OR 298 Calls a Bond Election NOTICE OF BOND ELECTION THE STATE OF TEXAS § COUNTY OF DALLAS § CITY OF COPPELL § TO THE RESIDENT, QUALIFIED ELECTORS OF THE CITY OF COPPELL, TEXAS: NOTICE IS HEREBY GIVEN that an election will be held in the city of Coppoll, Texas, on the 4th day of February, t984, pursuant to and in accordance with the Ordinance Calling a Bond Election, adopted by the City Council of said City and attached hereto and made a part of this Notice for all intents and purposes. CITY OF COPPELL /s/Dorothy Timmons City Secretary, City of Coppell, Texas [SEAL] ORDINANCE NO. 298 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, CALLING A BOND ELECTION TO BE HELD WITHIN SAID CITY, MAK- ING PROVISIONS FOR THE CONDUCT OF THE ELECTION AND OTHER PROVISIONS INCIDENT AND RELATED TO THE PURPOSE OF THIS ORDI- NANCE THE STATE OF TEXAS § COUNTY OF DALLAS § CITY OF COPPELL § WHEREAS, the City Council has determined that an election should forthwith be called and held in the City of Coppell, Texas, for the purpose of submitting the Propositions for the issuance of bonds of said City for the purposes hereinafter set forth; and WHEREAS, the meeting at which this Ordinance is considered is open to the public as required by law; and that public notice of the time, place and purpose of said meeting was given as required by Article 6252-17, V.T.C.S.; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: 1. That an election shall be held in and throughout the City of Coppell, Texas, on the 4th day of February, 1984, which is not less than fifteen (15) nor more than ninety (90) days from the date of this Ordinance, at which election the following propositions shall be submitted: PROPOSITION NO. 1 "Shall the City Council of the City of Coppell, Texas, be authorized to issue general obligation bonds of said City in the amount of $9,900,000, maturing serially in such installments as may be fixed by the City Council, the maximum maturity being not more than forty (40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance, for the purpose of providing funds for permanent public improvements, to-wit: constructing and improving streets and sidewalks in and for the City, including the acquisition of rights-of-way and the construction and improvement of traffic signali- zation and storm drainage channels and other street drainage improvements, and to provide for the pay- ment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION NO. 2 "Shall the City Council of the City of Coppell, Texas, be authorized to issue general obligation bonds of said City in the amount of $2,850,000, maturing serially in such installments as may be fixed by the City Council, the maximum maturity being not more than forty (40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance, for the purpose of providing funds for permanent public improvements, to-wit: acquiring, constructing, improving and equipping a municipal government center in and for said City, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to ereate a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION NO. 3 "Shall the City Council of the City of Coppell, Texas, be authorized to issue general obligation bonds of said City in the amount of $1,730,000, maturing serially in such installments as may be fixed by the City Council, the maximum maturity being not more than forty (40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shah be determined within the discretion of the City Council at the time of issuance, for the purpose of providing funds for permanent public improvements, to-wit: acquiring, constructing, improving and equipping fire stations in and for said City, including the acquisition of sites therefor, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION N<). 4 "Shall the City Council of the City of Coppell, Texas, be authorized to issue general obligation bonds of said City in the amount of $1,200,000, maturing serially in such installments as may be fixed by the City Council, the maximum maturity being not more than forty (40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of -2- issuance, for the purpose of providing funds for permanent public improvements, to-wit: acquiring, constructing, improviDg and equipping a municipal services center in and for said City, including the acquisition of a site or sites therefor, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as ~hey become due?" PROPOSITION NO. 5 "Shall the City Council of the City of Coppell, Texas, be authorized to issue general obligation bonds of said City in the amount of $545,000, maturing serially in such installments as may be fixed by the City Council, the maximum maturity being not more than forty (40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance, for the purpose of providing funds for permanent public improvements, t~-wit: acquiring, and improving land for park and recreational pur- poses, including constructing, improving and equipping recreational facilities in and for said City, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION NO. 6 "Shall the City Council of the City of Coppell, Texas, be authorized to issue general obligation bonds of said City in the amount of $100,000, maturing serially in such installments as may be fixed by the City Council, the maximum maturity being not more than forty (40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance, for the purpose of providing funds for permanent public improvements, to-wit: acquiring, constructing, improving and equipping an emergency warning system in and for said City, including the acquisition of sites therefore, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?" -3- 2. That the City election precinct for this election shall consist of the territory situated within the Dallas County election precinct located within the corporate limits of the City and bearing the following number, and the polling place and officers of said election shall be as follows, to-wit: DALLAS COUNTY ELECTION PRESIDING ALTERNATE PRECINCT POLLING PLACE JUDGE PRESIDING JUDGE 1101 Pinkerton Elementary Mrs. Evelyn Marcaline Hempel School (Foyer & Ottinger Hallway) Southwestern Blvd. Coppell, Texas Said polling place shall be open from 7:00 a.m. to 7:00 p.m. The Presiding Judge shall appoint not less than two (2) nor more than six (6) qualified election clerks to serve and assist in the conduct of said election, provided that if the Presiding Judge named above actually serves as expected, the Alternate Presiding Judge shah be one of such clerks. By approving and signing this Ordinance, the Mayor of said City officially confirms his appointment of the aforesaid election officers to serve at said election; and by passing this Ordinance the City Council of said City approves and concurs in the appointment of the aforesaid election officers. A public school of instruction on the use of the electronic voting system for those persons who will conduct said election at the polling place and those persons who will be at the central counting station shah be held on or before February 1, 1984, at the City Hall, 616 S. Coppe]l Road, Coppert, Texas, and notice therefor shall be given, all in accordance with the provisions of the Texas Election Code, as amended. Such public school of instruction shall be open to any interested person. 3. That voting at and on the date of said election, and absentee voting therefor, shah be by the use of a lawfully approved electronic voting system. The preparation of the voting equipment to be used in connection with said electronic voting system and the official ballots for said election shall conform to the Texas Election Code, as amended, so as to permit the electors to vote "For" or "Against" the aforesaid Propositions, with the ballots for said electronic voting system to contain such provisions, markings and language as required by law, and with such Propositions to be expressed substantially as follows: PROPOSITION NO. 1 THE ISSUANCE OF $9,900,000 GENERAL OBLIGA- TION STREET IMPROVEMENT BONDS PROPOSITION NO. 2 THE ISSUANCE OF $2,850,000 GENERAL OBLIGA- TION MUNICIPAL GOVERNMENT CENTER BONDS PROPOSITION NO. 3 THE ISSUANCE OF $1,730,000 GENERAL OBLIGA- TION FIRE STATION BONDS PROPOSITION NO. 4 THE ISSUANCE OF $1,200,000 GENERAL OBLIGA- TION MUNICIPAL SERVICES CENTER BONDS PROPOSITION NO. 5 THE ISSUANCE OF $545,000 GENERAL OBLIGAT- TION PARK BONDS PROPOSITION NO. 6 THE ISSUANCE OF $100,000 GENERAL OBLIGATION EMERGENCY WARNING SYSTEM BONDS 4. That absentee voting for said election shall be conducted by the City Secretary, who is hereby appointed the Clerk of Absentee Voting, at the City Secretary's office in the Coppell City Hall, 616 S. Coppell Road, Coppell, Texas. For the period absentee voting for said election is permitted by law, the Clerk shall keep said office open for absentee voting during regular hours on each day except Saturday, Sunday and official State holidays. 5. All resident, qualified electors of the City shah be permitted to vote at said election. In addition, the election materials enumerated in the Texas Election Code, as amended, shah be printed in both English and Spanish for use at the polling places and for absentee voting for said election. 6. That the holding of the election herein ordered shall be in compliance with the Texas Election Code, as amended, except as modified by the applicable provisions of Vernon's Texas Civil ~a~u~es, as amended. 7o Mrs. Evelyn Ottinger, who is a qualified voter of the City of Coppel], Texas, is hereby appointed presiding judge of the central counting station. The presiding judge of the central counting station shall make returns of the election to the City Council of said City and the ballot boxes shall be delivered to the custody of said City Council in compliance with the applicable laws of the State of Texas; and the ballots properly marked in conformance with the provisions of the Texas Election Code, as amended, for votes cast both during the period of absentee voting and during the election herein ordered, shall be-counted by automatic tabulating equipment as provided in the Texas Election Code, as amended. 8. That notice of said election shall be given by posting a notice containing a substantial copy of this Ordinance at three (3) public places within said City and also at the City Hall not less than fourteen (14) days prior to the date upon which said election is to be held, and by publication of said notice on -5- the same day in each of two (2) successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen (14) days prior to the date set for said election.
