B.Consider approval of a Resolution approving a Tax Abatement Agreement by and between the City of Coppell and Fulgent Genetics, Inc.; and authorizing the Mayor to sign. End of Consent Agenda 11.Presentation regarding ARPA Final Allocation. Deputy City Manager Traci Leach gave the presentation to Mayor and City Council. Councilmember Biju Mathew left at 8:30 p.m. City Manager Reports, Project Updates, Future Agendas, and Direction from Work Session 12. City Manager Mike Land gave the following report: S. Belt Line – All lanes are open. The contractor is continuing to work on punch list items. DART – continuing to work on franchise relocations at Freeport and the storm drain installation across Freeport. Woodhurst – The contractor has poured the westbound lane from Sandy Knoll to the Cul de Sac. Andy Brown Park West Streambank Repair – The temporary repair to the bank failure is complete. Site cleanup and interim fencing is being installed before the trail can be re-opened. Fire Station #5 – Groundbreaking is coming in June. Community Experiences Master Plan – The next Public Input meeting is scheduled for Thursday, June 6 at 6PM at the Arts Center. The community input survey will also go live on June 1. The link to the survey will be available on the website and all social media channels. Storm Cleanup – Crews have been working all day removing trees from the roadways to the right of way. Some of the trees belong to HOA properties or individual property owners. They will be responsible for the final clean-up. Trees belonging to the City will be removed. Parkway Blvd. and authorizing the Mayor to sign. 2040: Perpetuate a Learning Environment Introduction: The purpose of this agenda item is to ask Council to approve an Ordinance for PD-183R2-C, to allow for a 46,265 sq. ft. Fine Arts Building, a 4,600 sq. ft. Tennis Building and field equipment/event areas on 63.478 acres of property located at 185 W. Parkway Blvd. Background: On April 18, 2024, the Planning and Zoning Commission unanimously recommended approval of this zone change request. Coppell High School is planning to construct two new buildings and a new field equipment event area for their students. On May 14, 2024, City Council unanimously approved this request with the following conditions that have been added to the ordinance: 1. There may be additional comments during the Detail Engineering review. 2. A plat will be required showing the revised fire lanes and easements. 3. PD Conditions: 1. To allow the landscaping as proposed. 2. Approve the site plan as presented. Benefit to the Community: This will help enrich the students lives. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance and Zoning Map of the City of Coppell, Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and the same is hereby amended to grant a change in zoning from PD-183R-C (Planned Development 183 Revised - Commercial) to PD-183R2-C (Planned Development 183 Revision 2 - Commercial), to approve the amended Detail Site Plan, amended Landscape Plan, 18 2 Elevations and Signage Plan for a 46,265-sf Fine Arts building, a 4,600-sf Tennis building and Field Activity Area for the Coppell High School Service Center, on 63.478 acres of land located at 185 W. Parkway Blvd and being more particularly described in Exhibit “A” attached hereto and made part hereof for all purposes. SECTION 2. That the Planned Development-183R2-Commercial shall be used only for educational related public school purposes in accordance with development regulations as provided herein and subject to the following development regulations as set forth herein below: A. Development of the property shall be in accordance with the previous zoning and regulations as provided in Ordinances 91500-A-649, except as herein amended; B. Use, construction and maintenance of the property shall be in accordance with the amended Site Plan, amended Landscape Plan, Elevations and Provisions in accordance with applicable regulations contained in the Code of Ordinances; C. Development, construction and use shall conform to the amended Detail Site Plan as depicted in the Exhibit “B”. D. Development shall conform to the amended Landscape Plan as depicted in the Exhibit “C”. E. Development shall conform to the Elevations and Signage Plan for the elements as set forth and depicted in Exhibit “D”. SECTION 3. That the Detail Site Plan, Landscape Plan, Elevations and Signage Plan, and all comments and notes set forth therein, attached hereto as Exhibits “B” through “D” are made a part hereof for all purposes, and hereby approved as development regulations. SECTION 4. That the above property shall be used only in the manner and for the purpose provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and as amended herein. 19 3 SECTION 5. That the development of the property herein shall be in accordance with building regulations, zoning ordinances, and any applicable ordinances except as may be specifically altered or amended herein. SECTION 6. That all provisions of the Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 7. That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. Sandy Lake Rd. 2040: Create Business and Innovation Nodes Introduction: This is a simple request, but because it involves a setback encroachment and an addition of an attached sign to a canopy, we could not process the request administratively. Background: This request is to allow a porte-cochere/canopy to encroach into the required 60’ front yard setback. It is proposed to be setback approximately 34-feet from the W. Sandy Lake Road right-of-way. This will be located outside the TP&L Electric Easement that runs parallel to Sandy Lake. They are requesting to have an attached “Welbilt” sign on the west side of the proposed addition. Because the addition is considered a canopy and the sign section of the Zoning Ordinance prohibits signage on canopies, the applicant is requesting a PD Condition be added to allow signage on canopies. Staff is in support of the addition because it enhances the entry and offers the visitors relief from the unpredictable weather. In addition to the PD Conditions being added, the applicant is proposing to make the following modifications: • One tree is proposed to be relocated to the east. • A 60 square foot monument sign is proposed to be located on the SH 121 frontage road with evergreen shrubs. • There is an emergency generator, mechanical equipment and dumpsters/compactors proposed on the east side of the building in the dock area. These are proposed to be screened with solid metal enclosures. • A small canopy and signage are proposed at the northwest corner of the building. 68 2 • Speed humps are proposed to be located in the drive aisle west of and in front of the building to prevent cut through traffic. The intent of this initiative, which was adopted by City Council, was to revise the 1996 Future Land Use Plan and to rezone these properties from Light Industrial to Highway Commercial to “allow the land owners significant flexibly in development options to take advantage of the highway access while assuring compliance with the vision for the City’s most visible corridors”. The 2030 Comprehensive Plan reinforced this vision by designating this property as Freeway Special District. A Concept Plan for hotels, office and retail uses was approved in 2018, along with a Detail Site Plan for two hotels on 6 acres along the eastern portion of the site. No specific retail or offices users were identified for the remaining 11 acres of the site. 70 ITEM # 5 Page 2 of 4 In November 2021, a zoning change request was approved to establish a new Concept Site Plan for hotels, an Office/Warehouse and a commercial building on 16.58 acres of property and a Detail Site Plan for two Hotels (Home2Suites and a Marriott Element), on approximately 6.01 acres of land, and a Detail Site Plan for an Office/Warehouse building on 9.01 acres of land and an amendment to the 2030 Comprehensive Master Plan from Freeway Special District to Industrial Special District on the 9.01 acre portion on the east. The 9.01-acre lot is the subject property. HISTORIC COMMENT: This property does not have any historic significance. TRANSPORTATION: SH 121 is a state highway, recently built to standard. Sandy Lake Road is a six-lane divided thoroughfare.
