OR 86-359 Annexes 186.438 acres ANNEXATION ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 86359 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ANNEXING THE HEREINAFTER DESCRIBED TERRITORY INTO THE CITY OF COPPELL, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF THE CITY TO INCLUDE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE CITY LIMITS AND GRANTING TO ALL INHABITANTS AND OWNERS OF SAID PROPERTY, ALL THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING ALL INHABITANTS BY ALL THE ORDINANCES, ACTS, RESOLUTIONS AND REGULATIONS OF THE CITY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING THE EFFECTIVE DATE OF SAID ORDINANCE. WHEREAS, the City Council of the City of Coppell, Texas, finds that the hereinafter described territory is contiguous and adjacent to the corporate iimits of the City of Coppell, and does not exceed one-half mile in width; and WHEREAS, the Building Official of the City prepared a service plan for the area, a copy of which is attached hereto as Exhibit "A'; and WHEREAS, after notice was duly given, public hearings on the proposed annexation were held by the City Council all in compliance with Article 970-A, Vernon's Annotated Civil Statutes of the State of Texas; and WHEREAS, the City Council has concluded that such area should be annexed into and made a part of the City of Coppell, Texas: NOW, THEREFORE, BE IT ORDAINED BY THE CiTY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECT~_')N !. That the fofiow{ng describ~.d territocy be, and the seAne is hereby, annexed into and made a part of the corporate limits of the City of Coppeil, Texas, and the same shall hereafter be included within the territorial_ limits of said City, and the inhabitants thereof shall hereafter be entitled to all rights and privileges of other citizens of the City, and shall be bound by the ordinances, acts, resolutions and regulations of the City of Coppell, Texas. Said territory hereby annexed is listed below as "Tract 2", being the Tract 2 shown on that certain plat prepared by Ginn Inc., dated March 1986 and marked (j-302) and being described as follows: Tract 2. BEiLG a tract of land situated in the Cordella Bowen Survey, Abstract 56, and the jefferson Ti!ley Survey, Abstract 1474 of Dallas County, Texas, and being more particularly that tract of land located at the northwest come; of the intersecticn of Belt Line Road (!20' ROW) with tH-635, described by metes and bounds as follows: BEGINNING at a point which is the intersection of the West line of Belt Line Road (120' ROW) and the Northeast line of IH-635 (variable width ROW) marked by a concrete monument; THENCE N 71 degrees i7'55" W along said northeast line of IH-635 a distance of 1544.42 feet; THENCE continuing along said northeast line N 51 degrees 13'38" W a distance of 1057.19 feet; THENCE continuing along said northeast line N 39 degrees 38'42" W a distance of 808.75 feet; THENCE continuing along said northeast line N 35 degrees 27'05 W a distance of 1268.98 feet; THENCE N 0 degrees 29'50" E a distance of 79D.27 feet to a point being the northwest corner cf this tract and also being the southwest corner of a tract of land conveyed to Coppall Independent 6chool District by deed in Volume 417, Page 461, Deed Records of Dallas County, Texas; THENCE N 88 degrees 43'51" E a distance of 2395.85 feet to the most northerly northeast corner of this tract; THENCE S 1 degree 16'13" W a distance of 1111.50 feet to the most southerly southwest corner of a tract of land conveyed to Connell Development Company by deed in Volume 4378, Page 376, and Volume 4420, Page 275, Deed Records of Dallas County, Texas; THENCE S g9 degrees 47'35" E along tne south line of said Cormell tract a distance of 1174.44 feet to a point on the west line of Belt Line Road'(120' ROW), said point being the most easterly northeast corner of this tract and also being the southeast corner of the Cormell tract; THENCE S 0 degrees 17'22" W along the west line of Belt Line Road a distance of 2541.58 feet to the Point of Beginning and containing 186.438 acres, more or less. SECTION 2. It is the intention of the City to annex only that territory which is legally subject to being annexed by the City and should any portion of the above described territory be not subject to legal annexation by the City of Coppell, Texas, such fact shall not prevent the City from annexing such portion of said territory which is subject to legal annexation by the City of Coppell, Texas. Therefore, if any provision or portion of the territory herein descrihc~ i~ held to be invalid by a court of competent jurisdiction, such provision or portion of land shall be deem~,i as separate, distinct and independent and such holding shall not affect the validity of the remaining prcv~sinns of this ordinance or portions of land annexed by this ordinance. SECTION 3. This ordinance shall take effect from and after its pasage as the law in such cases provides. SERVICE PLAN FOR AREA BEING CONSIDERED FOR ANNEXATION ~. ~t 5~ ACRE TRACT When annexed the services proposed to be provided by the City of Coppell shall be as follows: Police and Fire services will be provided immediately to the same extent as provided other areas already in the city. Zoning protection wi]] be provided immediately to the same extent as provided other areas already in the city. Subdivision regulation protection will be provided immediately to the same extent as provided other areas already in the city. Garbage collection will be provided immediately to the same extent as provided other areas already in the city. City inspection and enforcement of building, electrical and other ordinances will be enforced immediately to the same extent as enforced in other areas already in the city, thereby protecting the health and safety of persons and property in the area. Gas, electric and telephone services will be provided through city franchise. Connection to existing water and sewer lines will be provided in accordance with City ordinances, policies and regulations and upon connection such services will be provided at the same rates as charged others within the city. Extension of water and sewer into areas will be done in accordance with city ordinances, policies and regulations as development, improvement or construction commences within the area and in accordance with city policy as to city participation.
