ORDINANCE NO. 294
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 6
OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL, TO PROVIDE
REGULATIONS IN CONNECTION WITH THE BUSINESS OF SELLING CHRISTMAS TREES
WITHIN THE CITY; REQUIRING A PERMIT; REQUIRING CLEANUP AFTER SALE IS
COMPLETED; REGULATING SETBACK, BUILDING SITE AND PARKING; PROVIDING A
REPEALING CLAUSE; PROVIDING A SEVERABLIITY CLAUSE; PROVIDING FOR A
PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00)
FOR EACH OFFENSE AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1. AMENDING CODE TO REGULATE SALE OF CHRISTMAS TREES
The City of Coppell Code of Ordinances is hereby amended by adding to Chapter
6 The following new Article 6-7:
"ARTICLE 6-7
CHRISTMAS TREE SALES
Section 6-7-1 PERMIT REQUIRED
Any person, firm, or corporation desirous of operating a Christmas
tree sales lot shah first obtain a permit from the Building Inspection
Department. The applicant for such a permit shah file a letter and
site plan containing the following information:
A. Location and size sales lot.
B. The dates and hours of operation of the sales lot.
C. Location and size of any proposed advertising and/or signs
for said sales lot. A maximum size of 30 square feet per
surface. All signs shah be removed prior to January 10th.
D. Consent of landowner.
The charge for a permit shall be $50.00
Section 6-7-2 CLEANUP OF SALES LOT
Sales lots shall be returned to their original condition prior to
January 10th. A $500.00 bond shall be filed with Building Inspector
against the completion of this obligation.
Section 6-7-3 SETBACKS
Trees shall be set back 30 feet from City right-of-way and at least
10% of the width of the lot from interior property lines.
Section 6-7-4 BUILDING SITE
A temporary building or trailer, with a maximum size of 100 square
feet, may be placed on the lot during sales operation. Such building
or trailer must be removed prior to January 10th. An electrical
permit will be required for any electrical power to such building or
trailer. Building or trailer will be set back 30 feet from the City
right-of-way and 10 feet from interior property lines.
Section 6-7-5 ACCESS AND PARKING
Access to sales lot shah be provided so as not to cause traffic
problems on adjacent streets. One customer parking space shall be
provided for every 300 square feet of lot area. No customer parking
will be allorbed within the City right-of-way."
SECTION 3. REPEALING CLAUSE
All ordinances, or parts of ordinances, inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 4. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance
shall be adjudged invalid or held anconstitutional, the same shah not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part so
decided to be invalid or unconstitutional.
SECTION 5. PENALTY CLAUSE
Any person, firm or corporation violating any of the provisions of this ordinance
shah be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a
penalty of fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense,
and each and every day such offense is continued shall constitute a new and separate
offense.
SECTION 6. EFFECTIVE DATE
This ordinance shall take effect immediately from and after the publication of
its caption, as the law in such cases provides.
