AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 314 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY, THE CHAPTER PROVIDING FOR THE PLACEMENT OF TRAFFIC CONTROL DEVICES WITHIN THE CITY, TO PROVIDE THAT THE ERECTION AND MAINTENANCE OF TRAFFIC CONTROL DEVICES SHALL BE SUPPORTED BY A TRAFFIC ENGINEERING INVESTIGATION CONDUCTED BY THE TRAFFIC ENGINEER; PROVIDING THAT THE TRAFFIC ENGINEER SHALL BE THE CITY'S CONSULTING ENGINEERS ACTING AS ENGINEERS FOR THE CITY; AND PROVIDING THAT THE TRAFFIC ENGINEER SHALL DETERMINE THE NECESSITY FCR INSTALLING TRAFFIC CONTROL DEVICES CONSISTENT WITH THE TEXAS MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES FCR STREET AND HIGHWAYS, HERETOFORE ADOPTED, AND ANY AMENDMENTS THERETO; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF Tt!E CITY OF COPPELL, TEXAS: SECTION 1. AMENDMENT TO ARTICLE 8-2 TRAFFIC CONTROL DEVICES The following sections of Chapter ~, Article 8-2 are hereby smended to read as follows: "Section 8-?-zl DIRECTOR OF TRAFFIC CONTROL AND TRAFFIC ENGINEER In absence of specific appointment, the Chief of Police shall be the Director of Traffic Control. The Traffic Engineer shall be the City's Consulting Engineers acting as Engineer for the City. Section 8-2-5 UNIFORM TRAFFIC CONTROL DEVICES All traffic control devices, erected and maintained within the City shall conform with the Texas Manual on Uniform Traffic Control Devices for Streets and Highways, Volumes I and II, as the same shall from time to time be amended (hereinafter called the ~ianual). Section 8-2-10 DUTY TO ERECT The Traffic Engineer shall determine the necessity for installing and maintenance of all traffic control devices within the City. Such determination shall be consistent with the above mentioned N;anual (Texas Manual on Uniform Traffic Control Devices for Streets and Highways, Volumes I and II) and based upon a traffic engineering investigation covering all relevant facts and in eonformanee with accepted engineering criteria. The Traffic Engineer shall report such study and findings to the City Council and the Director of Traffic Control with his recommendation as to any specific installation or maintenance requirements. The Traffic Engineer shall determine when traffic control devices should be installed under tb.e specific instruction of the Traffic Engineer to ensure that installation and maintenance be performed by a specified and qualified person. Based upon the recommendations of the Traffic Engineer, the Director of Traffic Control shall install, erect and rpaintain all traffic control devices within the City, or cause the same to be done, in accordance with this ordinance and consistent with the above mentioned N?anual. Whenever the Director of Traffic Control has erected and installed an official traffic control device at any location within the City, or has caused the same to be done under his direction, he shall thereafter file a report with the City Secretary and the Traffic Engineer, in writing, stating the type of traffic control device, and when and where the same was erected and installed. The City Seeretrary shall file and maintain such report of the Director of Traffic Control and the reports of the Traffic Engineer as a part of the official papers of the office of the City Secretary. Any traffic control device within the City which is determined by the Director of Traffic Control, based uDon recommendation of the Traffic Engineer, to be no longer needed for safety or welfare of the citizens of the City may be caused to be removed by the Director of Traffic Control or a person aetin~ in such capacity. The Director of Traffic Control, based upon an engineering study by the Traffic Engineer, shall determine that all existing traffic control devices which have been placed or erected within the City are in compliance with the provisions of this Article, as herein amended and consistent with the above mentioned Manual." SECTION 2. REPEALING CLAUSE AH ordinances, or parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed. SECTI©N 3. SEVERABILITY CLAUSE If any article, paragraph or subdivision, clause or Drovision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 4. PENALTY CLAUSE Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a penalty of fine not to exceed the sum of Two ~{undred Dollars ($200.00) for each offense, and each and every day such effense is continued shall constitute a new and separate offense. SECTION 5. EFFECTIVE DATE This ordinance shall take effect immediately from and after the publication of its caption, as the law in such eases provides.
