OR 283 Abandons street right-of-way AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 283 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ABANDONING AN UNUSED STREET RIGHT-OF-WAY; PROVIDING THAT SUCH ABANDONMENT SHALL BE THE INTEREST WHICH THE CITY MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING THAT SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM DEED THAT MAY BE RECORDED WITH THE COUNTY CLERK OF DALLAS COUNTY, TEXAS; AND FOR PROVIDING AN EFFECTIVE DATE. WHEREAS, the property described herein is a 2.980 acre tract of land conveyed to the County of Dallas by Deed recorded in Volume 76089, Page 2475, Deed Records Dallas County, Texas, for the construction of a proposed road; and WHEREAS, the right-of-way described herein was never used as a public road; and WHEREAS, because the County, by statute, has no jurisdiction over rights- of-way within an incorporated municipality, the County of Dallas was requested to quitclaim the subject right-of-way to the City of Coppell so that the City of Coppell might quitcIaim the property to the original grantor; and WHEREAS, on the 2rid day of August, 1982 at a regular meeting of the Commissioner's Court of Dallas County, Texas, said Court did by order quitclaim said property to the City of Coppell, Texas; and WHEREAS, the City of Coppell has determined that the following street right-of-way is no longer needed for public purposes; and WHEREAS, the abutting property owner desires that said street right-of-way be abandoned; NOW, THEREFORE: BE IT ORDAINED BY TflE CITY COUNCIL OF Tile CITY OF COPPELL, TEXAS: SECTION 1. That the hereinafter described right-of-way for street and road purposes is no longer needed or necessary for public purposes and should be abandoned in favor of J. Laurence Martin, Trustee, the abutting property owner. The street and road of right-of-way being abandoned herein is described as follows, to-wit: Being a 2.980 acre tract of land in the McKinney & Williams Survey, Abstract No. 1054 and the E. A. Crow Survey, Abstract No. 301 of the County of Dallas and City of Coppell, Texas. Said tract being 100.0 feet in width and extending across the W. R. Sandford, Trustee, Tract from Denton Tap Road Southeasterly to the East property line of said tract. BEGINNING at a point in the East right-of-way line of Denton Tap Road (100.0 feet wide) that is 59.9 feet S.0°44'E., measured along said East right-of-way line, from the common line between said Crow Survey and McKinney & Willjams Survey. Said beginning point being in the proposed South right-of-way line of Bethel-Belt Line Road (100o0 feet wide) and in a curve whose radius point bears S.7°02'29'1W., 1095.92 feet; THENCE N.0°44'W., with the East right-of-way line of Denton Tap Road 100.85 feet to a point in the proposed North right-of- way line, a point in a curve whose radius point bears S. 6°23'12"W., 1195.92 feet; THENCE Southeasterly, with last mentioned curve to the right whose radius is 1195.92 feet concentric to and 50.0 feet from centerline, 675.85 feet to the end of said curve; THENCE S. 51°11'E., parallel to and 50.0 feet from centerline, 615.58 feet to a point in the East property line of said Sandford tract; THENCE S.0°i!'E., with said East property line, 128.68 feet to a point in the proposed Southwest right-of-way line; THENCE N.51°ll'W., parallel to and 50.0 feet from centerline, 696.56 feet to the beginning of a curve to the left; THENCE Northwesterly, with a curve to the left that has a radius of 1095.92 feet, concentric to and 50.0 feet from centerline, 607.78 feet to the Place of Beginning and containing 2.980 acres of land. SECTION 2. That the above described right-of-way be, and the same is hereby, abandoned in favor of J. Laurence Martin, Trustee, the owner of the abutting property. SECTION 3. That this abandonment ordinance shall constitute a Quitclaim Deed in favor of J. Laurence Martin, the abutting property owner, and a certified copy of the same may be filed in the Deed Records of Dallas County, Texas, to indicate such abandonment. SECTION 4. The abandonment provided for herein shah extend only to the public right, title and interest which the City of Coppell, Texas may have in and to said street right-of-way, and shall be construed to extend only to such interest that the governing body of the City of Coppell, Texas, may legally and lawfully abandon. SECTION 5. The fact that the above described street and road right-of-way is no longer needed or necessary for public purposes, and that such right-of-way should be abandoned in favor of the abutting property owner or owners, creates an urgency and an emergency in the preservation of the public health, safety and welfare, and requires that this ordinance shall take effect immediately froin and after its passage, as the law in such cases provides.
