OR 298-A-1 Paper absentee ballotsOrdinance 298A1 AMENDED NOTICE OF BOND ELECTION THE STATE OF TEXAS § COUNTY OF DALLAS § CITY OF COPPELL § TO THE RESIDENT, QUALIFIED ELECTORS OF THE CITY OF COPPELL, TEXAS: NOTICE IS HEREBY GIVEN that an election will be held in the City of Coppell, Texas, on the 4th day of February, 1984, pursuant to and in accordance with the Ordinance No. 298 Calling a Bond Election, adopted by the City Council of said City on January 10, 1984, and the Ordinance amending such Ordinance No. 298 which amendatory Ordinance is attached hereto and made a part of this Notice for all intents and purposes. CITY OF COPPELL /s/Dorothy Timmons City Secretary, City of Coppell, Texas [SEAL] ORDINANCE 298A1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, AMENDING ORDI- NANCE NO. 298 CALLING A BOND ELECTION TO BE HELD WITHIN SAID CITY AND MAKING PRO- VISIONS FOR THE CONDUCT OF THE ELECTION AND OTHER PROVISIONS INCIDENT AND RELATED TO THE PURPOSE OF SAID ORDINANCE NO. 298; RATIFYING THE USE OF PAPER ABSENTEE BAL- LOTS AND REPEALING CONFLICTING ORDI- NANCES THE STATE OF TEXAS § COUNTY OF DALLAS CITY OF COPPELL § WHEREAS, the City Council (the "City Council") of the City of Coppell, Texas (the "City"), passed and approved Ordinance No. 298 on January 10, 1984, which Ordinance called a bond election to be held within the City on February 4, 1984; and WHEREAS, said Ordinance No. 298 provided for the absentee voting for said election would be by use of a lawfully approved electronic voting system; and WHEREAS, the City Council has determined and hereby does determine that, taking into account the printing time required for the preparation of absentee voting ballots for use in an electronic voting system, the use of absentee ballots which are designed for an electronic voting system would shorten the time period during which absentee voting would be conducted; and WHEREAS, the City Council desires that absentee voting be conducted for the maximum time period allowed by law and the availability of absentee ballots; and WHEREAS, the City Council has determined and hereby does determine that the use of paper ballots for absentee voting will result in a longer period for absentee voting than would otherwise be available with absentee voting ballots prepared for use with an electronic voting system; and WHEREAS, the City Council desires to amend Ordinance No. 298, passed and adopted by the City Council on January 10, 1984, to provide for a change to paper ballots for absentee voting; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: 1. That the first sentence of Section 3 of Ordinance No. 298 referenced in the preamble hereof is hereby amended to delete any reference to absentee voting and accordingly shah read as follows: "That voting at and on the date of said election shall be by the use of a lawfully approved electronic voting system." 2. That the first sentence of Section 4 of Ordinance No. 298 referenced in the preamble hereof is hereby amended to read as follows: "That as to absentee voting for said election, paper ballots shall be used and such voting shall be conducted by the City Secretary, who is hereby appointed the Clerk of Absentee Voting, at the City Secretary's office in the Coppe]l City Hall, 616 S. Coppell Road, Coppell, Texas." 3. That the second sentence of Section 7 of Ordinance No. 298 referenced in the preamble hereof is hereby amended to read as follows: "The presiding judge of the central counting station shall make returns of the election to the City Council of said City and the ballot boxes shall be delivered to the custody of said City Council in compliance with the applicable laws of the State of Texas; and the ballots properly marked in conformance with the provisions of the Texas Election Code, as amended, for votes cast during the period of absentee voting herein specified shall be counted manually and for votes cast during the election herein ordered shall be counted by automatic tabulating equipment all as provided in the Texas Election Code, as amended." 4. That notice of the amendments made by this ordinance ahall be given by posting a notice containing a substantial copy of this ordinance at three (3) public places with the City and also at City Hall as soon as practicable after the passage of this ordinance; such notice shall be posted as close as possible to the prior posting of Ordinance No. 298. Additionally, notice of the amendments made herein shall be made by publication of a notice containing a substantial copy of this ordinance to be published in a newspaper of general circulation within the City in two consecutive weeks preceding February 4, 1984. 5. That the use of p~per ballots for absentee voting prior to the passage of this ordinance is in all things ratified and confirmed as of the date of such usage. 6. That all ordinances in conflict with the terms and provisions of this ordinance are hereby in all things repealed to the extent of such conflict and only to the extent of such conflict.
