A motion was made by Vice Chair Portman, seconded by Commissioner Hafemann, to approve the minutes of the May 16, 2024, Planning and Zoning meeting. The motion was approved unanimously, 7-0. 6.Consider approval of Site Plan, Lovett Industrial, Lot 1, Block A, a total of 6.56 ac. split between the City of Coppell and the City of Lewisville, for the construction of an office warehouse building (81,156-sf.) in Lewisville and associated parking located in Coppell, located at the southeast corner of Vista Ridge Mall Dr. and SH 121 and subject to an inter-local agreement. Chairman Haas opened the Public Hearing and asked for those who signed up to speak: 1) Justin Keller, 829 Bullock St., spoke against the proposed request. 2) Julio Castenada, 821 Bullock St., spoke against the proposed request. 3) Rich Pilone, 801 Howell, spoke against the proposed request. 4) Viswanatha Kichili, 196 Southwestern, spoke against the proposed request. Chairman Haas closed the Public Hearing. Cole Baker, E.I.T., Graduate Engineer, City of Coppell, was present to answer questions of the Commission regarding parking on the street. Luay Rahil, City of Coppell Assistant Director of Community Development, was present to answer questions of the Commission regarding Code Compliance. The motion failed with the following vote, 3-4. HEARING DATE: September 10, 2024 STAFF REP.: Mary Paron-Boswell, AICP Senior Planner LOCATION: 619 Oakbend Dr. SIZE OF AREA: 0.74 acres CURRENT ZONING: PD-109-SF-9 (Planned Development 109 - Single-Family -9) REQUEST: PD-109-SF-9 (Planned Development 109 - Single-Family -9) to PD-109R3-SF-9 (Planned Development 109 Revision 3- Single-Family -9) to approve a short-term rental on 0.74 acres of property located at 619 Oakbend Dr., at the request of Scott A. Young, the property owner. APPLICANT: Owner: Scott A. Young 619 Oakbend Dr. Coppell, TX 75019 972-268-1741 scottyoung@certifiedlights.com HISTORY: On May 30, 2023, the Coppell City Council approved an ordinance amending the Code of Ordinances, Chapter 12, Article 30 (S or SUP, Special Use Permits) defining and establishing Special Use Permit requirements for lodging houses (short-term rental,(STRs), bed and breakfasts, boarding homes, hostels, vacation homes, and corporate housing) within SF-7, SF-9, SF-12, SF-18, SF-ED and H Districts. All existing and future short-term rentals will be required to have a Special Use Permit (SUP) in addition to registering with the city, in order to legally operate in the City of Coppell. HISTORIC COMMENT: This property has no noted historical significance. TRANSPORTATION: Oakbend Drive is a local street. ITEM # 6 Page 2 of 3 SURROUNDING LAND USE & ZONING: North: Residential - PD-109-SF-9 (Planned Development 109 - Single-Family -9) South: Residential - PD-100-SF-9 (Planned Development 100 - Single-Family -9) East: Residential - PD-109-SF-9 (Planned Development 109 - Single-Family -9) West: Residential - PD-109-SF-9 (Planned Development 109 - Single-Family -9) COMPREHENSIVE PLAN: Coppell 2030, A Comprehensive Master Plan, shows this property as appropriate for Residential Neighborhood. DISCUSSION: The applicant has owned the home since 2012 and has a homestead exemption. The applicant is wanting to rent out four (4) of the five (5) bedrooms. Site Plan The residence is located on the south side of Oakbend Drive. The single-family home has a two-car garage that fronts the street since there is no alley. There are an additional two (2) spaces on the driveway for guest vehicles to park. Guests would have access to the entire house which includes a kitchen, laundry room, living room, game room on the interior and an outdoor kitchen, pool and basketball court on the exterior. There are no signs on the buildings indicating that it is a STR. According to Code Compliance, the home received a permit for an STR in 2021. It was used for short-term rentals until the license was revoked in 2022 because the property was not the property owner’s primary residence, as they had indicated on their Airbnb listing that they had moved out. They were given a letter to cease all operations of this as a short-term rental. Mr. Young appealed this decision to the Board of Adjustment, where at such time his permit was revoked. The home was then listed for long-term rental on-line, without a permit. Code Compliance started a case for this as well. The applicant did come in for a permit and has been renting the home since 2022 for long term rentals as well as starting back up with illegal Short-Term Rentals for which they were sent a letter in June of this year. Code Compliance had also issued letters for delinquent HOT taxes which were subsequently paid. Part of the current process for having a STR is registering with the city and paying HOT Taxes, which will still be required should this case be approved. Mr. Young has indicated that he does live there, however, at the moment, the home is being rented out for a long-term rental, so he is living elsewhere. He also indicated that if he was not there then his son would be there, as there is a requirement that the owner be residing at the residence during the rental period. He does own two other properties according to Dallas County Appraisal records. Staff also reached out to the Police Department and there was a complaint on file for noise from one of the neighbors back in 2021. Staff did find the home advertised online for rent but has since been removed. Staff has also received several phone calls from the neighborhood indicating that they were not in favor of the request and of past issues with previous STR rentals at this address. ITEM # 6 Page 3 of 3 RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Based on the information provided above Staff is unable to recommend approval of this request. Should the Commission choose to recommend approval of this request, staff would recommend the following conditions: 1. PD Conditions: a. To obtain a STR permit prior to their current one expiring. b. Notify staff of any change of property ownership. c. Limit the rental to four rooms for less than 30 days. ALTERNATIVES: 1. Approval of the request 2. Denial of the request 3.
