ORDINANCE NO. 314A1
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING SECTION 8-2-
10 OF CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY, THE CHAPTER
PROVIDING FOR THE PLACEMENT OF TRAFFIC CONTROL DEVICES WITHIN THE
CITY, TO PROVIDE THAT THE CITY COUNCIL SHALL APPROVE THE ERECTION AND
MAINTAINANCE OF TRAFFIC CONTROL DEVICES AS RECOMENDED BY THE TRAFFIC
ENGINEER; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS ($200.00) FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1. AMENDMENT TO ARTICLE 8-2 TRAFFIC CONTROL DEVICES
The following section of Chapter 8, SECTION 8-2-10, IS hereby amended by
adding thereto the underlined portions of said section so that said section shall read
as follows:
"Section 8-2-10 DUTY TO ERECT
The Traffic Engineer shall determine the necessity for
installing and maintenance of all traffic control devices within
the City. Such determination shall be consistent with the
above mentioned Manual (Texas Manual on Uniform Traffic
Control Devices for Streets and Highways, Volumes I and II)
and based upon a traffic engineering investigation covering
all relevant facts and in conformance with accepted
engineering criteria. The Traffic Engineer shall report such
study and findings to the City Council and the Director of
Traffic Control with his recommendation as to any specific
installation or maintenance requirements. The Traffic
Engineer shall report to the City Council when traffic control
devices should be installed under the specific instruction of
the Traffic Engineer to ensure that installation and
maintenance be performed by a specified and qualified person.
Based upon the recommendations of the Traffic Engineer, and
upon approval of the City Council, the Director of Traffic
Control shah install, erect and maintain all traffic control
devices within the City, or cause the same to be done, in
accordance with this ordinance and consistent with the above
mentioned Manual Whenever the Director of Traffic Control
has erected and installed an official traffic control device
at any location within the City, or has caused the same to
be done under his direction, he shall thereafter file a report
with the City Secretary and the Traffic Engineer, in writing,
stating the type of traffic control device, and when and
where the same was erected and installed. The City Secretary
shall file and maintain such report of the Director of Traffic
Control and the reports of the Traffic Engineer as a part of
the official papers of the office of the City Secretary.
Any traffic control device within the City which is determined
by the Director of Traffic Control, based upon recommendation
of the Traffic Engineer, to be no longer needed for safety
or welfare of the citizens of the City may be caused to be
removed by the Director of Traffic Control or a person acting
in such capacity.
The Director of Traffic Control, based upon an engineering
study by the Traffic Engineer, shall determine that all existing
traffic control devices which have been placed or erected
with the City are in compliance with the provisions of this
Article, as herein amended and consistent with the above
mentioned Manual."
SECTION 2. REPEALING CLAUSE
All ordinances, or parts of ordinances, inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 3. 8EVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shah be adjudged invalid or held unconstitutional, the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decided to be invalid or unconstitutional.
SECTION 4. PENALTY CLAUSE
Any person, firm or corporation violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and, upon conviction, shah be punished by a
penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense,
and each and every day such offense is continued shall constitute a new and separate
offense.
SECTION 5. EFFECTIVE DATE
This ordinance shall take effect immediately from and after the publication of
its caption, as the law in such cases provides.
