City officials. In any election, except the city official's own, a city official shall not: Use the prestige of the city official's position with the city on behalf of a candidate, political party, or political committee, including but not limited to: An endorsement, a city official (who is a city official only because that person is an appointed member of a board, commission, or body) is not prohibited from lending the city official's name so long as the office held with the city is not mentioned; Any election ordered by the City of Coppell on a proposition or measure, a city council member, board or commission is prohibited from lending the city official's name and official city title; and Serve as the designated campaign treasurer for a candidate under the Texas Election Code; or Solicit or receive contributions for a candidate, political party, or political committee, except that a city official is not prohibited from serving on a steering committee to plan a program of solicitation and listing the member's name without reference to the office held when the committee as a whole is listed. Influencing subordinates. A city official shall not, directly, or indirectly, induce or attempt to induce any city subordinate of the official to: Participate in an election campaign, contribute to a candidate or political committee, or engage in any other political activity relating to a particular party, candidate, or issue; or Refrain from engaging in any lawful political activity. A general statement merely encouraging another person to vote does not violate this subsection. Paid campaigning. A city official shall not directly or indirectly accept anything of value for political activity relating to an item pending on the ballot, if the official participated in, or provided advice relating to, the exercise of discretionary authority by a city body that contributed to the development of the ballot item. "Anything of value" does not include a meal or other item of nominal value the city official receives in return for providing information on an item pending on the ballot. Official vehicles. A city official shall not display or fail to remove campaign materials on any city vehicle under his or her control. Charter provisions. A city official shall comply with the provisions governing political activity. Public property and resources. City Manager Mike Land gave the following updates: Magnolia Park Trail – The contractor has begun installing the bank stabilization for the pond. Woodhurst – The project is substantially complete. The contractor is continuing to work on final cleanup and punch list items. DART – The contractor is working on completing sidewalks and asphalt repairs at several of the intersections. Fire Station #5 – The contractor is continuing with the brick and stone as well as starting to sheetrock and insulating the walls. Service Center – The contractor is performing subgrade prep for the foundation of the new building. Freeport/Northwestern Traffic Signal – All the ADA ramps, sidewalks and conduit have been installed. The signal poles and equipment should be arriving in the next few weeks and will be installed. I-635 U-turn – TXDOT has planned another overnight closure of the west bound mainlaines on 635 for Tuesday Feb 4th from 10pm-4am. Mayor and Council Reports on Recent and Upcoming Events.9. Background: On December 19, 2024, The Planning and Zoning Commission recommended unanimous approval (6-0) subject to the following conditions: 1. Proposed PD to increase allowed restaurant area on Lots 1 & 3, Block A to 10,120 square feet. 2. Proposed PD to utilize an exception to allow 209 parking spaces to accommodate the proposed increase in restaurant uses that would typically require 214 parking spaces. 3. Hours of operation shall not exceed 10 a.m. to 12:00 a.m., daily. 4. Proposed signage shall require a permit. 5. A grease trap be installed that is adequately sized to support the restaurant use. On January 14, 2025, the City Council (7-0) approved the zoning change request with the same conditions. Benefit to the Community: This will add another restaurant option for residents. Legal Review: The City Attorney drafted the ordinance. 2 Fiscal Impact: This will generate additional sales tax revenue. Recommendation: The Community Development Department recommends approval of the Ordinance and authorizing the Mayor to sign. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of Coppell, Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and the same is hereby amended by granting a change in zoning from PD-157R8-C (Planned Development- 157 Revision 8 - Commercial) to PD-157R9-C (Planned Development-157 Revision 9 - Commercial) to allow the operation of a 1,167 square foot restaurant located at 817 S MacArthur Blvd along the west side of S MacArthur Blvd; south of E Belt Line Rd, for the property described in Exhibit “A” attached hereto and made a part hereof for all purposes; and, to approve the Detail Site Plan, Floor Plan, and Building Elevations & Sign Plan for said development, and made part hereof City of Coppell Ordinance Pg 2 4925-5468-5972 v.1 for all purposes, subject to the detailed Site Plan and development regulations as amended and provided in this ordinance. SECTION 2. That the Planned Development-157R9-Commercial shall be used and developed in accordance with the Commercial District Regulations except as provided herein and subject to the following development regulations: A. Except as amended herein and as provided in this Ordinance, the property shall be developed in accordance with Planned Development – 157 Revision 8 - Commercial zoned property as set forth in Ordinance 91500- A- 763, as amended, which is incorporated herein as set forth in full and hereby republished. B. To increase the allowable restaurant area on Lots 1 & 3, Block A to 14,020 square feet, as depicted on Exhibit B, the Detail Site Plan for Lots 1 & 3, Block A. C. To allow 209 parking spaces (reduction of five parking spaces) to accommodate the restaurant uses within the Planned Development, Lots 1 & 3, Block A, as depicted on Exhibit B. D. The hours of operation of the restaurant shall be between the hours of 10 a.m. to 12:00 a.m., daily, as stated on Exhibit C, Floor Plan. E. Proposed signage, as depicted on Exhibit D, Building Elevations & Sign Plan, shall be allowed upon issuance of the required permit. F. A grease trap be installed that is adequately sized to support the restaurant use as provided in the applicable building and planning code ordinances as amended and adopted by the City. SECTION 3. That the Detail Site Plan, Floor Plan, and Building Elevations & Sign Plan attached hereto as Exhibits “B” though “D”; respectively shall be deemed as development regulations to this development. That the above property shall be used and maintained only in the manner and for the purpose provided in this ordinance, as heretofore amended, and as amended herein. SECTION 5. That the development of the property herein shall be in accordance with building regulations, zoning ordinances, and any applicable ordinances except as may be specifically altered or amended herein. SECTION 6. That all provisions of the Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 7. That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 8. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in effect when the offense was committed, and the former law is continued in effect for this purpose. SECTION 9. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every day such violation shall continue shall be deemed to constitute a separate offense. Denton Tap Road; and authorizing the Mayor to sign. 2040: Create Business and Innovation Nodes Introduction: This agenda item is presented for City Council approval of an Ordinance for case PD-320-TC, to allow for the operation of a Jason’s Deli restaurant with a drive-through. Background: On December 19, 2024, The Planning and Zoning Commission recommended unanimous approval (6-0) subject to the following conditions: 1. To allow for a restaurant with a drive-through area as presented. 2. To allow for the landscaping as presented. 3. Hours of operation shall not exceed 10 am to 10 p.m., daily. 4. Any proposed signage shall require a separate submittal and permit. 5. The restaurant must be served by an adequately sized grease trap on-site. On January 14, 2025, the City Council (7-0) approved the zoning change request with the same conditions, but modifying #3, to read: 3. Hours of operation shall not exceed 7 a.m. to 10 p.m. daily. Benefit to the Community: This will add another restaurant option for residents. That the Comprehensive Zoning Ordinance and Map of the City of Coppell, Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and the same is hereby amended by granting a change in zoning from TC (Town Center) to PD-320-TC (Planned Development-320- Town Center) to allow for a drive-through in connection with a restaurant use, as provided herein in a Detail Site Plan, on 1.674 acres of property located on the east side of Denton Tap Road between Parkway Blvd and Town Center Drive, at 240 N. SECTION 2. That the Property will be used and developed for a restaurant with a drive- through as provided in PD-320-TC and Code of Ordinances, is hereby approved subject to the following development regulations: A. To allow for a 4,618-sf restaurant use with a drive-through as depicted on the Site Plan, Exhibit B. B. To allow the landscaping as shown on the Landscape Plan, Exhibit C. C. The hours of operation shall not exceed 7 a.m. to 10:00 p.m., daily. D. The proposed signage shall require a permit. E. A grease trap be installed that is adequately sized to support the restaurant use as provided in the applicable building and planning code ordinances as amended and adopted by the City. SECTION 3. That the Detail Site Plan, Landscape Plan, and Building Elevations attached hereto as Exhibits “B” though “D”; respectively shall be deemed as development regulations to this development. SECTION 4. That the above property shall be used and maintained only in the manner and for the purpose provided in this ordinance, as heretofore amended, and as amended herein. SECTION 5. That the development of the property herein shall be in accordance with building regulations, zoning ordinances, and any applicable ordinances except as may be specifically altered or amended herein. That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 8. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in effect when the offense was committed, and the former law is continued in effect for this purpose. SECTION 9. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every day such violation shall continue shall be deemed to constitute a separate offense. SECTION 10. That this ordinance shall take effect immediately from and after its passage and the publication of its caption, as the law and charter in such cases provide. The only change is to add a new piece of adjoining property (Lot 2), to the existing agreement. This will allow for the sanitary sewer connection already in place for existing Lot 1 to be extended to the new Lot 2. Background: The Feather Smash badminton group has purchased an acre property fronting Vista Ridge Mall Drive and platting it as Lot 2. This is to the west and contiguous to the existing 30,726-sf facility, and in front of the existing concrete batch plant to the south. Feather Smash is proposing to construct 12 pickleball courts and a 1,230-sf clubhouse. This new development is solely in the City of Lewisville. Lot 1 is an oddly shaped piece of property made up of multiple parcels with portions located in Coppell and other portions located in Lewisville. The parcels in Coppell had no street access, and this development combined the various parcels to create one lot, providing street access from Vista Ridge Mall Drive in Lewisville. Since the project lies within two municipalities, an Interlocal Agreement between the City of Coppell and the City of Lewisville will be required to be approved by both cities. The Interlocal Agreement states what the responsibilities are for each city, who is to provide what service, the collection of associated fees of development, refuse services as well as emergency services. Each respective city will provide water to those portions of the property within its respective city limits, and shall collect revenue from their respective sales, impact fees and other associated fees. Each city shall bill separately for stormwater drainage. Each city shall zone the property within their respective city. Lot 1 contains the existing badminton building and associated parking; Lot 2 will have the 12 new pickleball court, 1,230-sf clubhouse and a portion of the 10 new parking spaces proposed. The City of Lewisville is proposing to bring the plat to its City Council in January. Coppell shall provide sanitary sewer to the property which will include Lot 2, with this amendment and 2 the property shall have a domestic meter from Coppell. Irrigation shall come from each respective city. Coppell shall be responsible for inspection of the sanitary sewer line and shall have the right to review and inspect the plumbing facilities located in Lewisville to ensure that the facilities are compatible and consistent with Coppell’s system and are not in violation of any of Coppell’s relevant ordinances. Tree mitigation fees shall be paid to the respective cities. In terms of emergency services, the City of Lewisville shall provide law enforcement services, unless a criminal event takes place in Coppell’s city limits that the city of Lewisville cannot enforce, the City of Coppell shall assist as needed. Lewisville shall provide firefighting and emergency services, health inspections, code enforcement, animal services and other inspection/enforcement services unless an incident takes place in Coppell’s city limits that the city of Lewisville cannot enforce, the City of Coppell shall assist as needed. The City of Lewisville shall provide municipal solid waste services. Benefit to the Community: This will provide additional recreational opportunities for both communities. Legal Review: This Interlocal Agreement has been reviewed by the City of Lewisville’s Attorney and Staff, and the City of Coppell’s Attorney and Staff representatives from Planning, Building Inspections, Engineering, Fire and Police Departments. The City of Lewisville is scheduled to consider this agreement at their January City Council meeting. Fiscal Impact: None Recommendation: The Planning Department recommends APPROVAL of the Interlocal Agreement between the City of Coppell and the City of Lewisville. 4875-5747-1462, v. 1 STATE OF TEXAS DENTON COUNTY § § § § AMENDMENT AND RESTATEMENT TO THE PLANNING AND INTERLOCAL AGREEMENT This Amendment and Restatement to the Planning and Interlocal Agreement executed December 10, 2019 (“Agreement”), is made by and between the City of Coppell (“Coppell”) and the City of Lewisville (“Lewisville”), both of which are political subdivisions of the State of Texas. Lewisville and Coppell shall be referred to herein collectively as the “Parties.” WHEREAS, on December 10, 2019, Coppell and Lewisville executed the “Planning and Interlocal Agreement” (“Original Agreement”) concerning the property described as Feather Smash Addition, Lot 1, Block A, described in Exhibit Bas the “Existing Site”; and WHEREAS, the Parties wish to add additional property, Feather Smash Addition, Lot 2, Block A, described in Exhibit ‘B’ as the “Proposed Site,” to the Original Agreement through this amendment and restatement; and WHEREAS, Coppell and Lewisville are contiguous and adjacent cities which support orderly and logical land use patterns and jurisdictional boundaries; and WHEREAS, the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, authorizes any local government to contract with one or more local governments to perform governmental functions and services under the terms of the Act; and WHEREAS, state law further authorizes local government to enter into agreements and contracts of the nature envisioned in this Agreement; and WHEREAS, Coppell and Lewisville have determined there are two tracts of land, the Existing Site and Proposed Site, more specifically described as provided in Exhibit “A” (the “Property”), that lie within the corporate jurisdiction of each city that cannot reasonably and economically be utilized solely within one jurisdiction of either Coppell or Lewisville; and WHEREAS, Coppell and Lewisville agree that such Property can more reasonably and economically be served by both cities; and WHEREAS, Coppell and Lewisville have the Original Agreement approved on December 10, 2019, in Coppell and December 2, 2019, in Lewisville for the Existing Site from which the developer would like to extend the sanitary sewer; and WHEREAS, Coppell and Lewisville agree that each city shall provide various government services to the Property for water, sewer, subdivision regulation, zoning, building permits, emergency services, and municipal solid waste; and WHEREAS, Coppell and Lewisville, in the true spirit of governmental cooperation, intend this Agreement to reflect sound growth management principles and interregional planning. TERM The term of this Agreement (“Term”) shall be effective December 10, 2019 (“Effective Date”), and shall continue for twenty (20) years with automatic five (5) year renewals thereafter. II. MUNICIPAL SERVICES The Parties hereby agree to provide the following municipal services to the Property: A.Water 1. Each city shall provide water to those portions of the Property within its respective city limits. Each city shall receive the revenues from the sale of water within its city limits, including impact fees, tap fees, inspection fees, and water use fees. 2. Each city shall separately bill the appropriate party for water provided by said city. B.Sanitary Sewer 1. Coppell shall provide sanitary sewer to the Property at the Coppell current rates, as amended. Coppell shall receive all revenues from sanitary sewer collection and treatment, including any impact fees, inspection, fees, and other fees. 2. In order to facilitate the calculation of sanitary sewer charges, the Property shall have the domestic meter from Coppell, and Coppell shall be responsible for the maintenance of said meter. Irrigation meters shall be from each respective city for the irrigation water usage in each city and each city shall be responsible for the maintenance of their irrigation meter. 2. Coppell shall be responsible for inspection of the sanitary sewer line and shall have the right to review and inspect the plumbing facilities located in Lewisville to ensure that the facilities are compatible and consistent with Coppell’s system and are not in violation of any of Coppell’s relevant ordinances. Coppell’s ordinances shall prevail in the event of an inconsistency or conflict with Lewisville ordinances as they relate to the sanitary sewer system and plumbing facilities. 3. Coppell shall bill the Property for sanitary sewer service located at and utilized for the entire Property. Stormwater drainage mitigation shall be in accordance with the engineering requirements of both cities. Each city shall separately bill the Property for stormwater fees for the portion of the Property located within its respective city limits. Zoning, Platting, Engineering Site Plan, Permitting & Inspections 1.Zoning and Land Use – The cities shall endeavor to zone the Property within their respective city in a manner that is compatible and conducive to development. 2.Platting – a. Existing Site: A single plat shall be filed for review and approval by both cities. The Property shall be platted into one lot that crosses the city limit lines. The single plat shall be reviewed and approved by both cities with signatures of both cities on the plat. Waivers, if any, shall be approved as provided in the respective jurisdiction’s adopted ordinances and regulations. Proposed Site: A single plat shall be filed for review and approval by the City of Lewisville. 3.Engineering Site Plan – a. Existing Site: A single ESP shall be filed for review and approval by both cities. All portions of the Property located within Lewisville shall meet Lewisville development requirements, except for sanitary sewer standards, which shall be governed by Coppell. All portions of the Property located within Coppell shall meet Coppell standards, except that Lewisville fire-lane widths and turning radii shall be applied. Both cities shall endeavor to ensure that the development of the Property has a consistent aesthetic appeal. b. Proposed Site [Lot 2, Block A]: A single ESP shall be filed for review and approval by the City of Lewisville. All portions of the Property located within Lewisville shall meet Lewisville development requirements, except for sanitary sewer standards, which shall be governed by Coppell. A utility easement shall be provided to this lot to provide sanitary sewer service from Lot 1. A shared parking easement shall also be provided to satisfy the on-site parking requirements of Lot 2. 4.Tree Mitigation Fees – In accordance with Lewisville ordinances, tree mitigation fees shall be paid to Lewisville for trees removed from any part AMENDMENT AND RESTATEMENT TO THE PLANNING AND INTERLOCAL AGREEMENT Page 4 of 10 4875-5747-1462, v. 1 of the Property located within Lewisville. In accordance with Coppell ordinances, tree mitigation fees shall be paid to Coppell for trees removed from any part of the Property located within Coppell. 5.Permitting and Inspections – i. In the event of simultaneous construction of public infrastructure and building construction, the escrow of funds equal to the value of all public improvements located in both cities for the entire Property shall be collected by Lewisville. All fire lanes and water to the building shall be in service prior to vertical construction. ii. Lewisville shall provide all building inspections and building permits as it relates to the Property. Coppell shall provide infrastructure inspections and construction development permits as it relates to the Property within Coppell and any connection for sanitary sewer to Coppell’s system. Lewisville shall not issue a building permit or certificate of occupancy until those improvements being built have passed inspection in accordance with both cities’ development regulations and ordinances and this Agreement. Coppell may choose to participate in any sanitary sewer or plumbing inspection. iii. A pre-construction meeting shall be scheduled with both cities’ permitting and inspection teams prior to issuance of any building permits. A core inspection team will be comprised of representatives from both cities. These inspectors will be assigned to the Project throughout the duration of its development. E.Emergency Services & Other Services 1. Lewisville shall provide law enforcement services on the Property, including reporting, investigation, and enforcement of criminal law. In the event that a criminal incident occurs in Coppell’s city limits in violation of a Coppell ordinance that the Lewisville police department cannot enforce, Lewisville shall contact Coppell for assistance in reporting, investigation, and enforcement of Coppell ordinances. Coppell shall assist in any way reasonably possible. 2. Lewisville shall provide firefighting and emergency services including all fire suppression activities, EMS responses, rescues, pre-incident planning and other first responder fire department activities. 3. Lewisville shall provide fire prevention, emergency management, health inspections, code enforcement, animal services, and other inspection/enforcement services offered to properties located within Lewisville. In the event that an incident occurs in Coppell’s city limits in AMENDMENT AND RESTATEMENT TO THE PLANNING AND INTERLOCAL AGREEMENT Page 5 of 10 4875-5747-1462, v. 1 violation of a Coppell ordinance that Lewisville staff cannot enforce, Lewisville shall contact Coppell for assistance in reporting, investigation, and enforcement of Coppell ordinances. Coppell shall assist in any way reasonably possible. F.Trash Service 1. For purposes of municipal solid waste service, the Property is subject under Lewisville’s ordinances and regulations, notwithstanding of the location of the waste receptacle; and, thus only Lewisville’s municipal solid waste hauler shall be used to service the Property and Lewisville shall bill for such service. III. RIGHT TO AUDIT Either party shall have the right, at its expense, to audit the books of the other party to verify compliance with the provisions herein. IV. DEFAULT Failure of either party to comply with or perform any term, obligation, or condition of the Agreement shall constitute an event of default. The non-defaulting party shall give written notice to the other party of any default, and the defaulting party shall have thirty (30) days to begin to cure said default. Should said default remain uncured, the non-defaulting party shall have the right to terminate this Agreement, enforce specific performances as appropriate, or maintain a cause of action for damages caused by the event(s) of default, to the extent authorized by law. V. MISCELLANEOUS A. This Agreement embodies the entire agreement between the Parties and may only be modified in writing executed by both Parties. B. This Agreement shall be binding upon the Parties hereto, their successors, and assigns. Neither of the Parties will assign nor transfer an interest in this Agreement without the written consent of the other party. C. Either party may file a certified copy of this Agreement in the real property records of Denton County, Texas. D. If any article, paragraph, subdivision, clause, or phrase of this Agreement be adjudged invalid or held unconstitutional for any reason, such judgment or holding shall not affect the validity of this Agreement as a whole or any part or provision thereof other than the part so declared to be invalid or unconstitutional. E. Per Ordinance No. 2014-1399, the CRDC shall appoint, on an annual basis, the President and Vice President from its membership. On January 27, 2025, the CRDC Board nominated and unanimously approved the following members as officers: Aaron Straach – President Thomas Dwyer – Vice President There are no term limits for Officers in the Ordinance or within the Bylaws. Background: In addition to these officers being nominated and approved by the CRDC Board, the City Council must also approve these officer appointments annually. Per Ordinance No. 2014-1399: “A vacancy in the office of president and vice president which occurs by reason of death, resignation, disqualification, removal, or otherwise, shall be appointed by the board, with approval by the city council, for the unexpired portion of the term of that office.” Benefit to the Community: Appointing officers to serve on the CRDC Board ensures that Board meetings are presided over in accordance with all applicable Bylaws and Ordinances. 2 Legal Review: Item does not need legal review.
