OR 330 Abandons easement AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 330 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ABANDONING A 20 FOOT EASEMENT IN FAVOR OF THE ABUTTING PROPERTY OWNER; PROVIDING THAT SUCH ABANDONMENT SHALL BE ALL THE INTEREST THE CITY MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING THAT SUCH ORDINANCE SHALL CONSTITUTE A QUITCLAIM DEED THAT MAY BE RECORDED WITH THE COUNTY CLERK OF DALLAS COUNTY, TEXAS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Coppell, Texas, has determined that the City has no further need for the certain easement hereinafter described and that the City's interest therein should be abandoned; and WHEREAS, Wiseco Land Development, Corp., the owner of the property on which said easement exists, desires that such easement be abandoned; and WHEREAS, the City has determined that the City has no need for such portion of said easement and that the cost of keeping such easement is in excess of the fair market value of the City's interest in the portion of easement being abandoned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the hereinafter described portion of easement within the limits of the City of Coppell, Texas, is no longer needed or necessary for City public purposes as an easement and should be abandoned in favor of the owner of the property burdened with said easement, to wit: Wiseco Land Development, Corp. The easement being abandoned is described as follows: BEING a 20 foot wide strip of land situated in the Alfred Logsdon Survey, Abstract No. 783 in Dallas County, Texas, said strip of land also being part of a 20 foot wide utility easement to the City of Coppell as recorded in Volume 79074, Page 0081 of the Deed Records of Dallas County, Texas, said easement crossing a 283.667 acre tract and a 20 acre tract of land described as Tract A-2 and Tract C as conveyed to M. Douglas Adkins, Trustee, by deed from Good Financial Corp., dated September 27, 1976 and recorded in Volume 76188, Page 2355 of the Deed Records of Dallas County, Texas, said strip of land being 10.00 feet either side of the following described centerline; COMMENCING at a point in the south line of the said Adkins Tract C, said point being N. 88° 55' 00" W., 10.00 feet from the southeast corner of the said Adkins Tract C; Thence N. 1° 05' 00" E., 390.00 feet to the POINT OF BEGINNING of section of easement to be abandoned; THENCE N. 1° 05' 00" E., 1150.00 feet to a point for corner; THENCE N. 86~ 35' 00" E., 450.00 feet to the end of said centerline and containing 0.73 acres (32,000 square feet) of land. SECTION 2. The City of Coppell, Texas, hereby abandons all its right, title, and interest in and to said portion of easement as above described and abandons all such interest the City may have in said portion of easement in favor of Wiseco Land Development, Corp., the owner of the property burdened by said easement. SECTION 3. That the abandonment of the City's interest in said easement shall constitute a quitclaim deed in favor of Wiseco Land Development, Corp., the owner of the property burdened by said easement, and a certified copy of this ordinance may be filed in the Deed Records of Dallas County, Texas, to indicate such abandonment. SECTION 4. The abandonment provided for herein shall extend only to the public right, title, and interest of the City of Coppell, Texas, in and to said portion easement, and shah be construed to extend only to the interest that the governing body of the City of Coppell, Texas, may legally and lawfully abandon. SECTION 5. The provisions of this ordinance are severable, and should any section, paragraph, sentence, clause or purchase thereof be declared unconstitutional or void, such declaration shall not effect any of the remaining portions hereof. SECTION 6. This ordinance shall take effect immediately from and after its passage as the law in such cases provides.
