RE 2023-1212.3 Order Special Election4874-4361-0509, v. 1 RESOLUTION NO. 2023-1212.3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, DECLARING A VACANCY AND ORDERING A SPECIAL ELECTION FOR COUNCILMEMBER PLACE 5 OF THE CITY COUNCIL OF THE CITY OF COPPELL TEXAS TO FILL AN UNEXPIRED TERM; PROVIDING FOR ADMINISTRATION BY DALLAS AND DENTON COUNTY ELECTIONS ADMINISTRATORS; PROVIDING FOR PRESIDING ELECTION JUDGE AND AN ALTERNATE PRESIDING JUDGE; PROVIDING FOR EARLY VOTING; PROVIDING APPLICATION FOR BALLOT BY MAIL; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Councilmember Place 5 had been elected as a City Councilmember for a three-year term of the City of Coppell Texas; and WHEREAS, the Councilmember has declared himself as a candidate for another elected position for the Texas Legislature; and WHEREAS, the Texas Constitution declares that a member who is serving a three-year term has resigned his or her position upon declaration of another elective office and, therefore, has resigned his position on December 7, 2023; and WHEREAS, the City Council shall declare a vacancy; and in accordance with the Texas Constitution and Coppell Home Rule Charter order a special election to fill the unexpired term of Councilmember Place 5 of the Coppell City Council, Coppell, Texas at the next uniform election date on May 4, 2024. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the City Council of the City of Coppell, Texas, hereby declares that there is a vacancy for Councilmember Place 5 for the City Council of the City of Coppell, Texas. SECTION 2. That the City Council hereby orders a special election in conformity with the Texas Constitution and the Home Rule Charter of the City of Coppell, Texas, to be held on May 4, 2024, to elect a City Councilmember for Place 5 of the City Council of the City of Coppell, Texas to serve the remainder of the unexpired term. The candidate filing period for the Special Election will be January 17 through February 16, 2024. SECTION 3. That the special election shall be administered by the Dallas and Denton County Elections Administrators in accordance with the provisions of the Texas Election Code. SECTION 4. That a Presiding Election Judge and an Alternate Presiding Election Judge shall be appointed in accordance with the Special Election. SECTION 5. That early voting by personal appearance shall be conducted at Coppell Town Center , 255 Parkway Blvd, Coppell, Texas . Early voting will be conducted Monday , April 22 through Tuesday , April 30, 2024. Qualified residents of Coppell may vote early for the Special Election by personal appearance at either the Coppell City Hall or at any other branch locations, as published by Dallas and Denton Counties. Applications can be submitted by Mail , Carrier Delivery , Fax or Email. Applications for a ballot by mail shall be mailed to: Dallas County residents Dallas County Elections Department 1520 Round Table Drive Dallas , Texas 75247 Denton County residents Denton County Elections Administration P .O. Box 1720 Denton, TX 76208 Application for ballot by mail must be received no later than the close of business on April 23, 2024. SECTION 6. That the City Secretary shall present such returns to the City Council for the canvassing of said election. Such canvass shall be conducted by the City Council not earlier than the 3rd day nor later than the 13th day after the election. SECTION 7 . That this Resolution shall take effect immediately from and after its adoption and it is so resolved.
