands and western perimeter. The building lots have a range of 32%-36%
landscaping. Per the developer, the POA will maintain all landscaping on-site.
RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
Staff is recommending APPROVAL of the request subject to:
1. There may be additional comments during the Detail Engineering review.

Introduction:
The purpose of this agenda item is to consider a demotion permit for existing structures located at 509 W.
Bethel Road. The site has two existing buildings on it that date back to 1948 and 1953. Currently, the
buildings are underutilized, and in need of work. The developer Chris Collins has indicated that he would be
willing to repurpose elements from the existing buildings into the new buildings. Regardless of whether the
zoning for the new development is approved, the owner would like to be able to clear the site for
redevelopment.
Background:
There is a current proposal for the site to create seven lots that would contain six mixed-use buildings and one
parking lot (previous item on this agenda). In the Old Coppell Master Plan section that speaks to character
defining buildings, there is the following statement, “While it is not recommended that future demolitions be
prohibited for these buildings, their preservation is strongly encouraged.” The authors recognize that there
may be opportunities to preserve or restore buildings and there may be other opportunities to preserve historic
elements of the buildings.
On March 16, 2023, the Planning and Zoning Commission recommended APPROVAL of for the demolition
existing structures on-site.
Benefit to the Community:
This will give additional commercial redevelopment opportunities for the property.

Recommendation:

HISTORY: There are two structures on the site. According to the Historic Resource Survey,
the “T” shaped building was built in 1948 as the Coppell Baptist Church, replacing
a building erected in 1896. The other structure, an education building, is an addition
to the church that was built in 1953 and housed the kitchen, nursery, and Sunday
School rooms. Additional information regarding the style of the structure has been
included as an attachment. In December of 2022, a request for this site failed by a
vote of (3-4) by the Coppell City Council. The request included 7 lots (three (3)
mixed-use office/residential, two (2) mixed-use retail/residential, one (1) retail
building and one (1) common parking lot.) A new request to develop the site has
been made and would require the removal of the buildings.
HISTORIC COMMENT: The site has Historic District zoning and is listed in the Historic Resource Survey
as Priority A (church) and Priority B (education building). According to the survey
Priority A is architecturally and historically significant and Priority B is historically
significant. The resource survey lists the “T” shaped church as a one-story
minimalist traditional structure that lacks decorative detailing but does have a front-
facing gabled roof and front porch. The survey also lists the educational building
as being constructed in the minimalist traditional style featuring wood construction,

a front gabled roof and a simple façade. The buildings are not registered on the
State or Federal Historic Registries.
TRANSPORTATION: West Bethel Road is a two-lane undivided road and Main Street is a two-lane
divided road with angled on-street parking.
SURROUNDING LAND USE & ZONING:
North – Residence & Salon, (H)
South – Office and City parking lot (PD-250R8-H)
East - Restaurant (PD-250R8-H)
West – Office buildings (PD-275-H)
COMPREHENSIVE PLAN:
Coppell 2030, A Comprehensive Master Plan, indicates this property as Old
Coppell Historic District. The Old Coppell Master Plan identifies this area as ideal
for mixed-use with a retail and service concentration for ground floors.
