ORDINANCE NO. 327
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ANNEXING THE
HEREINAFTER DESCRIBED TERRITORY INTO THE CITY OF COPPELL, TEXAS, AND
EXTENDING THE BOUNDARY LIMITS OF TfiE CITY SO AS TO INCLUDE SAID
HEREINAFTER DESCRIBED PROPERTY WITHIN THE CITY LIMITS AND GRANTING TO
ALL INHABITANTS AND OWNERS OF SAID PROPERTY, ALL THE RIGHTS AND
PRIVILEGES OF OTHER CITIZENS AND BINDING ALL INHABITANTS BY ALL TIIE
ORDINANCES, ACTS, RESOLUTIONS AND REGULATIONS OF THE CITY; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING THE EFFECTIVE DATE OF SAID ORDINANCE.
'WHEREAS, the City Council of the City of Coppell, Texas, finds that the
hereinafter described territory is contiguous and adjacent to the corporate limits of
the City of Coppell, and does not exceed one-half mile in width; and
WHEREAS, the Building Official of the City prepared a service plan for the area,
a copy of which is attached hereto as Exhibit "A"; and
WHEREAS, after notice was duly given, public hearings on the proposed annexation
were held by the City Council all in compliance with Article 970-A, Vernon's Annotated
Civil Statutes of the State of Texas; and
WHEREAS, the City Council has concluded that such area should be annexed into
and made a part of the City of Coppell, Texas:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the following described territory be, and the same is hereby,
annexed into and made a part of the corporate limits of the City of Coppell, Texas,
and the same shall hereafter be included within the territorial limits of said City, and
the inhabitants thereof shall hereafter be entitled to aH rights and privileges of other
citizens of the City, and shall be bound by the ordinances, acts, resolutions and
regulations of the City of Coppel], Texas.
Said territory hereby annexed being described as follows:
Tract 1
ALL THAT CEP~TAIN lot, tract or parcel of land situated in the PETER
HARMONSON SURVEY, ABSTRACT NO. 604 and the B.B.B. and C.R.R.
CO. SU~{VEY, ABST~{ACT NO. 145, Denton County, Texas, being part of
a called First Tract and all of a called Second Tract in a deed conveyed
by Fred R. Saunders, Joan L. Knowles, and husband Thomas G. Knowles,
Charles Sanders, Hershell Sanders and J. E. Sanders to T. J. Turner and
Colon R. Kelly as recorded in Volume 501, Page 57, Deed Records, Denton
County, Texas and being more particularly described as follows:
COMMENCING at a fence post at the Northeast corner of said First Tract;
THENCE S 01° 36' 50" W, 552.00 feet along or near a fence line to the
POINT OF BEGINNING;
THENCE S 01° 36' 50" W, along or near a fence line passing at 1577.00
feet the Southeast corner of said First Tract, same being the Southeast
corner of the Peter Harmonson Survey, Abstract No. 604, and the Northeast
corner of the B.B.B. and C.R.R. Co. Survey, Abstract No. 145, same being
the Northeast corner of a called Second Tract as recorded in Volume 501,
Page 57, Deed Records, Denton County, Texas and continuing on said
course a total of 2640.00 feet to an iron rod for corner, same point
sometimes referred to or shown as the Dallas-Denton County line, same
being in the North line of a tract of land conveyed by CCS Venture, a
Texas joint venture to SBS Venture, a Texas joint venture as recorded in
Volume 84038, Page 2223, Deed Records, Dallas County, Texas;
THENCE N 88o 57' 00" W, 504.95 feet along said North line to a point
for corner in or near the center of Denton Creek;
THENCE N 43° 25' 26" W, 188.23 feet along or near the center of Denton
Creek to a point for corner;
THENCE N 61° 24' 22" W, 270.82 feet along or near the center of Denton
Creek to a point for corner;
THENCE N 17° 19' 08" W, 419.72 feet along or near the center of Denton
Creek to an iron rod for corner;
THENCE N 01° 21' 29" E, 1982.02 feet along or near a fence line to a
point for corner;
THENCE S 88° 57' 00" E, 1024.53 feet to the POINT OF BEGINNING and
containing 59.024 acres of land, more or less.
SECTION 2. It is the intention of the City to annex only that territory which
is legally subject to being annexed by the City and should any portion of the above
described territory be not subject to legal annexation by the City of Coppell, Texas,
such fact shall not prevent the City from annexing such portion of said territory which
is subject to legal annexation by the City of Coppert, Texas. Therefore, if any provision
or portion of the territory herein described is held to be invalid by a court of competent
jurisdiction, such provision or portion of land shall be deemed as separate, distinct and
independent and such holding shall not affect the validity of the remaining provisions
of this ordinance or portions of land annexed by this ordinance.
SECTION 3. This ordinance shall take effect froin and after its pasage as the
law in such cases provides.
