ORDINANCE NO. 86349
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE DISASTER
CONTROL REGULATIONS OF THE CITY BY AMENDING CHAPTER 16 OF THE CODE
OF ORDINANCES OF THE CITY BY ADDING THERETO A NEW ARTICLE 16-2 TO
PROVIDE THE DUTIES AND POWERS OF SHELTER MANAGERS DURING NATIONAL
EMERGENCIES; PROVIDING THAT IT SHALL BE UNLAWFUL TO REFUSE TO CARRY
OUT THE ORDERS OF THE SHELTER MANAGER AND HIS APPOINTED STAFF DURING
NATIONAL EMERGENCIES; PROVIDING A REPEALING CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED
THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE, EXCEPT WHERE
A DIFFERENT PENALTY HAS BEEN ESTABLISHED BY STATE LAW FOR SUCH OFFENSE,
THE PENALTY SHALL BE THAT FIXED BY STATE LAW AND FOR ANY OFFENSE
WHICH IS A VIOLATION OF ANY PROVISION THAT GOVERNS FIRE SAFETY, ZONING,
PUBLIC HEALTH AND SANITATION, A PENALTY OF FINE NOT TO EXCEED THE SUM
OF ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE; AND DECLARING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS.
SECTION 1. AMENDING CHAPTER 16 OF CODE OF ORDINANCES
That Chapter 16 of the Code of Ordinances of the City of Coppell, Texas, be,
and the same is hereby, amended by adding thereto a new ARTICLE 16-2 to read as
follows:
"ARTICLE 16 - 2
SHELTER MANAGERS DURING NATIONAL EMERGENCIES
Section 16-2-1 DUTIES AND POWERS OF SHELTER MANAGERS
That in case of National emergency, Public Shelter Managers duly
appointed by the civil Preparedness Coordinator/Director shall open
public shelters, take charge of all stocks of food, water and other
supplies stored in said shelter, admit the public according to the
City's shelter use plan, and take whatever control measures as are
necessary for the protection and safety of the occupants. (Ord. )
Section 16-2-2 REFUSAL OF SHELTER MANAGER'S ORDERS UNLAWFUL
Shelter Managers are authorized to use reasonable restraint against
those who refuse to cooperate with the routine of shelter living
under emergency conditions. Refusal to carry out the orders of
the Shelter Manager and his appointed staff during such National
emergencies shall be deemed a misdemeanor and unlawful, punishable
by fine as provided by this Code for such violations." (Ord. )
SECTION 2. REPEALING CLAUSE
All ordinances, or parts of ordinances, inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 4. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shall be adjudged invalid or held unconstitutional, the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decided to be invalid or unconstitutional.
SECTION 5. PENALTY CLAUSE
Any person, firm or corporation violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a
penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense,
except where a different penalty has been established by State Law for such offense,
the penalty shall be that fixed by state law and for any offense which is a violation of
any provision that governs fire safety, zoning, public health and sanitation, a penalty
of fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each offense,
and each and every day such offense is continued shall constitute a new and separate
offense.
SECTION 6. EFFECTIVE DATE
This ordinance shall take effect immediately from and after the publication of
its caption, as the law in such cases provides.
