OR 307.1 Parking and storage of trailers AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 307A1 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, REGULATING THE PARKING AND/OR STORAGE OF BOATS, BOAT TRAILERS, STOCK TRAILERS, CAMPER TRAILERS, TRAILERS, SEMITRAILERS, MOTOR HOMES, TRUCK TRACTORS, BUSES AND OTHER SIMILAR VEHICLES ON THE PUBLIC STREETS AND IN RESIDENTIAL AREAS OF THE CITY; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. DEFINITIONS. A. Residential area or residential lot as used in this ordinance shall mean any area or lot occupied by residential dwellings even though the area is zoned for ~l use other than residential. B. Front yard shall mean the ares of a residential lot which is forwaro of the front building line. C- Side yard shall mean the area of a residential lot on either side of the dwelling which is between the front building line and the rear building line. D. Rear yard shall mean the area of a residential lot between the rear building line and the rear of the lot. E. The vehicles named herein which do not have a earnman meaning or definition shall have the meaning ascribed to them in Article 6675a- 1, Vernon's Annotated Civil Statutes. SECTION 2. PARKING PROHIBITED ON PUBLIC STREETS IN RESIDENTIAL AREAS. Except as otherwise provided herein, it shall be unlawful for ~ny person to park on any public street within any residential area of the City, for a period lon~er than two (2) hours, any trailer, boat trailer, stock trailer, camper trailer, semitrailer, mobile home, truck tractor or bus. This section shall not apply to the above mentioned commercial vehicles used by public service utility companies engaged in repairing or extending public service utilities or to such vehicles used during construction at a construction site, or any commercial moving vehicle actively engaged in a moving operation. This section shall also not apply to any vehicle engaged in strcet construction, maintenance or repair. SECTION 3. CERTAIN PARKING OR STORAGE PROHIBITED IN FRONT, SIDE AND REAR YARDS OF A RESIDENTIAL LOTS. A. ]'he Darklag, standing or storage of any truck, trailer, bus or other recreational vehicle that has a rated capacity in excess of one and one-half (1½) tons according to the manufacturer's classification, or is over thirty-two (32) feet in length is not permitted on any portion of a residential lot within the City. B. The parking, standing or storage of any motor vehicle, trailer or boat that has a rated capacity of one and one-half (1½) tons or less or is less than thirty-two feet (32) in length sball be permitted only in the rear yarcj of any residential lot except as folows: 1. An operable motor vehicle with valid state registration and inspection may be parked in the front yard or siQe yard if parked on a surface that meets the standards for parking surfaces contained in the City's regulations for offstreet parking. This exception is not available if the vehicle is a truck tractor, truck, bus or other recreational vehicle that has a rated capacity in excess of one and one-half (] ~) tons according to the manufacturer's classification, or if the vehicle is over thirty-two (32) feet in length. 2. A boat, trailer or recreational vehicle may be parked in the front yard if parked on a surface that meets the standards for parking surfaces contained in the City's offstreet parking regulations, and the vehicle cannot be reasonably placed in either the rear or side yard. 3. A boat, trailer or recreational vehicle may be parked in the side yard if parked on a surface that meets the stan~jaros for parking surfaces contained in the City's offstreet parking regulations~ 4. A vehicle displaying a registration insignia or identification card issuecl by the state to a permanently or temporarily disableG person for the purposes of Article 6675a-5e.1, Vernon's Texas Civil Statutes shall be expempt from the provisions of this ordinance. SECTION 4. SPECIAL EXCEPTIONS. Tile Board of Adjustment may grant a special exception not to exceed 30 days to the provisions of this ordinance when, in the opinion of the Board, the special exception will not adversely affect neighboring property. SECTION 5. REPEALING CLAUSE. All ordinances, or parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed. SECTION 6. SEVERABILITY CLAUSE. If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the valiGity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 7. PENALTY CLAUSE. Any person, firm or corporation violating any of the provisions of this ordinance shall t~e deemed guilty of a misdemeanor and, upon conviction, shall bc punished by a penalty of fine not to exceed the sum of Two liundred Dollars ($200.00) for each offense, anG each and every day such offense is continued shall constitute a new and separate offense. SECTION 8. EFFECTIVE DATE. This ordinance shall take effect immediately from and after the publication of its caption, as the law in such cases provides.
