AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, BY AMENDING
THE CODE OF ORDINANCES, AS HERETOFORE AMENDING
CHAPTER 3 ‘CITY DEPARTMENTS’, ARTICLE 3-5. “SOLID WASTE,
RECYCLABLE MATERIALS, AND YARD TRIMMING PROGRAM’; BY
AMENDING SECTION 3-5-3- ‘DEFINITIONS’ BY REPEALING
DEFINITION FOR ‘CURBSIDE’ AND REPLACING IT WITH NEW
DEFINITION FOR ‘CURBSIDE’ AND BY ADDING DEFINITION FOR
‘FENCE LINE’; BY AMENDING SECTION 3-5-9 ‘LOCATION FOR CITY
PROGRAM COLLECTION AT RESIDENTIAL PROPERTIES’ OF SAID
CHAPTER AND ARTICLE, BY ADDING SUBSECTIONS ‘C’ AND ‘D’;
PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Coppell, Texas has determined that it is the
City’s best interest to update the definition of ‘curbside’ and amending regulations in Section 3-
5-3 and 3-5-9 under Chapter 3, Article 3-5.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the Code of Ordinances of the City of Coppell, Texas, be, and the same
is hereby amended by amending Chapter 3 ‘City Departments’, Article 3-5 ‘Solid Waste recyclable
Materials and Yard Trimming Program’ by amending Section 3-5-5 ‘Definitions’ by repealing
definition of ‘curbside’ and replacing it with new definition and by adding definition of ‘fence
line’, to read as follows:

The following words, terms and phrases, when used in this article, shall have
the meaning ascribed to them in this section, except where the context clearly indicates
a different meaning:
Brush . . . . .

Construction and demolition debris means . . . .
Curbside means the area where an improved surface of the driveway intersects the
pavement edge of the street or alleyway.

Fence line means the place where a rear yard fence is lawfully constructed and is
parallel to the alley.

SECTION 2. That the Code of Ordinances of the City of Coppell, Texas, be, and the same
is hereby amended by amending Chapter 3 ‘City Departments’, Article 3-5 ‘Solid Waste recyclable
Materials and Yard Trimming Program’ by amending Section 3-5-9 ‘Location for city program
collection at residential properties’ by adding Subsections ‘C’ and ‘D’ to read as follows:
“CHAPTER 3 – CITY DEPARTMENTS
ARTICLE 3-1. – WATER DEPARTMENT

ARTICLE 3-5. SOLID WASTE RECYCLABLE MATERIALS,
AND YARD TRIMMING PROGRAM
Sec. 3-5-1. – Applicability

Sec. 3-5-9. – Location for city program collection at residential properties.
Occupants of residential properties shall place set -outs at appropriate location
at or before 7:00 a.m. but not prior to 6:00 p.m. the day prior to the scheduled
collection day. Occupants shall receive the collections at the following location:

A. Special service. . . . . .

C. Street pick up . After refuse pick up , all residential and recycling containers
shall be removed from the curbside to a location behind the front building line.
D. Alley – After refuse pick-up, all residential and recycling containers shall be
removed from the curbside. If the residence does not have a fence, such
container shall be removed to a location no closer than five feet from the edge
of the alley pavement and be placed in such a manner as to prevent the
containers from rolling into the alley, spilling, or littering.”
SECTION 3. That all provisions of the Code of Ordinances of the City of Coppell, Texas,
in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other
provisions not in conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 4. That should any word, phrase, paragraph, section or portion of this
ordinance or of the Code of Ordinances, as amended hereby, be held to be void or
unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance
or of the Code of Ordinances, as amended hereby, which shall remain in full force and effect.
SECTION 5. That this ordinance shall become effective from and after its passage and
the rates established herein shall be effective on _______________, 2023.
