OR 312-A-1 Streetscape & Landscape Plans AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 312A1 AN ORDINANCE OF TIlE CITY OF COPPELL, TEXAS, AMENDING 'TllE SUBDIVISION ORDINANCE OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED, TO IMPLEMENT THE STREETSCAPE PLAN OF THE CITY; PROVIDING FOR A LANDSCAPE PLAN; PROVIDING LANDSCAPING TREATMENT REQUIRE.MENTS; PROVIDING ADDITIONAL STREET AND ALLEY REQUIREMENTS; PROVIDING ADDITIONAL STORM SEWER REQUIREMENTS; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That Section IX-B of the Subdivision Ordinance of the City be, and the same is hereby, amended by adding thereto a new Subsection 17, which shall read as follows: "17. A landscape plan shall be submitted and shall conform to the guidelines established in the City of Coppell Streetscape Plan. a. For residential subdivisions and for non-residential subdivisions where the landscaping occurs in common areas to be maintained by a property owners association, these plans shall include: Edge treatment along major and minor arterials and collectors; Subdivision entry features including monument signs; Screening walls; Required sprinkler systems." SECTION 2. That Section 1X-C of the Subdivision Ordinance of the City be, and the same is hereby, amended by adding thereto the following sentence: "The Landscaping Plans shall be prepared by or under the supervision of a Registered Landscape Architect in the State of Texas and shall bear his seal on each sheet. The Sprinkler Plans shall be designed by a Licensed Landscape lrrigator." SECTION 3. That Section XII-A of the Subdivision Ordinance of the City be, and the same is hereby, amended by adding thereto the following sentence: "Any change in landscape design during construction shall be made by the Landscape Architect whose seal and signature are shown on the plans as shall be approved by the City Engineer." SECTION 4. That Section X1V of the Subdivision Ordinance of the City be, and the same is hereby, amended by adding the word "landscapingn so that said section shall read as follows: "Prior to final acceptance by the City of the improvements in the subdivision, the Engineer for the Developer shah submit to the Engineering Department a complete, reproducible set of drawings of paving, drainage, water, sanitary sewer, landscaping, and other improvements showing all changes n~ade in the plans during construction and containing on each sheet an "As-Built" stamp bearing the signature of the Engineer and the date. In addition, one reproducible drawing of the utility plan sheets containing As-Built information shall be submitted." SECTION 5. That Appendix A, Section I, "Streets and Alleys," Snbsection D, be amended by deleting therefrom Subsection h, dealing with Brick Pavers, and Subsection o dealing with Median Treatment and adding thereto a new Subsection n, which shall read as follows: "n. Jogging and Bike Paths to require conformance to approved City Streetscape Plan and approved City Jogging/Bike Trail Plan." SECTION 6. That Appendix A of the Subdivision Ordinance of the City, Section I, "Streets and Alleys," be amended by adding thereto a new Section E, which shall read as follows: "E. Landscaping Treatment Requirements 1. Median Treatment. All medians shall be landscapeci and irrigated with a sprinkler system in accordance with the approved City Streetscape Plan. When a DeveloDer is responsible for the construction of a median opening and left turn lanes in the median, guidelines set forth in the approved Streetscape Plan, and to delineate all pedestrian/bike path erossings at streets. Pavers shall be selected in eonformanee with standards set forth in the approved City Streetscape Plan. All pavers shall be set on a concrete foundation. Colors shall either be in earth gone reds or grays." SECTION 7. That Appendix A of the Subdivision Ordinance of the City, Section I1, "Storm Sewers," Subsection A, be amended by adding to Paragraph 2 thereof the following: "Grasscrete with sod or ground cover shall be allowed as a~ alternate construction technique." SECTION 8. That Appendix A of the Subdivision Ordinance of the City, Section II, "Storm Sewer," Subsection A, be amended by adding to Paragraph 3 thereof the following sentences: "Excavated channels shall be landscaped so as to conform to the minimum standards established in the approved Streetscape Plan. ~laintenanee shall be done by a home owners association whose by-laws have been approved by the Planning Commission and City Couneilo SECTION 9. That Appendix A of the Subdivision Ordinance of the City, Section II, "Storm Sewers," Subsection A, be amended by adding to Paragraph 7 thereof the following sentence: "Sloped headwalls at a 1:3 slope using stone or brick facing over a concrete base shall be encouraged. (Figure 22 of the Coppell Streetsea._'2e Plan) SECTION 10. That Appendix A of the Subdivision Ordinance of the City, Section II, "Storm Sewers," Subdivision A, be amended by adding to Paragraph 9 thereof the following sentences: "All bridges shall be constructed with stone or brick facings and shall conform to the pedestrian access guidelines established in the aperoved City Streetscape Plan and the approved Jogging/Bike Plan. Alternate bric!ge construction styles (beside brick/stone facings) shall be accepted if approved by the City Engineer." SECTION 11. That Appendix A of the Subdivision Ordinance of the City, Section VIII, "Miscellaneous," Subsection B, be amended to read as follows: "B. Sidewalks: Sidewalks shall be constructed of 2000 psi concrete having a width of not less than 4 feet and a ~..inimum thickness of 4 inches. Sidewalks shall be constructed for atl iota adjoining dedicated streets, along major thoroughfares where lots do not adioin the street, across power line easements and in other areas where pedestrian walkways are necessary. Sidewalk construction may be delayed until develooment of lots, but in locations not adjacent to lots and across bridges and culverts, the sidewalk shall be constructed with the other improvements to the subdivision. Sidewalks adjacent to screening walls shall be 5 feet in width and shall generally be placed against the curb leaving a landscape strip between the wall and sidewalk. Routing to clear poles, trees or other obstacles shall be subject to approval by the City Engineer. Sidewalks shall be constructed one foot from the property line within the street or thoroughfare right-of-way and shall extend along the street frontage including the side of corner lots and block ends. Sidewalks along divided arterials shall be no less than 5 feet in width. Concrete pavers shall be incorporated into the design of sidewalks along arterials according to the guidelines established in the approved Streetscape Plan." SECTION 12. REPEALING CLAUSE All ordinances, or parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed. SECTION 13. SEVERABILITy CLAUSE If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 14. PENALTY CLAUSE Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a penalty of fine not to exceed the sum of Two Hundred Dollars ($2e. 0.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 15, EFFECTIVI5 DATE This ordinance shall take effect immediately from and after the publication of its caption, as the law in such cases provides, DULY PASSED by the City Council of the City of Coppell, Texas, on the ~,~.~ 0ay of ..
