Deputy City Manager Kent Collins gave the following updates: Magnolia Park Trail – First phases of construction are underway. Woodhurst – All the utilities have been completed and paving of the westbound lanes is finished. The contractor is now working on paving the eastbound lanes. DART – They are working on completed all the pavement repairs on S. Coppell road and its expected to be open by the end of this week. Fire Station #5 – Underground utilities are complete. The contractor is preparing the building slab. Service Center – We have a kickoff meeting with the contractor this week to begin Phase 1, which is the north parking lot. Background: The Criminal Justice Center, which consists of the Police Department and Municipal Court, was constructed in 1995. In the original construction, the Police Department housed temporary prisoners in a small holding facility. The holding facility consisted of a booking area and several jail cells. Also, in the original construction was a communications center, commonly referred to as dispatch. The dispatch center housed all the radio equipment used to communicate with officers in the field. In 2012, after service agreements were finalized for jail and dispatch services, the Police Department renovated those spaces to accommodate office spaces. Included in these renovations were the conversion of the existing jail to a designated patrol area and conversion of the dispatch center to an additional training room. The renovations also included an expansion of the locker rooms. However, no ventilation system was included in the expansion. The expansion did not include the small gym or the breakroom. There are many needs and improvements that need to be made to the Police Department workspace. As stated above, both locker rooms, men’s, and women’s, need improvements. Neither locker room has 2 adequate ventilation, which causes mold problems, odors and ultimately, officer complaints. The current gym will not accommodate more than three individuals simultaneously. To support the Department’s physical fitness needs, the gym should be large enough to accommodate approximately five individuals safely and comfortably. As for the current breakroom, it does not accommodate more than five people at one time. To support the Department’s space needs, the breakroom should accommodate up to 12 people. This much-needed space would help alleviate officers from having to find additional eating spaces. In October of 2023, Council directed staff to proceed with the initial design evaluation and needs assessment of the existing facility with Parkhill. At the December 12, 2023, meeting, Council approved the Justice Center Expansion Schematic Design (SD) contract in the amount of $319,874.00, to facilitate design of the expansion and renovation to the SD level of plans. This allowed for budgeting at the SD level so that accurate pricing decisions could be made. At that time, staff anticipated returning to update City Council at the end of the SD design to request an amendment to finalize the design. Tonight, final architectural costs are being considered to complete the project design at the Construction Document (CD) level and will carry the project through construction completion and warranty phase. If approved by the Council, the total value of the contract from design to warranty phase will be $868,874.00. Benefit to the Community: To provide Sustainable Government, the Justice Center Expansion will provide adequate and compliant locker rooms, increase break room capacity, and provide gym space for required physical testing and fitness standards. Legal Review: The City Attorney has reviewed the original contract. The proposed project will include extension of the existing 30-inch concrete storm drainpipe, reconstruction of the pipe outfall to be a vertical headwall flush with existing retaining walls on either side, and installation of a new anchored concrete drop structure apron to prevent future undercutting of the outfall. 2 The original design contract, executed in March 2023 for $48,900.00, faced delays due to high water levels in Denton Creek, which impacted the survey crew’s ability to gather the necessary data. During this time, additional failures occurred, necessitating further design modifications and structural improvements. Please note that this contract amendment is for additional engineering design services only. The actual construction of this project will be awarded at a subsequent meeting. As this storm drain is located in a city-owned easement, the city is responsible for its maintenance. Background: Construction for the Blackberry Farm development began in 2022, and the developer is currently working on completing final items to close out Phase 1 of the project. As part of the project, four new streets were constructed. The streets in this subdivision are privately owned and maintained by the Blackberry Farm HOA and are dedicated by plat as a Utility, Drainage, Emergency Access, and Limited General Public Access Easement. Section 542.008 of the Texas Transportation Code allows municipalities to extend traffic regulations to roads within a private subdivision so that the roads in the subdivision are under the same rules as roads owned by the municipality, if the municipality finds the extension of these regulations to be in the best interest of the municipality. A separate ordinance related to this provision is on the agenda for this meeting. By default, a street with no posted speed limit in the State of Texas is 30 mph. Section 545.356 of the Texas Transportation Code allows municipalities to declare a lower prima facie speed limit not less than 25 mph, if it determines that 30 mph is unreasonable or unsafe. The City of Coppell has modified the speed limit on residential streets to 25 mph under this provision of the code. 2 The speed limit signs for this subdivision are being installed by the developer as part of their approved construction drawings. Since that purchase, the Tasers have reached Axon’s end of life for software and hardware support, upgrades, or maintenance and need to be replaced. In August 2019, the City of Coppell entered into an agreement with Axon to purchase in-car and body worn cameras. Included in the purchased package was unlimited cloud-based storage, live streaming video of officers in the field, redaction, and case sharing software. The contract was for five years. The new Axon contract combines those two separate items into one new bundled contract along with several additional features for the term of five years. The contract includes new body worn cameras (including replacements in two years), in-car cameras, live streaming, GPS of officers in the field, unlimited cloud-based storage, and case sharing between agencies. The new tasers will be the latest model and includes all the training equipment including cartridges needed for the next five years. The contract also includes replacing existing older cameras in the Interview Room and Juvenile Holding Room. Those cameras were originally purchased in 2014 and are part of an older system 2 that doesn’t include cloud storage. The new cameras would connect those two rooms with the Axon database for faster and more efficient workflow when viewing or retrieving those videos. Benefit to the Community: By renewing this contract, Axon will continue to provide the Police Department tasers, body worn and in-car camera solutions along with cloud storage for our digital evidence for the next five years. We would also have access to additional features like collecting evidence from citizens through digital links, live view and GPS location of officers in the field and sharing evidence with the Dallas County District Attorney’s Office. Axon provides the Coppell Marshals Office with body worn cameras and the unlimited cloud storage and management of those videos. In addition to the video solutions, the City also purchase the Tasers from Axon. This request aligns with Pillar 3 of Coppell 2040 Vision. Background: In 2018, the Coppell Municipal Court purchased the X2 Taser for all the Marshals. Since that purchase the Tasers have reached Axon’s end of life for software and hardware upgrades, maintenance, and support and need to be replaced. In August 2019, the City of Coppell entered into an agreement with Axon to purchase in-car and body worn cameras. Included in the purchased package was unlimited cloud-based storage, live streaming video of officers in the field, redaction, and case sharing software. The contract was for five years. The new Axon contract combines those two separate items into one new bundled contract along with several additional features for the term of five years. The contract includes new body worn cameras (including replacements in two years), in-car cameras, live streaming, GPS of officers in the field, unlimited cloud-based storage, and case sharing between agencies. The new tasers will be the latest model and includes all the training equipment including cartridges needed for the next five years. 2 Benefit to the Community: By renewing this contract, Axon will continue to provide all the Marshals Office tasers and body worn camera solutions along with cloud storage for the digital evidence for the next five years. The City would also have access to additional features like collecting evidence from citizens through digital links and live view and GPS location of officers in the field. Legal Review: This agenda item has been reviewed by Legal. Fiscal Impact: The fiscal impact of this Agenda item is $65,961.70 as provided by the fund balance in the Municipal Court Building Security Fund. The full value of the five-year contract will be reflected in the purchase order and each successive year will deduct 1/5 of the amount until the contract’s end. Background: In 2015, the Police Department launched a program called Citizens on Patrol (COPS). The intentions of this program were to engage with the Community, solicit volunteers from among them, help our Police Department reduce and prevent crime, assist police with non-law enforcement activities, and maintain a constant visible presence in the City of Coppell. At the time of launch, the Citizens on Patrol had one vehicle assigned to them. Since then, the program has continually grown to the benefit of the citizens of Coppell and the Police Department. Over the past nine years the Citizens on Patrol program has expanded from one vehicle to three vehicles with multiple vehicles being deployed at the same time on a weekly basis. From January 2024 until August of 2024, COPS volunteers have worked a total of 2,905.75 hours, which averages to 83.02 hours every week. During that time, they have assisted with traffic accidents, motorist assists, vacation house checks, missing persons, and being visible in school zones and throughout the city. Ultimately this program, through the contributions of our citizens who volunteer, has effectively become a force multiplier benefiting our community. Currently the oldest vehicle assigned to the Citizens on Patrol is a 2013 Chevy Tahoe. This came from the Police Department’s patrol division in 2018. Historically, vehicles from the Patrol division do not have a long life span due to normal wear and tear stemming from the everyday driving on 2 patrol. The request of the new vehicle is being made to replace this 2013 Chevy Tahoe, which is the oldest vehicle in their fleet of three. This request aligns with Pillar 3 of the City’s 2040 vision. Benefit to the Community: By adding this new replacement COPS vehicle, the program will continue to thrive and be a visible presence in the City of Coppell. These vehicles are an essential piece of equipment used by the COPS volunteers to help in their continued support of the citizens of Coppell and the Coppell Police Department. FREQUENCY OF MEETINGS -The applicable statutes require the board of directors to meet a minimum of once each calendar quarter. 1 Dallas Central Appraisal District Date: August 23, 2024 To: Wes Mays, Mayor, City of Coppell | wmays@coppelltx.gov Sent Via Email From: Shane Docherty, Executive Director/Chief Appraiser Re: Election/Appointment of Members to Board of Directors of the Dallas Central Appraisal District Number of Votes Allocated To: Coppell is 35 Senate Bill 2 (or “SB 2”), enacted by the 88th Texas Legislature during its Second Called Session, amended several sections of the Texas Property Tax Code regarding the composition of the board of directors for appraisal districts in counties with a population of 75,000 or more (a “populous county”). Dallas County is a ‘populous county’. Specifically, Article V, Section 5.03 of SB 2 added Section 6.0301 to the Tax Code that sets forth the amendments relating to the composition and method of selection of appraisal district boards of directors in populous counties. Article V of SB 2 will became effective July 1, 2024, and Sections 5.04 and 5.13 of SB 2 became effective on October 12, 2023. Section 6.0301 of the Texas Property Tax Code provides that an appraisal district in a populous county shall be governed by a board of nine (9) directors composed of both appointed and elected directors. Five (5) of the directors are to be appointed by the taxing units that participate in the district in the manner as previously prescribed by Section 6.03 of the Tax Code (the “levy method”), and three (3) directors are to be elected by majority vote at the general election for state and county officers by the voters of the county in which the district is established. The County tax assessor-collector serves as a voting ex office member. SB 2 required the first election for elected directors for districts within populous counties be held on the uniform election date in May 2024. The three (3) additional Board members were elected as a result of the May 4, 2024 election, became a part of the Dallas CAD Board of Directors and the Dallas County Tax Assessor/Collector became a voting ex officio member effective July 1, 2024. Prior to 2024 and pursuant to the provisions of the Texas Property Tax Code in 1979, the agencies of Greater Dallas County agreed to change the manner in which board representatives were chosen. By special provision of the Property Tax Code, it was decided that the City of Dallas , Dallas ISD and Dallas County would each appoint one (1) member each and the remaining two (2) candidates would be elected by all Suburban Cities (excluding Dallas) and all Suburban School Districts (excluding Dallas ISD). Each group, Suburban Cities and Suburban Schools, could nominate one candidate for their respective group and vote from among the nominations to elect by majority vote (one vote per entity) one (1) member to represent the Suburban Cities and one (1) member to represent the Suburban School Districts. This method of appointment and election of the Board members no longer applies with the passage of Senate Bill 2. 2 Effective January 1, 2025, the five (5) appointed board of directors will be elected according to Tax Code Section 6.03, or the “Levy Method”. The voting entitlement of a taxing unit that is entitled to vote for directors is determined by dividing the total dollar amount of property taxes imposed in the district by the taxing unit for the preceding tax year by the sum of the total dollar amount of property taxes imposed in the district for that year by each taxing unit that is entitled to vote, by multiplying the quotient by 1,000, and by rounding the product to the nearest whole number. That number is multiplied by the number of directorships to be filled. There are 5,000 total votes to be allocated based on each taxing unit’s tax levy as compared to the total levy for all taxing units. Each taxing unit eligible to vote and participate in the appointment process may nominate up to five candidates for the Dallas CAD Board of Directors. The five directors appointed by the taxing units serve staggered four-year terms beginning on January 1st of every other even-numbered year. To provide for the transition for the staggered terms, two (2) directors must be appointed to serve a term of one year, and three (3) directors shall be appointed to serve a term of three years. Thereafter, all appointed directors serve four-year terms. Following the election the Chief Appraiser in conjunction with the elected directors will draw lots to determine which two (2) directors serve a term of one year. The first step in this process is for the Chief Appraiser to calculate the voting entitlement of each taxing unit that is entitled to vote and notify the county judge and each county commissioner, the presiding officer of each city/town, city manager or city secretary, the presiding officer of each school district and the school district superintendent, the presiding officer of the college district, the college president, chancellor or other chief executive officer of the college district. In addition to your taxing unit’s votes being provided in the Subject line of this memo, I have included an attachment showing the number of votes for each county, city, school district and college district that is entitled to vote. The next step is the nomination of the candidates. A taxing unit is not required to submit nominations, but if it chooses to do so, the nomination may be made only by a resolution adopted by the governing body and submitted to the Chief Appraiser before October 15, 2024. For your convenience, a sample resolution for nomination is included with this notification. Please include the full name and address of each candidate nominated in the resolution. You may provide each individual you are considering for nomination with a copy of the attached Nominee Information Questionnaire for them to complete. The Questionnaire will provide information to the taxing unit and help ensure the nominees meet the eligibility requirements for a Board of Director position. The nominated candidate needs to submit a biography or resume to be used by the other taxing entities in determining and casting their votes on the ballot. The Chief Appraiser will, before October 30, prepare and submit a ballot of the timely submitted nominees to each taxing unit that is eligible to vote. The governing body of each taxing unit entitled to vote shall submit a resolution casting its votes to the Chief Appraiser before December 15 (since December 15 is a Sunday the due date is extended to the next day that is not a Saturday, Sunday or holiday) The governing body of the taxing unit entitled to vote may cast all of its votes for one candidate or distribute them among the candidates for any number of the director positions. The Chief Appraiser will then count the votes and declare the five candidates who received the largest cumulative votes as elected and submit the results before December 31, 2024 to each of the taxing unit and to the candidates. Below is the calendar for the appointment process as prescribed by Texas Property Tax Code Section 6.03. Before October 1: In accordance with Texas Property Tax Code Section 6.03(d) and (e), the chief appraiser shall calculate the number of votes to which each taxing unit other than a conservation and 3 reclamation district [i.e. special district] is entitled and shall deliver written notice to each of those units of its voting entitlement before October 1, 2024 (normally of each odd-number year). Before October 30: In accordance with Texas Property Tax Code Section 6.03 (j) the Chief Appraiser shall prepare a ballot listing the nominated candidates and deliver the ballot to the taxing units eligible to vote. Before December 15 (since December 15 is a Sunday this due date is the next day that is not Saturday, Sunday or a holiday): In accordance with Texas Property Tax Code Section 6.03 (k) each taxing unit that is entitled to vote shall determine its vote by resolution and submit the same to the Chief Appraiser. Before December 31: In accordance with Texas Property Tax Code Section 6.03 (k) the Chief Appraiser will count the votes, declare the five candidates who received the largest cumulative vote totals elected, and submit the results to each taxing unit in the District and to the candidates. For your convenience the qualifications to be an appointed member are resident of Dallas County and shall have resided in Dallas County for at least two years prior to the date such person takes office (January 1, 2025) and must satisfy the following: Section 6.035 of the Tax Code provides that an individual is ineligible to serve on an appraisal district board of directors and is disqualified from employment as chief appraiser if the individual is related within the second degree by consanguinity (blood) or affinity (marriage), as determined under Chapter 573, Government Code, to an individual who is engaged in the business of appraising property for compensation for use in proceedings under this title or of representing property owners for compensation in proceedings under this title in the appraisal district. Similarly, an individual is ineligible to serve on an appraisal district board of directors and is disqualified from employment as chief appraiser if the individual owns property on which delinquent taxes have been owed to a taxing unit for more than 60 days after the date the individual knew or should have known of the delinquency unless: (A) the delinquent taxes and any penalties and interest are being paid under an installment payment agreement under Section 33.02 of the Tax Code; or (B) a suit to collect the delinquent taxes is deferred or abated under Sections 33.06 or 33.065 of the Tax Code. Per Section 6.035 of the Tax Code, an individual is also ineligible to serve on the board of directors of an appraisal district if the individual: (1) has served as a member of the board of directors for all or part of five terms, unless: (A) the individual was the county assessor-collector at the time the individual served as a board member; or (B) the appraisal district is established in a county with a population of less than 120,000; (2) has engaged in the business of appraising property for compensation for use in proceedings under this title at any time during the preceding three years; (3) has engaged in the business of representing property owners for compensation in proceedings under this title in the appraisal district at any time during the preceding three years; or (4) has been an employee of the appraisal district at any time during the preceding three years.
