OR 2024-1620 Citizens AppearanceORDINANCE NO. 2024-1620AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THECODE OF ORDINANCES BY AMENDING CHAPTER 1,'ADMINISTRATION', ARTICLE 1-10, RULES, TIMES AND PROCEDURESFOR CONDUCTING CITY COUNCIL MEETINGS, SECTION 1-10-6.2.1, BYREPEALING SAID SECTION OF SUCH ARTICLE AND CHAPTER IN ITSENTIRETY AND ADDING A NEW SECTION 1-10-6.2.1 'CITIZENSAPPEARANCES'; PROVIDING A 3 MINUTE TIME LIMIT WITH NOAGGREGATE LIMITATION; PROVIDING FOR REDUCING INDIVIDUALSPEAKER TIME TO NO LESS THAN ONE MINUTE IF THERE ARE MORETHAN 30 SPEAKERS; PROVIDING A REPEALING CLAUSE; PROVIDING ASEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.WHEREAS, the City of Coppell believes it will benefit to amend and update the City'sCode of Ordinances;WHEREAS, the City desires to amend the Rules, Times and Procedures for ConductingCity Council Meetings previously implemented for the benefit of the citizens of the City ofCoppell.NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF COPPELL, TEXAS:SECTION 1. That the Code of Ordinances of the City ofCoppell, Texas, be and in the sameis hereby amending Chapter 1, 'Administration', by Article 1-10 "Rules, Times and Procedures forConducting City Council Meetings", Section 1-10-6.2.1 "Citizen Appearance", repealing saidsection in its entirety and adopting a new Section 1-10-6.2.1 of said Chapter and Article to providetime for citizen appearance from two (2) minutes to three (3) minutes; and, by eliminating theaggregate time limits; and to allow the mayor to reduce individual speaker time to no less than oneminute if there is more than 30 speakers to hereinafter read as follows:"CHAPTER 1-ADMINISTRATIONSec. 1-10-1 Creation.ARTICLE 1-10. RULES, TIMES AND PROCEDURES FOR CONDUCTING CITYCOUNCIL MEETINGSSec. 1-10-6.2.1 Citizen appearance. Persons wishing to speak on any matter other than anitem scheduled for a public hearing on the agenda, must sign a register and list their residenceaddress, provided by the city secretary on a table outside the council chambers, and such personsPage 14896-1490-5842.v. may be heard only at the "citizens appearance" portion of a regular meeting or special meeting.Each speaker must state his or her name and address of residence. Presentations by individualsduring the "citizens appearance" shall be limited to three (3) minutes each. In the event that thereare more than thirty (30) speakers registered for citizens appearance, the mayor may reduce eachspeaker's time to no less than one minute per speaker. Those persons who signed up to speak atthe "citizens appearance" shall be called upon in the order that they have signed the providedregister. No personal attacks by any speaker shall be made against any member of the council,mayor, individual, group or corporation (Charter Article 3, Section 3.12)."SECTION 2. That all provisions of the ordinances of the City of Coppell in conflict withthe provisions of this ordinance be and the same are hereby repealed and any provisions not so inconflict shall remain in force and effect.SECTION 3. That should any sentence, paragraph, subdivision, clause, phrase or sectionof this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall noteffect the validity of this ordinance as a whole, or any part or provision thereof other than the partso decided to be invalid, illegal or unconstitutional, and shall not effect the validity of the Code ofOrdinances as a whole.SECTION 4. It is hereby declared to be the intention of the City ofCoppell that the sections,paragraphs, sentences, clauses, and phrases of this Article are severable and, if any phrase, clause,sentence, paragraph, or section shall be declared unconstitutional by the valid judgment or decreeof any court of competent jurisdiction, such unconstitutionality shall not affect any of the remainingphrases, clauses, sentences, paragraphs, and sections.SECTION 5. An offense committed before the effective date of this ordinance is governedby the prior law and the provisions of the Code of Ordinances, as amended, in effect when theoffense was committed, and the former law is continued in effect for this purpose.SECTION 6.
